(APN[s]: 303-021-94 &95) The City of Fresno Development and Resource Management Department has completed review of Revised Tentative Parcel Map No.2010-02 dated May 04,2012. This letter is written to advise you that the Director of the Development and Resource Management Department has approved the proposed revisions to the tentative parcel map which have been deemed to be minor revisions in accordance with Section 12-1005.2 of the Fresno Municipal Code. EXPIRATION: The approval or conditional approval of this vesting tentative Parcel Map expires two years from the original date of approval of the tentative parcel map on August 10, 2010. The revisions to the conditions of approval dated May 17,2012 shall not affect the anniversary date of the approved tentative map. The expiration shall terminate all proceedings and a final Parcel Map may not be filed without first processing a new Tentative Parcel Map. EXTENSION: Modification of a tentative parcel map after approval or conditional approval does not extend the two year time limit. The divider may request an extension of the tentative map expiration date by filing a written application together with the fee set forth in the Master Fee Schedule at the time of the request with the Director of the Development and Resource Management Department prior to the expiration date of the map. The applicant must state the reasons for requesting the extension. New conditions may be imposed if an extension is granted. Discretionary extensions may not exceed an aggregate of six years. The following specific conditions are applicable to this tentative map. In accordance with the provisions of Government Code §66020(d)(1), the imposition of fees, dedications, reservations or exactions for this project are subject to protest by the project applicant at the time of approval or conditional approval of the development or within 90 days after the date of the imposition of the fees, dedications, reservations or exactions imposed on the development project. APN: 303-021-95 PLAN CONSISTENCY 2. The subject site is located within the jurisdiction of the Woodward Park Community Plan and the 2025 Fresno General Plan. These plans designate the subject property for Office Commercial planned land uses. Pursuant to Table 2 (Planned Land Use and Zone District Consistency Matrix)of the 2025 Fresno General Plan and applied within all community plans the existing C-P/UGM/cz (Administrative and Professional Office/Urban Growth Managemenf/with conditions of zoning)zone district is consistent with the Office Commercial planned land use designation for the subject property. ZONING 3. Comply with the provisions of the State of California Government Code Sections §66410 - §66499.58 of the SMA and the City FMC Chapter 12, Article 10 (Subdivision of Real Property). CONDITIONS OF ZONING 4. Conditions of zoning applicable to the subject property have been either previously satisfied or will have been deemed satisfied upon the provision of dedications and improvements Conditions of Approval Tentative Parcel Map No. 2010-02 August 10, 2010 (Revised May 17, 2012) Page 3 adjacent to the subject property in accordance with the Conditions of Approval for Conditional Use Permit Application No. C-06-074 dated September 20, 2007; and/or, the Conditions of Approval contained herein. MODIFICATIONS TO PROPERTY DEVELOPMENT STANDARDS 5. Proposed parcels "A" through "I" are consistent with the C-P (Administrative and Professional Office)zone district property development standards subject to approval of a special permit for a planned development project. 6. Execute a Mutual Easements and Reciprocal Use Agreement between proposed Parcels"A" through "I" of Tentative Parcel Map No. 2010-02. a) Conditional Use Permit Application No. C-06-074 was approved on September 21,2007 for the subject property authorizing the development of the subject property with two approximately 53,967 square-foot three story buildings;an approximately 45,622 square- foot"mixed use" building;two stand alone buildings,one of which is approximately 9,522 square feet in area, while the other is approximately 8,714 square feet in area; and, three pads on the periphery of the subject property measuring approximately 2,625, 3,015 and 3,500 square feet in area. i) A revision to the site plan for Conditional Use Permit Application No. C-06-074 shall be approved prior to recordation of the Parcel Map and shall include the property lines as proposed pursuant to Revised Tentative Parcel Map No. 2010-02, dated JUnG 14,c- -ivTv May 04, 2012; thereby authorizing the creation of the office planned development. 7. In accordance with Section 12-1011(f)(6) every lot shall abut on a public street, except where adequate internal circulation is provided by a private streets or streets in an approved planned unit development. a) All parcels must be provided access to a public street right-of-way under a planned development special permit. • NOTE: In accordance with Section 12-216.5-J of the Fresno Municipal Code, there shall be adequate vehicular access to off-street parking facilities from a dedicated and improved street, service road, or alley, the design of which shall be approved by the Director of Public Works. b) Access, circulation, and parking on the subject property shall be provided and maintained in accordance with approved entitlements for the subject property (Conditional Use Permit Application No. C-06-074); or, any revisions or amendment thereto, as may be approved by the Development and Resource Management Department. No modifications to said access or circulation may be made without prior approval from the Development and Resource Management Department. Conditions of Approval Tentative Parcel Map No. 2010-02 August 10, 2010 (Revised May 17, 2012) Page 4 i) Execute a Mutual Easement and Reciprocal Use Agreement between proposed Parcels"A"through"I"of Revised Tentative Parcel Map No. 2010-02 dated juRe-14, 2019 May 04,2012.The Mutual Easements and Reciprocal Use Agreement shall,at a minimum, provide: (1) Mutual and reciprocal access to East Nees Avenue, North Fresno Street, and East EI Paso Avenue; (2)Shared parking;(3)Cross drainage; (4) Shared solid waste facilities(if applicable);and,(5)Maintenance and retention of on- site utilities, fire suppression systems, improvements, and facilities as appropriate. The required Mutual Easements and Reciprocal Use Agreement shall also contain a term, which assures that combinations of facilities within the proposed planned development shall provide the automobile parking area or number of spaces required for each facility, and that the area or spaces provided for one facility shall not be construed as satisfying the requirements of another facility. • NOTE: The conditions of the Mutual Easements and Reciprocal Use Covenant are intended to benefit the public and public properties as well as properties appurtenant; and, secure the enforceability of properties'obligations for retention and maintenance of access, utilities, facilities, and improvements. Failure to comply with the terms of the Covenant may result in the revocation of the Certificate of Occupancy of Special Permit by the City for use of any Parcel of the properties involved. Accordingly, the City of Fresno shall have the right to enforce this Statement by any legal or equitable means. For further information regarding these requirement Contact the Planning and Development Department at (559) 621-8277. ii) Final, executed and notarized documents shall be recorded with the parcel map. c) All of the agreements required to be executed within this section shall run with the land and bind all successors and assigns. • NOTE: Any amendment to the above provisions or any other provision specifying any right of the City shall require the prior written consent of the City. 8. Pursuant to Section 12-216.5-A& B, all lots created within the C-P zone district shall have: (1)A minimum area of 10,000 square feet; (2) A minimum lot width of 65 feet; and, (3) A minimum depth of 110 feet. • NOTE: Under a planned development special permit and in accordance with Section 12-306-N-21 of the FMC, all otherwise required property development standards applicable to the proposed development of a site and to individual lots proposed to be created within such site, may be modified or waived provided the Director or the Planning Commission, as the case may be, determines the proposed development conforms to the provisions of Subsection 12-306-N-21 and all other applicable provisions of the FMC. a) As the subject property will be developed in accordance with Conditional Use Permit Application No. C-06-074, the subsequent proposed alterations and modifications to the Conditions of Approval Tentative Parcel Map No. 2010-02 August 10, 2010 (Revised May 17, 2012) Page 5 subject property (i.e., the subdivision of the subject property in accordance Tentative Parcel Map No. 2010-02); and, deviations from property development standards for Lot Area, Width and Depth are hereby approved in conjunction with the proposed planned development of the subject property and subject to the conditions of approval contained herein. GENERAL CONDITIONS 9. Any existing and/or proposed structure(s)on the site may be affected due to the location of the proposed parcel lines. The placement of a parcel line in close proximity to any existing and/or proposed structure(s) requires that the structure(s) be found in compliance with the fire resistive standards of the Uniformed Building Code, Chapter 5. a) Compliance with the prevailing Uniform Building Code as it relates to exterior wall protection, allowable area, etc. (as applicable to new parcel line locations) must be demonstrated prior to recordation of the Parcel Map. Contact the Planning and Development Department, Building and Safety Services Division at(559) 621-8200. • NOTE: In the event the structures do not comply they must be modified so as to meet the requirement. 10. All off-site and public improvements shall be constructed in accordance with the Public Works Department Standards, Specifications and Policies. Engineered construction plans and estimates for all or part of the required work shall be required prior to the issuance of Street Work Permits unless otherwise determined by the City Engineer. The cost for such plan preparation, review and construction inspection shall be at the subdivider's expense. 11. Any existing utilities, including but not limited to, street lights, traffic signals, fire hydrants, poles (power, telephone, cable, etc.), which must be relocated or removed in conjunction with the construction of off-site improvement requirements, shall be the responsibility and at the expense of the subdivider. 12. All existing offsite overhead utilities within the limits of the tentative parcel map, including but not limited to, electrical systems, communication systems and street lighting systems shall be placed underground in accordance with the provisions of Section 12-1011 and Resolution No. 78-522/88-229, and the policies of the Public Works Department. 13. When street/safety lighting installations are required,street lighting plans shall be submitted for review and approval by the Traffic Engineer prior to the issuance of permits for the work. Services to street lighting installations shall be separated from the electrical service(s) serving the development. The type, location and service for street lighting installations shall be as determined by the Traffic Engineer. Street lighting installations shall be dedicated to the City upon completion and acceptance of the installations. 14. Sidewalks(including wheelchair ramp landings)and driveway approaches,for undeveloped parcels of this parcel map, shall be required and constructed at the time of site development. Conditions of Approval Tentative Parcel Map No. 2010-02 August 10, 2010 (Revised May 17, 2012) Page 6 a) Curb ramps with "Detectable Warning Devices" are required at all corners within the limits of this parcel map. 15. Whenever covenants or agreements are required, they shall be prepared by the city upon receipt of the fee in accordance with the adopted Master Fee Schedule. All covenants and agreements must be approved by the City Attorney's Office and shall be recorded with the final parcel map. 16. Telephone, cable, and other public utilities which propose above-ground facilities (such as cabinets) determined by the Planning and Development Director to be oversized shall be located in an additional easement area outside of the required landscape strip. 17. All work and engineered plans for public improvements shall conform to the 2002 Edition of the City of Fresno Standard Specifications and Drawings(City Council Resolution No.70-36 and Resolution Nos. 84-361) and any amendments thereto, hereinafter referred to as the Public Works Standards. 18. The subdivider shall dedicate and construct public easements to facilitate the construction of curbs, gutters, sidewalks with street tree wells and irrigation systems (when applicable), permanent pavement, street/safety lighting, bus bays, right turn lanes, bike lanes, bike paths, multi-purpose trail,wheelchair ramps and public utilities in accordance with City plans, ordinances, resolutions and policies, and the Standard Specifications of the Public Works Department within the limits of the parcel map. 19. Existing improvements that are not to the planned alignment shall be removed and required improvements installed to the new street alignment and grade. Existing improvements to remain in place shall be repaired if determined to be damaged and/or off grade by the City Engineer. Existing driveway approaches not identified for current or future utilization shall be removed and sidewalk(when applicable), curb and gutter shall be installed to match existing or proposed street line and grade as determined by the City Engineer. 20. A minimum four foot wide clear path of travel is required along the public sidewalk on all frontages of the property as required by Title 24 of the California Administration Code as determined by the City Engineer. An on-site pedestrian easement and construction of a path may be required if Title 24 provisions cannot be met within the public rights-of-way. All such public easements shall be identified and dedicated with the processing and recordation of the Final Parcel Map and/or at the time of Special Permit review for the proposed development of the parcel(s). 21. All required signing and striping shall be installed and paid for by the developer/owner. The signing and striping plans shall comply with the current Caltrans standards and shall be submitted to the Public Works Department for review and approval as a part of the street improvement plans for this tentative map. 22. If not existing, street work on major streets shall be designed to include Intelligent Conditions of Approval Tentative Parcel Map No. 2010-02 August 10, 2010 (Revised May 17, 2012) Page 7 Transportation Systems (ITS) conduit in accordance with the Public Works ITS specifications. 23. The subdivider may either construct or install required improvements, when required; or, enter into a bonded secured agreement with the City of Fresno providing for the construction of the required improvements and sufficient security prior to the recordation of a Parcel Map (final). SPECIFIC CONDITIONS STREETS AND RIGHTS-OF-WAY 24. Any and all remnant portions of existing public street rights-of-way, which are associated with "Old" Friant Road and located within the limits of parcels proposed to be created pursuant to Tentative Parcel Map No.2010-02 shall be properly abandoned/vacated with the Parcel Map. a) Alternatively, provide evidence of the abandonment/vacation of the respective rights-of- way referenced above prior to recordation of the Parcel Map. • NOTE: Please see attached exhibits related to the respective area in question and/or contact Alan James, Supervising Engineering Technician with the Public Works Department at (559) 621-8693 for further information. 25. Comply with all of the requirements and conditions stipulated within the attached Public Works Department, Engineering Division (Traffic Planning) memorandum dated July 28, 2010; except as follows a) Street work on major streets is not required to be designed to include Intelligent Transportation Systems (ITS) conduit as a condition of the tentative parcel map. b) Pay all applicable fees as referenced within the above referenced Public Works, Engineering Division memorandum in accordance with the fee schedule provided herein below; and the following: i) State of California Department of Transportation(Caltrans)fees,as applicable,shall be paid to the City of Fresno Public Works Department,Traffic Engineering Division prior to recordation of the Parcel Map. Contact the Traffic Engineering Division at (559) 621-8820 for more information. • NOTE: The proposed planned development project's fair share contribution to mitigate for impacts to State Facilities have been calculated as provided within the attached State of California Department of Transportation (Caltrans) memorandum dated July 13, 2007; prepared pursuant to Conditional Use Permit Application No. C-06-074. Conditions of Approval Tentative Parcel Map No. 2010-02 August 10, 2010 (Revised May 17, 2012) Page 8 26. Comply with all of the requirements and conditions stipulated within the attached memorandum from the Public Works Department, Engineering Division(Parks Supervisor) dated July 27, 2010 SANITARY SEWER SERVICE The nearest sewer mains to serve the proposed project are an 8-inch main located in East Nees Avenue and a 15-inch main located in North Fresno Street. The following sewer improvements shall be required prior to providing sewer service to the project: 27. Comply with all of the requirements of the Department of Public Utilities, Planning and Engineering memorandum dated July 21, 2010. WATER SERVICE The nearest water mains to serve the proposed project are a 14-inch main located in East Nees Avenue and a 14-inch main located in North Fresno Street. The following water improvements shall be required prior to providing City water service to the project: 28. Comply with all of the requirements of the Department of Public Utilities, Water Division memorandum dated j, ly 23 2010 IaFi apy 31 _ March 09, 2012. • NOTE: The only modification reflected in the March 09, 2012 memorandum is the inclusion of a provision to allow deferment of the required detailed water usage analysis to site development. This change is consistent with Mitigation Measure D-12 of the 2025 Fresno General plan Master Environmental Impact Report (MEIR) No. 10130, which requires that such analysis be provided for development projects. Therefore, this modification is interpreted as being intended to clarify the timing of such requirement and not as a modification to the condition or requirement itself for purposes of the revised map. FRESNO METROPOLITAN FLOOD CONTROL DISTRICT (FMFCD) 29. The subdivider shall be required to comply with all of the specific requirements imposed by the FMFCD for the subdivision or any amendments or modifications to those requirements, which may be granted by the FMFCD Board of Directors, pursuant to Section 13-1307 of the FMC. These requirements are identified in the attached District's letter to the Planning and Development Department dated July 29, 2010. FRESNO IRRIGATION DISTRICT (FID) 30. Attached for the applicant/subdivider's records and consideration is the memorandum from the Fresno Irrigation District dated July 27, 2010. The effective date of this ordinance is September 20,2008. Contact the County of Fresno, Public Works and Planning Department to determine payment of this fee obligation. Confirmation by the County of Fresno is required before the City of Fresno can issue building permits. The Board of Directors of the Fresno County Regional Transportation Mitigation Fee Agency approved Resolution No.2009—01 requiring the payment of Regional Transportation Mitigation Fee. The effective date of this resolution is January 1, 2010. Contact the Council of Fresno County Governments (FCOG) to determine this fee obligation. Confirmation by the FCOG is required before the City of Fresno can issue building permits. *Living Unit Equivalents are calculated by multiplying the number of Net Acres by 5.8 Living Unit Equivalents for commercial or 3.0 Living Unit Equivalents for industrial to arrive at the total number of Living Unit Equivalents. **Upon occupancy of the project,the subdivider shall pay the appropriate sewer facility charge pursuant to the Simple Tiered Equity Program (STEP) as determined by the Department of Public Utilities, Wastewater Division, Environmental Services Section (559-621-5153). DIAZ, Senior Engineering Technician Department of Public Utilities Water Division SUBJECT: REVISED-WATER REQUIREMENTS FOR TENTATIVE PARCEL MAP NO. 2010-02 General PM-2010-02 proposing a 9-lot office commercial planned development subdivision for approximately 12.18 net acres, 12.43 gross acres, of property located on the southwest corner of the intersection of East Nees Avenue and North Fresno Street, 269 East Nees Avenue,APN 303-021-94, 95. Water Service The City of Fresno ("City") and Pinedale County Water District ("PCWD") both have existing water mains capable of providing service to their respective service areas within the proposed project. The nearest City water mains to serve the proposed development are a 14-inch main located in East Nees Avenue and a 14-inch main located in North Fresno Street. The City also has a planned Capital Improvement Project that will extend the 14-inch main in North Fresno Street to East EI Paso Avenue,then west in East EI Paso Avenue connecting to the existing 14-inch water main within the River Park Shopping Center. It is estimated that this project will be completed by January 1, 2012. The following water improvements shall be required prior to water service to the project: 1. A portion of this project is located outside of the City of Fresno's ("City')water service area and within the service area of Pinedale County Water District(PCWD). The City will not split water service on the project. Water service must be consolidated for the entire project for service from either the City or PCWD, but not both. If the developer wants to receive water service from the City, the developer must receive LAFCo approval, complete the detachment process from PCWD and consolidate the entire project within the City's water service area. In the alternative, if the developer wants to receive water service from PCWD the developer must receive LAFCo approval, complete the detachment process from the City and consolidate the entire project with PCWD's water service area. 2. If the project receives water service from the City, the following shall apply: a. City of Fresno water service is contingent upon providing all domestic, fire, and irrigation water service to the entire development as proposed in Tentative Parcel Map No. 2010- 02 and Conditional Use Permit No. C-06-074. b. Separate water services with meters shall be provided to each lot created. c. Proposed Parcels "F" and "G"shall be required a cross-access agreement for water service across proposed Parcel "D". d. The developer shall provide a detailed water usage analysis identifying water fixture, landscape, and laundry efficiencies to document water conservation design characteristics, subject to approval by the Director of Public Utilities. The analysis shall be deferred to site development. e. The development shall incorporate water use efficiency for landscaping including the use of artificial turf and native plant materials, reducing turf areas, and discouraging the development of artificial lakes, fountains and ponds unless only untreated surface water or recycled water supplies are used for these decorative and recreational water features as appropriate and sanitary. f. All irrigation clocks/control devices shall be based on evapotranspiration and include the use of soil probes and rain sensors. g. All multi-story building(s)shall incorporate booster pumps for domestic water use within the building(s). h. Seal and abandon any existing on-site well in compliance with the State of California Well Standards, Bulletin 74-90 or current revisions issued by California Department of Water Resources and City of Fresno standards. i. Two independent sources of water, meeting Federal and State Drinking Water Act Standards, are required to serve the tract including any subsequent phases thereof. The two-source requirement may be accomplished through any combination of water main extensions, construction of supply wells, or other acceptable sources of water supply approved by the Assistant Public Utilities Director. 3. If the project receives water service from PCWD, development shall comply with the requirements of the Pinedale County Water District. MODIFICATIONS TO PROPERTY DEVELOPMENT STANDARDS 5. Proposed parcels "A" through "I" are consistent with the C-P (Administrative and Professional Office)zone district property development standards subject to approval of a special permit for a planned development project. 6. Execute a Mutual Easements and Reciprocal Use Agreement between proposed Parcels"A" through "I" of Vesting Tentative Parcel Map No. 2010-02. a) Conditional Use Permit Application No. C-06-074 was approved on September 21,2007 for the subject property authorizing the development of the subject property with two approximately 53,967 square-foot three story buildings;an approximately 45,622 square- foot"mixed use" building; two stand alone buildings,one of which is approximately 9,522 square feet in area, while the other is approximately 8,714 square feet in area; and, three pads on the periphery of the subject property measuring approximately 2,625, 3,015 and 3,500 square feet in area. i) A revision to the site plan for Conditional Use Permit Application No. C-06-074 shall be approved prior to recordation of the Parcel Map and shall include the property lines as proposed pursuant to Tentative Parcel Map No. 2010-02, dated June 14, 2010; thereby authorizing the creation of the office planned development. 7. In accordance with Section 12-1011(f)(6) every lot shall abut on a public street, except where adequate internal circulation is provided by a private streets or streets in an approved planned unit development. a) All parcels must be provided access to a public street right-of-way under a planned development special permit. • NOTE: In accordance with Section 12-216.5-J of the Fresno Municipal Code, there shall be adequate vehicular access to off-street parking facilities from a dedicated and improved street, service road, or alley, the design of which shall be approved by the Director of Public Works. b) Access, circulation, and parking on the subject property shall be provided and maintained in accordance with approved entitlements for the subject property (Conditional Use Permit Application No. C-06-074); or, any revisions or amendment thereto, as may be approved by the Development and Resource Management Department. No modifications to said access or circulation may be made without prior approval from the Development and Resource Management Department. i) Execute a Mutual Easement and Reciprocal Use Agreement between proposed Parcels "A" through "I" of Tentative Parcel Map No. 2010-02 dated June 14, 2010. The Mutual Easements and Reciprocal Use Agreement shall, at a minimum, provide: (1) Mutual and reciprocal access to East Nees Avenue, North Fresno Street, and Conditions of Approval Vesting Tentative Parcel Map No. 2010-02 August 10, 2010 Page 4 East EI Paso Avenue; (2)Shared parking;(3)Cross drainage; (4)Shared solid waste facilities (if applicable); and, (5) Maintenance and retention of on-site utilities, fire suppression systems, improvements, and facilities as appropriate. The required Mutual Easements and Reciprocal Use Agreement shall also contain a term,which assures that combinations of facilities within the proposed planned development shall provide the automobile parking area or number of spaces required for each facility, and that the area or spaces provided for one facility shall not be construed as satisfying the requirements of another facility. • NOTE: The conditions of the Mutual Easements and Reciprocal Use Covenant are intended to benefit the public and public properties as well as properties appurtenant; and, secure the enforceability of properties'obligations for retention and maintenance of access, utilities, facilities, and improvements. Failure to comply with the terms of the Covenant may result in the revocation of the Certificate of Occupancy of Special Permit by the City for use of any Parcel of the properties involved. Accordingly, the City of Fresno shall have the right to enforce this Statement by any legal or equitable means. Pursuant to Section 12-216.5-A& B, all lots created within the C-P zone district shall have: (1) A minimum area of 10,000 square feet; (2) A minimum lot width of 65 feet; and, (3) A minimum depth of 110 feet. • NOTE: Under a planned development special permit and in accordance with Section 12-306-N-21 of the FMC, all otherwise required property development standards applicable to the proposed development of a site and to individual lots proposed to be created within such site, may be modified or waived provided the Director or the Planning Commission, as the case may be, determines the proposed development conforms to the provisions of Subsection 12-306-N-21 and all other applicable provisions of the FMC. a) As the subject property will be developed in accordance with Conditional Use Permit Application No. C-06-074,the subsequent proposed alterations and modifications to the subject property (i.e., the subdivision of the subject property in accordance Tentative Parcel Map No. 2010-02); and, deviations from property development standards for Lot Area, Width and Depth are hereby approved in conjunction with the proposed planned development of the subject property and subject to the conditions of approval contained herein. Conditions of Approval Vesting Tentative Parcel Map No. 2010-02 August 10, 2010 Page 5 GENERAL CONDITIONS 9. Any existing and/or proposed structure(s)on the site may be affected due to the location of the proposed parcel lines. The placement of a parcel line in close proximity to any existing and/or proposed structure(s) requires that the structure(s) be found in compliance with the fire resistive standards of the Uniformed Building Code, Chapter 5. a) Compliance with the prevailing Uniform Building Code as it relates to exterior wall protection, allowable area, etc. (as applicable to new parcel line locations) must be demonstrated prior to recordation of the Parcel Map. All off-site and public improvements shall be constructed in accordance with the Public Works Department Standards, Specifications and Policies. Engineered construction plans and estimates for all or part of the required work shall be required prior to the issuance of Street Work Permits unless otherwise determined by the City Engineer. The cost for such plan preparation, review and construction inspection shall be at the subdivider's expense. 11. Any existing utilities, including but not limited to, street lights, traffic signals, fire hydrants, poles (power, telephone, cable, etc.), which must be relocated or removed in conjunction with the construction of off-site improvement requirements, shall be the responsibility and at the expense of the subdivider. 12. All existing offsite overhead utilities within the limits of the tentative parcel map, including but not limited to, electrical systems, communication systems and street lighting systems shall be placed underground in accordance with the provisions of Section 12-1011 and Resolution No. 78-522/88-229, and the policies of the Public Works Department. 13. When street/safety lighting installations are required, street lighting plans shall be submitted for review and approval by the Traffic Engineer prior to the issuance of permits for the work. Services to street lighting installations shall be separated from the electrical service(s) serving the development. The type, location and service for street lighting installations shall be as determined by the Traffic Engineer. Street lighting installations shall be dedicated to the City upon completion and acceptance of the installations. 14. Sidewalks(including wheelchair ramp landings)and driveway approaches,for undeveloped parcels of this parcel map, shall be required and constructed at the time of site development. a) Curb ramps with "Detectable Warning Devices" are required at all corners within the limits of this parcel map. 15. Whenever covenants or agreements are required, they shall be prepared by the city upon receipt of the fee in accordance with the adopted Master Fee Schedule. All covenants and Conditions of Approval Vesting Tentative Parcel Map No. 2010-02 August 10, 2010 Page 6 agreements must be approved by the City Attorney's Office and shall be recorded with the final parcel map. 16. Telephone, cable, and other public utilities which propose above-ground facilities (such as cabinets) determined by the Planning and Development Director to be oversized shall be located in an additional easement area outside of the required landscape strip. 17. All work and engineered plans for public improvements shall conform to the 2002 Edition of the City of Fresno Standard Specifications and Drawings(City Council Resolution No. 70-36 and Resolution Nos. 84-361) and any amendments thereto, hereinafter referred to as the Public Works Standards. 18. The subdivider shall dedicate and construct public easements to facilitate the construction of curbs, gutters, sidewalks with street tree wells and irrigation systems (when applicable), permanent pavement, street/safety lighting, bus bays, right turn lanes, bike lanes, bike paths, multi-purpose trail,wheelchair ramps and public utilities in accordance with City plans, ordinances, resolutions and policies, and the Standard Specifications of the Public Works Department within the limits of the parcel map. 19. Existing improvements that are not to the planned alignment shall be removed and required improvements installed to the new street alignment and grade. Existing improvements to remain in place shall be repaired if determined to be damaged and/or off grade by the City Engineer. Existing driveway approaches not identified for current or future utilization shall be removed and sidewalk(when applicable), curb and gutter shall be installed to match existing or proposed street line and grade as determined by the City Engineer. 20. A minimum four foot wide clear path of travel is required along the public sidewalk on all frontages of the property as required by Title 24 of the California Administration Code as determined by the City Engineer. An on-site pedestrian easement and construction of a path may be required if Title 24 provisions cannot be met within the public rights-of-way. All such public easements shall be identified and dedicated with the processing and recordation of the Final Parcel Map and/or at the time of Special Permit review for the proposed development of the parcel(s). 21. All required signing and striping shall be installed and paid for by the developer/owner. The signing and striping plans shall comply with the current Caltrans standards and shall be submitted to the Public Works Department for review and approval as a part of the street improvement plans for this tentative map. 22. If not existing, street work on major streets shall be designed to include Intelligent Transportation Systems (ITS) conduit in accordance with the Public Works ITS specifications. 23. The subdivider may either construct or install required improvements, when required; or, enter into a bonded secured agreement with the City of Fresno providing for the construction of the required improvements and sufficient security prior to the recordation of a Parcel Map (final). Water Service The nearest water mains to serve the proposed Parcels A, B, C, F, G, H and I are a 14-inch main located in East Nees Avenue and a 14-inch main located in North Fresno Street. The following water improvements shall be required prior to providing City water service to the project: 1. Construct a 14-inch water main (Including Fire Hydrants) in North Fresno Avenue from East EI Paso Avenue north approximately 600-linear feet to the existing 14-inch main located in North Fresno Avenue. 2. Construct a 14-inch water main (Including Fire Hydrants) in East EI Paso Avenue from North Fresno Avenue west approximately 600-linear feet to the existing 14-inch located in East EI Paso Avenue. 3. Separate water services with meters shall be provided to each lot created. 4. Proposed Parcels "F" and "G"shall be required a cross-access agreement for water service across proposed Parcel "D". 5. The developer shall provide a detailed water usage analysis identifying water fixture, landscape, and laundry efficiencies to document water conservation design characteristics, subject to approval by the Director of Public Utilities. 6. The development shall incorporate water use efficiency for landscaping including the use of artificial turf and native plant materials. reducing turf areas, and discouraging the development of artificial lakes, fountains and ponds unless only untreated surface water or recycled water supplies are used for these decorative and recreational water features as appropriate and sanitary. 7. All irrigation clocks/control devices shall be based on evapotranspiration and include the use of soil probes and rain sensors. 8. All multi-story building(s) shall incorporate booster pumps for domestic water use within the building(s). 9. Proposed Parcels "D" and "F" are located within the jurisdiction of Pinedale Public Utility District for water service. The applicant should contact Pinedale Public Utility District for service conditions and/or restrictions. 10. Seal and abandon any existing on-site well in compliance with the State of California Well Standards, Bulletin 74-90 or current revisions issued by California Department of Water Resources and City of Fresno standards. 11. Two independent sources of water, meeting Federal and State Drinking Water Act Standards, are required to serve the tract including any subsequent phases thereof. The two-source requirement may be accomplished through any combination of water main extensions, construction of supply wells, or other acceptable sources of water supply approved by the Assistant Public Utilities Director.
