A RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO, CALIFORNIA,
APPROVING THE APPLICATION FOR GRANT FUNDS FROM THE STATE OF
CALIFORNIA DEPARTMENT OF CONSERVATION, DIVISION OF RECYCLING
FOR A BEVERAGE CONTAINER RECYCLING EDUCATION PROGRAM.
WHEREAS, the State of California, Department of Conservation administers the
California Beverage Container Recycling and Litter Reduction Act (Assembly Bill 2020- Chapter
1290, Statutes of 1986), establishing a beverage container recycling program for the State of
California with a goal to achieve an 80 percent recycling rate for beverage container types covered
under the program; and
WHEREAS, the Department of Conservation, Division of Recycling manages'California's
beverage container recycling program; and
WHEREAS, the Department of Conservation, Division of Recycling's goal is to regulate
the beverage container, and the Division has been delegated the responsibility for administering
the program within the state, setting up necessary procedures governing application by cities and
counties under the program; and
WHEREAS, said procedures established by the Department of Conservation 'require the
applicant to certify by resolution the approval of said application to the state; and
WHEREAS, the applicant will enter into an agreement with the State of California for
development of the project.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Fresno as
follows:

I. The Council finds that there is no substantial evidence in the record that Plan
Amendment No. A-96-006 may have a significant effect on the environment and
hereby adopts the negative declaration prepared for this project.
2. The Council of the City of Fresno hereby adopts Plan Amendment No. A-96-006
amending the Bullard Community Plan as depicted on Exhibit "A", attached hereto
and incorporated herein by reference.
