CD CD LA— U Z O U RELEASE OF STATEMENT OF COVENANTS AFFECTING LAND DEVELOPMENT DEFERRING CERTAIN URBAN GROWTH MANAGEMENT FEES TO THE TIME OF ISSUANCE OF CERTIFICATE OF OCCUPANCY AND CREATION OF LIEN FOR TRACT NO. 3095 Release of Covenant Fee Deferral Tract No. 3095 Page 2 RELEASE OF COVENANT WHEREAS, Fresno Supreme, Inc., A California Corporation, entered into a covenant providing for deferral of certain urban growth management fees dated October 10, 1980 and recorded on October 21, 1980 in Book 7607, Pages 424 - 427 of Official Records of Fresno County, hereinafter referred to as the "Covenant;" and WHEREAS, the property affected by said Agreement is more particularly described as follows: Parcel C of Parcel Map 83-20, according to the map thereof recorded in Book 42, Page 85 of Parcel Maps, Fresno County Records. and hereinafter designated and called the `Subject Property'; and WHEREAS, the Planning and Development Department Director has determined that the deferred fee obligations per said Covenant for the Subject Property were fully paid on February 7, 2007. NOW,THEREFORE,in accordance with the provisions of said Covenant,the City of Fresno does hereby release the Subject Property from said Covenant and that it shall be of no further force or effect.
