City of REPORT.TO THE PLANNING COMMISSION AGENDA ITEM NO. v-s-2 COMMISSION MEETING 6/1/05 June 1, 2005 APPROVED BY F OM: STAFF Planning R . anrnng Division ► D"4906 Planning and Development Department 76ARTMENT DIRECTOR SUBJECT: REQUESTII FOR A TWO YEAR EXTENSION OF TIME FOR THE FILING_ OF A FINAL, MAP FOR VESTING TENTATIVE TRACT NO. 5150/UGM BACKGROUND The proposed subdivision consists of a 28-lot single-family residential planned unit development with gated, private streets on 1j3.4 gross acres of property located on the west side of North Chestnut Avenue, between East Copper and East International Avenues. i On May 7, 2003, the Fresno City Planning Commission approved the subdivision map for an initial two years subject to the conditions noted in the Planning Commission Resolution No. 11849. The Planning Commission approved a revision to the tentative tract mapon February 2, 200.5 which did, not affect the expiration date of the tentative map. The approved map wouldl'', have expired on Saturday, May 7, 2005. Section 66452(e) of the Subdivision Map Act, however, provides that prior to the expiration,of an approved or conditionally-approved tentative map, upon application by'Ithe subdivider to extend that map, the map is automatically extended 60 days or until the application for the extension is approved, conditionally approved, or denied,whichever occurs first. A timely request for a two-year extension of time was filed by the applicant on Monday, May 9, 2005. Pursuant to Section 66452 of the Subdivision Map Act, extensions of time, not to exceed an aggregate of five years, may be approved or conditionally approved by the Commission. The City, under Section 1112-1005 of the Fresno Municipal Code, may review each request for extension for possible modifications to the original conditions of approval. The staff has reviewed the original conditions of approval and the subdivision map and has found no basis for any modifications to those conditions. RECOMMENDATION j Based upon the above information, staff recommends that the Planning Commission: 1. APPROVE the request for a two-year extension of time to May 7, 2007 for the filing of the final map of Vesting Tentative' Tract No. 5150, subject to the original conditions of approval as contained in Planning Commission Resolution No. 11849. WHEREAS,. a Vesting Tentative Map of Tract No. 5150/UGM was filed with the City of Fresno and proposes a 27-lot single family residential subdivision on approximately 13.4 acres of land located on the -west side of North Chestnut Avenue, between East Copper and East International Avenues; and, WHEREAS, the Northeast Area Plan and Implementation.Committee considered this application at its meeting of March 24, 2003, and recommended approval of the project;and, WHEREAS,the Fresno City Planning Commission conducted a public hearing on May 7,2003,to review the proposed subdivision and considered the staff report and invited testimony with respect to the proposed subdivision;and, WHEREAS, the Planning and Development Department staff recommended approval of the proposed. project subject to all conditions of approval contained in the staff report dated May 7, 2003; and, WHEREAS, no person spoke in opposition to the project; and, WHEREAS, the Fresno City Planning Commission hereby finds and determines that there is no substantial evidence in the record to indicate that Vesting Tentative Tract Map No. 5150/UGM may have a significant effect on the environment as identified by the Finding of Conformity to the 2025 Fresno General Plan Master Environmental Impact Report(MEIR No. 10130)dated April 15;2003, prepared for Environmental Assessment No. R-03-09/C-03-029/T-5150. The study indicates that the project, if approved, would conform to the land use designation and land use policies of the 2025 Fresno General Plan and is within the scope of Master Environmental Impact Report No. 10130. Therefore, staff has issued a finding that the project proposal is in conformance to the 2025 Fresno General Plan Master Environmental Impact Report(MEIR No. 10130)dated April 15,2003,which incorporates a MEIR Mitigation . Monitoring Checklist. This environmental finding was properly noticed.with no comments filed within the 20-day review and comment period. BACKGROUND[ANALYSIS The applicant,Lawrence Partners,has filed Rezoning Application No.R-03-09,Conditional Use Permit No C-03-029 and Vesting Tentative Tract Map No. 5150 for 13.4 acres of property located on the west side of North Chestnut Avenue (alignment) between East.lnternational and East Copper Avenues. The rezone application is requesting a zone change from the AL-20 (County) zone district to the R-1-C/UGM (Single Family'Residential%Urban..Growth Management) zone district. Vesting Tentative Tract Map No. 5150/UGM is proposing to subdivide the subject property into 27 single family lots for a density of 2..2 units per acre. On November 19,2002,the City Council,through Resolution No.2002-379,adopted the 2025 Fresno General Plan which updated the Woodward Park Community Plan. The updated Community Plan designates the subject property for medium low density residential land use. The applicant wishes to pursue development of the subject property with 27 single family homes.The requested R-1-C/UGM zone district conforms to this medium low density residential land use designation as indicated by the 2025 Fresno General Plan's "Planned Land Use and Zone District Consistency Matrix". Surrounding land uses are characterized by single family residential development to the southwest,and.vacant land and rural residences to the north, south, east and west. A final tract map(FT-5110) has,been submitted for..the adjacent land to the west of the site. This map proposes to develop 48 single family residential lots. Access to the subject site will be from North Chestnut Avenue, a designated collector street. A_second point. of access.for' emergency vehicles is located at the western boundary of the tract and will connect to Final Tract No. 5110. The traffic generated by this project can be accommodated by the planned circulation system. Sewer and water . infrastructure availability and service demands have been verified by the Department of Public Utilities with required facilities to be located in North Chestnut Avenue. REPORT TO THE PLANNING COMMISSION' - Rezoning Application No. R-03-09 Conditional Use Permit Application No. C-03-029 Vesting Tentative Tract Map No. T-5150/UGM May 7, 2003 Page 3 - Vesting Tentative Tract Map and Conditional Use Permit Applications The applicant has filed.Conditional Use Permit Application No.C-03-029 to allow for a gated subdivision with private streets. The applicant has also filed Vesting Tentative Tract Map No. 5150/UGM to subdivide.the 13.4 acre project site into 27 single family residential lots. Major Street Improvements- The mprovementsThe 2025 Fresno General Plan designates North Chestnut Avenue,between East Copper and East Behymer Avenues, as a collector street which requires a 94-foot right-of-way. The developer will be required to dedicate and construct improvements for Chestnut Avenue. Other improvements include the construction of curb, gutter, sidewalk, and transition paving within the limits of the tract; construction of an underground street lighting system; and relinquish access rights to Copper Avenue for all residential lots adjacent to the street frontage. These street improvements are outlined in more detail in the Vesting Tentative Tract Map Conditions of Approval dated May 7, 2003. Interior Streets and Required Sidewalks The developer will be required to design and construct all street related improvements as shown in Conditional Use Permit Application No. C-03-029 Exhibit "A", dated March 18, 2003. All interior streets in the subdivision will be private and have a total easement width of 37.feet. The installation of sidewalks on both sides of the streets throughout this tentative map is not required since the streets are private. The private street improvement width is 32 feet with an additional two and a half feet on each side for a total.street easement of 37 feet. On-street parking will be allowed on both sides of the private street. Landscaping/Walls Given that the proposed subdivision abuts a collector street;.the developer will be required to install 11 feet of landscaping (8 feet net per Conditional Use Permit Application No. C-03-029 Exhibit "A" dated March 18, 2003) along North Chestnut Avenue. In addition, the applicant will be required to install a solid wall at the rear of the required landscape setback which will mitigate the adverse effect of noise generated by vehicles traveling on North Chestnut Avenue. Lot Dimensions The R-1-C/UGM zone district requires minimum lot sizes of 9,000 square feet for lots in the subdivision. All of the lots in the subdivision exceed the minimum lot size requirement. In addition, all lots exceed the minimum lot width (70 feet) and depth (110 feet) as required by the R-1-C zone district. The subdivision map, based on the required findings for approval and subject to the recommended conditions of approval, and the standards and policies of the 2025 Fresno General Plan and Woodward Park Community Plan, complies with applicable zoning, subdivision, and UGM requirements. Therefore, staff recommends approval. Action by the Planning Commission on the tract map and conditional use.permit application, unless appealed to the City Council, is final. State law further provides that the proposed subdivision map be denied if any one of the Finding Nos. 2 - 5 below is made in the negative. In addition, State law requires that a subdivision be found to provide for future passive and natural heating or cooling opportunities in the subdivision development (Finding No. 6 below). 1:• The proposed subdivision map, together with its design and improvements is consistent with the City's 2025 General Plan and any applicable specific plan, because the Woodward Park Community Plan designates the site for Medium Low Density Residential land uses and subject to Section 12-403-B of the Fresno Municipal Code, the project design meets the density and zoning ordinance criteria for development in this plan designation. 2. The proposed subdivision design and improvements are not likely to cause serious public health and..safety problems, because the conditions of approval have shown and will insure that the subdivision conforms with City health and safety standards. 5. The proposed subdivision design will not conflict with public easements within or through the.site, because conditions of approval will assure noninterference with any existing or proposed public easements. 6. The design of the subdivision provides,to the extent feasible,for future passive and natural heating or cooling opportunities in the subdivision,because of the appropriate use and placement of landscaping plant materials and because of the orientation of the proposed lots. Based upon the plans and information submitted by the applicant and the recommended conditions of 'project approval, staff has determined.that these findings can be made. FINDINGS PER FRESNO MUNICIPAL CODE SECTION 12-405-A-2. a. All applicable provisions of this Code are complied with and the site of the proposed use is adequate in size and shape to accommodate said use,and accommodate all yards,spaces,walls and fences,parking, loading, recycling areas, landscaping, and other required features;and, The subject site is approximately 13.4 acres in size and has an adequate amount of space, if developed in accordance with the project's site plan,to meet all applicable requirements of the Code and as established. in the Special Permit Conditions of Approval dated April 30, 2003, including yards, spaces, walls and fences, parking, landscaping and other required features. b.. The site for the proposed use relates to streets and highways adequate in width and pavement type to carry the quantity and kind of traffic generated by the proposed use;and, Staff from the Transportation Planning section of the Public Works Department has estimated that the proposed development will generate approximately 258 daily vehicle trips which will not impact Chestnut Avenue,a collector street which is adequate to serve the proposed development. All traffic Will enter and exit the site from North Chestnut Avenue; a second point of access is required for emergency only. C. The proposed use will not be detrimental to the public welfare or injurious to property or improvements in the area in which the property is located. The third finding shall not apply to uses which are subject to the provision of Section 12-306-N-30 of this Code. The staff of the Planning and Development Department has determined that the proposed use will not be detrimental to the public welfare or be injurious to property or improvements in the area in which the property is located if developed in accordance with the various conditions/requirements established through the rezoning and conditional use permit application review process. CONDITIONS OF.APPROVAL 1. The following specific conditions are applicable to this subdivision map. When the grading plan establishes a top of slope beyond the required landscape easement noted and the construction of the required wall is to be established coincident with the top of slope then the required minimum easement width shall be expanded to include the full.landscaped area up to the wall location. 9. Maintenance of the required 11-foot combined landscape and pedestrian easement located along North Chestnut Avenue may be the responsibility of the City Landscaping and Lighting Maintenance -District. Contact Public Works Department, Engineering Services Division staff for information regarding the City's District. The property owners shall petition the City for annexation to the City's district prior to final map approval. 10. If there are suspected human remains, the Fresno County Coroner shall be immediately contacted. PARK SERVICE 24. The applicant shall install landscaping, required trees, etcetera, in compliance with the Parks Division memorandum dated April 10, 2003. Urban Growth Management Requirements 25. The subdivider shall be required to pay the appropriate UGM Park Capital Fee at the time of final map approval. Fee payment may be deferred until time of building permit issuance in accordance with the requirements of Section 12-4.509-C-3, Fresno Municipal Code. FIRE SERVICE 26. Fire service will be provided by Fire Station No. 21. Provide residential hydrants per Public Works Standards. Comply with Fire Department memoranda dated March 19, 2003. 27. There shall be two points of access to the subdivision, including during construction`. Urban Growth Management Requirements J 28. The subdivider shall pay the appropriate Fire Station Capital Fee at the time of final map approval. If appropriate,fee payment may be deferred until the time of building permit issuance in accordance with the requirements of Section 12-4.508-D-3, Fresno Municipal Code STREETS AND RIGHTS-OF-WAY 29. The subdivider shall make provisions. for the physically handicapped in accordance with the Department of Public Works standards and as.required by State law. 30. All existing and proposed utility systems shall be installed underground in accordance with Section 12-1011(h) of the Fresno Municipal Code. All dead-end streets created by this subdivision shall be properly barricaded in accordance with City standards within seven (7)days from the time the streets are surfaced or directed by the Engineer. All of the required street improvements,including.proposed private streets,shall be constructed and/or installed in accordance with City of Fresno standard specifications, unless modified by the Director of the Public Works Department. 34. No raised concrete will be allowed within street right-of-way. 35. The developer shall comply with Rule 8060 of,the San Joaquin Valley Air Quality Pollution Control District for the control of fugitive dust requirements from paved and unpaved roads. 36. Wherever street furniture is proposed or existing within the proposed sidewalks a minimum of 4 feet unobstructed sidewalk path should be maintained to comply with ADA requirements. If necessary dedicate a pedestrian easement to accommodate for the 4 feet minimum unobstructed path requirement. 37. North ChestnutAvenue(94 ft. Collector Standards)—Dedicate right of way for public street purposes to a 94-foot wide collector street standard as required by Public Works Transportation Planning Section in a letter dated May 1,2003 and as shown on Conditional Use Permit Application No.C-03-029 Exhibit "A" dated March 18, 2003. 38. Construct concrete curb and gutter, sidewalk, and 20 feet of permanent paving and transition as necessary within the limits of the tract. The sidewalk shall be constructed to a I0-foot residential pattern. 39. Construct an underground street lighting system per E-1 of Public Works standards within the limits of this tract. Spacing and design shall conform to Public Works standards for collector streets 40. Relinquish direct access to North.Chestnut Avenue from lots 1, 2, 19,-20 and 27 of this tract 41. Handicap access ramps are required at all corners within the limits of this tract: Interior Streets 42. The design of the fire access abutting:Tentative Tract Map No. 4903 shall encompass 5-foot curb radiuses and shall be constructed in accordance with Public Works Standard'P-67 within the'limits of the tract. Urban Growth Management Requirements In accordance with the City's Urban Growth Management Policy relative to major street extensions and'other street improvements necessary to provide adequate emergency and service vehicle access; the following improvements are required. 43. This project falls within the.UGM Major Street Zone F; therefore pay UGM Major Street fees. 44. The City of Fresno is proposing a restructure of the Urban Growth Management process for all UGM areas in the city with the update of the 2025 Fresno General Plan: This process may entail a new fee structure to build-out all components of major streets in UGM areas. Should this process be approved with the new general plan or any other process, this development shall be entitled to reimbursement, for any costs.of construction above the designated fee that may be established with this.new process. Conditions of Approval Vesting Tentative Tract Map No. 5150/UGM Page 6 May 7, 2003 North Chestnut Avenue 45. Construct the two 17-foot center section travel lanes from the northerly limits of this tract to the south, to the intersection of East international Avenue. 46. Dedicate a minimum of 44-foot wide easement for public street purposes(centered along the east line of the northwest quarter of Section 13, 12-20) from the southerly limits of this subdivision to. the intersection with East International Avenue. 47. Dedicate an additional 22-foot wide easement for public street purposes immediately east of the easterly limits of this subdivision. SEWER SERVICE No public sanitary sewer facilities exist in the project.vicinity adjacent.to the tract at this time. Public sewer main extensions within East International Avenue,North Cedar Avenue,North Maple Avenue and East Copper Avenue have been required with other projects, but cannot be precisely determined until the sewer system planning issues noted below are resolved. Master planning for sewage collection and treatment facilities in the project vicinity has not been completed at this time. Prior to submittal of the final map package with improvement plans,subdivider shall participate with otherdevelopers in the project vicinity under City oversight to develop a comprehensive plan for sewer facilities including sanitary sewer pipelines, sewer:lift stations and wastewater treatment facilities. . The master plan may also address potential beneficial re-use of treated effluent. This tract is subject to the findings procedure for sewer service associated with the Woodward Park Community Plan EIR. The following conditions are required to provide sanitary sewer service to.the tract. 48. The developer shall participate in construction of a sewer lift-station and force-main facilities as approved by the City of Fresno. 49. An 8-inch sewer main extension shall be installed within North Chestnut Avenue from the northeast corner of the subdivision to East,tnternational Avenue then west in East International Avenue to the existing 8-inch sewer main. 50. Provide a separate house branch to each lot�created. 51. ' All public sanitary sewer facilities shall be constructed in accordance with Public Works standards, specifications, and policies. . 52. The developer's engineer shall provide a preliminary sewer layout for City review prior to submitting plan and profile drawings for plan check. Urban Growth Management Requirements It has been determined that the 42-inch segment of the .Herndon Trunk Sewer between. Fresno Street and Howard Avenue will be impacted as a result of this project; therefore, the developer shall construct the .following improvements prior to issuance of occupancy permits unless otherwise stated: 53. The developer shall be required to enhance(by pipelining)the 42-inch segment of the Herndon Trunk Sewer between North Fresno Street and North Howard Avenue as a result of this project. The developer shall replace or enhance the existing 21-inch section of the sewer main to the capacity of the 42-inch sewer main immediately upstream. Match the upstream of the 42-inch sewer main located in North Cedar between East Herndon and East Fir Avenues. 55. Construct Master Plan Sewer Lift Station on East Copper Avenue,between Cedar and Maple Avenues, and force-main facilities as approved or directed by the City of Fresno. 56: Construct a 10-inch sewer main in East.Copper from an existing point of connection at the eastern boundary of Tentative Tract No. 4903 to North Chestnut Avenue. 57. Construct an 8-inch sewer main in North Chestnut from the southern-most boundary of the tract to East Copper Avenue. As an alternative to the above: 58. The City is willing to accept payment of the established sewer enhancement connection fee at the'time of development.. The City of Fresno would then assume responsibility to make the enhancements to mitigate this project's impacts on the sewer system. WATER SERVICE No public water facilities exist in the project vicinity adjacent to the tract at this.time: The nearest water facilities are a 14-inch Transmission Grid Main(TGM)located in East.International.Avenue'and a 24-inch TGM in North Chestnut Avenue at East International Avenue. The tract is zu.bj.ect to environmental findings for water service in accordance with adopted Woodward Park Community Plan requirements. The Public Utilities Department has determined that there is an adequate source of water to meet the demands of the proposed project; therefore, water mains can be extended to serve this tract with the following conditions. 59. A 16-inch Transmission Grid Main shall be extended, northerly from the intersection of East International and North Chestnut Avenues along the tract frontage 60. The tract, or any phase of the tract, is required.to have a minimum of two points of connection to the public water system approved:by the Water Systems Manager.. 61.
