Pursuant to Section 12-1205 of the Fresno Municipal Code,this letter is written to advise you that the Conditions of Approval dated April 03, 2012, are as noted on the attached document. Appeal: The divider or any aggrieved person may file an appeal regarding to conditions of approval within fifteen (15) days from the date of approval. To protest the Director's decision regarding the conditions of approval, you must appeal by filing a written appeal with the Director of the Development and Resource Management Department. Appeals must include the appellant's interest in/or relationship to the subject property, the decision or action appealed, and specific reasons why the appellant believes the decision or action appealed should not be upheld. Appeals must be submitted to the Director of the Development and Resource Management Department prior to 5 p.m. on April 18, 2012. EXPIRATION: The approval or conditional approval of this Tentative Parcel Map expires two years from the date of approval. The expiration shall terminate all proceedings and a final Parcel Map may not be filed without first processing a new Tentative Parcel Map. Modification of a Tental:ive Parcel Map after approval or conditional approval does not extend the two year time limit. EXTENSION: The divider may request up to a two year extension of the tentative map expiration date by filing a written application together with the fee set forth in the Master Fee Schedule at the time of the request with the Director of the Development and Resource Management Department prior to the expiration date of the map. The applicant must state the reasons for requesting the extension. New conditions may be imposed if an extension is granted. The following specific conditions are applicable to this tentative map. In accordance with the provisions of Government Code §66020(d)(1), the imposition of fees, dedications, reservations or exactions for this project are subject to protest by the project applicant at the time of approval or conditional approval of the development or within 90 days after the date of the imposition of the fees, dedications, reservations or exactions imposed on a development project. Upon conditional approval of Vesting Tentative Parcel Map No.2011-10,dated March 01,2012,the subdivider may prepare a Parcel Map(Final)in accordance with the approved tentative parcel map. Note that a Parcel Map may not be filed until the appeal period has expired. Should an appeal be filed pursuant to Section 12-1207 of the FMC, the application will be scheduled to be heard before the City of Fresno Planning Commission. The appellant may withdraw their appeal pursuant to Section 12-1207.2 of the FMC. Concurrent with the filing of a Parcel Map and when the provisions of Section §66436 of the SMA apply, the subdivider is responsible to send, by certified mail, a sketch of the proposed Parcel Map, together with a copy of Section §66436(a)(3)(A)of the SMA,to any public entity or public utility which has previously acquired a right-of-way easement. PLAN CONSISTENCY AND ZONING The subject property is located within the boundaries of the 2025 Fresno General Plan, Bullard Community Plan, and the Freeway 99-Golden State Corridor Redevelopment Plan,which designate the subject property for Light Industrial planned land uses. Pursuant to Section 12-403-B-2-b(2) of the Fresno Municipal Code, the existing M-3 (Heavy Industrial)zone district classification for the subject property may be found to be consistent with the Light Industrial planned land use designation subject to the following conditions: 1. The subdivider shall execute a covenant, in a form approved by the City of Fresno, restricting the future use of all parcels proposed to be created from a subdivision of the Conditions of Approval Vesting Tentative Parcel Map No. 2011-10 April 03, 2012 Page 2 subject property to those uses permitted by the M-1 (Light Manufacturing)zone district(as set forth in Section 12-226 of the FMC). a) The covenant shall run with the land and bind all successors and assigns. i) Failure to comply with the terms of the Covenant may result in the revocation of a Certificate of Occupancy of Special Permit by the City for use of any Parcel of the properties involved. Accordingly, the City of Fresno shall have the right to enforce this Statement by any legal or equitable means. A Lot Line Adjustment, conforming to the provisions of Section §§66412(d) of the State Subdivision Map Act and Section 12-1204(c) of the Fresno Municipal Code, shall be perfected to establish the proposed map/subdivision boundary depicted by Vesting Tentative Parcel Map No. 2011-10 prior to recordation of a Parcel Map. • NOTE: The parcel line adjustments approved for Lot Line Adjustment No.2011- 11 as recorded in Book 4, of Miscellaneous Maps, at Page 6, Fresno County Records(Document No. 2011-0141951) have been determined to be perfected and conform to the provisions of Section §§66412(d) of the State Subdivision Map Act and Section 12-1204(c) of the Fresno Municipal Code. The resulting parcels of said Lot Line Adjustment shall each be considered the lots of record for purposes of a Final Map. 3. Comply with the provisions of the State of California Government Code Sections §66410 - §66499.58 of the SMA and Articles 10 (Subdivision of Real Property)and 12 (Parcel Maps) of Chapter 12 of the FMC. MITIGATION MONITORING AND IMPLEMENTATION REQUIREMENTS 4. Future development of the subject property shall be subject to implementation of all mitigation measures, fees, and timelines identified within the Initial Study prepared for Environmental Assessment (EA) No. TPM-2011-10 and dated December 23, 2011. • NOTE: The Initial Study prepared for EA No. TPM-2011-10 resulted in a Finding of Conformity to the 2025 Fresno General Plan Master Environmental Impact Report (IVIEIR) No. 10130 and Air Quality MND. Development of the subject property shall be subject to implementation of all applicable mitigation measures included within the MIEIR and Air Quality MND for subsequent projects; included herein by reference. Contact Israel Trejo, Planner III, in the City of Fresno Development and Resource Management Department at (559) 621-8044 or via email at Israel.Treio@fresno.gov for assignment of addresses to parcels proposed to be created from a subdivision of the subject property. • NOTE: It is recommended that at least 6 months prior to the first occupancy,the Developer shall contact the local United States Postal Service representative to complete a Mode of Delivery Agreement for New Construction. The Mode of Delivery Agreement must have a District approval signature to be valid. In addition to completing the Agreement, the Developer shall provide a final map (with address details)to the local USPS representative. The Developer shall, at their own expense, procure, construct and install all mail receptacle facilities for each location as specified and approved by the USPS. 6. Any existing and/or proposed structure(s)on the site maybe affected due to the location of the proposed parcel lines. The placement of a parcel line in close proximity to (or through) any existing and/or proposed structure(s) requires that the structure(s) be found in compliance with the fire resistive standards of the Uniformed Building Code, Chapter 5. a) Compliance with the prevailing Uniform Building Code as it relates to exterior wall protection, allowable area, etc. (as applicable to new parcel line locations) must be demonstrated prior to recordation of the Parcel Map. All existing offsite overhead utilities within the limits of the tentative parcel map, including but not limited to, electrical systems, communication systems and street lighting systems shall be placed underground in accordance with the provisions of Section 12-1011 and Resolution No. 78-522/88-229, and the policies of the Public Works Department. 8. When required, all work and engineered plans for public improvements shall conform to the 2002 Edition of the City of Fresno Standard Specifications and Drawings (City Council Resolution No. 70-36 and Resolution Nos. 84-361) and any amendments thereto, hereinafter referred to as the Public Works Standards. a) Engineered construction plans and estimates for all or part of the required work shall be required prior to the issuance of Street Work Permits unless otherwise determined by the City Engineer. The cost for such plan preparation, review and construction inspection shall be at the subdivider's expense. Conditions of Approval Vesting Tentative Parcel Map No. 2011-10 April 03, 2012 Page 4 9. The subdivider shall dedicate and construct public easements to facilitate the construction of public improvements (when applicable)within the limits of the parcel map. a) All such public easements shall be identified and dedicated with the processing and recordation of a Parcel Map. 10. Repair all existing damaged and/or off grade off-site concrete street improvements as determined by the City of Fresno Public Works Department, Construction Management Division, (559) 621-5600. 11. Any existing utilities, including but not limited to, street lights, traffic signals, fire hydrants, poles (power, telephone, cable, etc.), which must be relocated or removed in conjunction with the construction of off-site improvement requirements, shall be the responsibility and at the expense of the subdivider. 12. The subdivider may either construct or install required public improvements,when required; or, enter into a bonded secured agreement with the City of Fresno providing for the construction of the required improvements and sufficient security prior to the recordation of a Parcel Map (final). 13. Whenever covenants or agreements are required, they shall be prepared by the city upon receipt of the fee in accordance with the adopted Master Fee Schedule. All covenants and agreements must be approved by the City Attorney's Office and shall be recorded with the final parcel map. SPECIFIC CONDITIONS STREETS AND RIGHTS-OF-WAY 14. Comply with all of the requirements and conditions included within the attached Public Works Department, Traffic and Engineering Services Division memorandums(including the memorandum from the Assistant Traffic Engineering Manager respective to the Traffic Impact Study) dated March 13, 2012 and December 06, 2011, or any amendment or modifications to those requirements which may be granted by the Director of the Department of Public Works prior to recordation of a Parcel Map; except as may be included herein below: a) Proposed public street alignments and widths shall conform to Vesting Tentative Parcel Map No. 2011-10 dated March 01, 2012; as approved by Resolution of the City Council on March 29, 2012. 15. Pursuant to Section 12-1206(c)(5) of the FMC, the subdivider shall provide for the installation of street trees, or payments in lieu of immediate installation of street trees and payment of street tree fees applying to the subdivision or the division of land as designated in the Master Fee Schedule. Contact Hilary Kimber at(559) 621-1345 for further information. SANITARY SEWER SERVICE The nearest sanitary sewer main to serve the proposed project is an 8-inch main located in West Holland Avenue. Sanitary sewer facilities are available to provide service to the site subject to the following requirements: 16. Comply with all of the requirements included within the Department of Public Utilities, Planning and Engineering (Sanitary Sewer)memorandum dated October 18, 2011; or, any amendment or modifications to those requirements which may be granted by the Director of the Department of Public Utilities prior to recordation of a Parcel Map. WATER SERVICE The nearest existing water mains to serve the proposed project are a 12-inch main located in West Holland Avenue, a 12-inch main located in North Brawley Avenue, and an 8-inch main located in North Knoll Drive. The following water improvements shall be required priorto providing Citywater service to the project: 17. Comply with all of the requirements included within the Department of Public Utilities,Water Division memorandum dated December 29, 2011; or, any amendment or modifications to those requirements which may be granted by the Director of the Department of Public Utilities prior to recordation of a Parcel Map. FRESNO METROPOLITAN FLOOD CONTROL DISTRICT (FMFCD) 18. The subdivider shall be required to comply with all of the specific requirements imposed by the FNIFCD for the subdivision or any amendments or modifications to those requirements, which may be granted by the FMFCD Board of Directors, pursuant to Section 13-1307 of the FMC. These requirements are identified in the attached District's letter to the Planning and Development Department dated October 19, 2011. FIRE SERVICE Fire service is available to the proposed tract subject to the following requirements: 19. Comply with all of the requirements included within the attached Fresno Fire Department memorandum dated October 06, 2011. COUNTY OF FRESNO DEPARTMENT OF PUBLIC HEALTH 20. Comply with all of the requirements included within the attached County of Fresno Department of Public Health memorandum dated October 19, 2011. The fee indicated above is based on the tentative map. Please see the attached memorandum from the Fresno Metropolitan Flood Control District (FMFCD)for Further information regarding considerations which may affect the fee obligation(s)or the timing or form of fee payment. On July 22, 2008, the Fresno County Board of Supervisors passed Ordinance No. 2008—023 requiring the payment of County Public Impact Facilities Impact Fees. The effective date of this ordinance is September 20, 2008. Contact the County of Fresno, Public Works and Planning Department to determine payment of this fee obligation. Confirmation by the County of Fresno is required before the City of Fresno can issue building permits. (The requirement to pay this fee is currently suspended by Fresno County. However, payment of this fee may be required if the fee has been reinstated at the time of issuance of building permits on the subject property.) The Board of Directors of the Fresno County Regional Transportation Mitigation Fee Agency approved Resolution No. 2009—01 requiring the payment of Regional Transportation Mitigation Fee. The effective date of this resolution is January 1, 2010. Contact the Council of Fresno County Governments (FCOG) to determine this fee obligation. RECOMMENDATION Based on the independent review conducted by the Development and Resource Management Department and the Public Works Department, it is concluded that the proposed street alignments and widths are acceptable and can accommodate the development of the proposed vesting tentative parcel map subdivision for industrial land uses. It is, therefore, recommended that the City Council take the following action: 1. ADOPT RESOLUTION approving the proposed street alignments and widths for Vesting Tentative Parcel Map No. 2011-10 as shown on attached Exhibit "A" dated March 01, 2012. EXECUTIVE SUMMARY Don Pickett & Associates, Inc., has filed Vesting Tentative Parcel Map No. 2011-10 to subdivide approximately 37.96 net acres of property located on the east side of North Brawley Avenue between West Gettysburg and North Weber Avenues in order to facilitate the future development of a 63-lot industrial park. New public street alignments and widths, which will be dedicated to serve parcels proposed to be created from the subdivision of the subject property, require acceptance of the governing body (City Council) prior to approval of the tentative parcel map. Five new local industrial street segments utilizing a 60-foot wide right-of-way section are proposed within the boundaries of the map. All streets proposed for dedication will be required to be improved in accordance with Department of Public Works standards, specifications and policies to afford appropriate access to the industrial properties. The new street alignments and widths are supported by the Development and Resource Management Department and Public Works Department. In accordance with the land use and environmental policies and provisions of the 2025 Fresno General Plan, the related Master Environmental Impact Report (MEIR) No. 10130 (SCH # 2001071097), and Mitigated Negative Declaration (MND) No. A-09-02 (SCH # 2009051016), the subject property may be developed at an intensity and scale that is permitted by the Light Industrial planned land use designation for the subject site. Thus, the proposed subdivision and future development of the subject property in accordance with the planned land use designation for the subject property will not facilitate an additional intensification of uses beyond that which would be allowed by the above-noted planned land use designation and that which was analyzed in MEIR No. 10130. Moreover, it is not expected that future development will adversely impact existing city service systems or the traffic circulation system that serves the subject property and its surrounding area. These infrastructure findings have been verified by the Public Works and Public Utilities Departments. It has been further determined that all applicable mitigation measures of MEIR No. 10130 and MND No. A-09-02 have been applied to the project necessary to assure that the project will not cause significant adverse cumulative impacts, growth inducing impacts, and irreversible significant effects beyond those identified by MEIR No. 10130 and MND No. A-09-02 as provided by CEQA Section 15177(b)(3). Pursuant to Section 21157.1 of the California Public Resources Code (California Environmental Quality Act), it may be determined that a subsequent project, as identified in the MEIR pursuant to Section 21157(b)(2) of the Public Resources Code and CEQA Guidelines Section 15177, falls within the scope of a MEIR, provided that the project does not cause significant impacts on the environment that were not previously examined by the MEIR. Relative to the specific project proposal, the environmental impacts noted in the MEIR, pursuant to the 2025 Fresno General Plan land use designation, include impacts associated with the Light Industrial planned land use designation specified for the subject property and the surrounding area. Based on the initial study prepared, the following findings are made: (1) The proposed project was identified as a Subsequent Project in MEIR No. 10130 because its land use designation and permissible densities and intensities are set forth in Figure 1-1 of MEIR No. 10130; (2) The proposed project will not generate additional significant effects not previously identified and analyzed by the MEIR or MND No. A-09-02 (as indicated on the attached Environmental Assessment Checklist) for the reasons discussed within the initial study and environmental assessment prepared for the subject project; and, (3) No new additional mitigation measures are required because the proposed project will not generate additional significant effects not previously identified and analyzed by the MEIR or MND. Therefore, the project proposal has been determined to be within the scope of the MEIR and MND as defined by Section 15177 of the CEQA Guidelines and staff has properly published a Finding of Conformity to MEIR No. 10130 dated December 23, 2011, with no comments received to date. In addition, after conducting a review of the adequacy of the MEIR pursuant to Public Resources Code REPORT TO THE CITY COUNCIL Proposed Street Alignment and Width March 22, 2012 Page 4 Section 21157.6(b)(1), the Development and Resource Management Department, as lead agency, finds that no substantial changes have occurred with respect to the circumstances under which the MEIR was certified and the MND adopted; and, that no new information, which was not known and could not have been known at the time that the MEIR was certified as complete or the MND was adopted, has become available. BACKGROUND / ANALYSIS Pursuant to Section 66426(c) of the Subdivision Map Act and Section 12-1203 of the City of Fresno Parcel Map Ordinance, the governing body (City Council) must approve any proposed public street alignments for industrially zoned property prior to approval of a tentative parcel map proposing more than four parcels. Therefore, staff is requesting that the City Council approve the public street alignments and widths proposed in order to facilitate Development and Resource Management Department approval of the tentative parcel map. It should be noted that City Council approval will also be required prior to recordation of a final Parcel Map; resulting in the actual subdivision of land. It should also be noted that approval of the tentative parcel map does not approve development on the parcels proposed to be created. A master development plan for the entirety of the subdivision and/or site plans for individual properties within the boundaries of the subdivision will be required to be approved through submittal of entitlement and special permit applications to the Development and Resource Management Department prior to issuance of any building permits for the subject property The subject property is currently vacant and is located within an area which is designated exclusively for light industrial uses. Furthermore, surrounding properties within the immediate vicinity of the subject property have already been predominantly developed with industrial, manufacturing and/or warehouse uses. Properties to the north and east of the subject property comprise a similar industrial park, which was previously subdivided and developed for the same purposes as the proposed project. The street alignments and widths proposed for the subject property will provide interconnectivity between both the existing and proposed industrial park subdivisions. The entirety of the subject property (as well as the existing adjacent industrial park subdivision to the north and east of the subject property) is currently zoned M-3 (Heavy Industrial District) but is planned for Light Industrial land uses by the 2025 Fresno General Plan and Bullard Community Plan. However, pursuant to Section 12-403-B-2-b(2) of the Fresno Municipal Code (FMC), a non-residential zone district, which does not meet the criteria of the Planned Land Use and Zone District Consistency Matrix of Section 12-403-13-1 of the FMC and Table 2 of the 2025 Fresno General Plan, may be found consistent with the land use designation of the subject site only upon the condition that the development and use of the subject site is restricted to uses permitted by a Consistent Zone District as identified within the consistency matrices of the FMC and 2025 Fresno General Plan. For this purpose, the City of Fresno will require that the property owner/subdivider enter into a covenant restricting Future use of the subject property to those uses permitted within the M-1 (Light Manufacturing) zone district. Recordation of the covenant will be made a condil:ion of approval of the tentative parcel map and will be required to be signed and recorded prior to recordation of a Parcel Map (final) to ultimately subdivide the subject property. CONCLUSION / RECOMMENDATION The appropriateness of the proposed project has been examined with respect to its consistency with the goals and policies of the 2025 Fresno General Plan and the Bullard Community Plan; its compatibility with surrounding existing or proposed uses; and, its avoidance or mitigation of potentially significant adverse environmental impacts. These factors have been evaluated as described above and by the accompanying environmental assessment. Upon consideration of this evaluation, it can be concluded that the acceptance and future dedication of the public streets alignments and widths proposed with Vesting Tentative Parcel Map No. 2011-10 and as represented in the attached Exhibit "A" dated March 01, 2012 are similarly appropriate for the project site. The site is located near the southeast corner of the intersection of Brawley and Gettysburg Avenues, approximately '/4 mile northeast the of State Route (SR) 99 interchange at Ashlan Avenue. Caltrans has the following comments: Given the nature of the proposed development and its proximity to SR 99, it is projected that trips generated by this site would impact the SR 99 interchange at Ashlan Avenue. Previous traffic studies have identified the need to accommodate projected future demand for: • An additional ramp-lane at the SR 99 northbound exit-ramp to Ashlan Avenue. • An additional ramp-lane at the SR 99 southbound exit-ramp to Ashlan Avenue. • Widen the Ashlan overcrossing in order to accommodate an additional eastbound to northbound left-turn lane. Table III (proposed Project Trip Generation) appears to be satisfactory; however, the study lucks a map detailing the projected trip distribution to and from the project site. Figure 4 (Project Only Trip Assignment) only shows the resulting movements at the studied intersections, but there is no way to trace these trips back to the project site in order to get a feel for the trip distribution that was used. Intersection 1 on Figure 4 does not show any projected trips coming off of the SR 99 southbound exit ramp to Ashlan Avenue. Considering the project site's proximity to the Ashlan interchange, there is an expectation of some impact to this exit ramp. The project site will be comprised of approximately 61 parcels ranging in size from 5,000 to 24,000 square feet. GENERAL COMMENTS and CONDITIONS 1. Trip generation based on the Institute of Transportation Engineers (ITE) Trip Generation Manual is acceptable for the General Light Industrial use (ITE code 110). The proposed project will generate 3,217 average daily trips (ADT), 425 trips during the AM peak hour and 448 trips during the PM peak hour. 2. This project shall pay its Traffic Signal Mitigation Impact (TSMI) Fee of $47.12 per ADT, per the Master Fee Schedule, at the time of building permit. Based on the reported AD7(ITE Code 110)for the proposed project, the fee would be $151,585.04 payable at time of building permit. The TSMI fee facilitates project impact mitigation to the City of Fresno Traffic Signal infrastructure so that costs are applied to each new project/building based on the generated ADT. The TSMI fee is credited against traffic signal installation/modifications and/or Intelligent Transportation System (ITS) improvements (constructed at their ultimate location) that plan to build out the 2025 General Plan circulation element and are included in the Nexus Study for the TSMI fee. The TSMI fee is regularly updated as new traffic signals are added, new grant funds offsets developer improvement costs, and/or construction costs increase/decrease. If the project is conditioned with traffic signal improvements in excess of their TSMI fee amount, the applicant may apply for fee credits (security/bonding and/or developer agreement required) and/or reimbursement for work in excess of their fee as long as the infrastructure is in place at the ultimate location. The applicant should work with the Public Works Department and identify, with a Professional Engineer's estimate, the costs associated with the improvements prior to paying the TSMI fee to determine any applicable fee credits and/or reimbursements. Project specific impacts that are not consistent with the 2025 General Plan, Public Works Standards, and/or are not incorporated into the TSMI fees are not eligible for TSMI fee reimbursement unless the City Engineer and City Traffic Engineer include the new traffic signal and/or ITS infrastructure in the next TSMI fee update and the applicant agrees to pay the new TSMI fee that includes the new infrastructure. Failure to pay this fee or construct improvements that are credited/reimbursable with this fee will result in a significant unmitigated impact as this fee is applied to all projects within the City Sphere of Influence. 3. This project shall pay its Fresno Major Street Impact (FMSI) Fee, which will be determined at time of building permit. This FMSI fee is creditable towards major street roadway imp•ovements included in the nexus study for the FMSI fee. 4. The project shall pay the Regional Transportation Mitigation Fee (RTMF). The southbound approach will then have one (1) through lane and one (1) left-turn lane. 7. The project will evaluate the intersection of Marty Avenue /Weber Avenue for the installation of an all-way stop-control at approximately 50 percent of the project build-out. 8. However, in accordance with the District's Drainage Fee Ordinance, Section 4.103.0(b), for divisions which at the time of approval are zoned for industrial use, and for all other divisions which do not require a final map, the total fee due is the minimum fee required for dedicated and improved streets and alleys, and developed parcels associated with the division, all remaining areas are being deferred. The applicable final fee shall be that most recently established by the Board of Directors prior to approval of the final subdivision map, or map evidencing the creation of parcels. The deferred portion of the drainage fee shall be paid upon development of each individual parcel and the applicable fee shall be that most recently established by the Board of Directors prior to issuance of a development permit. Reimbursement provisions, in accordance with the Drainage Fee Ordinance, will be included to the extent that developer's Master Plan costs for an individual drainage area exceed the fee of said area. Should the facilities cost for such individual area total less than the fee of said area, the difference shall be paid upon demand to the City/County or District. There is an existing twenty-foot (20') wide storm drain easement along the northeastern property line as shown on the attached sketch. A fifteen-foot (15') wide storm drain easement will be required whenever storm drain facilities are located on private property. No encroachments into either the existing or proposed easement shall be permitted including, but not limited to, foundations, roof overhangs, swimming pools, and trees. Any minor encroachments into the easement must be reviewed and approved by the District. The following paragraphs only apply towards development of the individual parcels and are not conditions for the recording of the map. In an effort to improve storm runoff quality, outdoor storage areas shall be constructed and maintained such that material that may generate contaminants will be prevented from contact with rainfall and runoff and thereby prevent the conveyance of contaminants in runoff into the storm drain system. The District encourages, but does not require that roof drains from non-residential development be constructed such that they are directed onto and through a landscaped grassy swale area to filter out pollutants from roof runoff. Runoff from areas where industrial activities, product, or merchandise come into contact with and may contaminate storm water must be directed through landscaped areas or otherwise treated before discharging it off-site or into a storm drain. Roofs covering such areas are recommended. Cleaning of such areas by sweeping instead of washing is to be required unless such wash water can be directed to the sanitary sewer system. Storm drains receiving untreated runoff from such areas that directly connect to the District's system will not be permitted. Loading docks, depressed areas, and areas servicing or fueling vehicles are specifically subject to these requirements.
