HomeMy WebLinkAboutPM 2018-03 - Conditions of Approval - 4/27/2018 CITY OF FRESNO DEVELOPMENT & RESOURCE MANAGEMENT DEPARTMENT CONDITIONS OF APPROVAL APRIL 27, 2018 TENTATIVE PARCEL MAP No. 2018-03 "FOR CONDOMINIUM PURPOSES" LOCATED ON THE SOUTH SIDE OF WEST FIGARDEN DRIVE;WEST OF NORTH BRAWLEY AVENUE NOTICE TO PROJECT APPLICANT All tentative maps are subject to the applicable provisions of the State Subdivision Map Act(SMA), Fresno Municipal Code (FMC), City policies, and City of Fresno Standard Specifications. The following specific conditions are applicable to this tentative map. In accordance with the provisions of Government Code §66020(d)(1), the imposition of fees, dedications, reservations or exactions for this project are subject to protest by the project applicant at the time of approval or conditional approval of the development or within 90 days after the date of the imposition of the fees, dedications, reservations or exactions imposed on a development project. Upon conditional approval of Tentative Parcel Map No. 2018-03, dated March 14, 2018, the subdivider may prepare a Parcel Map(Final)in accordance with the approved tentative parcel map. Note that a Parcel Map may not be filed until the appeal period has expired. Should an appeal be filed pursuant to Section 15-3314 of the FMC, the application will be scheduled to be heard before the City of Fresno Planning Commission. The appellant may withdraw their appeal pursuant to Section 15-5017 of the FMC. Concurrent with the filing of a Parcel Map and when the provisions of Section §66436 of the SMA apply, the subdivider is responsible to send, by certified mail, a sketch of the proposed Parcel Map, together with a copy of Section§66436(a)(3)(A)of the SMA,to any public entity or public utility which has previously acquired a right-of-way easement. ZONING 1. Comply with the provisions of the State of California Government Code Sections §66410 - §66499.58 of the SMA and Articles 31 (Land Division)and 35 (Parcel Maps)of Chapter 15 of the FMC. 2. Upon approval of Tentative Parcel Map No. 2018-03, the proposed subdivision for condominium purposes may be eligible for a waiver of the requirement for a Parcel Map Pursuant to Section 15-3503 of the Fresno Municipal Code. Contact Jon Bartel with the Public Works Department at (559) 621-8684; or, via email at Jon.Bartel(a)-fresno.gov for a determination of eligibility. a) A subdivider may request the waiver of the requirement for a Parcel Map, and the waiver Conditions of Approval Tentative Parcel Map No. 2018-03 April 27, 2018 Page 2 may be granted, in compliance with the Map Act (Section 66428), provided that the Director shall first find that the proposed subdivision complies with all applicable requirements of this Development Code and the Map Act as to area, improvement and design, floodwater drainage control, appropriate improved public roads,sanitary disposal facilities, water supply availability, environmental protection, and all other applicable requirements of this Development Code and the Map Act. i) Where public improvement requirements or fee payment obligations have been made (included within the conditions of approval contained herein), such requirements or obligations must be deemed to have been satisfied prior to acceptance of an application for a Parcel Map Waiver. • NOTE: Where public improvement requirements or fee obligations have been included herein, a certificate of completion or satisfaction of requirements shall be obtained from the respective department or agency responsible for the applicable public improvement requirement orfee obligation prior to submittal of an application for a Parcel Map Waiver. Such certificate shall be submitted to the Public Works Department, Traffic and Engineering Services Division, Land Section with an application for waiver of a Parcel Map. 3. Whenever a subdivision, includes area under common ownership(such as is the case within a common interest development for condominium purposes), the use, maintenance, and operation thereof shall be administered and governed by an association regulated by covenants, conditions, and restrictions (CC&R's) pursuant to Chapter 15-Article 40 of the Fresno Municipal Code and in accordance with the provisions and requirements related to Common Interest Developments pursuant to the Davis-Stirling Common Interest Development Act (§§1350-1376 of the California Civil Code). a) Declarations of Covenants, Conditions and Restrictions/Owners'Association documents (DCC&R's)which may be prepared for a Condominium Project on the subject property shall incorporate provisions in accordance with Chapter 15-Article 40 of the Fresno Municipal Code. i) Prior to the submittal of documents to obtain a public report for a Condominium Project and/or prior to the recordation of a Parcel Map and Condominium Plan as defined in Section 1351(e) of the California Civil Code, whichever is earlier, the subdivider shall submit to the City for review the Condo Plan, DCC&R's and association instruments, which shall be prepared compliant with any respective conditions or requirements identified by special permits/entitlements applicable to the subject property and/or the tentative parcel map and associated conditions of approval included herein. • NOTE: Failure to comply with the terms of required Covenants may result in the revocation of a Certificate of Occupancy or Special Permit by the City for use of any Parcel of the properties involved. Accordingly, the City of Fresno shall have the right to enforce this Statement by any legal or equitable means. GENERAL CONDITIONS 4. Contact Israel Trejo, Planner, in the City of Fresno Development and Resource Management Department at (559) 621-8044 or via email at Israel.Trelo(d--)fresno.gov for assignment of addresses to parcels and/or airspaces proposed to be created from a subdivision/condominium plan of/on the subject property. • NOTE: It is recommended that at least 6 months prior to the first occupancy,the Developer shall contact the local United States Postal Service representative to complete a Mode of Delivery Agreement for New Construction. The Mode of Delivery Agreement must have a District approval signature to be valid. In addition to completing the Agreement, the Developer shall provide a final map (with address details)to the local USPS representative. The Developer shall, at their own expense, procure, construct and install all mail receptacle facilities for each location as specified and approved by the USPS. 5. Any existing and/or proposed structure(s) on the site which may be utilized in conjunction with a condominium project are required to maintain compliance with any applicable standards of the California Building Code as it relates to wall protection, allowable area,etc. a) Compliance with the prevailing California Building Code must be demonstrated, respective to the location of new condominium boundaries which may be proposed to be described on a condominium plan, prior to recordation of a Condominium Plan. Contact the Development and Resource Management Department, Building and Safety Services Division at (559) 621-8200. • NOTE: In the event the structures do not comply with any applicable standards of the California Building Code, they must be modified so as to meet the standard. b) This project was reviewed by the fire department only for requirements related to water supply, fire hydrants, and fire apparatus access to the building(s) on site. Review for compliance with fire and life safety requirements for the building interior and its intended use are reviewed by both the Fire Department and the Building and Safety Section of DARM when a submittal for building plan review is made as required by the California Building Code by the architect or engineer of record for the building. 6. When required, all work and engineered plans for public improvements shall conform to the 2002 Edition of the City of Fresno Standard Specifications and Drawings (City Council Resolution No. 70-36 and Resolution Nos. 84-361) and any amendments thereto, hereinafter referred to as the Public Works Standards. a) Engineered construction plans and estimates for all or part of the required work shall be required prior to the issuance of Street Work Permits unless otherwise determined by Conditions of Approval Tentative Parcel Map No. 2018-03 April 27, 2018 Page 4 the City Engineer. The cost for such plan preparation, review and construction inspection shall be at the subdivider's expense. 7. The subdivider shall dedicate and construct public easements to facilitate the construction of public improvements (when applicable) within the limits of the parcel map. a) All such public easements shall be identified and dedicated with the processing and recordation of a Parcel Map. 8. Any existing utilities, including but not limited to, street lights, traffic signals, fire hydrants, poles (power, telephone, cable, etc.), which must be relocated or removed in conjunction with the construction of off-site improvement requirements, shall be the responsibility and at the expense of the subdivider. 9. The subdivider may either construct or install required public improvements,when required; or, enter into a bonded secured agreement with the City of Fresno providing for the construction of the required improvements and sufficient security prior to the recordation of a Parcel Map (final). 10. Whenever covenants or agreements are required, they shall be prepared by the city upon receipt of the fee in accordance with the adopted Master Fee Schedule. All covenants and agreements must be approved by the City Attorney's Office and shall be recorded with the final parcel map. SPECIFIC CONDITIONS STREETS AND RIGHTS-OF-WAY 11. The subdivider shall comply with all requirements and conditions included within the attached Department of Public Works, Traffic and Engineering Services Division memorandum dated April 16, 2018. PUBLIC UTILITIES Sanitary Sewer Service 12. The subdivider shall complywith all requirements included within the attached Department of Public Utilities, Planning and Engineering (Sanitary Sewer) memorandum dated April 19, 2018. Water Service 13. The subdivider shall complywith all requirements included within the attached Department of Public Utilities, Water Division memorandum dated April 12, 2018. The subdivider shall complywith all requirements included within the attached Department of Public Utilities, Planning and Engineering (Solid Waste Management)memorandum dated April 19, 2018. FRESNO METROPOLITAN FLOOD CONTROL 15. The subdivider shall comply with all requirements included within the attached Fresno Metropolitan Flood Control District memorandum dated April 17, 2018. FRESNO IRRIGATION DISTRICT 16. The subdivider shall comply with all requirements included within the attached Fresno Irrigation District memorandum dated April 13, 2018. DEVELOPMENT FEES AND CHARGES Pursuant to Government Code§66020(d)(1)each local agency shall provide to the project applicant a notice in writing at the time of the approval of a project or at the time of the imposition of the fees, dedications, reservations, or other exactions a statement, and notification that the 90-day approval period in which the applicant may protest has begun (please see Notice to Project Applicant contained herein above for further information). The effective date of this ordinance is September 20, 2008. Contact the County of Fresno, Public Works and Planning Department to determine payment of this fee obligation. Confirmation by the County of Fresno is required before the City of Fresno can issue building permits. The Board of Directors of the Fresno County Regional Transportation Mitigation Fee Agency approved Resolution No.2009—01 requiring the payment of Regional Transportation Mitigation Fee. The effective date of this resolution is January 1, 2010. Contact the Council of Fresno County Governments (FCOG) to determine this fee obligation. Confirmation by the FCOG is required before the City of Fresno can issue building permits. This can result in additional conditions of approval. 1. Identify existing sidewalk. Planning: 1. The parcel shown may include a portion of the adjacent parking lot. Without dimensions it is hard to tell if the vehicle overhang from the existing parking stalls is on this parcel. Is this covered in a cross access agreement? PUBLIC IMPROVEMENT REQUIREMENTS The Public Works Department, Traffic and Engineering Services Division, has completed its review and the following requirements are to be placed on this tentative map as a condition of approval by the Public Works Department. The following requirements are based on city records and the accuracy of the existing and proposed on-site and off-site conditions depicted on the tentative map. Requirements not addressed due to omission or misrepresentation of information, on which this review process is dependent, will be imposed whenever such conditions are disclosed. If the total domestic, commercial, industrial and irrigation water demands for the applicant's proposed project can be accommodated with the existing four 2-inch domestic meters and one 2-inch domestic meter, then the applicant shall not be required to pay a Water Capacity Fee Charge. b. If a larger water meter or fire service is required to accommodate the new, larger water demands, then the Water Capacity Fee Charge shall be calculated by subtracting the Water Capacity Fee Charge associated with the existing water meter size from the Water Capacity Fee Charge associated with the larger water meter size required for the applicant's project. The Water Capacity Fee Charges for different meter sizes are published in the City's Master Fee Schedule. d. The City reserves the right to require an applicant to increase or decrease the size of a water meter for a project or a property to ensure that the meter is properly sized to accommodate fire protection requirements, and to allow for accurate volumetric flow measurements at low- and high-flow conditions. e. The Water Capacity Fee Charge for any new or expanded service connection shall be payable prior to the issuance of a building permit at the fee level in effect on the date such permit is issued. 2. VII COMMUNITY agrees within thirty (30) days after the completion of the work described above and acceptance of such work by DISTRICT, to finalize payment to all contractors, vendors and others under contract to COMMUNITY for the entire cost of laying, constructing, and installing said pipeline, inlets, outlets, and other structures including the cost of all labor, materials, equipment, installation, trenching, backfilling,leveling and testing. In the event COMMUNITY neglects, fails, or refuses to pay the entire cost thereof, and complete said work in accordance herewith, DISTRICT may, but shall not be required to pay such cost and complete such work,and COMMUNITY does hereby agree to repay to DISTRICT any amounts so expended with interest thereon at the rate'of ten percent (10%) per annum. VIII COMMUNITY agrees to keep and maintain said pipeline, inlets,outlets and other structures appurtenant thereto,in good operating condition and repair for a period of one (1) year after the completion of (the first water season following the) construction and the acceptance of the pipeline project thereof by DISTRICT, and to pay all costs of such repairs and maintenance and of any replacement of any part thereof required to maintain said pipeline and structures in good operating condition. COMMUNITY agrees that said acceptance must be evidenced by a written and dated letter from DISTRICT. In the event COMMUNITY fails, neglects, or refuses to repair, maintain or replace any part of said pipelines or structures during said period of one (1) year, DISTRICT shall have the right, but shall not be required, to make any such repairs or replacements and COMMUNITY does hereby agree to repay to DISTRICT the cost of any such repairs or replacement with interest at the rate of ten percent (10%) per annum. DISTRICT shall have the right to request from COMMUNITY, COMMUNITY'S contractor cost of laying, constructing, and installing said pipeline, inlets, outlets, and other structures. If said contractor's cost is greater than COMMUNITY'S surety bond, DISTRICT shall have the right to request an additional bond from COMMUNITY, at COMMUNITY'S expense,to guarantee performance by COMMUNITY 'S contractor. Said bond may be reduced to SEVEN THOUSAND SIX HUNDRED AND 00/100 DOLLARS ($7,600.00) after the completion and acceptance of said work of construction, and all other conditions, terms, undertakings of this Agreement. This reduced amount shall be for guaranteeing the maintenance and repair of said pipeline and appurtenant structures for a period of one year from the date of said acceptance. The expense of bonds shall be borne by COMMUNITY. All such bonds shall be executed by COMMUNITY and a corporate bonding company licensed to transact such business in the State of California and acceptable to DISTRICT. Evidence of authority of an attorney-in-fact acting for the corporate surety must be provided in the form of a certificate as to his power of attorney and to effect on the date of the bonds. The form of the bonds or any E alternative security offered by COMMUNITY shall be subject to the,approval of the DISTRICT. XI i F I COMMUNITY agrees to indemnify and save DISTRICT free and harmless of and from any liability, loss, cost, damage, attorneys' fees or expense arising out of any claim of personal injury or property damage suffered by any person, or the death of any person, which arises as the result of any negligence on the part of COMMUNITY incurred in the performance of this Agreement, commencing upon the execution of this Agreement and continuing without interruption for a period of one year after acceptance of said pipeline by DISTRICT. E XII COMMUNITY agrees, at its own expense, to procure a Policy of Title Insurance issued to DISTRICT with liability limited to FIFTY THOUSAND EIGHT HUNDRED AND 00/100 DOLLARS ($50,800.00) showing title to the easement and right-of--way herein granted to DISTRICT to be free and clear of encumbrances, which would in any way interfere with t t FID No: 96-DI28-J862101 I 5 DISTRICT'S use of said easement and right-of-way. COMMUNITY shall furnish DISTRICT with said Policy after the completion and acceptance of said work. XIII COMMUNITY agrees to pay to DISTRICT, payment to accompany this Agreement, the sum of Seven Hundred and Fifty and 00/100 dollars ($750.00) to cover the cost of inspection during the period of construction of said pipeline project. COMMUNITY further agrees to pay those costs for inspection that exceed the amount of Seven Hundred and Fifty and 00/100 dollars ($750.00)to DISTRICT as determined by DISTRICT. COMMUNITY agrees and acknowledges that this fee is non-refundable and non-transferrable. XIV Upon full performance of this Agreement by COMMUNITY and the acceptance of said pipeline and structures by DISTRICT, DISTRICT agrees to quitclaim that portion of its present "H" Ditch No.128 right-of-way which will be replaced by said pipeline easement and right-of-way. This Agreement shall apply to and be binding upon the heirs, executors, administrators, successors, and assigns of the respective Parties hereto.
