These fees are being paid under protest pursuant to California Government Code Sections 66020 and 66021 for the following reasons: 1. The fee exceeds the reasonable cost of providing the service of facility for which the fee was imposed in violation of Government Code Sec. 66005 . 2 . The local enactment imposing the fee is unconstitutional on its face and as applied to this development. 3 . The local enactment imposing the fee was not adopted in accordance with the procedure mandated by Government Code Sec. 66017 . 4. The amount of fees to be collected from this project bears no reasonable relationship and is not limited to the need for sewer facilities caused by this development, in violation of Government Code Sec . 66000 et seq. 5 . Williamson, PE (209) 498-1696 Ara Chekerdemian WESTCAL, Inc. 2109 West Bullard Avenue, Suite 101 Fresno, California 93711 Dear Mr. Chekerdemian: SUBJECT: PROTEST OF SEWER CHARGES FOR TRACT 4788, PHASE 11 OF VESTING TENTATIVE TRACT 4432 This is in response to your letter dated August 21, 1997, advising the City that WESTCAL is paying all wastewater facility charges, major facility sewer charges, and trunk sewer charges for Tract 4788 under protest pursuant to Sections 66020 and 66021 of the Government Code. This letter was received subsequent to your previous protest letter dated August 14, 1997, which refers to an included payment for these sewer fees but did not indicate a site location for the fees being protested. A. The protest dated August 21, 1997, is not valid for the following reasons: 1. The protest of the Wastewater Facilities Charge (FMC 9-503-a-6) is premature as the vesting rights conferred onto Tract 4788 by Vesting Tentative Tract 4432 does not expire until March 13, 1999. Pursuant to Section 66498.1 of the Government Code, this new fee, which was established after the tentative tract was accepted for processing, is not applicable until two years after the recording date of the final map of Tract 4788. Payment for Wastewater Facilities Charges have not been tendered by WESTCAL. The provisions of Section 66020 (a)(1) of the Government Code requires that payment in full be tendered for the fees being protested. 2. With regard to the Major Facilities Charge (FMC 9-503-a-3), this fee was imposed on December 22, 1992, as a condition of Vesting Tentative Tract 4432 which is when it was approved by the City Council on December 22, 1992. Pursuant to the provisions of Section 66020(d)(1) of the Government Code, the protest of this fee is not valid as the time period which protests were allowed for this project has lapsed. 3. With regard to the Trunk Sewer Charge (FMC 9-503-a-5), this fee was imposed on December 22, 1992 as a condition of Vesting Tentative Tract 4432 which was approved by the City Council on December 22, 1992. Pursuant to the provisions of Section 66020(d)(1) of the Government Code, the protest of this fee is not valid as the time period which protests were allowed for this project has lapsed. Payment in full for this fee was duly tendered with the subdivision agreement for Tract 4788. WESTCAL Tract 4788 Payment Under Protest Page 2 August 29, 1997 B. The protest dated August 14, 1997, is not valid as it does not identify the project for which the fees were represented as being tendered. Our records do not indicate that WESTCAL tendered any payment at the time the protest letter of August 14, 1997, was submitted. If your records indicate otherwise, please provide proof of same. Based upon the foregoing, we have not considered any of the points raised in your letters as bases of the protest cited in those letters.
