A RESOLUTION OF THE COUNCIL OF THE CITY OF
FRESNO, CALIFORNIA, AUTHORIZING THE PUBLIC
WORKS DIRECTOR TO NEGOTIATE AND EXECUTE FUND
TRANSFER AGREEMENT NO. 75AO045 FOR $5,357,911
WITH CALTRANS FOR CAPITAL SUPPORT OF THE NEW
FRESNO INTER-CITY RAIL STATION.
WHEREAS, on December 30, 1994, the City of Fresno, hereinafter referred to
as "City," and the County of Fresno entered into a memorandum of understanding,
("MOU") to design and construct a new Fresno Inter-City Rail Station and related track
and platform work, hereinafter referred to as the "Project'; and
WHEREAS, City has applied to the California Transportation Commission
("CTC") for Transit Capital Improvement ("TCI") funds, to be allocated by CTC, for the
purpose of the Project; and
WHEREAS, the City has submitted a request for an allocation of funds;
WHEREAS, the CTC has programmed TCI funds for the Project, in CTC
Resolution Nos. G-93-04, MFP-95-51; MFP-96-19, and MFP-97-17; and
WHEREAS, the State of California, Department of Transportation, herein
referred to as "Caltrans," as the CTC's administering agency has submitted a draft
Fund Transfer Agreement No. 75AO045 in the amount of$5,357,911 for execution by
the City.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
FRESNO as follows:

1. The Public Works Director of the City is authorized and instructed to
negotiate the terms and conditions of Fund Transfer Agreement No. 75A0045
consistent with the intent of the MOU and to execute said Agreement on behalf of the
City;
2. Approval by the City of Fund Transfer Agreement No. 75A0045`with
Caltrans is contingent upon approval of said Agreement by the Board of Supervisors of
the County of Fresno pursuant to the MOU; and
3. The Public Works Director of the City is hereby authorized to execute all
documents reasonably necessary to effectuate the terms and conditions of Fund
Transfer Agreement No. 75A0045 on behalf of the City.
