PAST..�T 211987 LARSN, Rong d- ----------------ABOVE SPACE FOR RECORDER'S USE---------------- COVENANT TO HOLD PROPERTY AS ONE PARCEL WHEREAS, the undersigned, GRUPE DEVELOPMENT COMPANY- NORTHERN CALIFORNIA, A CALIFORNIA CORPORATION ( "Owner" ) , hereby represents and warrants that it is the record owner of Lots 1 - 59 , inclusive, of Tract 3800 , according to the Map thereof recorded in volume 44 of Plats at pages 97 , 98 , and 99 , Fresno County Records, situated in the City of Fresno, County of Fresno, State of California; and WHEREAS, Owner desires to combine the above-described 59 lots into 29 Parcels, as described on Exhibit "A, " which is attached and incorporated in this Covenant by reference ( "the Parcels" ) ; and WHEREAS, Owner desires to develop each Parcel with a single family detached residential dwelling, which dwelling will straddle the property line dividing the legal lots that make up such Parcel; and WHEREAS, with the exception of straddling the property line dividing the legal lots contained within a Parcel, each -1- residential dwelling will comply with all applicable provisions of the Fresno Municipal Code, Uniform Building Code, and other laws and regulations; NOW, THEREFORE, in consideration of the City of Fresno (the "City" ) granting permits and other development entitlements required for Owner to develop the Parcels, Owner covenants and agrees as follows : 1 . To hold the Parcels as individual parcels . Development on each Parcel shall comply with all property development standards for the R-1 zone district as set forth in the City ' s Zoning Ordinance, except for straddling the property line dividing the legal lots within each Parcel . The legal lots that constitute a Parcel may be sold together as a single parcel to a third party; however, the legal lots that constitute a Parcel may not be individually sold or transferred into separate ownership unless all property and building development standards for that lot have been met and any necessary parcel map or subdivision map approval has been obtained. If such a division of the lots is approved by the City, then the City shall cause the appropriate officer of the City to release the affected lots from this covenant . 2 . This covenant is for the benefit of the Parcels and the public property, and shall run with the Parcels . 3 . This covenant shall be binding on and inure to the benefit of the City, Owner, their respective successors in -2- r interest, assignees and transferees , and all subsequent owners of the Parcels .
