The City of Fresno Planning Division has completed its review of the subject parcel map dated
September 14, 2006. Pursuant to Section 12-1205 of the Fresno Municipal Code, this letter is
written to advise you that the Conditions of Approval dated November 16,2006,are as noted on the
attached document.
Appeal: The divider or any aggrieved person may file an appeal regarding to conditions of approval
within fifteen (15) days from the date of approval.
To protest the Directors decision regarding the conditions of approval, you must appeal by filing a
written appeal with the Director of the Planning & Development Department. Appeal must include
the appellant's interest in/or relationship to the subject property,the decision or action appealed,and
specific reasons why the appellant believes the decision or action appealed from should not be
upheld.
Appeals must be submitted to the Director of the Planning and Development Department prior to 5
p.m. on December 20, 2006.
EXPIRATION: The approval or conditional approval of this tentative Parcel Map expires two years
from the date of approval. The expiration shall terminate all proceedings and a final Parcel Map
may not be filed without first processing a new Tentative Parcel Map.
Modification of a Tentative Parcel Map after approval or conditional approval does not extend the
two year time limit.
EXTENSION: The divider may request an extension of the tentative map expiration date by filing a
written application together with the fee set forth in the Master Fee Schedule at the time of the
request with the Director of the Planning& Development Department at least thirty days before the
expiration date of the map. The applicant must state the reasons for the requesting the extension.
New conditions may be imposed if an extension is granted.
An extension may not exceed an aggregate of five years.

VESTING TENTATIVE PARCEL MAP No. 2006-38
East side of South East Avenue between East Central and East North Avenues
NOTICE TO PROJECT APPLICANT
All tentative maps are subject to the applicable provisions of the State Subdivision Map Act, Fresno
Municipal Code (FMC), City policies, and City of Fresno Standard Specifications. The following
specific conditions are applicable to this vesting tentative map.
In accordance with the provisions of Government Code §§66020(d)(1), the imposition of fees,
dedications, reservations or exactions for this project are subject to protest by the project applicant at
the time of approval or conditional approval of the development or within 90 days after the date of the
imposition of the fees, dedications, reservations or exactions imposed on the development project.
Upon conditional approval of Vesting Tentative Parcel Map No.2006-38,dated September 14,2006,
the subdivider may prepare a Final Parcel Map in accordance with the approved tentative map. Note
that a final parcel map may not be filed until the appeal period has expired. Should an appeal be filed
pursuant to Section 12-1207 of the FMC,the application will be scheduled to be heard before the City
of Fresno Planning Commission. The appellant may withdraw their appeal pursuant to Section
12-1207.2 of the FMC.
Concurrent with the filing of a final map and when the provisions of Section 66436 of the Subdivision
Map Act apply,the subdivider is responsible to send, by certified mail, a sketch of the proposed final
map, together with a copy of SMA Section 66436(a)(3)(A), to any public entity or public utility which
has previously acquired a right-of-way easement.
LEGAL STATUS OF SITE TO BE SUBDIVIDED
1. The parcel map site was legally created as:
Parcel C of Lot Line Adjustment No. 1999-32, in the city of Fresno,County of Fresno,State of
California,as evidence by an approved application of Lot Line Adjustment recorded on April 5,
2000,as Instrument 2000-0040243 of Official Records, in the office of the County Recorder of
said county and being more particularly described as follows:
The North quarter of the Southwest quarter and that portion of the Northwest quarter of
Section 26, Township 14 South, Range 20 East, Mount Diablo Base and Meridian, lying
Southerly of the centerline of the North Central Canal.
Excepting the East 1,755.04 feet thereof.
Also excepting therefrom the interest in all mineral rights in and under said land previously
reserved by record.

PLAN CONSISTENCY
2. The subject site is located within the jurisdiction of the Roosevelt Community Plan and the
2025 Fresno General Plan both of which designate the subject site for development with
heavy industrial planned land uses. Pursuant Table 2 of the 2025 Fresno General Plan, the
heavy industrial planned land use designation is consistent with the existing M-3/UGM(Heavy
Industrial/Urban Growth Managemeno zone district.
ZONING
3. Comply with provision of the State of California Government Code Sections §66410 -
§66499.58 SMA and the City FMC Chapter 12, Article 10 (Subdivision of Real Property).
4. Proposed Parcels A, B and C are consistent with the existing M-3/UGM zone district in terms
of lot area, depth and width. Furthermore, all proposed parcels abut a public right-of-way.
5. A covenant, to be prepared by the City,is required. The covenant shall require cross access
among proposed Parcels A, B and C of Vesting Tentative Parcel Map No. 2006-38. The
covenant shall run with the land and shall be recorded in the Office of the County Recorder.
Submit a copy of a title report identifying ownership and pay a fee in the amount of$250.00(or
fee at the time of submittal of the noted document in accordance with the adopted Master Fee
Schedule) to the Planning and Development Department.
GENERAL CONDITIONS
6. All off-site and public improvements shall be constructed in accordance with the Public Works
Department Standards, Specifications and Policies. Engineered construction plans and
estimates for all or part of the required work shall be required prior to the issuance of Street
Work Permits unless otherwise determined by the City Engineer. The cost for such plan
preparation, review and construction inspection shall be at the subdivider's expense.
7. Any existing utilities, including but not limited to,street lights,traffic signals,fire hydrants,poles
(power, telephone, cable, etc.), which must be relocated or removed in conjunction with the
construction of these off-site improvement requirements,shall be the responsibility and at the
expense of the subdivider.
8. All existing overhead utilities, including but not limited to, electrical systems, communication
systems and street lighting systems shall be placed underground in accordance with the
provisions of Section 12-1011,and Section 8-801 of the FMC, Resolution No.78-522/88-229,
and the policies of the Public Works Department.
9. When street/safety lighting installations are required,street lighting plans shall be submitted
for review and approval by the Traffic Engineer prior to the issuance of permits for the work.
Services to street lighting installations shall be separated from the electrical service(s)
serving the development. The type, location and service for street lighting installations shall
be as determined by the Traffic Engineer. Street lighting installations shall be dedicated to
the City upon completion and acceptance of the installations.

10. Sidewalks(including wheelchair ramp landings)and driveway approaches,for undeveloped
parcels of this parcel map,shall be required and constructed at the time of site development.
11. Whenever covenants or agreements are required, they shall be prepared by the city upon
receipt of the fee in accordance with the adopted Master Fee Schedule. All covenants and
agreements must be approved by the City Attorney's Office and shall be recorded with the
final parcel map.
12. Telephone, cable, and other public utilities which propose above-ground facilities(such as
cabinets) determined by the Planning and Development Director to be oversized shall be
located in an additional easement area outside of the required landscape strip.
13. All work and engineered plans for public improvements shall conform to the 2002 Edition of
the City of Fresno Standard Specifications and Drawings(City Council Resolution No.70-36
and Resolution Nos. 84-361) and any amendments thereto, hereinafter referred to as the
Public Works Standards.
14. The subdivider shall dedicate and construct public easements to facilitate the construction of
curbs, gutters, sidewalks with street tree wells and irrigation systems (when applicable),
permanent pavement, street/safety lighting, bus bays, right turn lanes, bike lanes, bike
paths, multi-purpose trail,wheelchair ramps and public utilities in accordance with City plans,
ordinances, resolutions and policies, and the Standard Specifications of the Public Works
Department within the limits of the parcel map.
15. Existing improvements that are not to the planned alignment shall be removed and required
improvements installed to the new street alignment and grade. Existing improvements to
remain in place shall be repaired if determined to be damaged and/or off grade by the City
Engineer. Existing driveway approaches not identified for current or future utilization shall be
removed and sidewalk(when applicable),curb and gutter shall be installed to match existing
or proposed street line and grade as determined by the City Engineer.
16. A minimum four foot wide clear path of travel is required along the public sidewalk on all
frontages of the property as required by Title 24 of the California Administration Code as
determined by the City Engineer. An on-site pedestrian easement and construction of a path
may be required if Title 24 provisions cannot be met within the public rights-of-way. All such
public easements shall be identified and dedicated with the processing and recordation of
the Final Parcel Map and/or at the time of Special Permit review for the proposed
development of the parcel(s).
17. All required signing and striping shall be done and paid for by the developer/owner. The
signing and striping plans shall be done per the current CalTrans standards and shall be
submitted as a part of the street construction plans for this tentative map to the Public Works
Department for review and approval.

18. The subdivider may either construct the required off-site improvements,when required,prior
to the approval of the final parcel map; or enter into an agreement with the City of Fresno
providing for the construction of the required improvements and sufficient security prior to
the approval of the final parcel map.
SPECIFIC CONDITIONS
STREET NAMES
19. The following street name(s) shall be corrected on Vesting Tentative Parcel Map No.
2006-38:

FIRE SERVICE
20. The Fresno Fire Department has indicated that the development of these parcels will require
the extension of the 14 inch city water main in South East Avenue approximately 1,250 feet
to the south and the addition of public fire hydrants every 450 feet along the frontage.
STREETS AND RIGHTS-OF-WAY
South East Avenue(Collector Street):
21. Construct concrete curb and gutter to Public Works Standard P-5. The sidewalk pattern
shall be constructed to 10 foot pattern.
22. Construct 20 feet of permanent paving (measured from face of curb)within the limits of this
map.
23. Construct an underground street lighting system (four lights)to Public Works Standard E-1
within the limits of this map. Spacing and design shall conform to Public Works Standard
E-8 for Collector Streets.
24. Irrigation/Canal Requirements: The developer shall enter into an agreement with the Fresno
Irrigation District(FID) providing for piping the canal(s) and submit an executed copy of the
agreement or commitment letter from FID to the Planning and Development Department. All
piping shall be located outside of the proposed street right-of-way. Any piping across city
streets shall be rubber gasketed reinforced concrete pipe (RGRCP) constructed
perpendicular to the street. Submit engineered plans to Public Works Department,
Engineering Division for review and approval.
25. Comply with Public Works Department, Engineering Division memorandum dated
September 7, 2006.

Sanitary Sewer Service
26. Construct an eight inch sanitary sewer main from the northerly portion of the proposed
project south across the project frontage for connection to future sewer service in East
Central Avenue.
27. Separate sewer house branches are required for each lot.
28. Abandon all existing on-site private sanitary septic tanks.
29. The project developer should contact Wastewater Management Division/Environmental
Services at (559) 621-5100 regarding conditions of service for special users.
30. Comply with the Department of Public Utilities, Planning and Engineering memorandum
dated October 18, 2006.
Sanitary Sewer Fees
31. The following Sewer Connection Charges are due and shall be paid for the Project:

Water Service
32. Construct a 14 inch transmission grid water main (including installation of City fire hydrants)
in South East Avenue extending the existing 14 inch main south of East North Avenue south
across the frontage of the parcel map.
33. Construct a 12 inch water main (including installation of City fire hydrants) within a 30 foot
water easement along the east boundary of the parcel map extending the existing 12 inch
water main south across the frontage of the parcel map.
34. Construct a 12 inch water main (including installation of City fire hydrants) within a 30 foot
water easement along the south boundary of the parcel map from South East Avenue east
across the frontage of the parcel map.
35. Separate services with meter boxes shall be provided to each parcel.
36. Seal and abandon existing on-site wells in compliance with the State of California Well
Standards, Bulletin 74-90 or current revisions issued by California Department of Water
Resources and City of Fresno standards.

37. Two independent sources of water, meeting Federal and State Drinking Water Act
Standards, are required to serve the development including any subsequent phases thereof.
The two source requirement may be accomplished through a combination of water main
extensions, construction of supply wells, or other acceptable sources of water supply
approved by the Water Systems Manager.
38. All public water facilities shall be constructed in accordance with Public Works Department
standards, specifications and policies.
FLOOD CONTROL AND DRAINAGE
39. The subdivider shall be required to comply with the specific requirements imposed by the
Fresno Metropolitan Flood Control District(FMFCD)for the subdivision or any amendments
or modifications to those requirements, which may be granted by the FMFCD Board of
Directors, pursuant to Section 13-1307 of the Fresno Municipal Code. These requirements
are identified in the attached District's letter to the Planning and Development Department
dated November 1, 2006.
40. The cost of construction of Master Plan facilities, excluding excavation and dedication of
storm drainage easements, is eligible for credit against the drainage fee of the drainage area
served by the facilities. A Development Agreement shall be executed with the District to
effect such credit. Reimbursement provisions, in accordance with the Drainage Fee
Ordinance,will be included to the extent that Developer's Master Plan costs for an individual
drainage area exceed the fee of said area. Should the facilities cost for such individual area
total less then the fee of said area,the difference shall be paid upon demand to the City or
District.
41. The Developer may construct the"Optional Master Plan facilities,"as shown on Exhibit No.
1, to provide permanent drainage service to SPR No. 2006-034. Developer shall give the
District 90 days advanced notification and time schedule of the Developer's intent to
construct the "Optional Master Plan facilities." The District and Developer will need to
coordinate the availability of the District's property and improvements for Basin "AX."
42. If the Developer chooses to construct the "Optional Master Plan facilities" and provides
storage in Basin "AX," the volume that must be excavated is 22,000 cubic yards and the
excavation shall be as directed by the District in an excavation permit obtained from the
District.
43. Prior to any work being initiated it he basin,the Developer or his Contractor shall obtain an
excavation permit from the District. The work consisting solely of stockpiling material
excavated from the basin within the basin, will not require a permit fee. However, for
material removed from the basin (off-site), a permit fee shall be paid prior to receiving the
permit. No importing of material is permitted.

44. The Developer shall acquire a 20 foot wide storm drainage easement and 30 foot wide
temporary construction easement to construct the"Optional Master Plan facilities,"as shown
on Exhibit No. 1 at no expense to the District. The District will consider acquisition of the
easements on behalf of the Developer if he cannot negotiate an acquisition. FMFCD needs
substantial advance notice to acquire property(180 days). The Developer shall deposit with
the District the estimated easement and appraisal costs with the Developers authorization to
proceed with any acquisition. The deposit shall include all acquisition costs, including if
determined by the District to be warranted, applicable legal costs.
45. The construction of the"Optional Master Plan facilities"includes storm drain work off-site of
this project in major streets. In order to minimize the interference with traffic,time limits and
liquidated damages will be included in the District/Developer Agreement and the
construction documents for the storm drain. Failure to comply with the limits will result in
reduced fee credits.
FRESNO IRRIGATION DISTRICT (FID)
46. FID's North Central No.26 pipeline traverses the subject property in the following exclusive
easement:
1. Recorded on February 23, 1977 as Document No. 17940, in Book 6745 Page 359,
Official Records of Fresno County.
II. Recorded on December 1,2003 as Document No.2003-0287117,Official Records of
Fresno County.
47. FID requires its easement be shown on the map with proper recording information,and that
FID be made a party to signing all plans which affect its easement and canal/pipeline facility
and also be made party to signing the final map.
DEPARTMENT OF TRANSPORTATION (CALTRANS)
48. The California Department of Transportation (Caltrans), District 6, Office of
Intergovernmental Relations has reviewed the proposed parcel map and request to review a
detailed operational statement at the time of tenant occupancy as indicated in their letter
dated October 17, 2006.

BACKGROUND
Vesting Tentative Parcel Map No.2006-38 filed by R.W. Greenwood Associates, Inc., on behalf of
Hey Dude, LP, and accepted for processing on September 14, 2006, proposes to create three
parcels for approximately 24.32 acres of property located on the east side of South East Avenue
between East Central and East North Avenues. The subject property is within the jurisdiction of the
Roosevelt Community Plan and the 2025 Fresno General Plan both of which designate the subject
property for heavy industrial planned land uses. The site is zoned M-3/UGM (Heavy
IndustriaUUrban Growth Management) and pursuant to Table 2 (Planned Land Use and Zone
District Consistency Matrix) of the 2025 Fresno General Plan and applied within all community
plans, the existing M-3/UGM zone district is consistent with the planned land use designation
of heavy industrial.
The proposed parcels meet all the property development standards of the M-3 zone district in terms
of lot area, depth,and width. All three parcels have access to a public right-of-way(i.e.,South East
Avenue). In addition to submitting the parcel map,the applicant filed and was granted approval of
Site Plan Review Application No. S-06-034 which proposed to develop the site with three concrete
tilt up buildings totaling 512,380 square feet. These buildings will be used as distribution
warehouses. This proposed project is an amendment to a previously approved project which
authorized the development of a 548,640 square foot warehouse(Site Plan Review Application No.
S-02-002). The site plan depicts cross access to and from all three buildings and therefore staff will
require that applicant provide a cross access agreement once the property lines are established per
the parcel map. This condition as well as other comments and conditions from responding agencies
have been incorporated into the conditions of approval for Vesting Tentative Parcel Map No.2006-
38 dated November 16, 2006.

REQUIRED FINDINGS
The initial study prepared for Environmental Assessment No.TPM No.2006-38 considered potential
environmental impacts associated with the tentative parcel map. The environmental assessment
resulted in a Class 15 Categorical Exemption (Section 15315/Minor Land Division of the California
Environmental Quality Act), was filed on November 16, 2006 with the City Clerk. Staff determined
that a Class 15 Categorical Exemption was appropriate given that the proposed project is located
within the M-3 zone district; the division consists of dividing land into four or fewer parcels; no
variances or exceptions are required; all services and access to the proposed parcel is to local
standards; the division of land is not involved in a division of a larger parcel within the previous 2
years; and the parcels do not have an average slope greater than 20 percent.
STATE SUBDIVISION MAP ACT
The Subdivision Map Act (California Government Code Section 66410 et. seq.) requires that a
proposed parcel map not be approved unless the map,together with its design and improvement,is
found to be consistent with the General Plan and any applicable specific plan(Finding No. 1 below).
State law further provides that the proposed parcel map be denied approval if any one of the Finding
Nos. 2-5, below, is made in the negative.
1. The proposed parcel map,together with its design and improvements is consistent with the
City's Roosevelt Community Plan and the 2025 Fresno General Plan which designate the
site for heavy industrial planned land uses which is consistent with the existing M-3/UGM
zone district.
2. The site is physically suitable for the proposed development because of the flat terrain of the
site and adequate access and drainage on and off the site. The Fresno Metropolitan Flood
Control District will require that the drainage from the site be diverted to the Master Plan
Inlets.
3. The proposed parcel map design and improvements are not likely to cause substantial and
considerable damage to the natural environment, including fish,wildlife or their habitat.The
site is located in an area that is fully developed with industrial uses. The area does not and
would not provide value for wildlife.
4. The proposed parcel map design and improvements are not likely to cause serious public
health and safety problems, because the conditions of approval have shown and will insure
that the subdivision conforms with City health and safety standards.
5. The proposed parcel map design will not conflict with pubic easements within or through the
site because conditions of approval will assure noninterference with any existing or
proposed public easements.
Staff, based on its own analysis, has determined that the parcel map, subject to the recommended
conditions of approval, otherwise complies with the design and property development standards of
the Zoning Ordinance and local Parcel Map Ordinance and recommends the approval of the parcel
map.

DIRECTOR DETERMINATION
1. Based upon the above analysis,the Planning and Development Director finds that Vesting
Tentative Parcel Map No. 2006-38 dated September 14, 2006, is consistent with the

Map No. 2006-38 dated September 14, 2006, subject to the conditions of approval dated

C. The proposed development is encouraged to select and implement storm water quality
controls recommended in the Fresno-Clovis Storm Water Quality Management
Construction and Post-Construction Guidelines (available at the District Office)to
meet the requirements of the State General Permits, eliminate the potential for non-
storm water to enter the municipal storm drain system, and where possible minimize
contact with materials which may contaminate storm water runoff.

EXHIBIT NO. 2
The cost of construction of Master Plan facilities, excluding excavation and dedication of storm
drainage easements, is eligible for credit against the drainage fee of the drainage area served by the
facilities. A Development Agreement shall be executed with the District to effect such credit.
Reimbursement provisions, in accordance with the Drainage Fee Ordinance,will be included to the
extent that Developer's Master Plan costs for an individual drainage area exceed the fee of said area.
Should the facilities cost for such individual area total less than the fee of said area, the difference
shall be paid upon demand to the City or District.
The Developer may construct the "Optional Master Plan facilities", as shown on Exhibit No. 1, to
provide permanent drainage service to SPR 2006-034. Developer shall give the District 90 days
advanced notification and time schedule of the Developer's intent to construct the"Optional Master
Plan Facilities". The District and Developer will need to coordinate the availability of the District's
property and improvements for Basin"AX".
If the Developer chooses to construct the "Optional Master Plan facilities" and provide storage in
Basin"AX",the volume that must be excavated is 22,000 cubic yards and the excavation shall be as
directed by the District in an excavation permit obtained from the District.
Prior to any work being initiated in the basin, the Developer or his Contractor shall obtain an
excavation permit from the District. The work consisting solely of stockpiling material excavated
from the basin within the basin,will not require a permit fee. However, for material removed from
the basin(off-site),a permit fee shall be paid prior to receiving the permit. No importing of material
is permitted.
The Developer shall acquire a twenty-foot(20')wide storm drain easement and thirty-foot(30')wide
temporary construction easement to construct the "Optional Master Plan facilities", as shown on
Exhibit No. 1 at no expense to the District. The District will consider acquisition of the easements
on behalf of the Developer if he cannot negotiate an acquisition. FMFCD needs substantial advance
notice to acquire property (180 days). The Developer shall deposit with the District the estimated
easement and appraisal costs with the Developers authorization to proceed with any acquisition. The
deposit shall include all acquisition costs, including if determined by the District to be warranted,
applicable legal costs.

OTHER REQUIREMENTS
EXHIBIT NO. 2
The construction of the "Optional Master Plan facilities" include storm drain work off-site of this
project in major streets. In order to minimize the interference with traffic,time limits and liquidated
damages will be included in the District/Developer Agreement and the construction documents for
the storm drain. Failure to comply with the time limits will result in reduced fee credits.
The following paragraphs only apply towards development of the individual parcels and are not
conditions for the recording of the map.
In an effort to improve storm water runoff quality, outdoor storage areas shall be
constructed and maintained such that material which generates contaminants will not
be conveyed by runoff into the storm drain system.
The District encourages, but does not require that roof drains from non-residential
development be constructed such that they are directed onto and through a
landscaped grassy swale area to filter out pollutants from roof runoff.
Runoff from areas where industrial activities, product, or merchandise come into
contact with and may contaminate storm water must be directed through landscaped
areas or otherwise treated before discharging it off-site or into a storm drain. Roofs
covering such areas are recommended. Cleaning of such areas by sweeping instead
of washing is to be required unless such wash water can be directed to the sanitary
sewer system. Storm drains receiving untreated runoff from such areas that directly
connect to the District's system will not be permitted. Loading docks, depressed
areas, and areas servicing or fueling vehicles are specifically subject to these
requirements. The District's policy governing said industrial site NPDES program
requirements are attached.

FID's comments and requests are as follows:
1. FID's North Central No. 26 pipeline traverses the subject property in the following
exclusive easements:
• Recorded on February 23, 1977 as Document No. 17940, in Book 6745 Page 359,
Official Records of Fresno County.
• Recorded on December 1, 2003 as Document No. 2003-0287117, Official Records of
Fresno County.
2. FID requires its easements be shown on the map with proper recording information, and
that FID be made party to signing all plans which affect its easements and canal/pipeline
facility and also be made party to signing the final map.

Subject: SANITARY SEWER REQUIREMENTS FOR PM-2006-38
General
PM-2006-38 proposes approximately 14.41 acres of property located on the east side of South East
Avenue between East North and East Central Avenues.
Environmental Recommendations
A NEGATIVE DECLARATION MAY BE ISSUED: The project may have adverse impacts but impacts
can be mitigated without further study or are not serious enough to warrant an Environment Impact
Report.
Sanitary Sewer Requirements
Sanitary sewer service is unavailable to serve the proposed project at this time.
1. Construct an 8-inch sanitary sewer main from the northerly portion of the proposed project south
across the project frontage for connection to future sewer service in East Central Avenue.
2. Separate sewer house branches are required for each lot.
3. Abandon all existing on-site private sanitary septic systems.
4. The project developer should contact Wastewater Management Division/Environmental Services
(559) 621-5100 regarding conditions of service for special users.

Sanitary Sewer Fees
The following Sewer Connection Charges are due and shall be paid for the Project:
1. Sewer Lateral Charge
2. Oversize Sewer Charge
3. Trunk Sewer Charge
4. Sewer Facility Charge (Non-Residential)
Upon connection of this Project to the City Sewer System the owner shall be subject to payment of Sewer
Facility charges per Fresno Municipal Code Section 9-505.1 and 9-505.2. Sewer Facility Charges consist
of two components, a Wastewater Facilities Charge and Trunk Sewer Charge where applicable.
Sewer Facility Charges are collected after occupancy on a bi-monthly basis over time based on metered
(water or sewer effluent)usage. The developer may contact the Department of Public Utilities (559) 621-
8554 to receive an estimated cost of the Sewer Facility Charges applicable to the project (based on a
constant sewer discharge and loading (Biochemical Oxygen Demand [BOD] and Total Suspended Solids
[TSS] levels anticipated) at the current rates in effect, at that time, per Fresno's Master Fee Resolution.
The developer shall provide data regarding estimated sewer discharge rates [flow] and loading [BOD/TSS
levels] required for calculating the estimated charges.

Subject: WATER REQUIREMENTS FOR TENTATIVE PARCEL MAP NO. 2006-38
The following conditions are required to provide water service to the development.
1. Construct a 14-inch transmission grid water main (including installation of City fire
hydrants) in South East Avenue extending the existing 14-inch main south of East North
Avenue south across the frontage of the parcel map.
2. Construct a 12-inch water main (including installation of City fire hydrants)within a 30-foot
water easement along the east boundary of the parcel map extending the existing 12-inch
water main south across the frontage of parcel map.
3. Construct a 12-inch water main (including installation of City fire hydrants)within a 30-foot
water easement along the south boundary of the parcel map from South East Avenue
east across the frontage of the parcel map.
4. Separate water services with meters shall be provided to each parcel.
5. Seal and abandon existing on-site well(s) in compliance with the State of California Well
Standards, Bulletin 74-90 or current revisions issued by California Department of Water
Resources and City of Fresno standards.
6. Two independent sources of water, meeting Federal and State Drinking Water Act
Standards, are required to serve the development including any subsequent phases
thereof. The two-source requirement may be accomplished through a combination of
water main extensions, construction of supply wells, or other acceptable sources of water
supply approved by the Water Systems Manager.
7. All public water facilities shall be constructed in accordance with Public Works
Department standards, specifications, and policies.

side of East.Avenue,approximately 750 .feet south of the intersection of East and North Avenues.
Caltrans has the following comments:
Trips generated from this site might impact the State Route(SR) 41 interchange at North
Avenue. Operational improvements are needed at the SR 41 interchange at North Avenue.
These improvements include modification of the traffic signals and the addition of two through.
Janes at the undercrossing. The current total estimated cost for these improvements is
$1,500,000. Trips generated from this site are also projected to impact the SR 99 interchange at
North Avenue. Caltrans has not identified a need for improvements to the SR 99/North Avenue
interchange so we will not be requesting mitigation to SR 99/North Avenue. However, should
conditions change, we may ask future development to mitigate for impacts to this interchange.
In order to determine this development's impact to the SR 41/North Avenue;interchange, a
detailed operational statement is required. We came to an agreement with the applicant at the
site plan stage that a detailed operational statement would be provided to Caltrans at the time of
tenant occupancy. Caltrans will use this operational statement to determine ifthere will be
impacts to the interchanges.
