SUBJECT: NOTICE OF APPROVAL OF TENTATIVE PARCEL MAP NO. 2011-01 DATED
JANUARY 25, 2011, PROPOSING A 3-LOT PARCEL MAP FOR PROPERTY
LOCATED ON THE SOUTHWEST CORNER OF THE INTERSECTION OF EAST
HERNDON AND NORTH MAPLE AVENUES.

The City of Fresno Development Services Division has completed its review of the subject parcel
map dated January 25, 2011. Pursuant to Section 12-1205 of the Fresno Municipal Code,this letter
is written to advise you that the Conditions of Approval dated April 08, 2011, are as noted on the
attached document.
Appeal: The divider or any aggrieved person may file an appeal regarding to conditions of approval
within fifteen (15) days from the date of approval.
To protest the Director's decision regarding the conditions of approval, you must appeal by filing a
written appeal with the Director of the Development and Resource Management Department.
Appeals must include the appellant's interest in/or relationship to the subject property, the decision
or action appealed, and specific reasons why the appellant believes the decision or action appealed
should not be upheld.
Appeals must be submitted to the Director of the Development and Resource Management
Department prior to 5 p.m. on April 26, 2011.
EXPIRATION: The approval or conditional approval of this tentative Parcel Map expires two years
from the date of approval. The expiration shall terminate all proceedings and a final Parcel Map
may not be filed without first processing a new Tentative Parcel Map.
Modification of a Tentative Parcel Map after approval or conditional approval does not extend the
two year time limit.
EXTENSION: The divider may request a up to a two year extension of the tentative map expiration
date by filing a written application together with the fee set forth in the Master Fee Schedule at the
time of the request with the Director of the Development and Resource Management Department
prior to the expiration date of the map. The applicant must state the reasons for requesting the
extension. New conditions may be imposed if an extension is granted.
Cumulative discretionary extensions may not exceed an aggregate of six years.

My name is Craig Green and I am the chairman of the Property Division Committee for the
Califomia/Nevada Church of God and authorized to conduct all business before the city pertaining to the

After receiving our notice of approval of the tentative parcel map NO. 2011-01, APN[S] 410-020-59, we
filed a letter of appeal in order to retain our right to appeal until we had sufficient time to review and
understand the conditions of approval. After reviewing the conditions and talking with the appropriate

Dear Director Dugan,
My name is Craig Green and I am the chairman of the Property Division Committee for the
California/Nevada Church of God and authorized to conduct all business before the city pertaining to the
division of the property located at 6901 North Maple.
I wanted to take a moment and express our considerable appreciation for all of the staff that we have
worked with there at the city.They have been friendly,knowledgeable, forthcoming with information and
suggestions and a pleasure to work with. Those we have had the most contact with are Will Tackett,
Frank Saburit and Mike Schmidt and without exception they have gone out of their way to help facilitate
the process of dividing our property.
We have just received our notice of approval of the tentative parcel map NO. 2011-01, APN[S] 410-020-
59. We are concerned because the window of appeal is very small and we have not had the time to work
through all of the requirements. This letter is being written in order to reserve our right to appeal.
The areas of concern are, but not limited to, the following:
$ Under General Conditions item 13. Our concern here is what exactly is being required
and to what extent.
$ Under Specific Conditions item 20. We have not had sufficient time to contact the right
persons and determine again the extent of what is being asked of us.
$ Under Development Fees and Charges there are numerous fees that we would like to
discuss and perhaps defer if that is possible.
$ Under City Wide Development Impact Fees item V. If the charge is $47.12 we have no
concerns but if this is a multiplier for square footage then yes we have a concern. We
simply need more time to verify and find answers.
$ We are concerned about the Traffic Signal Mitigation Impact fee,the Fresno Major Street
Impact Fees and the Regional Transportation Mitigation fees because we don't know the
cost of these items and whether or not those cost would make the future of this
development prohibitive. The main issue is that we need more time to get answers.
Therefore,we are formally asking to retain the right of appeal for these and other matters. Please feel free

The Department of Public Works offers the following comments regarding TPM 2011-01,
6799 North Maple Avenue located on the southwest corner of East Herndon and North
Maple Avenues:
GENERAL REQUIREMENTS
1. Public Works requires one approved street tree per 60 lineal feet of street
frontage. This parcel is being divided into three Parcels and one Remainder. The three
parcels have existing sidewalks. Traffic Engineering is requiring the addition of sidewalk
on the Remainder Parcel which is approximately 400 lineal feet long resulting in the
requirement of six (6) street trees.
2. There is no specified street tree for this pod-ion of N. Maple Ave. Please choose
an appropriate tree species From the attached list of street trees to plant in the parks-trip
between the curb & gutter and sidewalk.
3. Public Works requires a landscape and irrigation plan to be submitted at the scale
of 1"=20' prior to -the installation of landscaping within the right-of-way.

SOUTHWEST CORNER OF THE INTERSECTION OF EAST HERNDON AND NORTH MAPLE
AVENUES
NOTICE TO PROJECT APPLICANT
All tentative maps are subject to the applicable provisions of the State Subdivision Map Act(SMA),
Fresno Municipal Code (FMC), City policies, and City of Fresno Standard Specifications. The
following specific conditions are applicable to this tentative map.
In accordance with the provisions of Government Code §66020(d)(1), the imposition of fees,
dedications, reservations or exactions for this project are subject to protest by the project applicant
at the time of approval or conditional approval of the development or within 90 days after the date of
the imposition of the fees, dedications, reservations or exactions imposed on the development
project.
Upon conditional approval of Tentative Parcel Map No. 2011-01, dated January 25, 2011, the
subdivider may prepare a Parcel Map(Final)in accordance with the approved tentative parcel map.
Note that a Parcel Map may not be filed until the appeal period has expired. Should an appeal be
filed pursuant to Section 12-1207 of the FMC, the application will be scheduled to be heard before
the City of Fresno Planning Commission. The appellant may withdraw their appeal pursuant to
Section 12-1207.2 of the FMC.
Concurrent with the filing of a Parcel Map and when the provisions of Section §66436 of the SMA
apply, the subdivider is responsible to send, by certified mail, a sketch of the proposed Parcel Map,
together with a copy of Section§66436(a)(3)(A)of the SMA,to any public entity or public utilitywhich
has previously acquired a right-of-way easement.
PLAN CONSISTENCY
1. The Hoover Community Plan and 2025 Fresno General Plan designate the subject property
for development with uses consistent with the public facility/college planned land use. Table
2 of the 2025 Fresno General Plan, the "Planned Land Use and Zone District Consistency
Matrix," identifies the existing R-1-AH (Single Family Residential(Horses])zone district as
consistent with the Public Facilities/College Planned land use as the existing use of the
subject property is for the West Coast Bible College; and, parochial schools are a use
permitted subject to a conditional use permit and the provisions of Section 12-403 of the
FMC.
• NOTE: Section 12-403 of the Fresno Municipal Code stipulates that all zone
districts may be found consistent with the Public Facilities planned land use

designation, unless specifically prohibited; and, subject to the provisions of
Section 12-403 of the FMC and a conditional use permit. As the existing use of
the subject property is determined to be a quasi-public use consistent with the
Public Facilities/College planned land use designation for the subject property,
consistency may be determined for purposes of recordation of a subdivision
map. However, it shall hereby be acknowledged that expansion,changes and/or
alteration of/to the existing use of the subject property may require and be
subject to further review and approval or entitlement processes through the
Development and Resource Management Department prior to operation.
ZONING
2. Comply with the provisions of the State of California Government Code Sections §66410 -
§66499.58 of the SMA and the City FMC Chapter 12, Article 10 (Subdivision of Real
Property).
3. A certificate of compliance (or conditional certificate of compliance) pursuant to Section
66499.35 of the Subdivision Map Act shall be required to be obtained for the proposed
Remainder parcel prior to sale, lease, or Financing; and/or, prior to obtaining a permit or
other grant of approval for development of the Remainder parcel.
4. The subject property has been developed as an integrated site with common access,
utilities, facilities, and improvements, which will traverse proposed property lines and/or be
required to be shared in order to facilitate the proposed subdivision of the subject property.
a) Execute a Mutual Easements and Reciprocal Use Agreement between Parcels "A"
through "C", inclusive, of Tentative Parcel Map No. 2011-01 dated January 25, 2011.
The Mutual Easements and Reciprocal Use Agreement shall,at a minimum, provide: (1)
Mutual and reciprocal access to North Maple Avenue ; (2) Shared parking; (3) Cross
drainage; (4) Shared solid waste facilities (if applicable); and, (5) Provisions and
obligations for retention and maintenance of access, utilities,fire suppression systems,
facilities and improvements on the subject property.
i) Access, circulation, and parking on all of the properties to be included within, and
made party to, the cross-access agreement shall be provided and maintained in
accordance with approved entitlements for the respective properties; or, any
revisions or amendments thereto, as may be approved by the Development and
Resource Management Department. No modifications to said access or circulation
may be made without prior approval From the Development and Resource
Management Department.
• NOTE: The conditions of the Mutual Easements and Reciprocal Use Covenant
are intended to benefit the public and public properties as well as properties
appurtenant; and, secure the enforceability of properties'obligations for retention
and maintenance of access, utilities, facilities, and improvements. Failure to
comply with the terms of the Covenant may result in the revocation of the
Certificate of Occupancy of Special Permit by the City for use of any Parcel of

the properties involved. Accordingly, the City of Fresno shall have the right to
enforce this Statement by any legal or equitable means. For further information
regarding these requirement Contact the Development and Resource
Management Department at (559) 621-8277.
ii) Final, executed and notarized documents shall be recorded with the parcel map.
iii) All of the agreements required to be executed within this section shall run with the
land and bind all successors and assigns.
• NOTE: Any amendment to the above provisions or any other provision
specifying any right of the City shall require the prior written consent of the City.
GENERAL CONDITIONS
5. Any existing and/or proposed structure(s)on the site may be affected due to the location of
the proposed parcel lines. The placement of a parcel line in close proximity to any existing
and/or proposed structure(s) requires that the structure(s) be found in compliance with the
fire resistive standards of the Uniformed Building Code, Chapter 5.
a) Compliance with the prevailing Uniform Building Code as it relates to exterior wall
protection, allowable area, etc. (as applicable to new parcel line locations) must be
demonstrated prior to recordation of the Parcel Map. Contact the Development and
Resource Management Department, Building and Safety Services Division at(559)621-
8200.
• NOTE: In the event the structures do not comply they must be modified so as to
meet the requirement.
6. All existing offsite overhead utilities within the limits of the tentative parcel map, including but
not limited to, electrical systems, communication systems and street lighting systems shall
be placed underground in accordance with the provisions of Section 12-1011 and Resolution
No. 78-522/88-229, and the policies of the Public Works Department.
7. All work and engineered plans for public improvements shall conform to the 2002 Edition of
the City of Fresno Standard Specifications and Drawings(City Council Resolution No. 70-36
and Resolution Nos. 84-361) and any amendments thereto, hereinafter referred to as the
Public Works Standards.
8. All off-site and public improvements shall be constructed in accordance with the Public
Works Department Standards, Specifications and Policies. Engineered construction plans
and estimates for all or part of the required work shall be required prior to the issuance of
Street Work Permits unless otherwise determined by the City Engineer. The cost for such
plan preparation, review and construction inspection shall be at the subdivider's expense.
9. The subdivider shall dedicate and construct public easements to facilitate the construction of
curbs, gutters, sidewalks with street tree wells and irrigation systems (when applicable),

permanent pavement, street/safety lighting, bus bays, right turn lanes, bike lanes, bike
paths, multi-purpose trail,wheelchair ramps and public utilities in accordance with City plans,
ordinances, resolutions and policies, and the Standard Specifications of the Public Works
Department within the limits of the parcel map.
• NOTE: Telephone, cable, and other public utilities which propose above-ground
facilities (such as cabinets) determined by the Development and Resource
Management Department Director to be oversized shall be located in an
additional easement area outside of the required landscape strip.
a) All such public easements shall be identified and dedicated with the processing and
recordation of the Final Parcel Map and/or at the time of Special Permit review for the
proposed development of the parcel(s).
10. A minimum four foot wide clear path of travel is required along all street frontages of the
property as required by Title 24 of the California Administration Code, current ADA
regulations; and, as determined by the City Engineer.
• NOTE: An on-site pedestrian easement and construction of a path may be
required if Title 24 and ADA provisions cannot be met within-the public rights-of-
way.
a) Sidewalks (including wheelchair ramp landings) and driveway approaches, for
undeveloped parcels of this parcel map, shall be required and constructed at the time of
site development.
b) Any existing sidewalks in excess of 2%maximum slope must be brought into compliance
prior to acceptance by Public Works.
c) Curb ramps with "Detectable Warning Devices" are required at all corners within the
limits of this parcel map.
11. Repair all existing damaged and/or off grade off-site concrete street improvements as
determined by the City of Fresno Public Works Department, Construction Management
Division, (559)621-5600.
12. Existing driveway approaches not identified for current or future utilization shall be removed
and sidewalk (when applicable), curb and gutter shall be installed to match existing or
proposed street line and grade as deterrnined by the City Engineer.
• NOTE: There are no existing driveway approaches on the subject property,
which are required to be removed with the Parcel Map.
13. When street/safety lighting installations are required, street lighting plans shall be submitted
for review and approval by the Traffic Engineer prior to the issuance of permits for the work.
Services to street lighting installations shall be separated From the electrical service(s)
serving the development. The type, location and service for street lighting installations shall

be as determined by the Traffic Engineer. Street lighting installations shall be dedicated to
the City upon completion and acceptance of the installations.
14. If not existing, street work on major streets shall be designed to include Intelligent
Transportation Systems (ITS) conduit in accordance with the Public Works ITS
specifications.
15. All required signing and striping shall be installed and paid for by the developer/owner. The
signing and striping plans shall comply with the current Caltrans standards and shall be
submitted to the Public Works Department for review and approval as a part of the street
improvement plans for this tentative map.
16. Any existing utilities, including but not limited to, street lights, traffic signals, fire hydrants,
poles (power, telephone, cable, etc.), which must be relocated or removed in conjunction
with the construction of off-site improvement requirements, shall be the responsibility and at
the expense of the subdivider.
17. The subdivider may either construct or install required public improvements,when required;
or, enter into a bonded secured agreement with the City of Fresno providing for the
construction of the required improvements and sufficient security priorto the recordation of a
Parcel Map (final).
18. Whenever covenants or agreements are required, they shall be prepared by the city upon
receipt of the fee in accordance with the adopted Master Fee Schedule. All covenants and
agreements must be approved by the City Attorney's Office and shall be recorded with the
final parcel map.
SPECIFIC CONDITIONS
STREETS AND RIGHTS-OF-WAY
19. Comply with all of the requirements and conditions stipulated within the attached Public
Works Department, Traffic and Engineering Services Division memorandum dated March
03, 2011.
20. Pursuant to Section 12-1206(c)(5) of the FMC, the subdivider shall provide for the
installation of street trees, or payments in lieu of immediate installation of street trees and
payment of street tree fees applying to the subdivision or the division of land as designated
in the Master Fee Schedule. Contact the Parks Supervisor, Hilary Kimber at(559)621-1345
for further information.

SANITARY SEWER SERVICE
The nearest sanitary sewer main to serve the proposed project is a 10-inch main located in North
Maple Avenue. Sanitary sewer facilities are available to provide service to the site subject to the
following requirements:
21. Comply with all of the requirements of the Department of Public Utilities, Planning and
Engineering memorandum dated January 12, 2011.
WATER SERVICE
The nearest water main to serve the proposed project is a 12-inch main located in North Maple
Avenue. The following water improvements shall be required prior to providing City water service to
the project:
22. Comply with all of the requirements of the Department of Public Utilities, Water Division
memorandum dated February 16, 2011.
FRESNO METROPOLITAN FLOOD CONTROL DISTRICT (FMFCD)
23. The subdivider shall be required to comply with all of the specific requirements imposed by
the FMFCD for the subdivision or any amendments or modifications to those requirements,
which may be granted by the FMFCD Board of Directors, pursuant to Section 13-1307 of the
FMC. These requirements are identified in the attached District's letter to the Planning and
Development Department dated February 15, 2011.
CITY OF FRESNO FIRE DEPARTMENT
24. Comply with all of the requirements stipulated within the attached memorandum from the
City of Fresno Fire Department dated February 08, 2011.
FRESNO IRRIGATION DISTRICT
25. Comply with all of the requirements stipulated within the attached memorandum from the
Fresno Irrigation District dated March 01, 2011.

Notes:
On July 22, 2008, the Fresno County Board of Supervisors passed Ordinance No. 2008—023 requiring the
payment of County Public Impact Facilities Impact Fees. The effective date of this ordinance is September
20,2008. Contact the County of Fresno, Public Works and Planning Department to determine payment of this
fee obligation. Confirmation by the County of Fresno is required before the City of Fresno can issue building
permits.
The Board of Directors of the Fresno County Regional Transportation Mitigation Fee Agency approved
Resolution No.2009—01 requiring the payment of Regional Transportation Mitigation Fee. The effective date
of this resolution is January 1, 2010. Contact the Council of Fresno County Governments (FCOG) to

General Conditions
• Subrnittal of engineered construction plans to the Planning and Development Department for
approval must be made prior to the final map.
• All required signing and striping shall be installed and paid for by the developer/owner. The
signing and striping plans shall corrlply with the current Caltrans standards and be submitted as
a part of the street improvement plans.
• Additional offsite improvements will be required at the time of future site plan review.
• Curb ramps with "Detectable Warning Devices" are required at all corners within the limits of this
parcel map.
• Repair all damaged and/or off grade off-site concrete street improvements as determined by the
City of Fresno Public Works Department, Construction Management Division, (559) 621-5600.
Pedestrian paths of travel must also meet current ADA regulations. All existing sidewalks in
excess of 2% maximum cross slope must be brought into compliancerp for to acceptance by
Public Works.
• Underground all existing offsite overhead utilities with the limits of this map in accordance with

Street Dedications

Sorry, this is a bit lengthy but summarizes the landscape requirements found in Chapter 12 of
the FMC in this regard.
The Parcel Map ordinance improvement requirements (Section 12-1206 of FMC) provides that the
following improvements or payments in lieu of immediate installation of improvements and fees
shall be accomplished or paid by the subdivider:
(5) Provision of street trees, whose location and species shall be approved by the Parks and
Recreation Director. The subdivider shall pay the street tree fees applying to subdivision
or the division of land, as designated in the Master Fee Resolution.
(This is a little bit different than the Subdivision Ordinance [applicable to tract maps]
which requires, "the planting of street trees in planting strips and landscaping in frontage
road islands and in all required landscape areas, as approved by the Parks and Recreation
Director of the City.")
The Parcel Map ordinance is silent w/ respect to median island improvements.
The zoning ordinance addresses landscaping within median islands in Section 12-306-N-24,
where it stipulates that, at the time of development or major modification in an office,
commercial or industrial district which has frontage or a boundary adjacent to a major
street, or which has a boundary or local street that is also the boundary of property zoned
or planned for residential use, the property owner or developer shall provide and maintain a
landscaped area along the frontage or boundary adjacent to the major street, or along and
parallel to the major or local street that is the boundary of the property zoned or planned
for residential use...; and,

In addition to the above-de§rrlibed landscaped area, the proper owner or developer shall
provide landscaping and an irrigation system in any median island or frontage road median :in
and parallel with the major street frontage of the office, commercial or industrial district,
or in and parallel with the major or local street that is a boundary between the office,
commercial or industrial district and any property zoned or planned for residential use. The
median landscaping and irrigation system shall be installed according to standards
established by the Parks and Recreation Director from time to time. At the discretion of the
Director, the owner or developer may pay a median landscaping fee in the amount designated :in
the Master Fee Resolution in lieu of providing the median landscaping and irrigation system,
if existing median island landscaping is less than twenty-five percent of the total area
available for landscaping, or the proposed development is subject to Urban Growth Management
fees for landscaping and irrigation, or a landscaping and maintenance district has been
established to provide the landscaping and irrigation.
For purposes of this paragraph (j), a major modification shall mean any of the following:
(1)
Addition of a new building or structure;
(2)
An addition to an existing building or structure when the floor area of such addition exceeds
fifty percent of the floor area of the existing building or structure, or two thousand five
hundred square feet, whichever is less;
(3)
Expansion of an existing land use without structures by more than twenty-five percent; or
(4)
Change of use of an existing building requiring a change of occupancy permit.
Finally, if memory serves correctly, it has not been typical practice to require annexation
to CFD as a condition of approval of a Parcel Map, but I don't know that to do so is
prohibited.
Again, all of this just speaks to the provisions and requirements of Chapter 12, so I'm not
sure what other policies or ordinances may apply to DPW requirements in this regard.

The following paragraphs only apply towards development of the individual parcels and are not
conditions for the recording of the map.
In an effort to improve storm water runoff quality, outdoor storage areas shall be
constructed and maintained such that material which generates contaminants will
not be conveyed by runoff into the storm drain system.
The District encourages, but does not require that roof drains from non-residential
development be constructed such that they are directed onto and through a
landscaped grassy swale area to filter out pollutants from roof runoff.
Runoff from areas where industrial activities, product, or merchandise come into
contact with and may contaminate storm water must be directed through
landscaped areas or otherwise treated before discharging it off-site or into a storm
drain. Roofs covering such areas are recommended. Cleaning of such areas by
:sweeping instead of washing is to be required unless such wash water can be
directed to the sanitary sewer system. Storm drains receiving untreated runoff
from such areas that directly connect to the District's system will not be permitted.
Loading docks, depressed areas, and areas servicing or fueling vehicles are
specifically subject to these requirements. The District's policy governing said
industrial site NPDES program requirements are available. Contract the District's

The Fresno Irrigation District (FID) has reviewed the Tentative Parcel Map No. 2011-01
application pertaining to approximately 20.81 acres of property located southwest of Herndon
and Maple Avenues, APN: 410-020-59, and has the following comments and conditions:
1. FID's Helm Canal, consisting of a 48-inch pipeline, runs westerly, approximately five feet
south of the subject property, as shown on the attached map entitled "FID exhibit map".
2. FI D's right-of-way/easement for this canal is 60-feet wide as shown on adjacent property
Tract Map No. 2521 to the west and Tract Map No. 2412 to the east. See the attached
map entitled "FID right-of-way map" as reference. Most of this right-of-way is a recorded
easement per the Tract Maps for the adjacent properties. However, FID does not have
a recorded easement across the subject property.
3. FID is now requiring the applicant to grant an exclusive 30-foot wide pipeline easement
to FID across the subject property in accordance with FID standards, and that the
applicant enters into an agreement with FID for that purpose. This will allow FID's total
easement to be a consistent 60-foot width as with the adjacent properties to the east and
west.
4. The pipeline was installed in 1982 (28 years ago)as 48-inch inside diameter cast-in-
place monolithic concrete pipe (CIP-MCP). CIP-MCP is a non-reinforced pipe that is
easily damaged, extremely prone to leakage and does not meet FID's minimum
standards for developed (residential, industrial, commercial) parcels or urban areas.
However, because the pipeline is south of the subject property, FID will not require the
pipeline to be upgraded to meet FID's urban standards.

5. For informational purposes; FID's Teague Canal No. 119 pipeline crosses Herndon
Avenue near the northwest corner of the subject property as shown on the attached map
entitled "FID exhibit map". Should any street improvements be required along Herndon
Avenue and in the vicinity of the pipeline crossing, FID requires it review and approval of
all plans.
6. For informational purposes, an abandoned lateral of FID's Teague Canal No. 493
pipeline traverses along the south side of Herndon Avenue as shown on the attached
map entitled"FID exhibit map". This section of pipeline has been abandoned and is no
longer in use. However, the pipeline may still remain and should any improvements be
necessary for Herndon Avenue and in the vicinity of the pipeline, FID recommends the
applicant contact the City of Fresno to discuss the pipeline and the City my consider
having the pipeline removed and plugged.
7. FID requires its easement/property be shown on the final map with proper recording
information. FID must also be made party to signing the final map.
8. FID requires the Developer to submit for FID's approval a grading and drainage plan
which shows that the proposed development will not endanger the structural integrity of
the pipeline, or result in drainage patterns that could adversely affect FID.
9. FID requires its review and approval of all improvement plans which affect its
property/easements and canal/pipeline facilities including but not limited to Sewer,
Water, Fresno Metropolitan Flood Control District (FMFCD), Street, Landscaping, Dry
Utilities, and all other utilities.
10. FID does not allow FID owned property or easements to be in common use with public
utility easements but will in certain instances allow its property to be in common use with
landscape easements if the City of Clovis enters into the appropriate agreement with
FID.

Any urban residential development occurring as a result of project approval will have an impact on the District's
student housing capacity The District, through local funding, is in a position to mitigate its shortage of classrooms
to accommodate planned population growth for the foreseeable future. However, the District recognizes that the
legislature, as a matter of law,has deemed, under Government Code Section 65996,that all school facilities impacts
are mitigated as a consequence of SB 50's Level 1,2 and 3 developer fee legislative provisions.
Any new development on the subject property or conversion of non-habitable to habitable space is subject to
development fees of$2.97 per square foot for residential and $0.47 per square foot for commercial development.
Any new development on the property will be subject to the development fee prior to issuance of a building permit.

SEC. 12-403.-ZONE DISTRICT; AMENDMENT PROCEDURE.
This section shall govern the procedure for the enactment of an ordinance changing the zone district of
property.
A. INITIATION. Proceedings for changing the zone district of property may be initiated only pursuant to
Subsections 12_401-A-1 (Council resolution), 12-401.-A-2 (Commission resolution),or 12-401-A-4(application).
B. DETERMINATION OF CONSISTENCY. Upon the initiation of a zone district amendment,the
Director, based upon such information as may be available,shall determine if the proposed zone district is
consistent with the land use, density, intensity, objectives, policies, and programs specified in the General Plan
or an applicable community, specific or redevelopment plan when such zone district is consistent with the
corresponding land use designation as prescribed in the Zone District Consistency Table set forth in
Subsection__1.2-403-13-1, or if the planned land use consistency criteria set forth in Subsection 12-403-B-2 are
met.An amendment affecting lands subject to specific plan standards adopted in ;the area of a public use
airport, shall be referred to the Airport Land Use Commission for Determination of Consistency.
Exceptions:The Central Area Community Plan and certain specific and redevelopment plans
contain Zone District Consistency Tables particular to their own plan area that supersede this section.
Refer to those plans to determine the appropriate the consistency for properties located within the
boundaries of those certain plans.

2. Planned Land Use Consistency Criteria.A proposed change of zone district that does not meet
the criteria of the Zone District Consistency Table above, may be determined consistent with the
corresponding land use designated by the General Plan or an applicable community,specific, or
redevelopment plan except for the Exceptions noted in_Secbon 12-403-B above,subject to the following
conditions:
a. Upon initiation of a zone district amendment, a development plan (as defined in Section
12-105-D-7.1) shall be submitted except for the following projects.
(1) For a zone district change proposing a single family development that is not a
planned development, a subdivision map depicting the proposed lots shall be submitted in
lieu of a development plan.
(2) For a zone district change proposing a nonclustered planned development, a
development plan shall be submitted, however the landscape plan will not be required at
the time of initiation.
b. The following criteria shall be met so that the proposed zone district and related use
shall not adversely affect surrounding properties.
(1) For residential uses,the maximum density of the plan designation for the site
shall not be exceeded. In cases where a requested zone district has a density lower than
the plan designation of the subject site, said site shall be developed with a density not less
than the minimum density of the next lowest land use designation.This provision shall be
repealed as of October 24,2007.
Editor's note—Ord.No.20(16-154,§121,effective Oclober 24,2007,directs that subsection(1),above,be repealed,and the following
sutsection(2)and(3)be renumbered to subsection(1)and(2).
(2) For non-residential uses,when a requested zone district does not meet the
criteria of Subsection.1_2-403-13-1 above, it can be found consistent with the land use
designation of the subject site only upon the condition that the subject site is restricted to
uses permitted by a Consistent Zone District as identified in Subsection 12-403-13-1 above.
(3) In addition to the above referenced conditions, development of the project site
shall be in substantial accordance, as determined by the Director,with the development
plan required above.
