(APN: 501-043-06) The City of Fresno Planning Division has completed its review of the subject parcel map dated Septernber 02, 2008. Pursuant to Section 12-1205 of the Fresno Municipal Code, this letter is written to advise you that the Conditions of Approval dated December 17, 2008, are as noted on the attached document. Appeal: The divider or any aggrieved person may file an appeal regarding to conditions of approval within fifteen (15) days from the date of approval. To protest the Director's decision regarding the conditions of approval, you must appeal by filing a written appeal with the Director of the Planning & Development Department. Appeal must include the appellant's interest in/or relationship to the subject property,the decision or action appealed,and specific reasons why the appellant believes the decision or action appealed should not be upheld. Appeals must be submitted to the Director of the Planning and Development Department prior to 5 p.m. on January 05, 2009. EXPIRATION: The approval or conditional approval of this tentative Parcel Map expires two years from the date of approval. The expiration shall terminate all proceedings and a final Parcel Map may not be filed without first processing a new Tental:ive Parcel Map. Modification of a Tentative Parcel Map after approval or conditional approval does not extend the two year time limit. EXTENSION: The divider may request an extension of the tentative map expiration date by filing a written application together with the fee set forth in the Master Fee Schedule at the time of the request with the Director of the Planning& Development Department at least thirty days before the expiration date of the map. The applicant must state the reasons for requesting the extension. New conditions may be imposed if an extension is granted. Sincerely, PLANNING DIVISION Will ackett, Planner III PI ning and Development Department Enclosures: Vesting Tentative Parcel Map No. 2007-33 dated September 02, 2008 Conditions of Approval dated December 17, 2008 CITY OF FRESNO PLANNING AND DEVELOPMENT DEPARTMENT CONDITIONS OF APPROVAL DECEMBER 17, 2008 VESTING TENTATIVE PARCEL MAP No. 2007-33 "A PLANNED DEVELOPMENT" Northeast corner of the intersection of West Herndon and North Blythe Avenues; northwest corner of West Herndon Avenue and the new North Blythe Avenue Alignment. NOTICE TO PROJECT APPLICANT All tentative maps are subject to the applicable provisions of the State Subdivision Map Act (SMA), Fresno Municipal Code (FMC), City policies, and City of Fresno Standard Specifications. The following specific conditions are applicable to this tentative map. In accordance with the provisions of Government Code §66020(d)(1), the imposition of fees, dedications, reservations or exactions for this project are subject to protest by the project applicant at the time of approval or conditional approval of the development or within 90 days after the date of the imposition of the fees, dedications, reservations or exactions imposed on the development project. Upon conditional approval of Vesting Tentative Parcel Map No. 2007-33, a Planned Development, dated September 08, 2008, the subdivider may prepare a Final Parcel Map in accordance with the approved tentative map. Note that a final parcel map may not be filed until the appeal period has expired. Should an appeal be filed pursuant to Section 12-1207 of the FMC, the application will be scheduled to be heard before the City of Fresno Planning Commission. The appellant may withdraw their appeal pursuant to Section 12-1207.2 of the FMC. Concurrent with the filing of a final map and when the provisions of Section §66436 of the SMA apply, the subdivider is responsible to send, by certified mail, a sketch of the proposed final map, together with a copy of Section §66436(a)(3)(A)of the SMA,to any public entity or public utilitywhich has previously acquired a right-of-way easement. LEGAL STATUS OF SITE TO BE SUBDIVIDED The parcel map site is situated in the City of Fresno, County of Fresno, State of California, and was legally created as Parcel "A" of Lot Line Adjustment 04-92, in the City of Fresno, County of Fresno, State of California, as evidenced by an approved Application for Lot Line Adjustment recorded May 06, 1992 as Instrument No. 92-59864 of Official Records, in the Office of the County Recorder of said county and being more particularly described as follows: Lot 109 of Sierra Sky Park, according to the Map thereof recorded in Book 13, Page 27 of Plats, Fresno County Records. AP N(S): 501-043-06 PLAN CONSISTENCY 1. The proposed parcel map,together with its design and improvements is consistent with the City's 2025 Fresno General Plan, Bullard Community Plan, and Sierra Sky Park Land Use Policy Plan; all of which designate the site for Special Commercial planned land uses. The existing C-3/EA/UGM (Regional Shopping Center/Expressway Area Overlay/Urban Growth Management) zone district may be found to be consistent with the Special Commercial planned land use for the subject property pursuant to the description/definition of the Special Commercial planned land use within Section 4.2.1 of the Bullard Community Plan, which includes the provision of commercial goods and services to the large planned residential area between Sierra Sky Park and the Santa Fe railroad tracks. Furthermore, while the Special Commercial planned land use designation for the subject property is not included within the consistency matrix of the 2025 Fresno General Plan, pursuant to Section 12-403- B-2 of the Fresno Municipal Code, a zone district that does not meet the criteria of the Consistency Table may be determined consistent with the applicable General,community or specific plan subject to the submittal of a development plan. Site Plan Review Application No. S-07-107 was approved on May 30, 2008 and will serve as the development plan for the subject property. ZONING 1. Comply with the provisions of the State of California Government Code Sections §66410 - §66499.58 of the SMA and the City FMC Chapter 12, Article 10 (Subdivision of Real Property). The abandonment/vacation of North Blythe Avenue, as noted on the map, shall occur or be perfected prior to the acceptance of the Parcel Map (final). MODIFICATIONS TO PROPERTY DEVELOPMENT STANDARDS 3. Proposed Parcels "A"through "G," inclusive, of Vesting Tentative Parcel Map No. 2007-33 are consistent with the existing C-3 (Regional Shopping Cenfe� zone district subject to approval of a special permit for a planned development project. a) Site Plan Review Application No. S-07-107 shall be approved prior to recordation of the Parcel Map and shall include the property lines as proposed pursuant to Vesting Tentative Parcel Map No. 2007-33, dated September 08, 2008 thereby authorizing the creation of the commercial planned development. 4. In accordance with Section 12-1011-f(6) every lot shall abut on a public street,except where adequate internal circulation is provided by a private street or streets in an approved planned unit development a) All parcels must provide access to a public street right-of-way under a planned development special permit. • NOTE: In accordance with Section 12-219.5-J of the Fresno Municipal Code, there shall be adequate vehicular access from a dedicated and improved street, service road, or alley,to all lands within the C-3 zone district,the design of which shall be approved by the Director of Public Works. b) Access, circulation, and parking on the subject property shall be provided and maintained in accordance with approved entitlements for the subject property(Site Plan Review Application No. S-07-107); or, any revisions or amendments thereto, as may be approved by the Planning and Development Department. No modifications to said access or circulation may be made without prior approval from the Planning and Development Department. i) Execute a Mutual Easements and Reciprocal Use Agreement between Parcels "A" through "G" of Vesting Tentative Parcel Map No. 2007-33 dated September 08, 2008, inclusive. The Mutual Easements and Reciprocal Use Agreement shall, at a minimum, provide mutual and reciprocal access to North Blythe and West Spaatz Avenues, shared parking, cross drainage,shared solid waste facilities(if applicable), provisions and obligations for retention and maintenance of access, utilities, facilities, and improvements on the subject property.The required Mutual Easements and Reciprocal Use Agreement shall also contain a term, which assures that combinations of facilities within the proposed planned development shall provide the automobile parking area or number of spaces required for each facility, and that the area or spaces provided for one facility shall not be construed as satisfying the requirements of another facility. Conditions of Approval Vesting Tentative Parcel Map No. 2007-33 December 17, 2008 Page 4 • NOTE: The conditions of the Mutual Easements and Reciprocal Use Covenant are intended to benefit the public and public properties as well as properties appurtenant;and,secure the enforceability of properties'obligations for retention and maintenance of access, utilities, facilities, and improvements. Failure to comply with the terms of the Covenant may result in the revocation of the Certificate of Occupancy of Special Permit by the City for use of any Parcel of the properties involved. Accordingly, the City of Fresno shall have the right to enforce this Statement by any legal or equitable means. For further information regarding these requirement Contact the Planning and Development Department at (559) 621-8277. ii) Final, executed and notarized documents shall be recorded with the parcel map. c) All of the agreements required to be executed within this section shall run with the land and bind all successors and assigns. • NOTE: Any amendment to the above provisions or any other provision specifying any right of the City shall require the prior written consent of the City. GENERAL CONDITIONS 5. Any existing and/or proposed structure(s) on the site may be affected due to the location of the proposed parcel lines. The placement of a parcel line in close proximity to any existing and/or proposed structure(s) requires that the structure(s) be found in compliance with the fire resistive standards of the Uniformed Building Code, Chapter 5. a) Compliance with the prevailing Uniform Building Code as it relates to exterior wall protection, allowable area, etc. (as applicable to new parcel line locations) must be demonstrated prior to recordation of the Parcel Map. Contact the Planning and Development Department, Building and Safety Services Division at (559) 621-8200. • NOTE: In the event the structures do not comply they must be modified so as to meet the requirement. 6. All off-site and public improvements shall be constructed in accordance with the Public Works Department Standards, Specifications and Policies. Engineered construction plans and estimates for all or part of the required work shall be required prior to the issuance of Street Work Permits unless otherwise determined by the City Engineer. The cost for such plan preparation, review and construction inspection shall be at the subdivider's expense. 9. Any existing utilities, including but not limited to, street lights, traffic signals, fire hydrants, poles (power, telephone, cable, etc.), which must be relocated or removed in conjunction with the construction of these off-site improvement requirements, shall be the responsibility and at the expense of the subdivider. 10. All existing overhead utilities, including but not limited to, electrical systems,communication systems and street lighting systems shall be placed underground in accordance with the Conditions of Approval Vesting Tentative Parcel Map No. 2007-33 December 17, 2008 Page 5 provisions of Section 12-1011 and Resolution No. 78-522/88-229, and the policies of the Public Works Department. 11. When street/safety lighting installations are required,street lighting plans shall be submitted for review and approval by the Traffic Engineer prior to the issuance of permits for the work. Services to street lighting installations shall be separated from the electrical service(s) serving the development. The type, location and service for street lighting installations shall be as determined by the Traffic Engineer. Street lighting installations shall be dedicated to the City upon completion and acceptance of the installations. 12. Sidewalks(including wheelchair ramp landings)and driveway approaches,for undeveloped parcels of this parcel map,shall be required and constructed at the time of site development. a) Curb ramps are required at all corners within the limits of this parcel map. 13. Whenever covenants or agreements are required, they shall be prepared by the city upon receipt of the fee in accordance with the adopted Master Fee Schedule. All covenants and agreements must be approved by the City Attorney's Office and shall be recorded with the final parcel map. 14. Telephone, cable, and other public utilities which propose above-ground facilities (such as cabinets) deterrnined by the Planning and Development Director to be oversized shall be located in an additional easement area outside of the required landscape strip. 15. All work and engineered plans for public improvements shall conform to the 2002 Edition of the City of Fresno Standard Specifications and Drawings(City Council Resolution No.70-36 and Resolution Nos. 84-361) and any amendments thereto, hereinafter referred to as the Public Works Standards. 16. The subdivider shall dedicate and construct public easements to facilitate the construction of curbs, gutters, sidewalks with street tree wells and irrigation systems (when applicable), permanent pavement, street/safety lighting, bus bays, right turn lanes, bike lanes, bike paths, multi-purpose trail,wheelchair ramps and public utilities in accordance with City plans, ordinances, resolutions and policies, and the Standard Specifications of the Public Works Department within the limits of-the parcel map. 17. Existing improvements that are not to the planned alignment shall be removed and required improvements installed to the new street alignment and grade. Existing improvements to remain in place shall be repaired if determined to be damaged and/or off grade by the City Engineer. Existing driveway approaches not identified for current or future utilization shall be removed and sidewalk(when applicable),curb and gutter shall be installed to match existing or proposed street line and grade as determined by the City Engineer. 18. A rninimum four foot wide clear path of travel is required along the public sidewalk on all frontages of the property as required by Title 24 of the California Administration Code as determined by the City Engineer. An on-site pedestrian easement and construction of a path may be required if Title 24 provisions cannot be met within the public rights-of-way. All such Conditions of Approval Vesting Tentative Parcel Map No. 2007-33 December 17, 2008 Page 6 public easements shall be identified and dedicated with the processing and recordation of the Final Parcel Map and/or at the time of Special Permit review for the proposed development of the parcel(s). 19. All required signing and striping shall be installed and paid for by the developer/owner. The signing and striping plans shall comply with the current Caltrans standards and shall be submitted to the Public Works Department for review and approval as a part of the street improvement plans for this tentative map. 20. Additional off-site improvements will be required at the time of future site plan review. 21. The subdivider may either construct or install the required improvements,when required;or, enter into a bonded secured agreement with the City of Fresno providing for the construction of the required improvements and sufficient security prior to the approval of the final parcel map. SPECIFIC CONDITIONS STREET NAMES 22. Comply with all of the requirements and conditions of the Public Works Department, Engineering Division memorandum dated January 25, 2008. 24. This map is incomplete. Provide the following information to the satisfaction of the Public Works Department, Engineering Division prior to recordation of the Parcel Map: a) The southerly 26 feet of the proposed vacated North Blythe Avenue shall be retained as a Pedestrian/Bike Easement, along westerly alignment of Blythe. b) Show the proposed modified median island in the new Blythe-Spaatz alignment north of West Herndon Avenue, see attached Exhibit"A". MAJOR STREETS: West Herndon Avenue (Expressway[1347: 25. Dedicate a 26-foot (minimum) wide easement for Bike and Pedestrian purposes only. Conditions of Approval Vesting Tentative Parcel Map No. 2007-33 December 17, 2008 Page 7 (Additional right-of-way may be required for grading and drainage purposes.) 26. Construct a 12-foot wide concrete Bike and Pedestrian trail/path, complete with lighting, signing, striping, and landscaping, per the 2025 Fresno General Plan, Multi-Purpose Trails Plan Map and Public Works Standards P-59 and P-60 and the attached Exhibit "B". a) Identify route on the site plan and provide a cross-section prior to permits. b) Construct an expressway barrier fence within the limits of this application, per Public Works Standard P-74 and P-75. c) Submit engineered construction plans to Public Works. Submit lighting, signing and striping plans to Traffic Engineering for approval. Submit grading, landscape and irrigation plans to Engineering Services. 27. Where not existing, construct concrete curb and gutter to Public Works Standard P-5. The parkway shall be constructed to a 10-foot pattern. 28. Where not existing,construct 20 feet of permanent paving within the limits of this application and transition paving as necessary. 29. Construct an 80-foot bus bay curb and gutter at the northwest corner of Herndon and Blythe to Public Works Standard P-73, complete with a 10-foot monolithic sidewalk. 30. Where not existing, construct an underground street lighting system to Public Works Standard E-1 within the limits of this application. a) Spacing and design shall conform to Public Works Standard E-10 for Expressways; or, b) Show the existing street light locations on the plans and demonstrate that the existing street lights are constructed per current City of Fresno Standards. 31. Relinquish direct vehicular access rights to West Herndon Avenue within the limits of this application. QI 46- North 44M Avenue —West Spaatz Avenue (Modified Collector f94'-124'1): 32. Dedicate right-of-way as shown on the drawing number 15-A-7861 (attached), for public street purposes within the limits of this application to match the existing improvements to City of Fresno Modified Collector Standards. 33. Vacate the excessive right-of-way to match the existing street improvements at the northwest corner of this map prior to building permits. a) Submit an application for a feasibility study for all required vacations of existing public street rights-of-way prior to the approval of the Parcel Map. Conditions of Approval Vesting Tentative Parcel Map No. 2007-33 December 17, 2008 Page 8 i) The vacation of existing public rights-of-way shall be approved prior to development on the subject property. (Include this note on 'the site plan.) ii) If determined appropriate by the feasibility study, the vacation of existing public rights-of-way shall be perfected prior to occupancy of site improvements. • NOTE: This condition will be made a requirement of Site Plan Review Application No. S-07-107 authorizing the planned development of the subject property. The subdivider/developer of the subject property shall provide the City with a written agreement acknowledging this requirement of the conditions of approval for Site Plan Review Application No. S-07-107 prior to recordation of the Parcel Map. 34. Where not existing, construct concrete curb, gutter and sidewalk to Public Works Standard P-5. The curb shall be constructed to a 10-foot commercial pattern. 35. Where not existing, construct 20 feet of permanent paving (measured from face of curb) within the limits of this application. 36. Construct an underground street lighting system to Public works Standard E-1 within the limits of this application. a) Spacing and design shall conform to Public Works Standard E-10 for Expressways; or, b) Show the existing street light locations on the plans and demonstrate that the existing street lights are constructed per current City of Fresno Standards. New West Spaatz Avenue Alignment(108'-150'): 37. Vacate unnecessary right-of-way adjacent to this application, as shown on the map, prior to building permits. a) Submit an application for a feasibility study for all required vacations of existing public street rights-of-way prior to the approval of the Parcel Map. Contact Alan James of the Public Works Department at (559) 621-8693. i) The vacation of existing public rights-of-way shall be approved prior to development on the subject property. (Include this note on the site plan.) ii) If determined appropriate by the feasibility study, the vacation of existing public rights-of-way shall be perfected prior to occupancy of site improvements. • NOTE: This condition will be made a requirement of Site Plan Review Application No. S-07-107 authorizing the planned development of the subject property. The subdivider/developer of the subject property shall provide the City with a written agreement acknowledging this requirement of the conditions of Conditions of Approval Vesting Tentative Parcel Map No. 2007-33 December 17, 2008 Page 9 approval for Site Plan Review Application No. S-07-107 prior to recordation of the Parcel Map. 38. Comply with Section of the City Municipal Code. PY-HO/ o /v J_ 39. Modify the existing median and construct a new median island on North Blythe Avenue north of West Herndon Avenue to accommodate a northbound left turn into the subject property and eliminate left turns out, as shown on the attached Exhibit "A". 40. Relinquish direct vehicular access rights to North Blythe Avenue from West Herndon Avenue to the existing driveway approach, (as shown on the map). SANITARY SEWER SERVICE Sanitary Sewer Requirements: The nearest sanitary sewer mains to serve the proposed project are an 8-inch sanitary sewer main located in North Blythe Avenue and an 8-inch sanitary sewer main located in West Spaatz Avenue. Sanitary sewer facilities will be available to provide service to the site subject to the following requirements: 41. Connection to the 45-inch sanitary sewer main located in West Herndon Avenue shall not be allowed. 42. On-site sanitary sewer facilities shall be private. 43. Separate sewer house branches are required for each new lot created. 44. Abandon all existing on-site private sanitary septic systems. 45. Comply with all of the requirements of the Department of Public Utilities, Planning and Engineering memorandum dated January 16, 2008. Sanitary Sewer Fees: 46. The following Sewer Connection Charges are due and shall be paid for the Project: a) Sewer Lateral Charge b) Oversize Sewer Charge Area: 201s c) Trunk Sewer Charge d) Trunk Sewer Service Area: Herndon WATER SERVICE The following conditions are required to provide water service to the development: 47. Seal and abandon existing on-site well(s) in compliance with the State of California Well Standards, Bulletin 74-90 or current revisions issued by California Department of Water Resources and City of Fresno standards. 49. All public water facilities shall be constructed in accordance with Public Works Department Standards, specifications, and policies. 50. Comply with all of the requirements of the Department of Public Utilities, Water Division memorandum dated January 09, 2008. FRESNO METROPOLITAN FLOOD CONTROL DISTRICT (FMFCD) 51. The subdivider shall be required to comply with all of the specific requirements imposed by the FMFCD for the subdivision or any amendments or modifications to those requirements, which may be granted by the FMFCD Board of Directors, pursuant to Section 13-1307 of the FMC. These requirements are identified in the attached District's letter to the Planning and Development Department dated January 14, 2008. DEPARTMENT OF PUBLIC WORKS-SPECIAL DISTRICTS/PROJECTS AND RIGHTS-OF-WAY 52. Comply with all of the requirements of the attached memorandum from the Department of Public Works, Parks Supervisor dated January 09, 2008. STATE OF CALIFORNIA DEPARTMENT OF TRANSPORTATION (CALTRANS) 53. Attached for the applicant's records and consideration is the State of California Department of Transportation (Caltrans) memorandum dated January 23, 2008. BUREAU OF FIRE PREVENTION AND INVESTIGATIVE SERVICES 54. Attached for the applicant's records and consideration is the Fresno Fire Department memorandum dated January 10, 2008. COUNTY OF FRESNO — ROAD MAINTENANCE AND OPERATIONS DIVISION 55. Encroachment permits shall be required for any sewer or water trench cuts, utility work, etc. within West Spaatz avenue. FRESNO IRRIGATION DISTRICT 56. Comply with all of the requirements of the attached Fresno Irrigation District memorandum dated January 28, 2008. Runoff from the"EK"system will ultimately drain to the San Joaquin River. Drainage runoff from commercial and industrial land uses directly to the river is prohibited by City of Fresno and District policy. The District is therefore requiring on-site mitigation of the runoff quality prior to discharge to the public drainage system. The specific plan and detail of the proposed mitigation must be reviewed and approved by the District prior to implementation. The developer is responsible to implement mitigation features which will maintain compliance with the Local,State,and EPA standards and regulations throughout the life of the project. The subject site at the west property line contains a portion of an existing canal and an 18" storm drain pipeline that is used to manage recharge, storm water, and/or flood flows. The existing capacity must be preserved as part of site development. Additionally, site development may not interfere with the ability to operate and maintain the canal or pipeline. No encroachment over the pipelines shall be permitted including, but not limited to, foundations, roof overhangs, swimming pools, and trees. The following paragraphs only apply towards development of the individual parcels and are not conditions for the recording of the map. In an effort to improve storm water runoff quality, outdoor storage areas shall be constructed and maintained such that material which generates contaminants will not be conveyed by runoff into the storm drain system. The District encourages, but does not require that roof drains from non-residential development be constructed such that they are directed onto and through a landscaped grassy swale area to filter out pollutants from roof runoff. Runoff from areas where industrial activities, product, or merchandise come into contact with and may contaminate storm water must be directed through landscaped areas or otherwise treated before discharging it off-site or into a storm drain. Roofs covering such areas are recommended. Cleaning of such areas by sweeping instead of washing is to be required unless such wash water can be directed to the sanitary sewer system. Storm drains receiving untreated runoff from such areas that directly connect to the District's system will not be permitted. Loading docks, depressed areas, and areas servicing or fueling vehicles are specifically subject to these requirements. There are a total of thirty nine(39) street trees required for this project, fourteen(14) trees on West Herndon Avenue, and seven(7) trees on North Bryan Avenue and eighteen(18) trees on West Spaatz Avenue. Because there is an existing 10' sidewalk pattern on West Spaatz Avenue, the Public Works Department will accept street trees planted within 10' of the back of the sidewalk in-lieu-of street trees for this project. A trail system is proposed for West Herndon Avenue. The landscape plans and Final Map will need to indicate a Landscape Easement for Multi-Purpose Trails. The pipeline was installed as 30" diameter cast-in-place monolithic concrete pipe (CIP). CIP is a non-reinforced pipe that is easily damaged, extremely prone to leakage and does not meet FID's minimum standards for developed areas. FID requires the applicant replace the existing pipe with new 30" diameter rubber gasket reinforced concrete pipe (RGRCP) ASTIvI C-361, in accordance with FID standards and that the applicant enter into an agreement with FID for that purpose. 3. Should the pipeline be placed in a different alignment FID will require an additional easement be granted to FID. The applicant will need to meet with FID to determine the necessary alignment and width. 4. FID requires its easement be shown on the map with proper recording information, and that FID be made a party to signing all plans which affect its easement and canal/pipeline facility and also be made party to signing the final map.
