STATEMENT OF COVENANTS AFFECTING LAND DEVELOPMENT
TO PLANT AND MAINTAIN FRONT YARD TREES FOR TRACT NO. 4960
(Phase II of Vesting Tentative Map of Tract No. 4866)
RECITALS
A. WHEREAS, TREND HOMES, INC., California Corporation, hereinafter
referred to as "the Covenantor," is the owner of that certain real property in the City of
Fresno, County of Fresno, State of California, hereinafter referred to as "the Subject
Property" and more particularly described as:
Lots 1 through 79 inclusive of Tract No. 4960 according to the map thereof
recorded in Volume of Pages and
Fresno County Records, Fresno County.
B. The Covenantor hereby warrants that any and all parties having record title
interest in the Subject Property which may ripen into a fee have subordinated to this
instrument.
C. All such instruments of Subordination, if any, are attached hereto and made
a part of this instrument.
D. The Covenantor has applied to the City of Fresno for a final subdivision
map which would subdivide the subject property into a 79-lot single-family residential
subdivision project.

E. The City of Fresno desires to obtain covenants from the Covenantor to
insure that the Subject Property is not developed, used, or maintained in such a way as
to adversely affect adjoining properties.
COVENANTS. CONDITIONS, AND RESTRICTIONS
For favorable action on, and approval of, the Covenantor's application for approval of
Final Tract Map No. 4960, which is to be improved with public streets having a right-of-
way width of 50-feet, for the Subject Property as referred to hereinabove, the
Covenantor hereby covenants that the Subject Property shall be held, conveyed,
encumbered, used, occupied, developed, maintained, and improved subject to the
following covenants, conditions, and restrictions, which are for the purpose of
enhancing attractiveness, usefulness, value, and desirability of the Subject Property,
the surrounding property, and the public at large and to minimize possible adverse
effects on the public health, safety, peace, and general welfare. Each of the
covenants, conditions, and restrictions contained in this Statement will run with the
Subject Property and shall be binding on each successive owner of the Subject
Property and his heirs, administrators, successors, and assigns.
1. Covenantor hereby covenants as follows:
A. The Covenantor shall plant the front yard area of each lot with a
minimum of 2 medium size trees with the provision that each
medium size tree may be substituted with two (2) small trees.
B. The Covenantor shall maintain in good health the a minimum of 2
medium size trees or small trees which ever may be the case.
C. The single-family residential subdivision shall be developed in
substantial conformance with Vesting Tentative Tract No. 4866
dated , November 16, 1999.
2. The conditions of this Statement are intended to benefit the public and public
properties. Accordingly, the City of Fresno shall have the right to enforce this

Statement by any legal or equitable means against the Covenantor and such person or
persons in actual possession of Subject Property who directly or who through any
agent violate the terms hereof. All obligations of the Covenantor under this Statement
shall inure solely to the benefit of the City of Fresno. There are no third party
beneficiaries of such obligations nor shall the right of the City of Fresno be transferable
in any manner to any person other than to a successor municipal corporation whose
geographic boundaries include the Subject Property.
3. The foregoing conditions shall remain in full force and effect until such time
as the City of Fresno, pursuant to the district amendment procedure of the Fresno
Municipal Code, finds the enforcement of such condition is no longer equitable.
4. The provisions of this Statement shall be deemed independent and severable
and the invalidity or partial invalidity or unenforceability of any one provision or portion
thereof shall not affect the validity or enforceability of any other provision
hereof. Whenever the context so requires, any gender includes the other genders, the
singular includes the plural, and the plural includes the singular.

WHEREAS, TREND HOMES, INC., a California Corporation, hereinafter referred
to as "the Covenantor," is the owner of the real property situated in the City of Fresno,
County of Fresno, State of California, hereinafter referred to as"the Subject Property" and
more particularly described as;
Lots 1 through 79, inclusive of Tract No. 4960 according to the map thereof
recorded in Volume of Plats at Pages and A .�—,

WHEREAS, the Covenantor hereby warrants that any and all parties having record
title interest in the Subject Property which may ripen into a fee have subordinated to this

WHEREAS, Resolution No. 11191 of the Fresno City Planning Commission
conditionally approved Vesting Tentative Map of Tract No. 4866; and,
WHEREAS, Covenantor is required by the City as a condition of vesting tentative
map approval to install landscaping and an irrigation system for Lots 1, 15 and 57
inclusive, in a 10-foot landscape easement along the side and rear property lines of said
lots which side-onto and back-onto the West Escalon Avenue and install landscaping and
an irrigation system for Lots 15, 16, 19 through 22 inclusive, in a 10-foot landscape
easement along the side and rear property lines of said lots which side-onto and back-onto
the North Cecelia Avenue and install landscaping and an irrigation system for Lot 79
inclusive, in a 10-foot landscape easement along the side property line of said lot which
side-onto the North Jeanne Avenue frontages of the said Subject Property; and
WHEREASS�,.3aid:corsditions ,_-. prMt require that maintenance of the required
landscape easements of said lots of the vesting tentative map shall be the responsibility
of the homeowners association or the City's Community Facilities District No. 2 for the
maintenance of the landscaping as directed or required by Director of the Public Works
Department; and
NOW THEREFORE, it is agreed:
1. In consideration of the foregoing and the approval of the final map of Tract
No. 4960 by the City of Fresno, the Covenantor hereby covenants, promises and agrees

with the City of Fresno for the benefit of said City that:
1.1 Said landscaping and irrigation system will be designed and installed
according to a plan acceptable to the Director of the Parks, Recreation and
Community Services Department, and the Covenantor will request the City to annex
said Tract No.4960 to the City's Community Facilities District No. 2 as approved by
the City Council on January 9, 2001; and
2. The Covenantor shall fully disclose this condition to every potential
purchaser of any part of said lots of the Subject Property.
3. The annual assessment represents the fair share of the cost for maintenance
of the landscape easements maintained by the City within Vesting Tentative Map of Tract
No. 48661UGM. The first annual assessment is estimated at $ 81 .00 per lot. The first
annual assessment is only an estimate for the first year and the assessment may increase
or decrease or decrease in future years.
4. It is the intention hereof that this document shall constitute a covenant in
favor of the City of Fresno and shall run with the land and be binding upon the
undersigned, its grantees, heirs, and successors and assigns.
5. This covenant shall be deemed released and of no further effect upon a
written determination by the Director of the Public Works Department of the City of Fresno.
6. The provisions of this Statement shall be deemed independent and severable
and the invalidity or partial invalidity or unenforceability of any one provision or portion
thereof shall not affect the validity or enforceability of any one provision thereof.Whenever

A. WHEREAS, TREND HOMES, Inc., a California corporation, hereinafter referred
to as the "Covenantor," is the owner of that certain real property in the City of Fresno,
County of Fresno, State of California, hereafter referred to as the "Subject Property" and
more particularly described as follows and by this reference made part of this Statement
of Covenants:

NOW, THEREFORE, the Covenantor hereby covenants as follows:
COVENANTS. CONDITIONS. AND RESTRICTIONS
1. For the express purpose of administering the fee deferral process, the Fee
obligations for the Project may be prorated by the City to each lot, parcel, unit or building
on the Subject Property in-the manner established by the Development Director. The
intent of this provision is to prorate the Fee obligations of common use areas, outlots,
public street easements and similar miscellaneous areas of the Project in a reasonable
manner to each lot, parcel, unit or building of the Project to facilitate reasonable
administration of the fee deferral process.
2. At the sole discretion of the Development Director, when the proration of a Fee
obligation is not feasible to be administered on a lot, parcel, unit or building basis, the
Covenantor may be required to pay the total Fee obligation for such fee for the Project
with the first request for issuance of a certificate of occupancy for the Project.
3. The Covenantor may elect to pay any of the deferred Fees prorated to each lot,
parcel, unit or building as identified on the attached Exhibit "B", at any time after the
recordation of this instrument. The Fee obligations stated in said Exhibit "B" shall be
maintained by the Development Director and shall be adjusted to reflect the Fee rates in
effect at the time payment is made, and may be adjusted to account for any subsequently
approved reconfiguration to the size or number of lots, parcels, units or buildings. When
Covenantor elects to pay one or more of the deferred Fees in advance of the request for

year after final inspection of a building. This time period approximates with the Uniform
Building Code and Fresno Municipal Code period which provides for an active permit
life of 180 days, after last inspection, with provisions for one (1) extension of said
permit, not to exceed a period of 180 days.
8. Covenantor hereby waives any claim that the provisions of this covenant violate
Government Code Section 65961.
9. Each of the covenants, conditions, and restrictions contained in this Statement
shall run with the Subject Property and shall be binding upon each successive owner of
the Subject Property, heirs, representatives, successors and assignees. The Covenantor
hereby creates a lien upon the Subject Property to guarantee the performance of the
obligations of the Covenantor contained in this Statement.
10. The conditions of this Statement are intended to benefit the public and public
properties. Accordingly, the City of Fresno shall have the right to enforce this Statement
by any legal or equitable means. All obligations of the Covenantor in this Statement
shall inure solely to the benefit of the City of Fresno. There are no third party
beneficiaries of said obligations nor shall the right of the City of Fresno be transferable in
any manner to any person other than to a successor municipal corporation whose
geographic boundaries include the Subject Property.
11. In the event that litigation is instituted to enforce the processing of this covenant,
the parties agree that the prevailing party shall be paid reasonable attorney's tees.

hereinafter called "Grantor" , without regard for number, being the
ownertof the real property (hereinafter called "Grantor' s
property") situated in the County of Fresno, State of California,
as described on the attached Exhibit "A" ;
Hereby grants to the City of Fresno, a Municipal Corporation,
hereinafter called "Grantee" , an assignable easement and
right-of-way, for the use and benefit of the public, for the free
and unobstructed passage of aircraft in, through and across all the
+uair-� -space above. Grantor's real property,
horizontal plane 100 feet above the primary surface elevation
pursuant to Part 77 of the Federal Aviation Regulations (said
primary surface elevation for the Sierra Sky Park Airport is
established as 921.00 feet, USC & GS Datum) ;
TOGETHER with the continuing right to cause or allow in all the air
space above the surface of Grantor' s property such noise,
vibrations, fumes, dust, fuel particles, and other effects as may
be caused by or result from the operation of aircraft; and Grantor,
for Grantor and the successors in interest and assigns of Grantor,
does hereby fully waive and release any right or cause of action
which they or any of them now have or may have in the future
against Grantee, its successors and assigns, on account of or
arising out of such noise, vibrations, fumes, dust, fuel particles,
and other effects heretofore and hereafter caused by the operation
of aircraft in said air space;
ALSO TOGETHER with the continuing right in the Grantee, its
successors and assigns, to clear and keep clear Grantor 's property
of any and all obstructions which encroach upon or extend into the
hereinbefore-described easement and right-of-way, and for such
purpose to enter upon the surface of Grantor ' s property and cut and
remove underbrush and soil and demolish, cut, lower or remove
buildings or any structures, or any bushes, trees or other
vegetation which are located on or extend into or over so much of
the Grantor ' s property as lies below the easement and right-of-way
herein granted, and together with the right of ingress to, egress
from, and passage over Grantor ' s property for the purpose of
effecting and maintaining such clearance as aforesaid:
RESERVING unto the Grantor, its successors in interest and assigns,
the right to use and occupy Grantor ' s property for all purposes
which do not interfere with or abridge the rights hereby granted.
The term "aircraft" is defined for the purpose of this deed as
any contrivance now known or hereafter invented, designed, or used
for navigation or flight in air or space.
Grantor, for Grantor and the successors in interest and assigns
of Grantor, covenants and agrees that neither they nor any of them
will erect, or permit the erection of, any structure or object, or
permit the growth of any tree or other vegetation, or allow any
structure, object, tree, or other vegetation to remain, on the
Grantor ' s property which encroaches upon or extends into said
easement and right-of-way, and that neither they nor any of them
will hereafter use, or permit or suffer the use of, Grantor ' s
property in such manner as to create electrical interference with
radio communication to or from any aircraft, or as to make it
difficult for aircraft pilots to distinguish between airport lights
and other lights, or as to impair visibility in the vicinity of any
airport, or as to otherwise endanger the landing, taking-off, or
maneuvering of aircraft, it being understood and agreed that the
aforesaid covenants and agreements shall run with the land. Upon
transfer of title to Grantor's property, Grantor shall be released
from all obligations in this Deed, and the new owner shall succeed
to all obligations of Grantor hereunder; provided that Grantor shall
continue to be bound , by. thewaiver -.and-• release specified in the
third paragraph of this Deed with respect to rights or causes of
action arising at any time while Grantor is the owner of Grantor 's
property.
