ADOPT the attached Resolution approving the Final Map of Tract No. 5180 and accepting the dedicated public uses therein. 2. AUTHORIZE the Planning and Development Director to execute the Condominium Conversion Agreement for Tract No. 5180 EXECUTIVE SUMMARY The Subdivider, Huntington Blvd., LLC, a California Limited Liability Company, has filed for approval,the Final Map of Tract No. 5180. The project, a final map of Vesting Tentative Map No. 5180 for a 1-lot condominium subdivision on 9.55 acres, is located on the northeast comer of East Huntington Boulevard and "R" Street. The project proposes to subdivide the existing 220-unit Villa Santa Fe apartment complex into 220 condominium units on one common lot. The Final Map is technically correct and conforms to the conditionally approved tentative map, the Subdivision Map Act and local ordinances; it is consistent with, and implements the 2025 General Plan and the Central Area Community Plan. The provisions of Sections 66457 and 66474.1 of the Subdivision Map Act require that such final map be approved by the City Council. PROJECT INFORMATION PROJECT The Final Map of Tract No. 5180, a 1-lot condominium subdivision on 9.55 acres. LOCATION The northeast corner of East Huntington Boulevard and "R" Street. Ayyad, Trustee of sole member LAND USE & ZONING "Villa Santa Fen Apartment Complex; R-4 (High Density Multiple Family Residential) PLAN CONSISTENCY The project is consistent with the residential land uses designation of the Central Area Community Plan. REPORT TO THE CITY COUNCIL Final Map of Tract No. 5180 June 22, 2004 Page 2 COMPLIANCE WITH The Final Map conforms to all requirements of the Subdivision Map Act and SUBDIVISION MAP ACT local subdivision ordinances applicable to the conditions of approval of Vesting AND LOCAL Tentative Map No. 5180; the completion of the required work and ORDINANCES improvements have been guaranteed and applicable fees paid. BACKGROUND Tentative Map Approval: The Fresno City Planning Commission on January 7, 2004 adopted Resolution No. 11939 approving Vesting Tentative Map No. 5180(Tentative Map)to subdivide the existing 220-unit"Villa Santa Fe" apartment complex into a 220-unit airspace condominium on 1-common lot. The City Council on February 10, 2004 adopted Resolution No. 2004-48 approving the tentative map. The approval of Vesting Tentative Map No. 5180 remains effective until January 7, 2006. Condominium Conversion Agreement & Securities: The Subdivider has executed the Condominium Conversion Agreement and has posted security in the amount of $136,700 to guarantee the required work and improvements and the notices to tenants to comply with the provisions of Section 66427.1 of the Subdivision Map Act. The subdivision documents, security and resolution have been reviewed and approved by the City Attorney's office. Street Improvements: All streets shall be dedicated to City standards and have been improved with standard curb, gutter, street lighting, permanent pavement, and sidewalks. RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO, CALIFORNIA, APPROVING THE FINAL MAP OF TRACT NO. 5180 AND ACCEPTING DEDICATED PUBLIC USES THEREIN. WHEREAS, Huntington Blvd., LLC, a California Limited Liability Company, has offered for approval a Final Map designated as Tract No. 5180 ("map"), pursuant to approved Vesting Tentative Map No. 5180 ("tentative map") for a condominium project ("project"); and, WHEREAS, all the certificates which appear on the map (except the approval certificate of the Council of the City of Fresno and the recording certificate of the Recorder of the County of Fresno) have been signed and acknowledged and said map has been filed for approval; and, WHEREAS, the subdivision lies within the boundaries of the City of Fresno; and, WHEREAS, the map conforms to all of the requirements of the Subdivision Map Act of the State of California, and City ordinances, resolutions and standards, except that Sections 66492 and 66493 of the Subdivision Map Act may not be fully complied with at the time of passage of this resolution and owner previously filed with the Clerk of the Board of Supervisors of Fresno County, a Tax Compliance Certification Request along with copies of the map considered herewith by the Council;and, WHEREAS, Section 66427.1 of the Subdivision Map Act require that Council find that tenants of the apartments to be converted to condominiums under the map have been properly noticed pursuant to that Section; and, WHEREAS, the owner has complied with all noticing requirements of Section 66427.1 of the Subdivision Map Act except the requirement to notice the tenants of the final approval of the map by the Council; and, WHEREAS, the owner has entered into a Condominium Conversion Agreement for Tract No. 5180 which includes an agreement to comply with the requirement to notice the tenants of Council's final approval of the map; and, WHEREAS, the owner has complied with all necessary noticing and informational Resolution Approving the Final Map of Tract No. 5180 Page 2 requirements of Chapter 12,Article 9 of the Fresno Municipal Code for condominium conversions; and, WHEREAS, the Council finds that the proposed subdivision, together with the provisions for its design and improvement, is consistent with all applicable general and specific plans of the City; and, WHEREAS, the Subdivider and the Owners, whose signatures appear on the map, and others have offered for dedication certain streets, public utility easements, access rights and other public properties and uses as shown and delineated upon said map; and, WHEREAS, the Council of the City of Fresno, by formal resolution, approved said tentative map. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Fresno as follows: 1. The Council finds that all of the requirements under Section 66427.1 of the Subdivision Map Act for noticing tenants for condominium conversion have been met. 2. The Council finds that the owner has substantially complied with the requirements for condominium conversions under Chapter 12, Article 9 of the Fresno Municipal Code. 3. That the map is hereby approved and all of the streets, public utility easements, access rights and other public properties and uses offered for dedication on the map are hereby accepted, subject to complete compliance with Sections 66427.1, 66492 and 66493 of the Subdivision Map Act prior to release of the map for recordation. 4. The Council finds that the map is in substantial compliance with said tentative map,any deviations therefrom being deemed to be approved by the Council.
