Any urban residential development occurring as a result of project approval will have an impact on the District's student housing capacity The District, through local funding, is in a position to mitigate its shortage of classrooms to accommodate planned population growth for the foreseeable future. However, the District recognizes that the legislature, as a matter of law, has deemed, under Government Code Section 65996, that all school facilities impacts are mitigated as a consequence of SB 50's Level 1,2 and 3 developer fee legislative provisions. Any new development on the subject property or conversion of non-habitable to habitable space is subject to development fees of$2.97 per square foot for residential and$0.47 per square foot for commercial development. Any new development on the property will be subject to the development fee prior to issuance of a building permit.
