A RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO,
CALIFORNIA, AMENDING THE BULLARD COMMUNITY PLAN
(PLAN AMENDMENT NO. A-97-08)
WHEREAS, on December 12, 1988,by Resolution No. 88-426, the Council adopted the
Bullard Community Plan; and
WHEREAS, the Development Department has received an application from McCaffrey
Development to amend the land use designation of the aforementioned plan from Office
Commercial to Neighborhood Commercial for 6.5 acres of real property located on the
northwest corner of Herndon and Spruce Avenue; and
WHEREAS, said application also proposes to amend the land use designation of the
aforementioned plan from Medium-High Density Residential to Medium Density
Residential for 24 acres of real property located northeast of Spruce Avenue, north of
Hemdon Avenue; and
WHEREAS, City staff recommended approval of the portion of the amendment requesting
medium density residential land uses and recommended that the proposed amendment to
neighborhood commercial land uses be denied.
WHEREAS, on July 16, 1997, the Planning Commission held a public hearing to consider
Plan Amendment No. A-97-08 and recommended adoption of the proposed mitigated'
negative declaration and plan amendment as proposed by the applicant; and
WHEREAS, on July 29, 1997, the Council held a public hearing to consider Plan
Amendment No. A-97-08 and determined, based upon the testimony and information'
presented at the hearing and upon review and consideration of the environmental
documentation provided, that the adoption of the proposed amendment as requested by the
applicant is in the best interest of the City of Fresno.
NOW THEREFORE, BE IT RESOLVED by the Council of the City of Fresno as
follows:
1. The Council finds in accordance with their own independent judgement that
there is no substantial evidence in the record that Plan Amendment No. A-97-08
may have a significant effect on the environment and hereby adopts the
(mitigated) negative declaration prepared for this project.

2. The Council of the City of Fresno hereby adopts Plan Amendment No. A-97-08
amending the Bullard Community Plan as follows;
a. Change the land use designation from Office Commercial to
Neighborhood Commercial for a 6.5 acre site as depicted on Exhibit "A"
attached hereto and incorporated herein by reference.
b. Change the land use designation from Medium-High Density Residential
to Medium Density Residential for a 24 acre site as depicted on Exhibit
"A" attached hereto and incorporated herein by reference.
