Ewell, hereinafter called "Owner,"entered into an agreement with intent to demolish, remove and clear the main structure from Parcel B and to demolish, remove, and clear the accessory structure from Parcel A, if no main structure is constructed on Parcel A, within the term of said agreement; and WHEREAS, the property affected by said Agreement is more particularly described as follows: Parcel A That portion of Parcels A and B of Parcel Map No. 85-60, according to the map thereof recorded in Book 47 of Parcel Maps at Page 51, Fresno County Records, being more particularly described as follows: Beginning at the Southwest corner of said Parcel A; thence North 00020'05" West, along the West line of said Parcels A and B , a distance of 160.00 feet;thence North 88059'00"East,parallel with the South line of said Parcel A, a distance of 125.00 feet; thence South 00020'05" East, parallel with the West line of said Parcels A and B, a distance of 160.00 feet to the South line of said Parcel A; thence South 88059'00" West, along the South line of said Parcel A, a distance of 125.00 feet to the Point of Beginning. Parcel B That portion of Parcels A and B of Parcel Map No. 85-60, according to the map thereof recorded in Book 47 of Parcel Maps at Page 51, Fresno County Records, being more particularly described as follows: Beginning at a point on the South line of said Parcel A, said point being North 88059'00" East, a distance of 125.00 feet from the Southwest corner of said Parcel A; thence North 00020'05" West, parallel with the West line of said Parcels A and B, a distance of 160.00 feet; thence North 88059'00" East, parallel with the South line of said Parcel A, a distance of 127.00 feet to the East line of said Parcel A; thence South 00020'05" East, along the East line of said Parcels A and B, a distance of 145.18 feet; thence South 44019'28" West, a distance of 21.09 feet to the South line of said Parcel A; thence South 88059'00" West, along the South line of said Parcel A, a distance of 112.18 feet to the Point of Beginning. and hereinafter designated and called the `Subject Property'; and WHEREAS,the Planning and Development Director has determined that with the demolition of the previously existing stable barn on Parcel A, and the eminent construction of a new custom single family residence on Parcel B that the subject Agreement no longer is needed on the Subject Property. NOW,THEREFORE,in accordance with the provisions of said Agreement,the City of Fresno does hereby release the Subject Property from said Agreement and it shall have no further force or effect.
