NOTICE: This certificate relates only to compliance or noncompliance with the Subdivision Map Act and local ordinances enacted pursuant thereto. Development of the properties may require issuance of a permit or permits,or other grants of approval. WHEREAS,James A. McKelvey of MOTSCHIEDLER,MICHAELIDES&WISHON, LLP on behalf of JUDY GAGNEBIN has requested the issuance of a Certificate of Compliance for the real properties within the bounds of Tract No. 1557(Fort Washington Beach Estates)recorded on May 10, 1956 Volume 18 of Plats at Page 58, Fresno County Records,consisting of fifty-two(52)lots, hereinafter referred to as the"Subject Property"and also,"Map;"and WHEREAS,of the 52-lots created by the Map,Lots 45 through 51,inclusive,are noted on the Map for the use of the owners and residents as private streets and lanes and the purpose of Lot 52 is noted on the Map as, "Reserved for Well";and WHEREAS,the current Owners and Owners'real properties within the Subject Property are more particularly described in the attached Exhibit"A";and WHEREAS,the Subject Property was annexed to the City of Fresno pursuant to Annexation No.1112(Behymer-Friant#1),effective June 26, 1984;and WHEREAS,concurrent with the effective date of annexation of the Subject Property to the City of Fresno,the zone district classification of the Subject Property was automatically placed in the City's AE-5/UGM district;and WHEREAS,the State of California,State Lands Commission on April 24, 1992, notified the City of Fresno of the completion of certain Administrative Maps which identify the location of State sovereign ownership interests in the bed of the San Joaquin River between Friant Dam and Highway 99;and WHEREAS,the California State Lands Commission asserts fee ownership of the bed of the San Joaquin river between the two ordinary low waterlines and asserts a public trust easement between the ordinary low waterline and the ordinary high waterline of the San Joaquin River;and WHEREAS,on the basis of such Administrative Maps, it appears that Lots 31 through 45,inclusive, Lot 45, Lots 50 and 51,of the Subject Property(hereinafter referred to as the"Affected Lots")are within the sovereign Public Trust lands owned in fee and lands which are subject to the Public Trust Easement held by the State of California(State);and Conditional Certificate of Compliance Tract No. 1557(HTE 02-1218) Page 3 WHEREAS,with the exception of notes relating to U.S Government Meander Line, Points and Corners,the Map does not include or identify any such fee title interest or easement interests acquired by the State in 1850. NOW THEREFORE,the City of Fresno certifies that the Subject Property is in compliance with the provisions of the Subdivision Map Act and the Fresno Municipal Code and issues this Certificate of Compliance subject to the following conditions: 1. The Property Owners of the Subject Property to submit to the City a copy of a recorded agreement with the State,establishing the common boundary between the public trust lands owned by the State in fee title interest or easement interests and the private lands within the Subject Property owned in fee by the Property Owners;or 2. The Property Owners to submit to the City,a copy of recorded Quit Claim Deeds for the Subject Property where Property Owners'rights,title and interests have been conveyed to the State and where State's rights,title and interests have been conveyed to the Property Owner. That Property Owners of the Subject Property will be precluded from developing on any land or lots created within Tract No.1557 that has been deeded to the State of California by quitclaim deed unless agreed to in writing by the State of California;or 3. Upon failure to comply with conditions 1 and 2 above, The Property Owners'rights to develop the Subject Property shall be as follows: a. The California State Lands Commission asserts fee ownership of the bed of the San Joaquin River between the two ordinary low waterlines and asserts a public trust easement between the ordinary low waterline and the ordinary high waterline of the San Joaquin River. The Property Owner disputes the assertions of the California State Lands Commission. The Ordinary Low Waterline and the Ordinary High Waterline of the San Joaquin River were determined from survey by the California State Lands Commission(CSLC)in 1989,and their Administrative Maps depicting the results of this survey were made available for public inspection in April, 1992. The location of the lines of the Ordinary Low Waterline and the Ordinary High Waterline as shown on the Administrative Maps are incorporated by reference herein. b. No permits(including but not limited to building,grading, plumbing, mechanical or electrical permits)shall be issued by the City of Fresno for the Affected Lots or any portion of an Affected Lot. 4. Requests for permits for lots of the Subject Property which are situated wholly above the Ordinary High Waterline will be issued by the City of Fresno conditioned upon the following: a. Provide evidence,acceptable to the City,of the perpetual and continuing operation of the Subject Property by the Fort Washington Beach Estates, Inc.,a non-profit corporation, Conditional Certificate of Compliance Tract No. 1557(HTE 02-1218) Page 4 under the provisions of the Declaration Of Restrictions(Document No.87497,Book 3858, Page 291 et seq., Fresno County Records)and the names,titles, mailing addresses of the current officers of said Fort Washington Beach Estates, Inc.. b. Compliance with the provisions of the California Building Code. G. Compliance with the provisions of the City Zoning Code and the development standards of the AE-5(exclusive five-acre agricultural district) d. WATER REQUIREMENTS: 1. Dedication of a well site up to but not to exceed the standard 12,000 square foot site acceptable to the City of Fresno Water System Manager. 2. Two points of connection to City water mains acceptable to the City of Fresno Water System Manager. 3. Construction of public water mains from Friant Road to the Subject Property. 4. Construction of public water mains within the Subject property. 5. Installation of water services and meters to each lot. 6. Dedication of easements within the private street areas for continuing City operation and maintenance of any public water facilities. 7. All water system construction shall be to City of Fresno standard specifications. e. FIRE SERVICE REQUIREMENTS: 1. Install and maintain an automatic fire sprinkler system,approved by the City of Fresno Fire Chief,in each dwelling and structure to the extent as required by the Fresno Municipal Code. 2. Providing,constructing and maintaining a second point of access acceptable to the City of Fresno Fire Chief from the public street to the private roadway for emergency services vehicles. 3. Installation of fire hydrants as required by the City of Fresno Fire Chief. Conditional Certificate of Compliance Tract No. 1557(HTE 02-1218) Page 5 f. SANITARY SEWER REQUIREMENTS: 1. Construction of all sanitary sewer facilities and connection of each lot to the City of Fresno sanitary sewer system at a location and in a manner acceptable to the Public Utilities Director;or 2. Construction and connection to an alternative sanitary sewer system acceptable to the Public Utilities Director. 3. Preparation of plans by a registered Civil Engineer subject to City of Fresno review and approval for the construction of lift station(s), pumping facilities, mains or other appurtenances required to providing sanitary sewer service. 4. Payment of connection charges and/o impact fees applicable to providing sanitary sewer service. 5. Dedication of easements necessary for installation and continuing operation and maintenance of public sewer system facilities. 6. Sanitary sewer facilities constructed in private roadways or on private property not accessible to the public shall be identified as privately owned and maintained through Covenants,Conditions and Restrictions(CC&R's)recorded for the subdivision. g. STREETIMPROVEMENTS 1. LANES ROAD(a public street). Within the limits of the Subject Property,the construction of street improvements in accordance with City Standard Specifications. 2. PRIVATE STREETS AND LANES. Construction of pavement within the private roadways(said Lots 45 through 51 inclusive including private roadway over Lots 18 and 19)to each lot acceptable to the City Engineer. 3. APPROVED ACCESSES. Re-establish all of said Lot 46 as access for the Subject Property to Lanes Road in addition to the private roadway access over Lots 18 and 19. h. Providing for disposal and/or containment of storm water as required by the Fresno Metropolitan Flood Control District and the City Engineer. i. Payment of applicable development impact fees.
