They are in the City's name. We haven't seen them, but we have evidence that they exist, with the confirmations we've received. The CDs would not be set up as automatically renewable. The bank will contact us and ask us what we want done with them. Thanks for the info on the relationship between Dirk Poeschel and the Housing Authority. I'm assuming then that the contractor is the Housing Authority and these monies belong to them, if and when the project is completed. Thanks,Jon. Not sure about what direction to give you because Public Works administers the subdivision agreement. Rose or Maryann may have some insight. Dirk Poeschel is acting as an agent on behalf of the Housing Authority. Again,since I haven't seen the CD's can't answer that question. When Public Works determines that the improvements required are complete and accepted by the city then they will release the security for the subdivision. All we need to know at this point is if the CDs are acceptable. If they are not then please advise. Thanks. Jon From: Greg Wiles Sent: Thursday, October 30, 2008 3:55 PM To: Jon Bartel Cc: Karen Bradley; Alan Kawakami Subject: FW: 5549 CITY OF FRESNO CDS Hi,Jon, We have received trade confirmations from Bank of the West, Treasury Operations, indicating that four CDs have been set up in the name of the City of Fresno, one for$49,000, one for$3,000, one for$937,000, and one for$493,000. The interest rate is 2.5 percent and they all mature on Nov 24, 2008. Can you answer a couple of questions? 1 s When the CDs mature on Nov 24th, the bank will ask us for directions. Their normal practice will be to call us that day and ask what we want done. We can have the funds wired to us, have them wired to somebody else, or roll them over to a new CD. Who will give us directions as to what is to be done with the funds? Actually there's another possibility too.The interest only can be wired to anyone. So the CD would be rolled over and the interest only would be wired out. Again, who will tell us what is to be done with the interest? Finally, can you explain the roles of Dirk Poeschel Company and the Housing Authority? Whose money is it actually that's in the CDs? What it the relationship among the Poeschel Company,the Housing Authority, and the City? How will we know when the project is done? Thanks,Jon.
