Dear Mr. Bier,
Pursuant to our conversation a few weeks ago, the following is a list of fees we believe
relate to the Public Utilities Department that were paid under protest and/or protested at
the time of recordation of the final map.
Sewer Oversize Fee
Trunk Sewer Fee
Wastewater Facilities Charge
Water Supply Charge
Well Head Treatment Fee
Recharge Fee
1994 Bond Debt Service Fee
Transmission Grid Fee
Transmission Grid Main Bond Service Charge
We believe that the fees related to the sewer were improperly applied to property that will
not be connected to the City sewer system. We further believe that the water fees were
applied to the Outlots at an incorrect rate.
We would very much like to schedule a meeting with you and our engineer, Gary
Giannetta, at your earliest convenience so that these issues may be resolved as
expeditiously as possible. Please contact the undersigned so that we can coordinate a
mutually agreeable time.

SUBJECT: TRACT NO. 4706—FEE PROTEST RELATED TO OUTLOTS A, B,
AND C
Staff met with Mr. Sabah and Mr. Giannetta on July 23, 1999 regarding their protest of
various water and sanitary sewer fees related to the subject tract.
The following is the result of that meeting.
• Sewer Oversize Charge was calculated as a gross area of the tract and shall
include the Outlots resulting in no change to the fee calculated.
• Trunk Sewer Charge was calculated to include the Outlots based on an
equivalence of 5.8 units per acre. Since the Outlots would not be connected to the
sewer system, we agreed the Outlots would not be charged a Trunk Sewer
Charge.
• Wastewater Facilities Charge was not collected and is not applicable to the
Outlots, provided they do not receive sewer service.
Outlots A, B,and C are required to be landscaped and irrigated,therefore the following
water fees protested are required to provide service to the Outlots. These fees were
calculated based on an equivalence of 5.8 units per acre. This basis of calculation shall
prevail,unless the developer submits an alternate demand calculation for the Outlots and
the Water System Manager approves such calculation.

• Wellhead Treatment Fee
• Recharge Fee

The Transmission Grid Main Charge and Transmission Grid Main Bond Debt Service
Charge was calculated as a gross area of the tract, which included the Outlots. This basis
of the fees calculated shall also prevail.
On the basis of the above, please arrange for a reduction in the Trunk Sewer Charge and
reimbursement to the developer from the calculated 110.4 units collected to only include
the 90 residential units as agreed.
