MW PAA M When Recorded,Mail To: MAR 141996 City Clerk City of Fresno WILLKM C.GREENWOOD 2600 Fresno Street County Recorder S Fresno, CA. 93721-3623 SPACE ABOVE THIS LINE FOR RECORDER'S USE PW-96-13168 APN 403-050-29T RESOLUTION NO. 96-54 A RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO, CALIFORNIA,DEDICATING CERTAIN CITY-OWNED PROPERTY AS EASEMENTS FOR PEDESTRIAN WALKWAY,LANDSCAPE AND PUBLIC UTILITY PURPOSES WHEREAS, the City of Fresno owns certain property located at the southwest corner of Sierra Vista Avenue and Shepherd Avenue, as shown on attached Exhibit "A"; and WHEREAS,the subject property is being developed as Well Site No. 128; and WHEREAS,a portion of the subject property must be dedicated for public pedestrian purposes in order to comply with the requirements of the Americans with Disabilities Act of 1991 (ADA);and WHEREAS,certain other portions of the subject property must be dedicated for public utility and public landscape purposes in order to comply with the requirements of Conditional Use Permit No. C-91-114. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FRESNO AS FOLLOWS: 1. Those certain parcels of City-owned property shown on attached Exhibit"A" and described in attached Exhibit"B" are hereby dedicated for public use. q 5 4 1�h • 2. Nothing contained in this resolution shall be deemed or interpreted by any party to cause any interest created in the public pursuant to this resolution to ripen into any title,interest or right of the public against or adverse to the rights of the City of Fresno nor shall this resolution limit, restrict or modify the exemption of public property to title by prescription as defined within California Civil Code.Section 1007. 3. The City Clerk of the City of Fresno shall certify to the passage of this resolution and shall cause a certified copy thereof attested to by the Clerk under the seal of the City of Fresno to be recorded in the Office of The Recorder of the County of Fresno,California. 4. The City Design Engineer shall cause a City deed number to be assigned to the certified copy of this resolution to be recorded and will cause that certified copy to be filed in the Public Works deed file after it has been recorded.
