Home My WebLink AboutResolution - - 1998-333 - 11/10/1998 RESOLUTION NO. 98-333 RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO, CALIFORNIA, IN THE MATTER OF THE CHURCH-WILLOW NO. 2A REORGANIZATION CONFIRMING THE ORDER OF REORGANIZATION BY ANNEXATION TO THE CITY OF FRESNO AND DETACHMENT FROM THE FRESNO COUNTY FIRE PROTECTION DISTRICT AND THE KINGS RIVER CONSERVATION DISTRICT WHEREAS,this reorganization was conducted pursuant to the Cortese-Knox Local Government Reorganization Act of 1985 (Revised 1994), contained in Division 3, commencing with Section 56000 of the California Government Code; and, WHEREAS,the proposed reorganization known as Church-Willow No. 2A is described in attached Exhibits A and B; and, WHEREAS, on July 28, 1998,the Fresno City Council applied to the Local Agency Formation Commission for the proposed reorganization; and, WHEREAS, on September 23, 1998,the Local Agency Formation Commission (LAFCO) conducted a noticed public hearing on the subject reorganization and invited testimony from all interested persons; and, WHEREAS, after holding such duly noticed hearing, LAFCO adopted Resolution No. RO-98-17 approving the proposed "Church-Willow No. 2A Reorganization" involving the City of Fresno,the Fresno County Fire Protection District and the Kings River Conservation District; and, WHEREAS, LAFCO Resolution No. RO-98-17 authorized the City Council to conduct the proceedings for the reorganization in the manner provided by state law; and, WHEREAS, notice of the time and place for hearing objections to the proposed i reorganization has been given in the manner required by state law; and, g- 333 Council Resolution Church-Willow No. 2A Page 2 November 10, 1998 WHEREAS,the Council conducted a public hearing, and considered all testimony by persons who wished to object to the proposed reorganization; and, WHEREAS, all written protests or objections to the proposed reorganization,which were delivered to the Clerk of the City of Fresno prior to the close of the hearing, were considered and are on file in the office of the Clerk of the City of Fresno, County of Fresno, State of California; and, WHEREAS, at the close of the hearing,protests were not received from 25%of the registered voters residing within the reorganization; and, WHEREAS,the Council considered all factors required by law for a proposed district reorganization; and, WHEREAS,the Fresno County Assessor's roll will be used for the purpose of levying any assessments or taxes on the subject territory. NOW,THEREFORE,BE IT RESOLVED,by the Council of the City of Fresno as follows: 1. The Council hereby orders that the-territory referred to as the Church-Willow No. 2A Reorganization, described in Exhibits A and B attached,be annexed to the City of Fresno and the same territory be detached from the Kings River Conservation District and the Fresno County Fire Protection District. 2. The proposed reorganizations in the best interest of the territory included within the Church-Willow No. 2A Reorganization and lands have not been improperly omitted from or included within this'-reorganization. 3. For the purpose of the proposed reorganization,the subject territory is found to be inhabited. Council Resolution Church-Willow No. 2A Page 3 November 10, 1998 4. The reasons for this proposed reorganization are as follows: a. The subject territory is within the City of Fresno's Sphere of Influence. b. Municipal services will be more efficiently and economically provided. C. This project is a result of the City and County's policy to unify the metropolitan area and avoid creation of county islands. d. It is advantageous for the territory within the Church-Willow No. 2A Reorganization to be part of the City. 5. The Clerk of the City of Fresno shall immediately cause to be transmitted to the Executive Officer of the Fresno Local Agency Formation Commission a certified copy of this resolution. IT IS FURTHER RESOLVED by the Council of the City of Fresno that, the Church-Willow No. 2A Reorganization is hereby allocated to Council District No. 5.
