WILLIAMSON, Development Manager Planning & Development Services Division SUBJECT: RESOLUTION APPROVING THE FINAL MAP AND SUBDIVISION AGREEMENT - TRACT NO. 4053, "THE VILLAS II" BACKGROUND Project Location: East side of North Friant Road between East Shepherd Boulevard and North Fort Washington Road within the "Quincy Estates Village, of the Dominion (formerly Park Fort Washington) Planned Community Zoning: R-1/UGM (PC-1; Planned Community No. 1) No. of Lots : 53-lot single family residential planned development with (3) outlots Acreage: 12 . 4 acres Density: 5 .04 units per acre Plan Density: Woodward Park/Dominion Planned Community Specific Plan Medium Density Residential (4 . 99 to 10. 37 units/acres) Tentative Map Approval : Council Resolution 89-59, February 14 , 1989 The Subdivider, The Fresno Villas II , a California Limited Partnership, has executed the Subdivision Agreement and has posted security in the amount of $558 ,200.00 for performance and $279 , 100.00 for labor and materials . The Subdivider has paid cash in the amount of $80,793 . 84 for applicable fees. The Subdivider has also entered into a covenant deferring payment of Urban Growth Management Park Fees until lots are developed. REPORT TO THE CITY COUNCIL TRACT NO. 4053 Page 2 June 23. 1989 The Subdivision Agreement, the Urban Growth Management Park Fees Covenant and the Resolution approving the final map have been approved by the City Attorneys Office. The final map is in substantial compliance with the previously approved tentative map. THE ISSUE The Subdividers now seek final map approval in accordance with Subdivision Map Act and local ordinances for the purpose of recording the final map. CONCLUSIONS AND RECOMMENDATIONS The final map is in substantial compliance with the previously approved tentative map. and all conditions for final map approval have been satisfied . Therefore. pursuant to section 66474. 1 of the State Subdivision Map Act. the map must be approved by the City Council . It is recommended that the Council : 1. Adopt the attached Resolution approving the final map; and 2. Authorize the Public Works Director to execute the Subdivision Agreement on behalf of the city. FISCAL IMPACT OF RECOMMENDATION None. RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO. CALIFORNIA. APPROVING THE FINAL SUBDIVISION MAP OF TRACT NO. 4053/UGM, 'THE VILLAS 11 ' AND ACCEPTING DEDICATED PUBLIC USES THEREIN AND APPROVING AND AUTHORIZING EXECUTION OF THE SUBDIVISION AGREEMENT WHEREAS, The Fresno Villas II , a California Limited Partnership, has offered for approval a final subdivision map designated as Tract No. 4053: and WHEREAS, all the certificates which appear on the final map (except the approval certificate of the Council of the City of Fresno and the recording certificate of the Recorder of the County of Fresno) have been signed and acknowledged and said final map has been filed for approval ; and WHEREAS, said subdivision lies within the boundaries of the City of Fresno; and WHEREAS, said map conforms to all of the requirements of the Subdivision Map Act of the State of California, and City ordinances, resolutions and standards, except that Sections 66492 and 66493 of the Subdivision Map Act may not be fully complied with at the time of passage of this resolution, subdivider and owner having previously filed with the Clerk of the Board of Supervisors of Fresno County a Tax Compliance Certificate Request along with copies of the final map considered herewith by the Council ; and WHEREAS, the Council finds that the proposed subdivision, together with the provisions for its design and improvement, is consistent with all applicable general and specific plans of the City; and CLERK'S CERTIFICATE .STATE OF CALIFORNIA ) COUNTY OF FRESNO ) ss.
