The City of Fresno Planning Division has received the notice of appeal dated May 07, 2010 regarding the Conditions of Approval for Tentative Parcel Map No. 2009-11 dated May 03, 2010. This letter is written to advise you that the Director of the Planning and Development Department, upon further review of the conditions of approval, has made the following determinations with respect to the conditions of approval: 1. Condition No. 9 of the Conditions of Approval for Tentative Parcel Map No. 2009-11 dated May 03, 2010 shall remain with no modification. • NOTE: This is a general condition applicable to all projects involving off-site and public improvements where such requirements are specifically referenced and conditioned elsewhere in the document. If no off-site public improvements are specifically required within the conditions of approval, then this condition does not apply. Furthermore, if appropriate legal agreements have been entered into (in a form acceptable to the City of Fresno) with another entity for assumption of responsibilities referenced as requirements within the conditions of approval, then the City will concede that the obligations of such assumptions may be the responsibility of the assigned respective to said agreement. 2. Condition No. 10 of the Conditions of Approval for Tentative Parcel Map No.2009-11 dated May 03, 2010 shall remain with no modification. • NOTE: This is a general condition applicable to all projects involving off-site and public improvements where such requirements are specifically referenced and conditioned elsewhere in the document. If no off-site public improvements are specifically required within the conditions of approval, then this condition does not apply. Condition No. 11 of the Condil:ions of Approval for Tentative Parcel Map No.2009-11 dated May 03, 2010 shall remain with no modification. • NOTE: This is a standard condition applied to all proposed subdivisions or new development. However, it is acknowledged that the Fresno Municipal Code provides that the Director of Public Works may waive or defer certain improvement requirements associated with the development or subdivision of property. If a waiver or deferment of required improvements has been granted,then a recordable written agreement should have been prepared for such purpose. Upon receipt of an agreement demonstrating the determination of a waiver or deferment by the Public Works Director, staff will remove the respective condition; or, consider the condition as having been satisfied for the purposes of recordation of the Parcel Map. 4. Condition No. 13 of the Conditions of Approval for Tentative Parcel Map No. 2009-11 dated May 03, 2010 shall remain with no modification. • NOTE: This is a standard condition applicable to all projects to bring improvements within the public streets rights-of-way into compliance with contemporary standards. Verification of satisfaction of this condition is required to be made by City of Fresno Construction Management staff. Upon receipt of a determination by a City Engineering Inspector regarding satisfaction of this requirement,staff will remove the respective condition; or, consider the condition as having been satisfied for the purposes of recordation of the Parcel Map. 5. Condition No. 20 of the Conditions of Approval for Tentative Parcel Map No.2009-11 dated May 03, 2010 shall remain with no modification. • NOTE: Verification of satisfaction of this condition is required to be made by City of Fresno Construction Management staff. Upon receipt of a determination by a City Engineering Inspector regarding satisfaction of this requirement, staff will remove the respective condition; or, consider the condition as having been satisfied for the purposes of recordation of the Parcel Map. (Please also see notes above regarding assumption of obligations by separate entities.) 6. Condition No. 21 of the Conditions of Approval for Tentative Parcel Map No.2009-11 dated May 03, 2010 shall remain with no modification. • NOTE: Verification of satisfaction of this condition is required to be made by City of Fresno Construction Management staff. Upon receipt of a determination by a City Engineering Inspector regarding satisfaction of this requirement,staff will remove the respective condition; or, consider the condition as having been satisfied for the purposes of recordation of the Parcel Map. 7. Condition No. 23 of the Conditions of Approval for Tentative Parcel Map No.2009-11 dated May 03, 2010 shall remain with no modification. • NOTE: This is a general condition applicable to all projects involving off-site and public improvements where such requirements are specifically referenced and conditioned elsewhere in the document. Condition No. 26 of the Conditions of Approval for Tentative Parcel Map No.2009-11 dated May 03, 2010 shall remain with no modification. 10. Condition No. 29 of the Conditions of Approval for Tentative Parcel Map No.2009-11 dated May 03, 2010 shall remain with no modification. • NOTE: Please reference the attached memorandum from the Department of Public Works, Parks Supervisor dated May 11, 2010 for further information regarding this condition and its satisfaction. The Conditions of Approval dated May 03, 2010 shall remain in effect except as modified herein above. EXPIRATION: The approval or conditional approval of this tentative Parcel Map expires two years from the date of the original approval of the tentative parcel map on May 03, 2010. The revisions to the conditions of approval for the tentative parcel map shall not affect the anniversary date of the approved tentative map. The expiration shall terminate all proceedings and a final Parcel Map may not be filed without first processing a new Tentative Parcel Map. EXTENSION: Modification of a tentative parcel map after approval or conditional approval does not extend the two year time limit. The divider may request an extension of the tentative map expiration date by filing a written application together with the fee set forth in the Master Fee Schedule at the time of the request with the Director of the Planning & Development Department at least thirty days before the expiration date of the map. The applicant must state the reasons for requesting the extension. New conditions may be imposed if an extension is granted. Discretionary extensions may not exceed an aggregate of six years. Memorandum from the Department of Public Works, Parks Supervisor dated May 11, 2010 DEPARTMENT OF a LIBLIC WORKS TO: Will Tackett, Planner III Planning Department FROM: Hilary Kimber, Parks Supervisor II (559.621.8794) Public Works, Engineering Division DATE: May 11, 2010 SUBJECT: Tentative Parcel Map 2009-11; (APN: 477-124-38) In Reference to the Letter by Matthew Greenwood dated May 7, 2010 asking for the removal of certain conditions: The Public Works street tree requirements were first set on October 30, 2008 for C-08- 256, Edison Plaza Partnership, L.P. This CUP encompassed land from E. California to E. Lorena Ave. on S. Plumas St, from S. Plumas St. to S. Walnut Ave. on E. California Ave., from E. California Ave to the alleyway n/o E. Lorena Ave. on S. Walnut Ave. and the north side of E. Lorena from S. Plumas St. to the east end of the cul-de-sac. The second time this project was addressed was on April 21, 2009 with a revised site plan by Scott Beck on plans dated January 29, 2009. This plan set also included a conceptual landscape plan from Riverside Landscape dated January 20, 2009. Conditions for 4'x6' tree wells on S. Walnut and E. California Avenues; and onsite trees on E. Lorena Ave. in-lieu-of street trees. Plumas St. was still under consideration for a proposed alignment and E. Atchison Ave. was to be abandoned. To this date, I have never received landscape and irrigation plans for landscaping within the right-of-way and for onsite trees planted in-lieu-of street trees. Sophia Pagoulatos, Planning Manager, also does not have any copies of landscape and irrigation plans for onsite. Therefore, the landscaping and irrigation plan requirements for C-08-256 have not been met for both the Planning and Public Works Departments as some of the landscaping has already been installed. During the landscape maintenance period of the median island on S. Plumas St. I have observed five (5) Chinese Pistache (Pistacia chinensis) planted onsite within 10' of the back of the monolithic sidewalk on E. Lorena Ave. which will meet the Public Works street tree requirements for that street. There are eight (8) Goldenrain Trees (Koereuteria paniculata) onsite planted within 10' of the monolithic sidewalk on S. Plumas St. (one of which is dead). The dead tree should be replaced, then these eight trees will meet the Public Works requirement for the partial landscaping on S. Plumas St. (n/w corner is still undeveloped). There are no tree wells installed on E. California Ave. as required. There are nine (9) Chinese Pistache planted onsite; however, due to their location not residing within the 10' of the back of the monolithic sidewalk, these trees are not accepted as street trees. There is a parkstrip on S. Walnut Ave. instead of tree wells. Acceptable trees planted in the parkstrip will count towards the street tree requirements. There is one (1) Black A Tupelo (Nyssa sylvatic, , planted in the parkstrip in between .. _,ifornia and the first drive approach, one (1) planted in between the two drive approaches, five (5) planted in front of the church (one is dead) and two (2) trees planted in between the drive approach and Geary, and another two (2) planted in between Geary and the alleyway for a total of ten (10) trees planted within the parkstrip. The requirements for street trees planted on S. Walnut Ave. are eleven (11). When the dead tree is replaced, it will count towards the street tree requirement for S. Walnut Ave. The landscaping in the parkstrip along S. Walnut is dying due to an ineffective irrigation system. Prior to planking the dead Black Tupelo, it is suggested the irrigation system be checked for viability. The onsite Chinese Pistache and Goldenrain Trees planted on E. Lorena and S. Plumas, and the Black Tupelo trees on S. Walnut will meet the Public Works requirements for street trees when the dead trees have been replaced and landscape and irrigation plans are provided and approved by Public Works. The trees on E. California do not meet the Public Works requirement for street trees. Landscape and irrigation plans must be submitted for approved trees in tree wells along E. California Ave. All of the above information concerns the requirements for the site plan C-08-256 as referenced in Matthew Greenwood's letter, Item 29 that "All requirements have been met with CUP No. 08-256" and therefore, the street tree requirements for PM 2009-11 should be removed as a 'no comment'. Firstly, the conditions for C-08-256 have not been met. I have given steps to take so those conditions can be met. Secondly, Site Plans and Parcel Maps are two separate entities even though they may overlap; one is not reliant on the other. Therefore, Public Works set the S. Walnut Ave. street tree conditions in the Parcel Map (there is one dead Nyssa and dying shrubs in the parkstrip) as a measure to meet the our requirements for landscape and irrigation plans. The Parcel Map conditions will partially meet the Site Plan conditions for C-08-256. Public Works is not rescinding the landscape and irrigation plans or the street tree requirements at this time. The following conditions should be removed from the said draft, dated May 3, 2010. Item 9,the off-site and public improvements have been completed by California One Stop Reconstruction Project and Redevelopment Agency of the City of Fresno. The subdivider is not responsible for any off-site expenses. Item 10, all the off-site and public improvements have been accepted by the City of Fresno Construction Management Department. Item 11, the only existing overhead utilities are located along the West side of existing South Walnut Avenue. This requirement was waived by Conditional Use Permit No. 08-256. Item 13, Conditional Use Permit No. 08-256 installed all required sidewalks and wheel chair ramp landings with"Detectable Warning Devise". Item 20, please refer to Item 9, above. All requirements have been satisfied. Item 21, all street work has been completed and now exists. Item 22, this does not belong in the conditions. This is a different review process. Item 23, this does not apply. Item 26, the Department of Public Utilities should provide a letter of"No Comment". This site already has existing services installed by C.U.P. No. 08-256. v %aw Item 27, the Department of Public Utilities should provide a letter of"No Comment". This site already has existing services installed by C.U.P. No. 08-256. Item 29, the Department of Public Works, Parks Division should provide a letter of"No Comment". All requirements have been met with C.U.P. No. 08-256. The above Conditions of Approval items are "Boiler Plate" comments that should be amended for site specific conditions. The City of Fresno requires permits for all those items constructed and presumably all the City employees have access to the information. This information should not be the responsibility of the developer to prove, at the developers' expense. I don't believe Mayor Swearingin's pledge to "Fast Tract" projects can be accomplished with typical comments being forwarded to you from various City of Fresno Departments. PLAN CONSISTENCY 2. The subject site is located within the jurisdictions of the 2025 Fresno General Plan, Edison Community Plan, Fresno-Chandler Downtown Airport Master and Environs Specific Plan and Southwest Fresno General Neighborhood Renewal (GNRA) Redevelopment Plan. These plans designate the subject property for development with Office Commercial planned land uses. Pursuant to Table 2 (Planned Land Use and Zone District Consistency Matrix)of the 2025 Fresno General Plan and applied within all community plans the existing C-P/cz (Administrative and Professional Office District/with conditions of zoning) zone district is consistent with the Office Commercial planned land use designation for the subject property. ZONING 3. Comply with the provisions of the State of California Government Code Sections §66410 - §66499.58 of the SMA and the City FMC Chapter 12, Article 10 (Subdivision of Real Property). 4. Approval of Tentative Parcel Map No. 2009-11 for Condominium Purposes is contingent upon approval of Conditional Use Permit Application No. C-08-256; authorizing the planned development of the subject property. a) Conditional Use Permit Application No. C-08-256 shall be approved prior to recordation of the Final Map; and, shall include the property lines as proposed pursuant to Tentative Parcel Map No. 2009-11 dated March 22, 2010. b) All previously imposed conditions of approval respective to the use of the subject property as authorized by Conditional Use Permit Application No. C-08-256 remain in effect and are incorporated herein by reference. �.' 40w, Conditions of Approval Tentative Parcel Map No. 2009-11 May 03, 2010 Page 3 5. Execute a Mutual Easements and Reciprocal Use Agreement between proposed Parcel"A" of Tentative Parcel Map No. 2009-11, and Parcels 1 and 2 of the document entitled "Grant Deed" recorded May 20, 2009 as Instrument No. 2009-0068811 of Official Records (i.e., APN[s] Nos. 477-124-36 & 37). The Mutual Easements and Reciprocal Use Agreement shall, at a minimum, provide: (1)Mutual and reciprocal access to South Plumas Street and East Lorena, East California and South Walnut Avenues; (2) Shared parking; (3) Cross drainage; (4) Shared solid waste facilities; and, (5) Maintenance and retention of on-site utilities and/or improvements as may be appropriate. The required Mutual Easements and Reciprocal Use Agreement shall also contain a term, which assures that combinations of facilities within the proposed planned development shall provide the automobile parking area or number of spaces required for each facility, and that the area or spaces provided for one facility shall not be construed as satisfying the requirements of another facility. 6. Whenever a subdivision, includes area under common ownership, the use, maintenance, and operation thereof shall be administered by an owner's association regulated by covenants, conditions, and restrictions(CC&R's)pursuant to Section 12-1026 of the Fresno Municipal Code. a) Submit draft copies of Covenants, Conditions and Restrictions/Owners Association documents(CC&R's)for review and approval. Final,executed and notarized documents shall be recorded with the final map or alternatively submit recorded documents or docuements for recording. In an effort to improve storm runoff quality, outdoor storage areas shall be constructed and maintained such that material that may generate contaminants will be prevented from contact with rainfall and runoff and thereby prevent the conveyance of contaminants in runoff into the storm drain system. The District encourages, but does not require that roof drains from non-residential development be constructed such that they are directed onto and through a landscaped grassy swale area to filter out pollutants from roof runoff. Runoff from areas where industrial activities, product, or merchandise come into contact with and may contaminate storm water must be directed through landscaped areas or otherwise treated before discharging it off-site or into a storm drain.
