ADOPT the attached Resolutions: a. Approving the Final Map of Tract No. 5211 and accepting the dedicated public uses therein. 2. AUTHORIZE the Public Works Director to execute the: a. Subdivision Agreement. b. Statement of Covenants Affecting Land Development for Landscape Maintenance. c. Quitclaim Deed from the City to D.C. 5029 L.P., a California Limited Partnership. 3. AUTHORIZE the Public Utilities Director to execute the: a. Statement of Covenants Affecting Land Development Providing Special Solid Waste Disposal Services for Certain Lots. 4. AUTHORIZE the Planning and Development Director to execute the: a. Statement of Covenants Affecting Land Development Deferring Certain Sewer Connection Charges, Water Connection Charges, Urban Growth Management Fees and Development Fees to the time of issuance of Certificate of Occupancy and Creation of Lien. b. Statement of Covenants Affecting Land Development for Planting and Maintaining Front Yard Trees. EXECUTIVE SUMMARY The Subdivider, DC 5029 L.P., a California Limited Partnership, has filed for approval, the Final Map of Tract No. 5211. The project, a Final Map of Phase 2 of Vesting Tentative Map No. 5029/UGM, a 44-lot single-family residential subdivision and one outlot for open space landscape, on 8.67 acres, is located on the west side of North Millbrook Avenue and south of East Copper Avenues. The Final Map is technically correct and conforms to the conditionally approved tentative map,the Subdivision Map Act and local ordinances; It is consistent with, and implements the 2025 General Plan and the Woodward Park Community Plan. The provisions of Sections 66457 and 66474.1 of the Subdivision Map Act require that such final map be approved by the City Council. REPORT TO THE CITY COUNCIL Final Map of Tract No. 5211 April 4, 2006 Page 2 KEY OBJECTIVE BALANCE Council action regarding this final map optimizes the three Key Objectives of Customer Satisfaction, Employee Satisfaction, and Financial Management. Affirmative action by the Council will result in timely deliverance of the technical review, processing and filing of the final map as is reasonably expected by the customer. Prudent financial management is demonstrated by the expeditious completion of this final map inasmuch as the customer has paid to the City a fee for the processing of this final map and that fee is, in turn, funding the operations of the Planning and Development Department. Employee satisfaction is derived from the fact that the staff, who have reviewed and made a recommendation on this final map, have done so in a thorough and professional manner, thereby enhancing the sense of accomplishment in the completion of the final map process. PROJECT INFORMATION PROJECT The Final Map of Tract No. 5211 (Phase 2 of Vesting Tentative Map No. 5029/UGM), a 44-lot single-family residential subdivision and one outlot on 8.67 acres. LOCATION The west side of North Millbrook Avenues. (Council District 6, Council Member Duncan) SUBDIVIDER DC 5029 L.P., a California Limited Partnership, Jerry A. De Young, President of Team 5 Properties, Its General Partner LAND USE & ZONING Medium-Low density residential; R-1/EA/UGM (single-family residential/Expressway Area/Urban Growth Management) zoning is existing pursuant to Rezone Application No.01-03. PLAN CONSISTENCY The project is consistent with the Medium-Low density residential land use designation of the Woodward Community Plan. COMPLIANCE WITH The Final Map conforms to all requirements of the Subdivision Map Act and local SUBDIVISION MAP subdivision ordinances applicable to the conditions of approval of Vesting ACT AND LOCAL Tentative Map No. 5029/UGM; the completion of all public improvement ORDINANCES requirements have been guaranteed and applicable fees paid. BACKGROUND Tentative Map Approval: The Fresno City Planning Commission on April 17, 2002 adopted Resolution No. 11704 approving Vesting Tentative Map No. 5029 for a 336-lot single-family residential subdivision, with Three-outlot for future developed at an overall density of 4.3 units per acre. A minor map revision was approved by the Development Department Director on July 2, 2002 in accordance with F.M.C. § 12-1005.2(b)(3) reducing the number of lots by 336 to 334 lots. The revision also realign East Copper Avenue and the abutting lots to conform to the planned width and alignment for this major street. The shift of the said abutting lots on the north boundary lots on the north boundary of the map to the north also required the realignment of several internal local streets pattern except as noted from that as delineated on the originally approved tentative map. This redesign is consistent with the agreed redesign between the developer and the existing neighborhood to the west. The project is consistent with the medium-low density designation of the Woodward Park Community Plan. The approval of Vesting Tentative Map No. 5029 remains effective until Apri 17, 2007. REPORT TO THE CITY COUNCIL Final Map of Tract No. 5211 April 4, 2006 Page 3 Subdivision Agreement, Securities, Fees & Covenants: The Subdivider has executed the Subdivision Agreement and has posted securities in the amount of$275,000 for performance and $137,500 for labor and materials to guarantee the installation of the required public improvements. The Subdivider has paid cash in the amount of$217,370.89 for applicable fees and has entered into a covenant to defer the payment of certain sewer connection charges,water connection charges, Urban Growth Management fees and development fees in the amount of$87,598.56 to the time of issuance of Certificates of Occupancy. The Subdivider has also entered into covenants providing for the Temporary Storm Drainage Facilities, Landscape Maintenance, Special Solid Waste Disposal Services and for Sanitary Sewer Capacity in the Fowler Avenue Trunk Sewer and Deferring Payment of Interim Fee Surety to the time of Issuance of Certificate of Occupancy and Creation of Lien. The subdivision documents,securities and resolutions have been reviewed and approved by the City Attorney's office. Landscape Area Maintenance: A condition of approval of the Tentative Map is the installation and maintenance of the landscaping and irrigation the 15-feet wide landscape easements on all lots that side-onto East Olymipic East Copper and North Millbrook Avenue. The Subdivider has elected to satisfy the maintenance requirement by annexing the subdivision into the City's Community Facility District No. 2 (CFD-2). This condition will be satisfied with the anticipated annexation of this subdivision into CFD-2 which the Council is scheduled to act on April 4, 2006 prior to the Council acting on this final map item. Should the Council not approve the annexation of this subdivision into CFD-2, the Council must delay action of this final map. The Subdivider has executed the covenant for Landscape Maintenance and as a condition of the subdivision Agreement, is required to provide every prospective purchaser of each lot of the subdivision the "Notice of Special Tax", in accordance with the provision of Section 53341.5 of the California Government Code. The estimated annual assessment under CFD-2 is $601.00 per lot with a 3% annual increase. North Millbrook Avenue Vacation:The Tentative Map conditions of approval requires the vacation of a portion of North Millbrook Avenue to facilitate the re-alignment of the intersection of East Copper Avenue and North Friant Road and the re-alignment of North Millbrook Avenue to the east of it's present location. The Public Works Department has determined that all conditions of the vacation feasibility study for that portion of North Millbrook Avenue have been satisfied and that the vacation of the affected street areas can be perfected with the final map. This portion of North Millbrook Avenue was acquired in fee title by the County of Fresno in 1968 and passed on to the City upon annexation of the area in 2004. To facilitate the vacation of this portion of North Millbrook Avenue with the final map, the City must first quitclaim it's fee title interest to DC 5029 LP, the Subdivider of T-5211, before the Council takes action on approval of the final map. In conjunction with the recommended actions, the Council is also being requested to authorize the Public Works Director or his designee to execute the quitclaim deed for that portion of North Millbrook Avenue being vacated and incorporated into the final map of Tract No. 5211. Street Improvements: All interior streets,shall be dedicated in accordance with the 50-foot and 54-foot API-1 and API-2 standards and will be fully improved with standard curb,gutter,street lighting, permanent pavement, and sidewalks on both sides of the streets. RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO, CALIFORNIA, APPROVING THE FINAL MAP OF TRACT NO. 5211 AND ACCEPTING DEDICATED PUBLIC USES THEREIN WHEREAS, DC 5029 L. P., a California Limited Partnership, has offered for approval a Final Map designated as Tract No. 5211, ("map"), pursuant to approved Vesting Tentative Map No. 5029 ("tentative map"); and, WHEREAS,all the certificates which appear on the map(except the approval certificate of the Council of the City of Fresno and the recording certificate of the Recorder of the County of Fresno) have been signed and acknowledged and said map has been filed for approval; and, WHEREAS, the subdivision lies within the boundaries of the City of Fresno; and, WHEREAS, the map conforms to all of the requirements of the Subdivision Map Act of the State of California,and City ordinances, resolutions and standards,except that Section 66492 and 66493 of the Subdivision Map Act may not be fully complied with at the time of passage of this resolution and owner having previously filed with the Clerk of the Board of Supervisors of Fresno County a Tax Compliance Certificate Request along with copies of the map considered herewith by the Council; and, WHEREAS, the Council finds that the proposed subdivision, together with the provisions for its design and improvement, is consistent with all applicable general and specific plans of the City; and, WHEREAS,the Subdivider and the Owners,whose signatures appear on the map,and others have offered for dedication certain streets, public utility easements, access rights and other public properties and uses as shown and delineated upon said map and have provided funds for the acquisition of property not otherwise offered for dedication on such map; and, WHEREAS, the Planning Commission of the City of Fresno, by formal resolution, approved said tentative map. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Fresno as follows: 1. That the map is hereby approved and all of the streets, public utility easements, access rights and other public properties and uses offered for dedication on the map are hereby accepted, Resolution Approving the Final Map of Tract No. 5211 Page 2 subject to complete compliance with Sections 66492 and 66493 of the Subdivision Map Act prior to release of the map for recordation. 2. The Council finds that the map is in substantial compliance with said tentative map, any deviations therefrom being deemed to be approved by the Council.
