At is regular scheduled meeting on August 22, 2006; the Fresno City Council took the following action
regarding the above-referenced application:
1. Approved the environmental finding of Environmental Assessment No. -05-0 -3333 dated May
17, 2006, that the protect conforms to the provisions of the 2025 Fresno General Plan Master
Environmental Impact Report(MEIR No. 10 130).
2. Approved Rezone Application No. -05_93 requesting to rezone approximately 20 acres of
property from the AE-20 (County) zone district to the R-1/U (Single Famile `enti t
DistrictlUrban Growth Management)zone district.
On June 21, 2006, the City of Fresno Planning Commission approved the following:
1 Approved Vesting Tentative Tact Map No. 5588/UGM requesting to subdivide the subject '
property Into a 87-lot single family residential subdivision.
Enclosed is a dopy of the Planning Commission Resolution approving the tentative tract asap and Citi
Council Ordinance Bill adopted for the rezone application. Please note that this action shall become
effective thirty-one days after is passage.

NOW,THEREFORE,THE COUNCIL OF THE CITY OF FRESNO DOES ORDAIN AS FOLLOWS:
SECTION;1. Based upon the testimony and information presented at the hearing and upon review
and consideration of the environmental documentation provided,the adoption of the proposed rezoning
is in the best interest of the City of Fresno, The Council finds in accordance with its own independent
judgment that there is no substantial evidence in the record that the rezoning may have a significant
effect on the environment as identified by the Finding of Conformity` to the 2023 Fresno General Plan
[aster Environmental Impact Report , EIR No. 10130 dated a , 2006, prepared for
Environmental Assessment o. R-05-93/T-5588. Accordingly, Environmental Assessment No, R-05-

On the evening of the Planning ;Commission hearing, our client received notice
that Traffic Impact Fees would apply to their Tentative Tract Map as the map was
accepted for processing alter February 14, 2006. Subsequent td that date, the City has
acknowledged that proper notice was not igen; therefore, the February 140" date is
invalid,

This office represents Gary McDonald nt ld f res. In connection with the recent
Planning Commission approval of Tract 5588, the City of Fresno assessed a Regional
Street Fie of$1,279 per Arlt and a Southeast'Quadrant Major Street Fee of$5,771 per
unit as a condition of the approval of the vesting tentative map. This represents total few
for this 87 lot tract of$7,050 per unit or$613,350 for Tract 5588.
On the evening of the Planning Commission hearing, our client received notice
that Traffic Impact Fees would apply to their Tentative ract Map ,as the map was
accepted for processing after February 14, 2006. Subsequent to that cute, the City has
acknowledged that proper notice was not given, therefore, the February 10 date is
invalid.
Inasmuch as the City of Fresno has not yet formally taken the steps to property
assess such a .fee, this letter,,requests that the condition requiring the payment'of this fee
for Tact 5588 be waived, as Mr.'McDonald's submittal and approval prc predates
