A RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO,
CALIFORNIA, DEDICATING CERTAIN CITY-OWNED PROPERTY
AS AN EASEMENT FOR PUBLIC STREET PURPOSES
WHEREAS, the City of Fresno owns certain property located on the west side of
Blackstone Avenue north of Nees Avenue, as shown on attached Exhibit "Al'; and
WHEREAS, the subject property has been developed as Water Well Site No. 157; and
WHEREAS, a portion of the subject property must be dedicated for public street purposes
in accordance with the requirements of Conditional Use Permit No. 97-32 to accommodate a
portion of the sidewalk that was constructed outside of the existing public street right-of-way.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FRESNO
AS FOLLOWS:
1. That certain City-owned property shown on attached Exhibit "A" and described in
attached Exhibit "B" is hereby dedicated as an easement and right-of-way for public
street purposes.
2. Nothing contained in this resolution shall be deemed or interpreted by any party to
cause any interest created in the public pursuant to this resolution to ripen into any
title, interest or right of the public against or adverse to the rights of the City of
Fresno nor shall this resolution limit, restrict or modify the exemption of public
property to title by prescription as defined within California Civil Code Section 1007.

3. The City Clerk of the City of Fresno shall certify to the passage of this resolution and
shall cause a certified copy thereof attested to by the Clerk under the seal of the City
of Fresno to be recorded in the Office of The Recorder of the County of Fresno,
California.
4. The City Design Engineer shall cause a City deed number to be assigned to the
certified copy of this resolution to be recorded and will cause that certified copy to be
filed in the Public Works deed file after it has been recorded.

That portion of Lot 244 of Perrin Colony No. 2, according to the amended map thereof
recorded in Book 4 of Plats at Page 68, Fresno County Records, said portion being
situated in Section 28, Township 12 South, Range 20 East, Mount Diablo Base and
Meridian, and said portion being more particularly described as follows:
COMMENCING at the south quarter corner of said Section 28; thence S 89042'07 E,
along the south line of the southeast quarter of said Section 28, a distance of 456.67
feet to the southerly prolongation of the west right-of-way line of Blackstone Avenue;
thence N 1 041'16" W, along said southerly prolongation and along said westerly right-
of-way line of Blackstone Avenue, a distance of 370.00 feet to the southwest corner of
that certain parcel deeded to the City of Fresno with the recordation of a Director's
Deed from the State of California recorded July 13, 1993 as Document No. 93104371,
Fresno County Records; thence N 88118'44" E, along the south line of said parcel
deeded to the City of Fresno, a distance of 36.53 feet to the TRUE POINT OF
BEGINNING of this description; thence continuing N 88018'44" E, along the south line
of said parcel deeded to the City of Fresno, a distance of 10.42 feet to the southeast
corner of said parcel deeded to the City of Fresno, said southeast corner lying on the
arc of a non-tangent curve concave to the southeast and having a radius of 860.00
feet, a radial to said southeast corner bears N 75017'50" W; thence northeasterly,
along said non-tangent curve and along the westerly right-of-way line of Blackstone
Avenue, through a central angle of 3019'52", an arc distance of 50.00 feet; thence
S 45°5537" W, a distance of 20.95 feet to a point on the arc of a non-tangent curve
concave to the southeast and having a radius of 870.00 feet, a radial to said point
bears N 73011'09" W; thence southerly, along the arc of last said non-tangent curve,
through a central angle of 2°18'18", an arc distance of 35.00 feet to the TRUE POINT
OF BEGINNING.
