SUBJECT: ACTION OF THE FRESNO CITY PLANNING COMMISSION RELATING TO
VESTING TENTATIVE TRACT NO. 4959/UGM, REZONING APPLICATION NO.
R-00-36 AND CONDITIONAL USE PERMIT NO. 00-218
The Fresno City Planning Commission at its regular meeting of January 3, 2001, took the following
actions regarding the above-referenced applications:
1. APPROVED the Mitigated Negative Declaration issued on December 14, 2000, for
Environmental Assessment No. T-4959, R-00-036, C-00-218 subject to compliance with the
mitigation measures specified in the Mitigation Monitoring Checklist for the Environmental
Assessment.
2. APPROVED Vesting Tentative Tract No. 4959/UGM subject to compliance with
Development Department Conditions of Approval dated January 3, 2001. The project is a
32-lot single-family residential private street non-clustered planned development project on
19.4 acres of land located on the east side of North Van Ness Boulevard between West
Alluvial Avenue and the San Joaquin River Bluff.
3. RECOMMENDED APPROVAL to the City Council of Rezoning Application
No. 00-036 which would rezone the site from the R-1-EHBP/UGM zone district to the
R-1-ABP/UGM and the R-1-A/UGM zone districts to become effective upon recordation of a
final map or maps of Tentative Tract No. 4959 for any portion of the property encompassed by
said tentative tract map for which a final map is recorded.
2. APPROVED Conditional Use Permit No. C-00-218 subject to compliance with conditions of
the following:
A. Exhibit "A" dated January 3, 2001.
B. Special Permit Conditions of approval dated January 3, 2001.

Because the rezoning of the property requires final action by the City Council, the rezoning
application will be before the Council for review and adoption on January 23, 2001 at 10:30`a.m.
Enclosed are copies of the Planning Commission resolutions approving the tentative tract map and
conditional use permit. The action of the Planning Commission on the tentative tract map, unless
appealed to the City Council, is final. Planning Commission action on the conditional use permit is
final.

WHEREAS, the Fresno City Planning Commission hereby finds and determines that there is no
substantial evidence in the record to indicate that Rezoning Application No. R-00-036 may have a
significant effect on the environment.
NOW, THEREFORE, BE IT RESOLVED that the Fresno City Planning Commission considered the
Environmental Assessment No. T-4959, R-00-036, C-00-218, and recommends to the City Council that

the following resolution pursuant to a proceeding instituted under Conditional Use Permit
(CUP) Application No. C-00-218, filed by Colburn Thomason.
CONDITIONAL USE PERMIT REQUESTED: To authorize the construction of a 32-lot
single-family residential non-clustered private street planned development subdivision with
one outlot for access, parking, public utilities, drainage and landscaping.

studies made by itself and in its behalf, and of testimonies offered at said hearing, has found
that the project complies with the Fresno Municipal Code, the site relates properly to streets
and highways, the proposed use will not-be detrimental to public welfare or surrounding
properties, and that the project complies with the standards and criteria of the Residential
Planned Development Ordinance.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission finds that there is
no substantial evidence in the record that the project proposed by the Conditional Use Permit
may have a significant effect on the environment and hereby approves the Mitigated Negative
Declaration and adopts the Mitigation Monitoring Checklist prepared for this project.
BE IT FURTHER RESOLVED that Conditional Use Permit No. C-00-218 is approved,

The side-yard building set-backs within the R-1-A Zone District may be reduced
from ten feet to five feet provided that the amount of the reduction allowed on one

RESOLUTION NO. 11523
The Fresno City Planning Commission at its regular meeting on January 3, 2001, adopted the
following resolution pursuant to the Subdivision Map Act of the Government Code of the State of
California and the Municipal Code of the City of Fresno.
WHEREAS, a Tentative Map of Tract No. 4959 was filed with the City of Fresno and proposes a
32-lot single family residential planned development subdivision, with one outlot on
approximately 19.4 acres of land located on the east side of North Van Ness Boulevard between
West Alluvial Avenue and the San Joaquin River Bluff, and,
WHEREAS, the Planning Commission conducted a public hearing to review the proposed
subdivision and considered the staff report and invited testimony with respect to the proposed
subdivision; and,
WHEREAS, the Development Department staff recommended approval of the proposed project
subject to all conditions of approval contained in the staff report dated January 3, 2001 and
presented at the hearing; and,
WHEREAS, one persons spoke in opposition to the project.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission finds that there is no
substantial evidence in the record that the proposed tract map may have a significant effect on the
environment and considered the Mitigated Negative Declaration for Environmental Assessment
No. T-4959, R-00-036, C-00-218, issued on December 14, 2000, and adopts the Mitigation
Monitoring Checklist prepared for this project.
BE IT FURTHER RESOLVED that the Fresno City Planning Commission finds that approval of
Tentative Tract Map No. 4959 is consistent with the adopted General Plan, any applicable specific
plan, and the findings required pursuant to Section 66410 et. seq. of the Government Code.
BE IT FURTHER RESOLVED that the Fresno City Planning Commission hereby-approves
Tentative Tract No. 4959 subject to the Development Department Conditions of Approval dated
January 3, 2001.

The Fresno City Council at its regular meeting on February 27, 2001, took the following action
regarding the above-referenced applications:
1. ADOPTED Ordinance Bill No. 2000-24, approving Rezoning Application No. R-00-36 to
become effective on the thirty-first day after its passage and upon recordation of a final map or
maps of Vesting Tentative Tract No. 4959/UGM for any portion of the property encompassed by

the Zoning Ordinance on real property described in Exhibit"L"; and,
WHEREAS, the Council of the City of Fresno, on the 27th day of February, 2001,
received the recommendation of the Planning Commission and concurs therein.
NOW, THEREFORE, THE COUNCIL OF THE CITY OF FRESNO DOES ORDAIN
AS FOLLOWS:
SECTION 1. Based upon the testimony and information presenied at the hearing and
upon review and consideration of the environmental documentation provided, the Council finds
based upon its own independent judgment there is no substantial evidence in the record that the
rezoning may have a significant effect on the environment, and the environmental assessment
prepared for this project was considered and the mitigated negative declaration is adopted.
SECTION 2. The Council further finds that the adoption of the proposed rezoning is in
the best interests of the City of Fresno and is consistent with adopted plans and policies of the
City. -
SECTION 3. The zone district.of the real property described in Exhibit"h", located in -
the City of Fresno and shown on the Official Zone Map of the City of Fresno is reclassified.from. : :

STAFF ANALYSIS
The tentative map, originally considered and approved by the Fresno City Planning Commission on
January 3, 2001, provided for a 32-lot single-family residential planned development subdivision
with one outlot.
Staff has received a request for minor revisions to Vesting Tentative Tract_.No.4959 submitted on
September 24, 2001. The revisions propose to make minor adjustments the lot width and depth
of several lots in the project. The revision also proposes to amend the wall requirement for Lots 1,
31 and 32 to replace the masonry wall with wrought-iron fencing. The wrought-iron fencing was
previously approve by the Director for this project. The revision does not propose changes to the
street pattern from that as shown on the originally approved tentative map. The project would
remain consistent with the density plan designation shown for the site on the Bullard Community
Plan.

Staff has determined that the proposed revision meets the provisions of the Fresno Municipal Code
for minor revisions to approved tentative maps. In accordance with Section 12-1005.2(b)(3) of the
Municipal Code, staff recommends that the Revised Map of Vesting Tentative Map of Tract
No. 4959 dated September 24, 2001, and the wall amendment be approved by the Development
Department Director and shall replace the previously approved map. Be advised that the
anniversary date of the Planning Commission approval of the original tentative map (January 3,
2001) is not affected by this approval of the revised map.
CONDITIONS"OF APPROVAL
1. Revised Vesting Tentative Map of Tract No. 4959, dated September 24, 2001, is approved
to compliance with the Development Department Revised Conditions of Approval dated
January 3, 2001 and Revised Condition No.16 dated October 15, 2001.
STAFF RECOMMENDATION
Based upon the staff analysis of this application, staff recommends the Director grant approval of
the Revised Vesting Tentative Map-of Tract No. 4959, date September 24, 2001, subject to the
above conditions of approval.

The Fresno City Planning Commission at its regular meeting on January 3, 2001, adopted the
following resolution pursuant to the Subdivision Map Act of the Government Code of the State of
California and the Municipal Code of the City of Fresno.
WHEREAS, a Tentative Map of Tract No. 4959 was filed with the City of Fresno and proposes a
32-lot single family residential planned development subdivision, with one outlot on
approximately 19.4 acres of land located on the east side of North Van Ness Boulevard between
West Alluvial Avenue and the San Joaquin River Bluff; and, _ ..
WHEREAS, the Planning Commission conducted a public hearing to review the proposed
subdivision and considered the staff report and invited testimony with respect to the proposed
subdivision; and,
WHEREAS, the Development Department staff recommended approval of the proposed project
subject to all conditions of approval contained in the staff report dated January 3, 2001 and
presented at the hearing; and,
WHEREAS, one persons spoke in opposition to the project.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission finds that there is no
substantial evidence in the record that the proposed tract map may have a significant effect on the
environment and considered the Mitigated Negative Declaration for Environmental Assessment
No. T-4959, R-00-036, C-00-218, issued on December 14, 2000, and adopts the Mitigation
Monitoring Checklist prepared for this project.
BE IT FURTHER RESOLVED that the Fresno City Planning Commission finds that approval of
Tentative Tract Map No. 4959 is consistent with the adopted General Plan, any applicable specific
plan, and the findings required pursuant to Section 66410 et. seq. of the Government Code.
BE IT FURTHER RESOLVED that the Fresno City Planning Commission hereby-approves
Tentative Tract No. 4959 subject to the Development Department Conditions of Approval dated
January 3, 2001.

ENVIRONMENTAL FINDING
A finding of Mitigated Negative Declaration was filed on December 14, 2000.
BACKGROUND AND ANALYSIS
The Bullard Community Plan designates low density residential land uses for the property. The Plan
shows low density residential land uses planned for the property to the south, east and west. The plan
shows open space land uses planned for the property to.the north. The applicant proposes to subdivide the
site into 32 single-family residential lots with Tentative Tract No. 4969 and to construct a single-family
residence on each lot. Rezoning Application No. R-00-036 proposes to rezone the east 947 feet of the 19.4
acre subdivision site from the R-1-EH/BP/UGM to the R-1-A/BP/UGM and the R-1-A/UGM zone
districts to permit the development of the 29 of the 32 single-family residential lots. The proposed lots
fronting on the North Van Ness Boulevard will retain the exsting R-1-EH/BP/UGM zoning.The Van
Ness-Forkner Land Use Policy of the Bullard Community Plan requires minimum lot frontages of 150 feet
and minimum lot areas of 3 7,5 00 square feet for all of the lots in the subdivision which front onto.North
Van Ness Boulevard. The plan policy also requires that the remaining lots have minimum areas of 20,000
square feet. All of the lots in the subdivision equal or exceed these minimum lot size requirements. The
lots shall also meet the minimum lot dimension of the their respective zone distircts.
The proposed density yield of this single-family subdivision(1.6 units per acre) is within the expected
density yield for a R-1-E and R-1-A zoned project.
The Bullard Advisory Committee has reviewed the proposed tentative map, rezoning request and
conditional use permit and is recommending approval of the project.
Based upon the information contained in the staff report,the proposed rezoning of the subdivision to the
R-1-A/BP/UGM and the R-1-A/UGM zone districts, is considered consistent and compatible with the
existing and planned land uses in the area.
PLANNING COMMISSION ACTION
At its regular meeting of January 3, 2001,the Planning Commission by a vote of 5-0, with two absent,
took action to recommend approval of Rezoning Application No. R-00-036 and by the same vote approved
Tentative Tract No. 4959/UGM. One person spoke in opposition to the proposed rezoning application and
tentative subdivision map.

RECOMMENDATION
Based upon the information contained in the staff report, staff recommends the Council take the following
action:

2. APPROVE Rezoning Application No. 00-036 to rezone the subject property from the
R-1-EH/BP/UGM to the R-1-A/BP/UGM and R-1-A/UGM zone districts to become effective for
any portion of the site for which a final map of Tentative Tract No. 4959/UGM is recorded.

5. Submit deed restrictions or covenants restricting exterior colors and construction
materials to those compatible with the natural bluff environment and with the
surrounding development as required by Section 12-243.7-C, Fresno Municipal
Code.
6. Before any building or structure is erected or any grading is commenced on any
property in the BP - Bluff Preservation Zone District, a Site Plan Review
Application shall be approved by the Development Department.Director. Ref.
Section 12-243.4-A.
7. Public utilities easements, as necessary, shall be dedicated to the City of Fresno.
Any required relocation of existing utilities necessitated by required street
improvements will be paid for by the appropriate utility company or the developer
of the project. Contact the appropriate utility company for information. A Public
Utility Easement (PUE), ten feet (10') in width, shall be dedicated contiguous to all
street boundaries within the Tract Map. PG&E also requests that a PUE be
incorporated within all private street.
8. Proposed Declaration of Covenants, Conditions, and Restrictions (CC&R's) and the
proposed instruments for the owner's association are to be submitted to the
Development Department for review prior to final map approval. Said documents
are to be recorded with the final map or alternatively submit recorded documents or
documents for recording prior to finalacceptance of subdivision improvements.
Said documents shall include assignment of responsibility.to..the.owner's association
for on-site sewer and water lines and other provisions as stated in the Development
Department Guidelines for preparation of CC&R's dated January 11, 1985.
9. Outlot "A" shall be specifically for access, public utility easements, drainage,
parking and landscaping, common area and storm drainage.
10. Relinquish access rights to.the River Bottom Road from Lots 1,.31 and 32.x: Ref.
Section 12-1011-f-3, Fresno Municipal Code.

12 The subdivider shall pay applicable fees for, but not limited to, street trees,
street signs, water fees, sewer fees, and inspection fees in accordance with
Resolution No. 79-606 and Resolution No. 80-420 (Master Fee Schedule),
or any amendments, modifications or additions thereof and in accordance
with the requirements of State law as related to tentative maps.
�.3. The subdivider shall furnish to the City a subdivision guarantee of a title
company listing all parties having any right, title or interest and the nature of
their interest per State law.

Landscaping and Walls
15. Provide a 10-foot landscaped strip (and irrigation system) along River
Bottom Road along the north property line of Lots 1, 31 and 32. Installation
of the landscaping shall be with the site development and maintenance shall
be the responsibility of owners of each lot or a homeowners association.
Ref. Section 1210114-3, Fresno Municipal Code.
When the grading plan establishes a top of slope beyond the required
landscape easement noted and the construction of the required wall is to be
established coincident with the top of slope then the required minimum
easement width shall be expanded to include the full landscaped area up to
the wall location.
_ 16. Provide a 6-foot high solid masonry wall or decorative wrought-iron fence
at the rear of the landscape strip (required solid wall to meet requirements of
Section 12-105-W-2, and Section 12-306-N-19, Fresno Municipal Code),
.noted in Condition No. 15, above. Ref. Section 12-1011-f--3, Fresno
Municipal Code.
17. Improvement plans for required landscaping and irrigation systems shall be
submitted to the Development Department for review prior to final map
approval.

maps," any multiple final maps filed by the subdivider on this tract shall fully and
independently conform to all provisions of Chapter 12, Article 10 of the Fresno
Municipal Code (Subdivision of Real Property).
26. The subdivider shall obtain any and all permits required for the removal or
demolition of any building or structure located within the subdivision boundaries.
The developer shall also obtain any and all permits required for the closure of any
septic tank, cesspool or water well. All permits shall be obtained prior to
commencement of such work, in accordance with Chapter 13 of the Fresno
Municipal Code.
27. If archaeological and/or animal fossil material is encountered during project
surveying, grading, excavating, or construction, work shall stop immediately.
If there are suspected human remains, the Fresno County Coroner shall be
immediately contacted. If the remains or other archaeological material is possibly
Native American in origin, the Native American Heritage Commission (phone.
916-653-4082) shall be immediately contacted, and the California Archaeological
Inventory/Southern San Joaquin Valley Information Center (phone. 805-644-2289)
shall be contacted to obtain a referral list of recognized archaeologists. An
archaeological assessment shall be conducted for the project, the site shall be
formally recorded, and recommendations made to the City as to any further site
investigation or site avoidance/preservation.
If animal fossils are uncovered, the Museum of Paleontology, U.C. Berkeley shall
be contacted to obtain a referral list of recognized paleontologists. An assessment
shall be conducted by a paleontologist, and if the paleontologist determines the
material to be significant, it shall be preserved.
28. If, as part of this subdivision, a division will be made of any lot or parcel of land
upon which there is an unpaid special assessment levied under any State or local
law, including a division into condominium interest as defined in Section 783 of the
Civil Code, the subdivider shall file a written application with the City's Director
of Public Works, requesting apportionment of the unpaid portion of the assessment.
The application shall contain at least the-following information:
a. A full description of each assessed lot, parcel or interest to be divided and of
how such lot, parcel or___interest-will-be divided;

b. A request that the Engineer apportion the amount remaining unpaid on the
assessment in accordance with applicable law; and
C. Written consent of the owner(s) of each such lot, parcel, or interest to the
requested apportionment.
The application shall be filed prior to the approval of the final map by the City and
shall be accompanied by a fee, in an amount specified in the Master Fee
Resolution, for each separate lot, parcel or interest into which the original assessed
lot parcel or interest is to be divided. The fee shall be in an amount sufficient to
pay all costs of the City and the Engineer of Work responsible for determining the

29. Comply with the requirements in the attached memorandum from

Urban Growth Management.Requirements
30. The subdivider shall be required to pay the appropriate UGM Park Capital Fee at

STREETS AND RIGHTS-OF-WAY
33. The subdivider shall make provisions for the physically handicapped in accordance
with the Department of Public Works standards and as required-by State law.
34. All existing and proposed utility systems shall be installed underground in
accordance with Section 12-1011(h) of the Fresno Municipal Code. The
subdivider's attention is directed to the installation of street lights in accordance
with Resolution Nos. 68-1879 78-5221P 81-219 and 88-229.
35. The subdivider shall construct a complete underground street light system as
approved by the Traffic Engineer prior to final acceptance of the subdivision.
Height, type, spacing, etc., of standards and luminaires shall be in accordance with
Resolution Nos. 78-522 and 88-229,or any modifications thereto approved by the
City Council prior to installation, and shall be approved by the City Traffic
Engineer prior to final map approval. All lights shall be dedicated to the City upon
completion. Submit engineered construction plans to the Public Works Department
for approval.
36. The subdivider shall furnish to the City acceptable security to guarantee the
construction of the off-site street improvements inaccordance with all applicable
provisions of the Fresno Municipal Code and the-State-Subdivision Map Act.

39. An 8-inch sanitary sewer is existing in North Van Ness Boulevard. No extension
of public sewer main is required. Provided a separate house branch for proposed

If an on-site public water system within private streets is proposed to service this
tract, the water system, design must conform to Department of Public Utilities
requirements.
Urban Growth Management Requirements
40. The tract is located within the service area of the Herndon Avenue Trunk Sewer.
The appropriate trunk sewer fee is required to be paid prior to final map approval. .
41. The developer shall pay the appropriate sewer charges in effect for this area at the

WATER SERVICE
42. A 12-inch transmission grid water.main (TGM) and an 8-inch water main are

URBAN GROWTH MANAGEMENT REQUIREMENTS (GENERAL)
49. The developer of property located within the UGM boundaries shall comply with
all sewer, water and street requirements and pay all applicable.UGM fees imposed
under the Urban Growth Management process (with appropriate credit given for the
installation of required UGM improvements) in accordance with the requirements
of State Law as related to tentative tract maps.
50. The developer will be responsible for the relocation or reconstruction of any
existing improvements or facilities necessary to construct any of the required UGM
improvements.
Right-of-Way Acquisition
- 51. The developer will be responsible for the acquisition of anynecessary right-of-way
to construct any of the required UGM improvements.
Rights-of-Way acquisition shall include any rights-of-way necessary for proper
drainage, signing, pole relocation, and shoulder grading. In general, this will
require right-of-way to be provided approximately 10.feet outside the traveled lane.
The exact requirement must be determined at the project design stage based on the
existing conditions and detailed design information.
In the event an acquisition of any easement or right-of-way is necessitated by the
subject development, said acquisition will-be-accomplished-prior to final map
approval. The developer should contact the Real Estate Section of the Public
Works Department to receive procedural guidance in such acquisitions.

developer must request and grant to the City the full authority to attempt acquisition
either through negotiation or through its power of eminent domain. The developer
shall furnish to the City Public Works Department, Real Estate Section, an
appraisal report or a request for an estimated appraisal amount (to be determined by
the Real Estate Division) prior to preparation of a Subdivision Agreement.
The developer/owner shall submit adequate security in the form of a cash deposit to
guarantee payment of all costs associated with the acquisition, including staff time,
attorney's fees, appraisal fees, court costs, and all related expenditures and costs
necessary to effect the acquisition of such easements or rights-of-way.
Flood Control
52. The subdivider shall be required to pay any applicable storm drainage fees to
comply with Article 13, Chapter 13 of the Fresno Municipal Code.
53. The subdivider shall be required to comply with the specific requirements imposed
by the Fresno Metropolitan Flood Control District (FMFCD) for the subdivision or
any amendments or modifications to those requirements which may be granted by

These include conditions based on adopted City plans and policies, those determined.through site
plan review and environmental assessment essential to mitigate adverse effects on the

whole enhance the project and its relationship to the neighborhood and environment.
Discretionary conditions of approval are listed in the last section of this list of conditions under the
heading"Part F -Miscellaneous" and may be appealed. All code requirements, however, are mandatory
and may only be modified by variance, provided the findings pursuant to Fresno Municipal Code
Section 12-405.A can be made.
Approval of this special permit shall be considered null and void in the event of failure by the applicant
and/or the authorized representative, architect, engineer, or designer to disclose and delineate all facts

and information relating to the subject property and the proposed development including, but not
limited to, the following:
1. All existing and proposed improvements including but not limited to buildings and structures,

subject property and all of the preceding which are located on adjoining property and may
encroach on the subject property;
2. All public and private easements, rights-of-way and any actual or potential prescriptive
easements or uses of the subject property;
3. Existing and proposed grade differentials between the subject property and adjoining property
zoned or planned for residential use.
Approval of this special permit may become null and void in the event that development is not
completed in accordance with all the conditions and requirements imposed on this special
permit, the Zoning Ordinance, and all Public Works Standards and Specifications. The
Development Department shall not assume responsibility for any deletions or omissions resulting

PLANNING

Development is proposed in accordance with exist R-1-EIVBP/UGM and proposed
R-1-ABP/UGM and R-IAf(JGM zoning.
UNIT DESIGN
1. Dwelling shall have a minimum fully inclosed floor area of 3,000 square feet and two
story dwellings shall have a minimum first floor area of 2,000 square feet.

2. Each dwelling shall a minimum three car garage.
3. The rear and side building elevations of dwelling shall be in keeping with the, equal to in
design with the front building elevation.
4. Wood siding (or high-quality wood substitute), laid horizontally, either with overlap or
tongue-in-groove is preferred. Plywood or T-111 type siding shall not be allowed.
5. Brick siding may be allow if fully integrated into all exterior elevations.
6. Plaster or stucco siding, where consistent with the style of the residence may be allowed.
7. Roofing material shall be of high quality and durability. The roofing material type shall
match the style of the dwelling.
POPULATION DENSITY(Residential Proiects)
Allowable density is 2.18 dwelling units per acre.
BUILDING HEIGHT
The maximum allowable building height is 35 feet. The proposal is within the required height.
EXCEPTIONS: Overheight structure may be approved by the City Planning
Commission. However, no roof structure or any space above the height
limit shall be allowed for the purpose of providing additional living or
floor space. Submit a letter together with the filing fee to the Secretary
of the Planning Commission requesting approval.
BUILDING SETBACK OPEN SPACES AND LANDSCAPING
Lots 12, 13, and 14 shall have minimum front yards of 50 feet. Lots 12, 13 and 14 shall meet
the yard requirements of the R-1-E zone district. The proposed R-1-A lots (Lots 1 thru 11 and
15 thru 32) may have reduced front yards of 25 feet and reduced interior side yards of 5 feet,
except for Lots 15 and 27 which shall have a keylot side yard of 10 feet as shown on Exhibit A
dated January 3, 2000. Street.side side yards shall be a,minimum of 20 feet. All
encroachments in to rear yards shall be subject to Site Plan Review.
Lots 1, 28 thru 32 shall have a minimum main building set back of 30 from the top edge of the
bluff face, which may be approved by the Director subject to a site plan review process.

showing the number and types of trees; to the Planning Division. These plans must be

Prior to final inspection, a written certification, signed by a landscape professional approved by

FENCES.HEDGES, AND WALLS
Temporary fences to secure projects under construction are allowed. Any temporary fence shall be
adequately secured and constructed to prevent overturning due to wind, vandalism, and/or casual
contact by the general public. The construction shall be performed in such a manner as to minimize any
potential safety hazard which may occur as a result of improper fence installation or damage to the
fence.
OFF-STREET PARKING
A minimum of 15 guess parking spaces is required per the Exhibit A, dated May 17, 2000.
Lighting where provided to illuminate parking, sales or display areas shall be hooded-and so

both. The entry gate and walls are only approved for a maximum height of 8 feet with this

COVENANTS AND AGREEMENTS

general National Pollutant Discharge Elimination System permit be filed for all

responsibility to ensure that the Notice of Intent is filed in accordance with the
rezulations uublished in Volume 55. No. 222 of the Federal Register.

If archaeological and/or animal fossil material is encountered during project surveying, grading,
excavating, or construction, work shall stop immediately.

The proposed project has been evaluated with respect to each item on the attached environmental
checklist. This completed checklist reflects comments of any applicable responsible agencies and
research and analysis conducted to examine the interrelationship between the proposed project and the
physical environment. The information contained in the Environmental Assessment Application, the
checklist, and any attachments to the checklist, combine to form a record indicating that an initial study
has. been completed in compliance with the State CEQA Guidelines and the California Environmental
Quality Act.
Any rating of "2" on the checklist indicates that a specific adverse environmental effect has been
identified in a category which is of sufficient magnitude to be of concern. Such an effect may be inherent
in the nature and magnitude of the project or may be related to the design and characteristics of the
individual project. Effects rated in this manner are not sufficient in themselves to require the preparation
of an Environmental Impact Report and/or have been mitigated to the extent feasible.
All new development activity and many non-physical projects contribute directly or indirectly toward a
cumulative impact onrthe physical environment. The incremental effect contributed by this.project toward .
such a cumulative effect is not considered substantial in itself.
The proposed project is not expected to-result in any significant adverse effects in terms of the factors
considered on the environmental checklist, including any such factors for which minor effects have been
identified. Cumulative effects of a significant nature are also not expected. The proposed project will
not result in any adverse effects which fall within the "Mandatory Findings of Significance" contained in
Section 15065 of the State CEQA Guidelines. The finding is therefore made that the proposed project
will clearly not have a significant adverse effect on the environment.
This Mitigated Negative Declaration will be deemed final and effective.if no appeal is filed in the manner-
specified by Section 12-505 of the Fresno Municipal Code.

Bluff Preservation Overly Zone District (Section 12-243 of the Fresno Municipal
Code), the applicant will be required to prepare and submit a Soils Investigation
and Evaluation Report per therequirements of Section 12-1022(e) of the Fresno
Municipal Code. The soils report must address the development of the tract as
gelated-to-:the geologic'stability of the San Joaquin-River Bluffs and-establish a
minimum.setback for.the edge for.the proposed residential structures..
Any soils report must certify that the proposed project will not cause any.
;: significant-increase in the risk:of damage to the bluff face from erosion, slippage,
subsidence or other movement if the any mitigation measures:are done in

1.3 Unique Geologic or Physical Features
13.0-Aesthetics (Bluff Preservation Zone Districtl
The proposed project is located adjacent to the San Joaquin River Bluffs and is
within the "BP" Bluff Preservation Zone District. The 'BP".zone district applies
to an area extending 300 feet southerly from the toe of the bluff and is identified as
an area of special quality by reason of the topography, geologic substratum and
environment of the area.
Development within the BP zone district, which is on the San Joaquin River
Bluffs, shall be a minimum of 30 feet from the bluff edge as stated in the Bullard

Community Plan. The conditions of approval of Tentative Tract No. 4959 will
insure that development of this site will be in conformance with the-"BP zone
district standards applicable to this site.
2.0—AIR.QUALITY
The proposed project will cumulatively contribute to the-incremental-decline in local air
quality. However, the project's air quality impact in and.of itself is not considered
significant. The project site is located in Fresno County which,--in addition to the rest of
the San Joaquin Valley, has consistently exceeded State and Federal ozone and PM-10
standards. It is a nonattainment area for ozone and particulate matter and, within the
Fresno-Clovis Metropolitan Area, a nonattainment area for.carbon monoxide. Therefore,
it is necessary for all projects to analyze,-quantify and mitigate short term construction
impacts on air quality.
It is required that watering of the project site occur at least twice daily with complete
coverage during the clearing, grading and earth moving phases of the project to cut down
substantially on PM-10 emissions. To mitigate fugitive dust emissions during project
construction, the following measures are required:
1. On-site vehicle speed shall be limited to 15 mph;
2. All areas with vehicle traffic shall be watered periodically;
3. Roads shall be treated with a petroleum-based dust palliative;
4. Streets adjacent to the project site:shall be swept:as needed to
remove silt, which may have accumulated from construction
activities so as to prevent excessive amounts of dust.
Ozone emissions will be mitigated during construction by the following measures:
1. Equipment engines shall be maintained in good condition and
proper tune per manufacturer's specifications;
2. From August to October, the construction period shall be
lengthened so as to minimize the number of vehicles and
equipment operating at the same time.

The San Joaquin Valley Unified Air Pollution.Control.District (SJVUAPCD),..charged
with monitoring and improving local air quality,has developed the San Joaquin Valley ..
1991 California Clean Air Act Air Quality Attainment Plan (AQAP), which continues to
project nonattainment for the three above-noted pollutants. The-plan includes a number
of strategies to improve air quality including a transportation control strategy and a
vehicle inspection program.
The City of Fresno, in addition to the measures proposedby,the_SJ.VUAPCD, is

2.4--Generation of Construction Dust
Construction of the 32-lot single-family residential planned development subdivision will
contribute to short-term impacts on air quality in the form of increased dust and
particulate matter,. However, these impacts are local.in nature.and will cease upon
completion of the project. The construction phase of the project-will-be subject to•the
San Joaquin.Valley Unified Air Pollution Control District(SJVUAPCD)Regulation VIII,
Rule 8020, related to control of dust and fine particulate matter(PM10). This rule
mandates the.implementation of dust control measure&such as-cleaning, sprinkling and
sweeping of all construction sites to reduce the:potential for dust to the lowest possible
level.
3.0--WATER
The Water Division of the Public Works Department states that the development will-not
have an adverse impact on the city water system.

The northerly portion of Tentative Tract No. 4959, abuts the San Joaquin.River
Bluff area. :While.it appears that no unique, rare, or endangered plan or animal
species inhabit the project site,.the area below the bluff between this site and the
river is rural residential and a golf course. These open space areas will provide
adequate open space for wildlife habitat.
9.0--LAND USE
Development of.this site-will-be.conditions..on.compliance-with-the-Bullard-Community
Plan and its policies related to the Van Ness Boulevard Scenic Drive which will require
that lots fronting onto North VanNess Boulevard shall°have lotfrontages of.150-feet and
lot areas of37,500 square feet. Thesemaining lots.shall have minimum areas of 20,000
square feet.
10.0--TRANSPORTATION AND CIRCULATION
The 32-lot single-family residential planned development subdivision is expected to
generate approximately 320 vehicle trips per day(V.T.D.). North Van Ness Boulevard, a
-(a scenic drive); has an-ultimate capacity of-18,000.V.T.D.-Although those-streets-have
not reached=capacity to date,Ahe-level of:expected development in the area could will not
create deficiencies in the future.
11.0--URBAN SERVICES
11.4—Overcrowding of school facilities
The subject site is within the enrollment area of the-Clovis Unified School District.
Because of the rapid growth occurring within the district boundaries, the school
district has advised that the following conditions may exist when development
occurs:
a. The elementary school may not have capacity for students
from the area and, therefore, students may be bused to other
elementary schools within the District, or it may result in the
adjustment of school attendance areas within the District,
requiring students to attend another school;

b. .The students may attend more.than.one elementaryy school during
their elementary school years;
c. The students may have to attend elementary,junior high and high
schools-that are on double session, extended day, or year-round
schedules, or students may attend new facilities when they are
constructed.
'The district has.adopted developer,fees-in:.accordance:-mth.current-state:law,.
Which will require the developer.of this project.to pay.a fee.for'School facilities per .
-the:adopted schedule of fees.:1n addition,-the District has.requested that the
'owner/subdivider.provide the Above information to-all prospective purchasers of
property within the proposed project.
11.6--Availability of sewer lines of adequate capacity
The City of Fresno's Wastewater Treatment Plant, with an estimated hydraulic
treatment capacity of.80 million gallons of effluent per day (MGD).average dry
weather flow, is currently treating between 53 and-55 mgd.on-a-yearly-basis-with
some-daily total flows of 80 mgd. The treatment plant:is.approaching its overall
design capacity. This project,as proposed, will cumulatively contribute to the
short-term reduction of capacity at the plant.. In order to address this-situation and
to reduce the chance.of.eventual curtailments in the City's development process,
the City is in the process of expanding:-the-plant's:capacityAo..90-MGD.
13.0--AESTHETICS
No public or scenic vista will be obstructed by the development.and no valuable
vegetation will be removed. The developer proposes to use an archifectural design which
is compatible with surrounding developments.
14.0--HISTORICAL/ARCHAEOLOGICAL
There are no adjacent historical or archaeological sites. To ensure that any possible sites
will be protected, the following conditions have been added to this special permit
approval:

1. If.archaeological and/or animal fossil material.is.encountered
during project surveying;-grading,excavating;or construction,
work shall stop immediately.
2. If there are.suspected human remains, the Fresno County
Coroner shall be immediately contacted. If the remains or
other archaeological material ispossibly-Native-American in
origin, the Native American Heritage Commission shall.be
immediately contacted, and the California:Archaeological
Inventory/Southern.SanJoaquin Valley.Information Center
shall be contacted to obtain a referral list of recognized
archaeologists. Anarchaeological assessment shall be
.conducted for the project, the site shall be formally recorded,
and recommendations made to the City as to any-further.-site
investigation or site avoidance/preservation
3. If animal fossils are.uncovered, the Museum of Paleontology,
U.C. Berkeley shall be contacted to obtain a referral list of.
recognized paleontologists. -An'assessment shall be
conducted by a paleontologist and, if the paleontologist
determines the material to be significant, it shall be preserved.

Excessive energy consumption is not expected:to-occunwith.occupancy:ofahe
development.
Determination
On the basis of this initial evaluation,.it is determined that the proposed project is
consistent with all applicable City plans and policies and conforms to all
applicable zoning standards and requirements. It is further determined that the
proposed project will not have a significant effect on the environment. This is
because the mitigation measures required as conditions of project approval for the
subject special permit, which have been added to the project as defined, are
conditions upon which a negative declaration can be recommended. A

prepared by Provost and Pritchard,Inc. A landscapeplan.was.not submitted,however,the.Parks
Division offers the following comments regarding the"off-site"conditions as.:proposed on the site plan . .
STREET TREES:
1. Fresno Municipal Code requires. l tree per each 60 lineal feet of street frontage which will result in a
minimum of 6 street trees at this address. The tree species designated for the parkway strip will be
Eucalyptus to match existing trees on N.Van Ness, ;planted per city standards, including: root barriers,
protective cages, staking,and drip-irrigation. Landscape plans are required to show the tree species,to
show placement of the trees and drip irrigation.
2. Any existing eucalyptus trees will meet street tree requirements and may not be removed. (Fresno
Municipal Code 11-306(h)(2)]. Said tree(s)near any excavation,construction or street work shall be
sufficiently guarded and protected by those responsible for such work so as to prevent any injury to said
tree. No person shall excavate any ditches, tunnels or trenches,.or install pavement within a radius of four
feet from any public tree without the written permission of the Parks Division. (FMC 11-305(h)2.).
3. The property owner is required to provide an irrigation system to each street tree before occupancy.
The irrigation system shall comply with FMC 12-306-N-23.
4. The following notes shall appear on the landscape plan:
Trees planted within the right-of-way shall be planted by the property owner after first obtaining a
street tree planting permit and a street work permit Notify the Parks Division to verify the tree
planting locations 72 hours prior to any excavation (498-4239).
Trees planted in the right of way shall be located with the following minimum setbacks:
30' from street corners for visibility& 15'from driveways,stop signs, alleys, light poles and

Drilling to pierce hardpan shall be required prior to planting each street tree. Notify Parks
Inspector(559.498.4906)two working days in advance of drilling date for inspection of drilling
operations and to check backfilling procedures and safety barriers.
Drilling shall be completed withing the 14 days for which clearance was obtained for approved
locations. Holes shall be 2 feet in diameter and drilled to a depth where visual evidence of the
subsurface sand or gravel drainage stratum is apparent;the drainage hole shall.be drilled to a

minimum of 10 feet deep. Immediately following drilling,the hole shall be backfilled with soil
drilled from the hole, using sufficient water to thoroughly saturate the backfill material.
Immediately following backfilling,the white spot designating the planting site is painted black to
indicate the site has been drilled. The drilled sites are barricaded and checked daily for 5 working
days for soil settling. Soil levels are adjusted as necessary during this time. After 7 days,the
barricades and excess soil are removed. Soil shall be allowed to settle for a minimum of 20 days
prior to planting.
MEDIAN ISLANDS:
5. -Median island landscaping is required per FMC section 12-306-N-24. However,aerial photos verify
that no median island is constructed fronting the project boundaries and no further planting or in lieu of

secure a permit include, but are:not limited to: trucking terminals; municipal passenger
service--facilities;.manufacturing facilities; and other industrial activities .which might
generate contaminated runoff..The industrial permit is secured by filing a Notice of Intent
and paying a.fee to the State Water:.Resources Control Board,.=30 days prior to the
.beginning of operation. .The permittee.must also develop land implement a.storm-water
pollution prevention plan,reporting plan,and monitoring plan,and eliminate all prohibited
non-storm water discharges.
7. Construction activity including grading,clearing,grubbing,filling,excavation,development
or redevelopment of land that results in a disturbance of 5-acres or more (or less than 5
acres but part of a larger common-plan of development or sale)-must secure a constriction
storm water discharge permit in compliance with U.S.E.P.A.'s NPDES regulations (CFR
Parts 122-124,Nov..1990). The construction permit is secured by filing a Notice of Intent
and paying a fee to the State Water Resources Control Board prior to the commencement
of construction. The permittee must also develop and implement a storm water pollution
prevention plan, monitoring plan, reporting plan,and eliminate all prohibited non-storm
water discharges.
�8. The proposed development.shall-<implement,_all:-..applicable BMPs presented in the
Construction Site and Bost-ConstructionStorm Water -Management Guidelines
(available at the District Office),to reduce the release of pollutants in storm-water runoff
to the maximum extent practicable.
9. A requirement of the District may be appealed by filing a written notice of appeal with the
Secretary of the District within ten days of the date of this Notice of Requirements. -O

WHEREAS, the map conforms to all of the requirements of the Subdivision Map Act of the
State of California, and City ordinances, resolutions and standards, except that Section 66492 and
66493 of the Subdivision Map Act may not be fully complied with at the time of passage of this
resolution and owner having previously filed with the Clerk of the Board of Supervisors of Fresno
County a Tax Compliance Certificate Request along with copies of the final map considered
herewith by the Council; and,
WHEREAS, the Council finds that the proposed subdivision, together with the provisions for its
design and improvement, is consistent with all applicable general and specific plans of the City; and,
WHEREAS, the Subdivider and the Owners, whose signatures appear on the map, and others
have offered for dedication certain streets, public utility easements, access rights and other public
properties and uses as shown and delineated upon said map; and,
WHEREAS, the Planning Commission of the City of Fresno, by formal resolution, approved
said tentative map.

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Fresno as follows:
1. That the final map is hereby approved and all of the streets, public utility easements,
access rights and other public properties and uses offered for dedication on the map are
hereby accepted, subject to complete compliance with Sections 66492 and 66493 of the
Subdivision Map Act prior to release of the map for recordation.
2. The Council finds that the final map is in substantial compliance with the tentative map,
any deviations therefrom being deemed to be approved by the Council.
