SUBJECT: NOTICE OF APPROVAL OF TENTATIVE PARCEL MAP NO. 99-20 FOR
PROPERTY LOCATED ON THE SOUTHWEST CORNER OF NORTH FRIANT
ROAD AND NORTH FRESNO STREET
The City of Fresno Planning Division has completed its review of the subject map. Pursuant to FMC
Section 12-1205(c),this letter is written to advise that the conditions of approval are as noted on the
attached document, dated June 5, 2000.
If you have any questions regarding the conditions you must notify either Louie Rocha or Heather
Collier at 498-4453 no later than June 12, 2000,to request a review of the conditions. Otherwise, the
stipulated conditions of approval are in effect as of that date. No further notice will be sent.
Appeal: The divider or any aggrieved person may file an appeal regarding conditions of approval
within fifteen(15) days from the date of approval.
To protest the Director's decision regarding the conditions of approval,you must appeal by filing a
written appeal with the Director of the Development Department. The appeal must include the
appellant's interest in/or relationship to the subject property,the decision or action appealed, and
specific reasons why the appellant believes the decision or action appealed from should not be upheld
Appeals must be submitted to the Director of the Development Department prior to 5 p.m. on
June 20, 2000.
EXPIRATION: The approval or conditional approval of this tentative Parcel Map expires two years
from the date of approval. The expiration shall terminate all proceedings and a final Parcel Map may
not be filed without first processing a new Tentative Parcel Map.
Modification of a Tentative Parcel Map after approval or conditional approval does not extend the two
year time limit.

EXTENSION: The divider may request an extension of the tentative map expiration date by filing a
written application together with the fee set forth in the Master Fee Schedule at the time of the request
with the Director of the Development Department at least thirty days before the expiration date of the
map. The applicant must state the reasons for the requesting the extension. New conditions may be
imposed if an extension is granted.
An extension may not exceed an aggregate of 5 years.

CONDITIONS OF APPROVAL
VESTING TENTATIVE PARCEL MAP NO. 99-20
The City of Fresno Development Department has completed a review of the subject tentative parcel
map in accordance with the State Subdivision Map Act and the Fresno Municipal Code.
The conditions of approval for Vesting Tentative Parcel Map No. 99-20 are as follows:
I. Legal Status of Site to be Subdivided
A. The parcel map site, was legally created.
II. Zoning
A. Proposed parcels are consistent with the existing C-PfUGMIcz zone administrative
office district for a planned development of the parcel map site in terms of lot width,
depth and area.
The Fresno Municipal Code defines light industrial zone districts shall mean the
following districts: RP-L,R-P,and C-P.
B. The California Department of Transportation(CALTRANS), in response to City
staffs request for comments on this project believe city should assess the project's
impact on State-Route 99 and Herndon Avenue interchange to determine the
project's pro rata responsibility for area-wide circulation improvements.
The City's Public Works Department has concluded it is the responsibility of
Caltrans to design and construct the freeway improvements,the cost of which are
addressed either through Measure "C"or standard State funding mechanisms. City
staff, therefore, finds, that because no development fee has been established for these
improvements and are the responsibility of Caltrans, the developer of the tentative
subdivision map cannot be required to pay this unidentified improvement cost.

III. Modification of Property Development Standards/Planned Unit Development
A. The proposed subdivision requires the modification of the C-P zone district property
development standards in that is proposes the creation of parcels within an approved
office planned development which do not have direct access to a public street or
right-of-way. Such access may be accomplished by compliance with condition(s)
below.
B. If not already obtained, secure approval of Conditional Use Permit No. C-99-147,
submitted for the creation of an office planned unit development on the parcel map
site to reflect the proposed parcel modifications.
C. The placement of a parcel line in close proximity to the existing and or proposed
structure requires that the structures be found in compliance with the fire resistive
standards of the Uniform Building Code, Chapter 5. In the event the structures do
not comply they must be modified so as to meet the requirement.
The proposed structure(s) on the site may be affected due to the location of the
proposed parcel line. Compliance with the prevailing Uniform Building Code as it
relates to the exterior wall protection,allowable area, etc. (as applicable to new
parcel line locations) must be demonstrated prior to this conditions of approval.

D. Submit draft copies of Covenants,Conditions and Restrictions/Owners Association
documents (CC & R's) for review and approval. Final, executed and notarized
documents are to be recorded with the parcel map. CC &R's shall conform with the
provisions of Section 12-1026 FMC and address ingress, egress, sewer and water
service, maintenance, and access, fire protection, solid waste service, storm drainage,
parking and landscaping.
E. The existing structure(s) on the proposed parcels may be affected due the location of
the proposed parcel lines. Compliance with the prevailing California Building Code
(CBC) as it relates to allowable area and exterior wall protection is required prior to
approval of the lot line adjustment. This may include documentation prepared by an
architect or engineer submitted for plan review to Building and Safety Services,
permits and approved inspections to bring the affected building into conformance
with the CBC. For additional information contact Development Department,

IV. Plan Consistency
A. The Woodward Park Community Plan designates the parcel map site for
development with office commercial land uses. The Zoning District Consistency
Table of the Fresno Municipal Code identifies planned office developments as
consistent with the C-P/UGM/cz zone district.
V. On-Site Requirements
A. Fresno Metropolitan Flood Control District requirements:
See attached memo dated January 10, 2000.
B. Easements: The location,type, size, and record information of easements on and
through the site must be shown on the final map. A ten-foot easement per Public
Works Standards shall be provided along North Fresno Street per Master Multi-
Purpose Trails Manual Policy 5.2.1 Class I Bikeways.
The developer/owner will be responsible for the costs associated with any removal or
relocation of existing facilities on the property.
VI. Off-Site Improvement Requirements
A. Per Section 11-208, Subsection C of the Fresno Municipal Code, the developer will
be required to dedicate four to fourteen feet of right-of-way along North Friant Road
for an additional travel lane.
B. Sanitary Sewer System
I. Further extension of the public sanitary sewer system is not required.
However, the subdivider is required to serve the interior parcels with onsite
sewer to be dedicated to the City as a public system, public utility easements
shall be required, and the design of the onsite public system shall be shown on
engineered plans and profile drawings which shall be approved by the City
Engineer and the Department of Public Utilities.
C. Water Service
1. Further extension of the public water system is not required. However, the
subdivider is required to serve the interior parcels with onsite water utilities to
be dedicated to the City as a public system, public utility easements shall be
required, and the design of the onsite public system shall be shown on
engineered plans and profile drawings which shall be approved by the City
Engineer and the Department of Public Utilities.

D. Assessment District No. 100
1. The subject property is situated within City of Fresno Assessment District
No. 100. Contact Dave Valenzuela of the City's Public Works at(559) 498-
4737 to make arrangements to apportion the existing assessment. An
application form needs to be filed and an apportionment fee in the amount of
$1,950. Must be paid prior to map approval.
E. Parks, Recreation and Community Services
1. Comply with Parks Department requirements in accordance with the Parks
memorandum dated January 10, 2000.
VII. General Public Works Requirements
A. DEDICATIONS. The subdivider shall dedicate public easements to facilitate the
construction of curbs, gutters, sidewalk, bus bays,right turn lanes, bike lanes, bike
paths, multi-purpose trail, wheelchair ramps and public utilities in accordance with
City plans, ordinances,resolutions and policies,the Standard Specifications of the
Public Works Department within the limits of the parcel map. Additionally, a
minimum 4 foot wide clear path of travel is required along the public sidewalk on all
frontages of the property as required by Title 24 of the California Administration
Code as determined by the City Engineer. An on-site pedestrian easement and
construction of a path may be required if Title 24 provisions can not be met within
the public rights of way. All such public easements shall be identified and dedicated
with the processing and recordation of the Parcel Map or at the time of Special
Permit reviews for the proposed development of the parcels.
B. STREET IMPROVEMENTS. The subdivider shall construct curb, gutters, curb
returns and landings, wheelchair ramps, sidewalks with street tree wells and
irrigation systems (when applicable), permanent pavement, street/safety lighting,
bike lanes, bike paths, multi-purpose trail, walls and fences in accordance with City
plans, ordinances, resolutions, policies and the Standard Specifications of the Public
Works Department within the limits of the parcel map.
Existing improvements that are not to the planned alignment shall be removed and
required improvements installed to the new street alignment and grade. Existing
improvements to remain in place shall be repaired if determined to be damaged
and/or off grade by the City Engineer. Existing driveway approaches not identified
for current or future utilization shall be removed and sidewalk(when applicable),
curb and gutter shall be installed to match existing or proposed street line and grade
as determined by the City Engineer.

C. SANITARY SEWER SYSTEM. The subdivider shall connect each parcel being
created to the City of Fresno's sanitary sewer system with a separate sewer house
branch unless other arrangements are approved by the City Engineer. All sanitary
sewer system improvements shall be constructed in accordance with City plans,
ordinances, resolutions, policies and the Standard Specifications of the Public Works
Department. The subdivider is required to construct sewer main extensions to serve
the parcel map in a manner determined by the City Engineer. The connection to the
City's sanitary sewer system requires the payment of all applicable sewer connection
charges in accordance with the provisions of FMC Chapter 9, Article 5 prior to the
approval of the map.
D. WATER SYSTEM. The subdivider shall connect each parcel being created to the
City of Fresno's water system with a separate water services and meters unless other
arrangements are approved by the City Engineer. All water system improvements
shall be constructed in accordance with City plans, ordinances, resolutions, policies
and the Standard Specifications of the Public Works Department. The subdivider is
required to construct water main extensions to serve the parcel map in a manner
determined by the City Engineer. The connection to the City's sanitary sewer system
requires the payment of all applicable water connection charges in accordance with
the provisions of FMC Chapter 14, Article 1 prior to the approval of the map
E. STREET, SEWER AND WATER CONSTRUCTION PLANS. The subdivider shall
provide street, sewer and water construction plans for the required public
improvements as determined by the City Engineer. Such plans shall be prepared by a
registered Civil Engineer and approved by the City Engineer prior to the issuance of
Street Work permits.
F. CONSTRUCTION/DEFERRAL. The subdivider shall construct the street, sanitary
sewer system and water system improvements required for this parcel map, and the
work deemed completed by acceptance of the work by the City Engineer,prior to the
approval and recordation of the Parcel Map.
Alternatively, the subdivider may request the deferral of the construction of such
improvements with a parcel map agreement. The City Engineer may approve such
agreement wherein the subdivider will be required to provide an Engineer's Estimate
of the work. The agreement will be prepared by the City and will require
performance securities as determined by the City Engineer.

VIII. Development Fees
All fees noted in this section shall be due and payable to the City of Fresno prior to the
approval of the final parcel map. All fee quotations are based on current rates. Applicant
shall pay the fee in effect at the time of final map approval.
GOVERNMENT CODE§66020(d)(1)
A protest filed pursuant to subdivision (a)shall be filed at th time of approval or conditional approval
of th development or within 90 days after the date of the imposition of the fees dedications,
reservations, or other exactions to be imposed on a development project. East local agency shall
provide to the project applicant a notice in writing at the time of the approval of the project or at the
time of the imposition of the fees, dedications, reservations, or other exactions, a statement of the
amount of the fees or a description of the dedications, reservations, or other exactions, and notification
that the 90-day approval period in which the applicant may protest has begun.

In accordance with Section 66497 of the Subdivision Map Act, the City must receive evidence of

evidence of payment to the engineer or surveyor must be received prior to the release of such
agreement and security.

SUBJECT: REQUIRED FINDINGS AND APPROVAL OF VESTING TENTATIVE
PARCEL MAP NO. 99-20
BACKGROUND
Tentative Parcel Map No. 99-20, filed by River Park Properties, on October 8, 1999, proposes the
creation of a 10 parcel planned office development from 17.8 acres located on the west side of North
Fresno Street, between North Friant Expressway and the Southern Pacific Railroad tracks. The project
site is zoned C-P/UGM/cz( Office Commercial). Approval of a tentative parcel map is subject to the
Development Director finding that the map is consistent with the officially adopted plans and policies
of the City of Fresno. Staff has reviewed the proposed design and improvement of Tentative Parcel
Map No. 99-20 and has determined that the map is consistent with adopted plans and policies as
described below.
Please review the following required findings for determination of consistency for the tentative parcel
map. Upon your determination that the required findings can be made, the applicant will be notified of
the conditions of approval of Tentative Parcel Map No. 99-20.
REQUIRED FINDINGS
California Environmental Quality Act(CEQA) - The California Environmental Quality Act(Public
Resources Code Section 21000 et seq.) and the State EIR Guidelines, Section 15061 (Review for
Exemptions), permit a public agency to determine whether a particular project is exempt from CEQA.
If a public agency finds that the activity is covered by the general rule that CEQA applies only to
projects which have the potential for causing a significant effect on the environment and it can be seen
with certainty that there is no possibility that the activity in question may have a significant effect on
the environment, the activity is not subject to CEQA and a notice of exemption or no possibility of
significant adverse effect is issued.
Environmental Assessment No. TPM-99-20 was completed for this project and issued on January 13,
2000 and filed with the Fresno City Clerk on January 21, 2000. An Amended Environmental
Assessment No. TPM-99-20 was completed on January 27, 2000 and filed with the Fresno City Clerk
on January 27, 2000.

State Subdivision Map Act- The Subdivision Map Act(California Government Code
Section 66410 et. seq.)requires that a proposed parcel map not be approved unless the map, together
with its design and improvement, is found to be consistent with the General Plan and any applicable
specific plan(Finding No. 1 below). State law further provides that the proposed parcel map be denied
approval if any one of the Finding Nos. 2 -5, below, is made in the negative.
1. The proposed subdivision map,together with its design and improvement is consistent with the
City's General Plan and any applicable specific plan, because the Woodward Park Community
Plan designates the site for office commercial land uses and the project design meets the
density and zoning ordinance criteria for development in this plan designation.
2. The site is physically suitable for the proposed type and density of development because of the
flat terrain of the site and adequate access and drainage on and off the site.
3. The proposed subdivision design and improvements are not likely to cause substantial and
considerable damage to the natural environment, including fish, wildlife or their habitat,
because of the urbanized nature of the area in which the site is located.
4. The proposed subdivision design and improvements are not likely to cause serious public
health and safety problems, because the conditions of approval have shown and will insure that
the subdivision conforms with City health and safety standards.
5. The proposed subdivision design will not conflict with public easements within or through the
site because conditions of approval will assure noninterference with any existing or proposed
public easements.
Staff, based on its own analysis, has determined that the parcel map, subject to the recommended
conditions of approval, otherwise complies with the design and property development standards of the
Zoning Ordinance and local Parcel Map Ordinance and recommends the approval of the parcel map.
DIRECTOR DETERMINATION
1. Based upon the above analysis, the Development Director finds that Tentative Parcel Map
No. 99-20 is consistent with the applicable plans and policies of the City of Fresno.
2. The Development Director hereby grants approval of Parcel Map No. 99-20 dated January 4,

As a follow up to my February 7, 2000 letter, we are appealing the
amended negative declaration, Environmental Assessment Numbers : TPM
99-20 if the processing of this amended negative declaration and
parcel map were not suspended.
The Initial Study for Environmental Assessment Numbers : TPM 99-20
states that the City of Fresno Traffic Engineering Section is
requiring North Friant Road dedications that should not be required
and we feel are illegal .
We are still waiting for the information that Mr. Bob Madewell said
that he would provide us so we can evaluate the City Traffic
Division' s request .

We have reviewed the vesting tentative parcel map for Riverpark Village bounded by
State Route(SR)41,Fresno Street and the abandoned railroad right-of-way. Caltrans
has the following comments:
• Consistent with previous correspondence on otherpro'ects in the vicinity of
the Friant Road Interchange, Caltrans is requesting a 99c study to determine
the adequacy of the current road system. This should be done for current
conditions as well as cumulative and full build (per Caltrans Guidelines for
Traffic Impact Studies),'Reference our letter dazed 11/8199(copy enclosed).
• Caltrans is concemed that additional traffic will exacerbate current operations
to the point of becoming a significant public j&&jX issue.
• We believe that Caltrans and the City need to work together to plan line the
SR 41/Priant Road Corridor to assure adequate operations, We believe this
would be prudent before issuing final entitlements. If this is not possible we
believe the City should process this project with a sufficient set-back of
buildings to preserve aU transportation options.
Please forward a copy of the revised vesting tentative tract map that addresses our
concerns and send a response to our comments prior to staff s recommendations to the

the onsite public system shall be shown on engineered plan and profile drawings which shall be approved
by the City Engineer and the Department of Public Utilities.

4. Availability of drainage facilities

6. The Federal Storm Water Regulations have identified eleven industry types which must
secure an industrial storm water discharges permit in compliance with the U.S.E.P.A.'s
NPDES regulations (CFR Parts 122-124, Nov. 1990). Industrial activities required to
secure a permit include, but are not limited to: trucking terminals; municipal passenger
service facilities; manufacturing facilities; and other industrial activities which might
generate contaminated runoff. The industrial permit is secured by filing a Notice of Intent
and paying a fee to the State Water Resources Control Board, 30 days prior to the
beginning of operation. The permittee must also develop and implement a storm water
pollution prevention plan,reporting plan,and monitoring plan,and eliminate all prohibited
non-storm water discharges.
7. Construction activity including grading,clearing,grubbing,filling,excavation,development
or redevelopment of land that results in a disturbance of 5 acres or more (or less than 5
acres if part of a larger common plan of development or sale)must secure a construction
storm water discharge permit in compliance with U.S.E.P.A.'s NPDES regulations(CFR
Parts 122-124,Nov. 1990). The construction permit is secured by filing a Notice of Intent
and paying a fee to the State Water Resources Control Board prior to the commencement
of construction. The permittee must also develop and implement a storm water pollution
prevention plan, monitoring plan, reporting plan, and eliminate all prohibited non-storm
water discharges.
8. The proposed development shall implement all applicable BMPs presented in the
Construction Site and Post-Construction Storm Water Quality Management Guidelines
(available at the District Office),to reduce the release of pollutants in storm water runoff
to the maximum extent practicable.
9. A requirement of the District may be appealed by filing a written notice of appeal with the Q
Secretary of the District within ten days of the date of this Notice of Requirements.
10. The District reserves the right to modify, reduce or add to these requirements, or revise
fees, as necessary to accommodate changes made in the proposed development by the
developer or requirements made by other agencies.

The drainage fee update is currently underway. The drainage fee obligation indicated is the
obligation which is valid at the date of this notice. Contact the District for a final drainage fee
obligation prior to issuance of a building permit.
TPM 99-020 shall be developed in a manner that will not restrict the conveyance of storm water
runoff southerly to the Sugar Pine Trail in rainfall events that exceed the design capacity of the
drainage system.
In an effort to improve storm water runoff quality, outdoor storage areas shall be constructed and
maintained such that material which generates contaminants will not be conveyed by runoff into
the storm drain system.
The District encourages, but does not require that roof drains from non-residential development
be constructed such that they are directed onto and through a landscaped grassy swale area to filter
out pollutants from roof runoff.
