A RESOLUTION OF THE COUNCIL OF THE CITY OF
FRESNO, CALIFORNIA AUTHORIZING THE REPAIR OF
FIRE STATION NO. 12 AND WAIVING COMPETITIVE
BIDDING BASED ON URGENT NECESSITY
WHEREAS, the roof structure of Fire Station No. 12 located on Marks Avenue
South of Shaw Avenue has failed; and
WHERAS, the roof structure is being shored in order to keep the fire station in
operation; and
WHEREAS, the roof structure needs to be repaired prior to the rainy season so the
fire station operation is not interrupted; and
WHEREAS, the City Charter of the City of Fresno, Section 1208(a) provides for
waiver of competitive bidding by recognition of urgent necessity in the replacement of
emergency apparatus.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Fresno as
follows: That the Council of the City of Fresno deems and finds based on the foregoing
facts, that waiver of competitive bidding requirements to be of urgent necessity to preserve
public safety, health, and property and directs staff to arrange for the expeditious repair

of the roof structure at Fire Station No. 12. It is further resolved that the Purchasing
Manager is hereby authorized to enter into a contract for the repair of the roof structure
described herein.
