(APN: 402-220-37, 60 &61) The City of Fresno Development Services Division has completed its review of revisions to the subject vesting tentative parcel map conditions of approval. Pursuant to Section 12-1205(d)(1)of the Fresno Municipal Code, this letter is written to advise you that the Director of the Development and Resource Management Department, in consultation with the City Engineer, has approved the proposed minor revisions as noted within the Revised Conditions of Approval for Vesting Tentative Parcel Map No. 2010-07 dated March 23, 2015;these changes have been deemed to be limited to changes which do not substantially alter the street pattern, lot configuration or overall design scheme The approved revisions to the conditions of approval for the vesting tentative parcel map shall become, for all purposes, the applicable tentative parcel map conditions of approval for the proposed subdivision and the conditions of approval which were originally issued shall be deemed withdrawn and shall no longer be of any force or effect for any purpose. EXPIRATION: The approval or conditional approval of the vesting tentative parcel map expires two years from the date of approval of the original tentative tract map on March 01, 2011. The revised conditions of approval issued for the subject vesting tentative parcel map shall not affect the anniversary date of the approved tentative parcel map. The expiration shall terminate all proceedings and a Parcel Map (Final) may not be filed without first processing a new Tentative Parcel Map, EXTENSION: Modification of tentative parcel rnap conditions of approval does not extend the two year time limit. The divider may request an extension of the tentative parcel map expiration date by filing a written application together with the fee set forth in the Master Fee Schedule at the time of the request with the Director of the Development and Resource Management Department at least thirty days before the expiration date of the map. The applicant must state the reasons for requesting the extension. New conditions may be imposed if an extension is granted. Discretionary extensions may not exceed an aggregate of six years. The following specific conditions are applicable to this tentative map. In accordance with the provisions of Government Code §66020(d)(1), the imposition of fees, dedications, reservations or exactions for this project are subject to protest by the project applicant at the time of approval or conditional approval of the development or within 90 days after the date of the imposition of the fees, dedications, reservations or exactions imposed on the development project. Pursuant to Table 2 (Planned Land Use and Zone District Consistency Matrix)of the 2025 Fresno General Plan(and applied to all community plans),the existing C-2/UGM/cz(Community Shopping Center/Urban Growth Management/with conditions of zoning), C-P/UGM/cz (Administrative and Professional OfficelUrban Growth Management/with conditions of zoning), and R-P/UGM/cz (Residential and Professional OfficelUrban Growth Managementlwith conditions of zoning) zone districts are consistent with the existing Community Commercial and Office Commercial planned land use designations for the subject property. [MITIGATION MONITORING REQUIREMENTS 1. On December 16, 2008 the Council of the City of Fresno adopted Resolution No. 2008- 357, adopting and certifying Final Environmental Impact Report(EIR) No. 10142 for the Fresno 40 Project. a) Development and subdivision of the subject property shall be subject to implementation of the mitigation measures, fees, and timelines as stipulated within the Mitigation Monitoring and Reporting Program identified as Table 1 (Exhibit "G") of Final EIR No. 10142; and, in accordance with the requirement stipulated herein. Comply with the provisions of the State of California Govemment Code Sections §66410- §66499.58 of the SMA and the City FMC Chapter 12, Article 10 (Subdivision of Real Property). CONDITIONS OF ZONING 3. On December 16, 2008 the Council of the City of Fresno adopted Bill No. B-81/Ordinance No. 2008-79 approving Rezone Application No. R-08-14 and establishing conditions of zoning respective to the development of the subject property. These conditions of zoning are applicable to the development of the subject property and do not apply to the recordation of the Parcel Map; except, as may be specifically required within the conditions of approval contained herein. MODIFICATIONS TO PROPERTY DEVELOPMENT STANDARDS 4. Proposed Parcels"A"through W,—""V," inclusive,of Revised Vesting Tentative Parcel Map No. 2010-07 are consistent with the existing C-2 (Community Shopping Center), C-P (Administrative and Professional Office)and R-P(Residential and Professional Office)zone districts subject to approval of a special permit for a planned development project. a) The site/development plan for Conditional Use Permit Application No.C-08-157 shall be approved prior to recordation of the Parcel Map and shall include the property lines as proposed pursuant to Revised Vesting Tentative Parcel Map No. 2010-07, dated Deseffiber-03;-2G1-0 March 23, 2015, thereby authorizing the creation of the planned development. 5. In accordance with Section 12-1011(6)every lot shall abut on a public street, except where adequate internal circulation is provided by a private street or streets in an approved planned unit development. a) All parcels must provide access to a public street right-of-way under a planned development special permit. • NOTE: In accordance with the provisions of Sections 12-215.5the Fresno Municipal Code,there shall be adequate vehicular access from a dedicated and improved street, service road, or alley, to all lands within the R-P, C-P, and C-2 zone districts, the design of which shall be approved by the Director of Public Works. b) Execute a Mutual Easements and Reciprocal Use Agreement between Parcels "A" through W"V"of Revised Vesting Tentative Parcel Map No. 2010-07 dated DeGerivber 03, 2010 March 23, 2015, inclusive. The Mutual Easements and Reciprocal Use Agreement shall,at a minimum,provide:(1)Mutual and reciprocal access to North Friant Conditions of Approval Revised Vesting Tentative Parcel Map No. 2010-07 MaFGh 91, 2011 April 24, 2015 Page 4 Road, North Fresno Street, and East Audubon Drive; (2) Shared parking; (3) Cross drainage; (4) Shared solid waste facilities (if applicable); and, (5) Provisions and obligations for retention and maintenance of access, utilities,fire suppression systems, facilities and improvements on the subject property. The required Mutual Easements and Reciprocal Use Agreement shall also contain a term, which assures that combinations of facilities within the proposed planned development shall provide the automobile parking area or number of spaces required for each facility,and that the area or spaces provided for one facility shall not be construed as satisfying the requirements of another facility. i) Access, circulation, and parking on all of the properties to be included within, and made party to, the cross-access agreement shall be provided and maintained in accordance with approved entitlements for the respective properties (Conditional Use Permit Applications C-08-157);or,any revisions or amendments thereto,as may be approved by the Development and Resource Management Department. No modifications to said access or circulation may be made without prior approval from the Development and Resource Management Department. • NOTE: The conditions of the Mutual Easements and Reciprocal Use Covenant are intended to benefit the public and public properties as well as properties appurtenant;and,secure the enforceability of properties'obligations for retention and maintenance of access, utilities, facilities, and improvements. Failure to comply with the terms of the Covenant may result in the revocation of the Certificate of Occupancy of Special Permit by the City for use of any Parcel of the properties involved, Accordingly, the City of Fresno shall have the right to enforce this Statement by any legal or equitable means. For further information regarding these requirement Contact the Planning and Development Department at(559)621-8277. ii) Final, executed and notarized documents shall be recorded with the parcel map. c) All of the agreements required to be executed within this section shall run with the land and bind all successors and assigns. • NOTE: Any amendment to the above provisions or any other provision specifying any right of the City shall require the prior written consent of the City. GENERAL CONDITIONS 6. Any existing and/or proposed structure(s)on the site may be affected due to the location of the proposed parcel lines. The placement of a parcel line in close proximity to any existing and/or proposed structure(s)requires that the structure(s)be found in compliance with the fire resistive standards of the Uniformed Building Code, Chapter 5. Conditions of Approval Revised Vesting Tentative Parcel Map No. 2010-07 NlaFsb 04,-2044 April 24, 2015 Page 5 a) Compliance with the prevailing Uniform Building Code as it relates to exterior wall protection, allowable area, etc. (as applicable to new parcel line locations) must be demonstrated prior to recordation of the Parcel Map. Contact the Development and Resource Management Department, Building and Safety Services Division at(559)621- 8200. • NOTE: In the event the structures do not comply they must be modified so as to meet the requirement. 7. All existing offsite overhead utilities within the limits of the tentative parcel map,including but not limited to, electrical systems, communication systems and street lighting systems shall be placed underground in accordance with the provisions of Section 12-1011 and Resolution No. 78-522/88-229, and the policies of the Public Works Department. 8. All work and engineered plans for public improvements shall conform to the 2002 Edition of the City of Fresno Standard Specifications and Drawings(City Council Resolution No.70-36 and Resolution Nos. 84-361) and any amendments thereto, hereinafter referred to as the Public Works Standards. 9. All off-site and public improvements shall be constructed in accordance with the Public Works Department Standards, Specifications and Policies. Engineered construction plans and estimates for all or part of the required work shall be required prior to the issuance of Street Work Permits unless otherwise determined by the City Engineer. The cost for such plan preparation, review and construction inspection shall be at the subdivider's expense. 10. The subdivider shall dedicate and construct public easements to facilitate the construction of curbs, gutters, sidewalks with street tree wells and irrigation systems (when applicable), permanent pavement, street/safety lighting, bus bays, right turn lanes, bike lanes, bike paths, multi-purpose trail,wheelchair ramps and public utilities in accordance with City plans, ordinances, resolutions and policies, and the Standard Specifications of the Public Works Department within the limits of the parcel map. • NOTE: Telephone, cable,and other public utilities which propose above-ground facilities (such as cabinets) determined by the Development and Resource Management Department Director to be oversized shall be located in an additional easement area outside of the required landscape strip. a) All such public easements shall be identified and dedicated with the processing and recordation of the Final Parcel Map and/or at the time of Special Permit review for the proposed development of the parcel(s). 11. A minimum four foot wide clear path of travel is required along all street frontages of the property as required by Title 24 of the California Administration Code, current ADA regulations; and, as determined by the City Engineer. Conditions of Approval Revise(I Vesting Tentative Parcel Map No. 2010-07 itlhRr4h_91-� April 24, 2015 Page 6 NOTE: An on-site pedestrian easement and construction of a path may be required if Title 24 and ADA provisions cannot be met within the public rights-of- way. a) Sidewalks (including wheelchair ramp landings) and driveway approaches, for undeveloped parcels of this parcel map,shall be required and constructed at the time of site development. b) Any existing sidewalks in excess of 2%maximum slope must be brought into compliance prior to acceptance by Public Works. c) Curb ramps with "Detectable Warning Devices" are required at all corners within the limits of this parcel map. 12. Repair all existing damaged and/or off grade off-site concrete street improvements as determined by the City of Fresno Public Works Department, Construction Management Division, (559) 621-5600. 13. Existing driveway approaches not identified for current or future utilization shall be removed and sidewalk (when applicable), curb and gutter shall be installed to match existing or proposed street line and grade as determined by the City Engineer. 14. When street/safety lighting installations are required, street lighting plans shall be submitted for review and approval by the Traffic Engineer prior to the issuance of permits for the work. Services to street lighting installations shall be separated from the electrical service(s) serving the development. The type, location and service for street lighting installations shall be as determined by the Traffic Engineer. Street lighting installations shall be dedicated to the City upon completion and acceptance of the installations. 15. If not existing, street work on major streets shall be designed to include Intelligent Transportation Systems (ITS) conduit in accordance with the Public Works ITS specifications. 16. All required signing and striping shall be installed and paid for by the developer/owner. The signing and striping plans shall comply with the current Caltrans standards and shall be submitted to the Public Works Department for review and approval as a part of the street improvement plans for this tentative map. 17. Any existing utilities, including but not limited to, street lights, traffic signals, fire hydrants, poles (power, telephone, cable, etc.), which must be relocated or removed in conjunction with the construction of off-site improvement requirements, shall be the responsibility and at the expense of the subdivider. 18. The subdivider may either construct or install required public improvements,when required; or, enter into a bonded secured agreement with the City of Fresno providing for the construction of the required improvements and sufficient security prior to the recordation of a Conditions of Approval Revised Vesting Tentative Parcel Map No. 2010-07 Marna 01 2011 April 24, 2015 Page 7 Parcel Map (final). 19. Whenever covenants or agreements are required, they shall be prepared by the city upon receipt of the fee in accordance with the adopted Master Fee Schedule. All covenants and agreements must be approved by the City Attorney's Office and shall be recorded with the final parcel map. SPECIFIC CONDITIONS STREETS AND RIGHTS-OF-WAY 20. Comply with all of the requirements and conditions stipulated within the attached Public Works Department,Traffic and Engineering Services Division memorandum dated February 14, 2011; and, the following: a) Item No, 7(A)of the Preliminary Report dated July 29,2010 identifies that a bus stop and sidewalk encroaches onto a portion of the subject property near the northerly corner of the subject property. Dedications of easements for public street purposes shall be sufficient at said location to accommodate the existing improvements. b) Mitigation Measure MM Trans-10a of the Mitigation Monitoring and Reporting Program for the Fresno 40 Project(Table 1 of EIR No. 10142) requires that prior to occupancy, the project applicant shall install at least one enhanced bust stop on the project frontage according to the preference of the City of Fresno and the Fresno Area Express (FAX). The bus stop shall include,at a minimum,a shelter, signage,transit information,lighting, and a trash receptacle. Additional enhanced bust stops may be required up to a maximum of three. • NOTE: The owner/developer shall coordinate with Fresno Area Express(FAX) for the future upgrade of all bus stops to current minimum standards and requirements. Pursuant to Section 12-1206(c)(5) of the FMC, the subdivider shall provide for the installation of street trees, or payments in lieu of immediate installation of street trees and payment of street tree fees applying to the subdivision or the division of land as designated Conditions of Approval Revised Vesting Tentative Parcel Map No. 2010-07 MaFGh 9111 April 24, 2015 Page 8 in the Master Fee Schedule. Contact the Parks Supervisor,Hilary Kimber at(559)621-1345 for further information. a) The Conditions of Approval for Conditional Use Permit Application No. C-08-157 dated December 03, 2008 require a 10-foot sidewalk pattern with 4-foot by 6-foot tree wells on North Fresno Street, North Friant Road, and East Audubon Avenue. The Sugar Pine Trail fronts the landscaping on East Cole Avenue and no street trees will be required for East Cole Avenue at this time. SANITARY SEWER SERVICE The nearest sanitary sewer mains to serve the proposed project are a 12-inch main located in North Fresno Street, a 10-inch main located in North Friant Road, and a 8-inch main located in East Audubon Drive. Sanitary sewer facilities are available to provide service to the site subject to the following requirements: 23. Comply with all of the requirements of the Department of Public Utilities, Planning and Engineering memorandum dated January 12, 2011. WATER SERVICE The nearest water mains to serve the proposed project are a 14-inch main located in East Audubon Drive and a 14-inch main located in North Fresno Street. The following water improvements shall be required prior to providing City water service to the project: 24. Comply with all of the requirements of the Department of Public Utilities, Water Division memorandum dated January 03, 2011; and, the following: a) Mitigation Measure MM PSU-6d of the Mitigation Monitoring and Reporting Program for the Fresno 40 Project (Table 1 of EIR No. 10142) requires that the proposed project shall dedicate approximately 4,024 square feet of land located adjacent to the west and south property boundaries of the existing Pump Station 94 for the purpose of constructing permanent water chlorination facilities, future wellhead treatment facilities and well site expansion for the existing Pump Station 94. b) Item 7(B)of the Preliminary Title Report dated July 29, 2010 indicates that a masonry block wall for City of Fresno Well Site No. 94 encroaches onto a portion of the subject property near the Northeasterly corner. i) Dedications for the purposes of required well site expansion and construction of water treatment facilities shall occur prior to the recordation of a Parcel Map and shall be sufficient to address any existing encroachments of facilities on the subject property as identified by the Preliminary Title Report. Conditions of Approval Revised Vesting Tentative Parcel Map No. 2010-07 MaFGh 01,-2-044 April 24, 2015 Page 9 FRESNO METROPOLITAN FLOOD CONTROL DISTRICT(FMFCD) 25. The subdivider shall be required to comply with all of the specific requirements imposed by the FMFCD for the subdivision or any amendments or modifications to those requirements, which may be granted by the FMFCD Board of Directors, pursuantto Section 13-1307 of the FMC. These requirements are identified in the attached District's letter to the Planning and Development Department dated January 13, 2011. a) Exhibit No. 2 of the FMFCD memorandum dated January 13, 2011 states that the tentative parcel map incorrectly indicates that there is a temporary storm drain easement shown at the northerly portion of the project site, which shall be removed. • NOTE: The Deed of Easement to the City of Fresno for storm drain purposes, recorded October 14, 1977, in Book 6895, Page 580, as Instrument/File No. 110688 of Official Records describes the easement as being temporary,"until a permanent local drainage facility, approved by the Fresno Metropolitan Flood Control District, is constructed to serve the entire subdivision designated on that certain map,approved by the Council of the City of Fresno on January 13, 1977, identified as Tentative Map of Tract No. 2739, "Woodward Park Estates", i) Prior to recordation of a Parcel Map, the subdivider shall provide a formal determination from FMFCD which acknowledges whether permanent local drainage facilities have been constructed to serve the Woodward Park Estates,as stipulated within the aforementioned deed of easement so that the City of Fresno may determine whether the temporary storm drain easement identified shall be applicable to the Parcel Map. CITY OF FRESNO FIRE DEPARTMENT 26. Comply with all of the requirements stipulated within the attached memorandum from the City of Fresno Fire Department dated January 04, 2011. FRESNO IRRIGATION DISTRICT (FID) 27. Comply with all of the requirements stipulated within the attached memorandum from the Fresno Irrigation District(FID)dated January 18, 2011. • NOTE: FID requires that it review, approve, and be made party to signing all improvement plans, including but not limited to, Sewer and Water, FMFCD, Street, Landscaping, Dry Utilities, and all other utilities. CLOVIS UNIFIED SCHOOL DISTRICT 28. Attached for the subdivider's records and/or consideration is the memorandum from Clovis Unified School District dated January 04, 2011. The proposed development of TPM 2010-007 is located in an area that has historically provided a passage for major storm water flows from the areas north of Audubon Drive across the proposed site and across the City of Fresno's Sugar Pine Trail over to Cole Avenue. The grading of the proposed site shall be designed such that there are not adverse impacts to the passage of said major storm water. The developer shall coordinate between the District and the City to accommodate improvements within the City's trail which may be necessary to convey the major storm flows to Cole Avenue. The developer has previously dedicated a Drainage Channel easement to the District for the passage of the major storm per Document No. 2007-0015017, Fresno County Recorder as shown on Exhibit No. 1. No structures,trees,shrubs,or other items which could impede the flowage shall be placed in the drainage channel. Grass,stones,concrete,asphalt or similar surface materials may be placed therein so long as they do not impede flowage. The site shall also be graded to block major storms from entering the site from Fresno Street. The channel easement must be added to TPM 2010-007. There is an existing storm drain easement running through the project site as shown on Exhibit No. 1. No encroachments into the easement shall be permitted including,but not limited to,foundations, roof overhangs,swimming pools,and trees. The developer of the property entered into Development Agreement No. 1446(D)-CW,Document No, 2007-003123,Fresno County Recorder in February 2003 to allow Friant Road street runoff to flow into a private on-site storm drainage collection system and then to District Master Plan facilities for deliverance to Basin"CW". Discharges from the private facilities to the District's storm drainage system shall consist only of storm water runoff and shall be free of solids and debris. The tentative parcel map submitted to the District incorrectly indicates there is a temporary storm drain easement shown at the northerly portion of the project site which shall be removed. The District encourages,but does not require that roof drains from non-residential development be constructed such that they are directed onto and through a landscaped grassy swalc area to filter out pollutants from roof runoff. Runoff from areas where industrial activities,product,or merchandise come into contact with and may contaminate storm water must be directed through landscaped areas or otherwise treated before discharging it off-site or into a storm drain. Roofs covering such areas are recommended. Cleaning of such areas by sweeping instead of washing is to be required unless such wash water can be directed to the sanitary sewer system. Storm drains receiving untreated runoff from such areas that directly connect to the District's system will not be permitted. Loading docks,depressed areas,and areas servicing or fueling vehicles are specifically subject to these requirements. FID previously reviewed and commented on the subject property as the Draft Environmental Impact Report—Fresno 40 Project on November 6, 2008. Those comments and conditions still apply in regards to the potential environmental impacts associated with this project and a copy is attached for your reference. FID would like to include the additional following comments as they pertain to the site development proposal: 1. FID does not own, operate or maintain any facilities located on the subject properties as shown on the attached FID exhibit map. 2. For informational purposes; FID's Forkner Canal No. 121 runs southwesterly and parallel along the northerly side of Friant Road as shown on the attached FID exhibit map. This canal is used primarily to divert water to the City of Fresno's Woodward Park for recreational and recharge purposes. 3. The section of the Forkner Canal pipeline adjacent to the subject property was installed in 1986 (25 years ago) as 24-inch diameter cast-in-place monolithic concrete pipe (CIP). CIP is a non-reinforced pipe that is easily damaged, extremely prone to leakage and does not meet FID's minimum standards for developed (residential, industrial, commercial)parcels or urban areas. 4. FID does have an exclusive 30-foot wide easement for the Forkner Canal pipeline that is approximately five feet outside of the Friant Road right-of-way as described in Document No. 61891 recorded August 23, 1966. If any street improvements are required along Mr.Will Tackett Re:TPM 2010-07 January 18, 2011 Page 2 of 2 Friant Road as a part of this development, FIR assumes the City will not be encroaching into this easement. However, if the City needs to encroach into FID's easement with any large earthmoving equipment(paddle wheel scrappers, graders, excavators,etc.)the City and/or its Contractor will be responsible for the repair of all damage(s)to the pipeline caused by the proposed project. 5. FID requires it review, approve and be made a party to signing all improvement plans, including but not limited to, Sewer and Water, FMFCD, Street, Landscaping, Dry Utilities, and all other utilities. 6. The proposed development may negatively impact local groundwater supplies. The area is currently agricultural land and a significant portion of its water supply is imported surface water, supplemented by groundwater pumping. Under current circumstances the project area is experiencing a modest but continuing groundwater overdraft. Should the proposed development result in a conversion from imported surface water to groundwater, this deficit will increase. FID suggests the City require the proposed development balance anticipated groundwater use with sufficient recharge of imported surface water in order to preclude increasing the area's existing groundwater overdraft. 7. During FID's review and comments in 2008 on the Draft Environmental Impact Report (DEIR)for the subject properties it was pointed out that the proposed project's potable water use will be required to be reduced by 20 percent. The project shall use intensive xeriscape, utilization of FID surface water for irrigation, artificial lawns, or other alternatives to achieve this potable water use reduction. FED supports the use of surface water where possible. However, most of the canal systems are not designed to deliver pressurized surface water in the urban environment as the DEIR suggested. It is FID's understanding that the proposed project would need surface water at varying flow rates and pressures. Most canal systems deliver water by gravity and are not pressurized systems. Also, FID's typical delivery season is 6 months and can be as short as 3 months depending on the hydrological year. If the Developer and/or City are still interested with having surface water delivered to the site, significant on-site improvements will be required such as large on-site storage tanks to accept surface water delivered from FID's Forkner pipeline. Another option may be the construction of an intertie with nearby Woodward Park where FID currently delivers surface water used to supplement the lakes and other water features.
