SIDE OF NORTH MAPLE AVENUE BETWEEN EAST COPPER AND EAST INTERNATIONAL AVENUES. The City of Fresno Planning Division has completed its review of the subject parcel map dated June 7, 2005. Pursuant to the Fresno Municipal Code FMC Section 12-1205, this letter is written to advise that the conditions of approval dated October 31, 2005, are as noted on the attached document. If you have any questions regarding the conditions notify me at (559) 621-8073 no later than December 1, 2005, to request a review of the conditions. Appeal: The divider or any aggrieved person may file an appeal regarding the conditions of approval within fifteen (15) days from the date of approval. HARO, Planning Manag Planning Division FROM: ` _PAUL BERNAL, Planner III Planning Division . . .SUBJECT: REQUIRED FPAND ROINDING APPROVAL OF TENTATIVE PARCEL MAP NO. 0WHICH POSES TO CREATE A FOUR PARCEL PLANNED DEVELOPMENT FOR PROPERTY LOCATED ON THE EAST SIDE OF NORTH MAPLE AVENUE BETWEEN EAST COPPER AND EAST INTERNATIONAL AVENUES BACKGROUND Tentative Parcel Map No. 2005-08 filed by Tejinder Randhawa, proposes to create a four lot residential parcel map planned development for approximately 2.42 acres of property on located on the east side of North Maple Avenue between East Copper and East International Avenues. Rezone Application No. R-05-23, approved by the City Council on October 11,2005 by Ordinance Bill No. 2005-119, reclassified the site to the R-1-B/UGM (Single Family Residential District/Urban Growth Management) zone district. The site is within the jurisdiction of the Woodward Park Community Plan and the 2025 Fresno General Plan. The Woodward Park Community Plan and the 2025 Fresno General Plan designate the subject property for low density residential planned land uses. Although Table 2 (Planned Land Use and Zone District Consistency Matrix) of the 2025 Fresno General Plan does not identify R-1-B zoning as consistent with the low density residential planned land use Section 12-403-B-2 of the Fresno Municipal Code(FMC)allows a proposed zone change that does not meet the criteria.of the Zone District Consistency Table to be deemed consistent with the corresponding land use designated by the General Plan and any applicable community plan subject to the submittal and approval of a development plan. The applicant has submitted Conditional Use Permit Application No.C-05-095 which is proposing to establish a planned development for private street purposes and establish building setbacks. The conditional use permit was approved by the Planning and Development Department Director on October 31,2005.. It is noted that Tentative Parcel Map No.2005-08 is proposing to create parcels that deviate from the property development standards of the R-1-B zone district given that the proposed parcels do not abut a public street or right-of-way. Pursuant to Section 12-306-N-21 of the FMC, the Director may modify property development standards of single family residential zoned property which is not less than two acres in area and to individual lots proposed to be created within such site subject to the filing and approval of a single unified project which is covered by a development entitlement (i.e. C-05-095). However, because the approved CUP did not depict the proposed parcel lines staff will require that the applicant revise the CUP inclusive of the proposed property lines. These conditions, as well other responding agencies conditions have been incorporated into the Conditions of Approval dated October 31,2005,for Tentative Parcel Map No. 2005-08. Planning & Development Department Tentative Parcel Map No. 2005-08 October 31, 2005 Page 2 REQUIRED FINDINGS The initial study prepared for Environmental Assessment No.R-05-23/TPM No.2005-08/C-05-95 considered potential environmental impacts associated with the rezone and conditional use permit applications and parcel map. The study indicates that the project, if approved,would conform to the land use designation and land use policies of the 2025 Fresno General Plan and is within the scope of the Master Environmental Impact Report No. 10130. Therefore, staff has issued a finding of conformity to the 2025 Fresno General Plan Master Environmental Impact Report(MSIR No. 10130) dated June 29, 2005,.which incorporates a MEIR Mitigation Monitoring Checklist. STATE SUBDIVISION MAP ACT The Subdivision Map Act (California Government Code Section 66410 et. seq.) requires that a proposed parcel map not be approved unless the map,together with its design and improvement,is found to be consistent with the General Plan and any applicable specific plan(Finding No. 1 below): State law further provides that the proposed parcel map be denied approval if anyone of the Finding Nos, 2-5, below, is made in the negative. 1. The proposed.parcel map,together with its design and improvements is consistent with the City's Woodward Park Community Plan and the 2025 Fresno General Plan.The Woodward Park Community Plan and the 2025 Fresno General Plan designate the site for low density residential planned land uses which is consistent with the R-1-B zone district as identified in Section 12-403-13-2 of the FMC. 2.1 The site is physically suitable for the proposed development because of the flat terrain of the site and adequate access and drainage on and off the site. The Fresno Metropolitan Flood Control District will require that the drainage from the site be diverted to the Master Plan Inlets. 3. The proposed parcel map design and improvements are not likely to cause substantial and considerable damage to the natural environment, including fish,wildlife or their habitat.The site is located in an area that is fully developed with residential uses. The area does not and would not provide value for wildlife. 4. Theproposedparcel map design and improvements are not likely to cause serious public health and safety problems,because the conditions of approval have shown and will insure that the subdivision conforms with City health and safety standards. In addition, during the entitlement process,staff will ensure that the conditions of zoning will be applied accordingly- 5. The proposed parcel map design will not conflict with pubic easements within or through the site because conditions of approval will assure noninterference with any existing or proposed public easements. Staff, based on its own analysis, has determined.that the parcel map, subject to the recommended conditions of approval,otherwise complies with the design and property development standards of the Zoning Ordinance and local Parcel Map Ordinance and recommends the approval of the parcel map. . Based upon the above analysis,the Planning and Development Director finds that Tentative Parcel Map No. 2005-08 dated June 7, 2005, is consistent with the applicable plans and policies of the City of Fresno. 2. The following specific conditions are applicable to this tentative map. In accordance with the provisions of Government Code 66020(d)(1), the imposition of fees, dedications, reservations or exactions for this project are subject to protest by the project applicant at the time of approval or conditional approval of the development or within 90 days after the date of the imposition of the fees, dedications, reservations or exactions imposed on the development project. Upon conditional approval of Tentative Parcel Map No.2005-08,dated June 07,2005,the subdivider may prepare a Final Parcel Map in accordance with the.approved tentative map. Note that a final parcel map may not be filed until the appeal period has expired. Should an appeal be filed pursuant to Section 12-1207 of the FMC,the application will be scheduled to be heard before the City of Fresno Planning Commission. The appellant may withdraw their appeal pursuant to Section 12-1207.2 of the FMC. Concurrent with the filing of a final map and when the provisions of Section 66436 of the Subdivision Map Act apply,the subdivider is responsible to send, by certified mail, a sketch of the proposed final map, together with a copy of SMA Section 66436(a)(3)(A), to any public entity or public utility which has previously acquired a right-of-way easement. LEGAL STATUS OF SITE TO BE SUBDIVIDED 1. The parcel map site was legally created as the South 165 feet of the North 542.30 feet of the West one-half of the Southwest one-quarter of the Northwest one-quarter of Section 13, Township 12 South, Range 20 East, Mount Diablo Base and Meridian, according to the Official Plat thereof. EXCEPTING THEREFORM an undivided one-half interest in and to all oil, gold or other minerals that may be situated in or under said land as reserved in the Deed recorded November 5, 1925 in Book 608, Page 6 of Official Records, Document No. 29578. PLAN CONSISTENCY 2. The subject site is located within the jurisdiction of the Woodward Park Community Plan and the 2025 Fresno General Plan. The Woodward Park Community Plan and the 2025 Fresno General Plan designate the parcel map for development with the low density residential Conditions of Approval Tentative Parcel Map No. 2005-08 October 31, 2005 - Page t planned land uses. The Zoning District Consistency Table of the FMC identifies low density residential planned land uses as consistent with the R-1-B/UGM (Single Family Residential DistrictlUrban Growth Management)zone district pursuant to Section 1.2-403-B-2 of the FMC. ZONING 3. Comply with provision of the State of California Government Code Sections 66410-66499.58 (the Subdivision Map Act) and the City of Fresno Municipal Code Chapter 12, Article 10 :(Subdivision of Real Property). 4.. Proposed parcels are consistent pursuant to Section 12-407.5 of the FMC. 5. Relinquish vehicular access rights to North Maple Avenue from Parcel A of Tentative Parcel Map No. 2005-08 dated June 7, 2005. 6. Pursuant to Policy 3-4.6 of the Woodward Park Community Plan provide a mandatory 20-foot landscape easement(and irrigation system)along the western property line of Parcel A which will be maintained by the homeowners association. 7. Construct a six-foot high solid masonry wall (at finished grade of proposed site) pursuant to the solid wall requirements of Section 12-306-H of the FMC at the rear of the required 20-foot landscape easements along North Maple Avenue.: Construction plans for required walls showing architectural appearance and location of all walls shall be submitted to the Planning and Development Department for review prior to Final Map approval: 8. Provide a corner cut-off area at the intersection of North Maple Avenue and the proposed private street easement in accordance with Section 12-306-H-3-d of the FMC. Corner cut-offs are established to provide an unobstructed view for vehicular and pedestrian traffic approaching an intersection. They are a triangular area formed by the property lines and a diagonal line adjoining points on the property lines, measured a specific distance from the point of their intersection. At the intersections of.streets, this distance is 30 feet. In case of rounded corners to the lot,the triangular area formed between the tangents to the curve and a diagonal line joining points on said tangent 30 feet. The corner cut-off area shall be landscaped including an irrigation system. 9. When the grading plan establishes a top of slope beyond the required landscape easement noted and the construction of the required wall is to be established coincident with the top of slope then the required minimum easement width shall be expanded to include the full landscaped area up to the wall location. MODIFICATIONS TO PROEPRTY DEVELOPMENT STANDARDS 10. Proposed parcels must be consistent with the R-1-B zone district for the parcel map site in terms of lot depth and area subject to approval of a special permit for a planned development project. All parcels must provide.access to public street rights-of-way under a planned development special permit. Conditions of Approval Tentative Parcel Map No.2005-08 October 31, 2005 Page 3 11. Conditional Use Permit Application No.C-05-095,which was approved on October 31,2005, by the Planning and Development Department Director, authorized_the development of residential planned development. The conditional use permit authorized the creation of a private street which provides access to the proposed parcels and proposed setbacks. The site plan shall be revised depicting the property lines as shown on Tentative Parcel Map No. 2005-08 dated June 7, 2005. .12. Submit draft copies of Covenants,Conditions and Restrictions/Owners Association documents (CC&R's)for review and approval. Final,executed and notarized document are to be located with the parcel map. CC & R's shall conform with the provisions of Section 12-1026 of the FMC and address ingress, egress, sewer and water service maintenance and access, fire protection, solid waste service, storm drainage, parking and landscaping as follows: i. Cross access for ingress/egress ii. Cross drainage Covenant for shared parking - iv. Covenant to maintain sewer, water and all other utilities v. Covenant for fire protection underground water supplies vi. Covenant to maintain all landscaping within the limits of this map vii. Covenant for shared solid waste facilities viii. Provide covenant agreement for access to land locked parcels ix. Provide covenant agreement for maintenance of fire suppression water system 13. The placement of a parcel line in close proximity to any existing and/or proposed structures requires that the structure be found in compliance with the fire resistive standards of the Uniformed Building Code, Chapter 5. In the event the structures do not comply they must be modified so as to meet the requirement. - 14. The proposed structure(s) on the site may be affected due to the location of the proposed parcel lines. Compliance with the prevailing Uniform Building Code as it relates to exterior wall protection, allowable area, etc. (as applicable to new parcel line locations) must be :. demonstrated prior to final map submittal. Contact the Planning and Development Department, Building and Safety Services Division at (559) 621-8200. GENERAL CONDITIONS 15. All off-site and public improvements shall be constructed in accordance with the Public Works Department Standards, Specifications and Policies.` Engineered construction plans and estimates for all or part of the required work shall be required prior to the issuance of Street Work Permits unless otherwise determined by the City Engineer. The cost for such plan preparation, review and construction inspection shall be at the subdivider's expense. 16. Any existing utilities, including but not limited to,street lights,traffic signals,fire hydrants,poles .(power, telephone, cable, etc.), which must be relocated or removed in conjunction with the construction of these off-site improvement requirements,shall be the responsibility and at the expense of the subdivider. All existing overhead utilities, including but not limited to; electrical systems, communication systems and street lighting systems shall be placed underground in accordance with the provisions.of Section 12-1011,and Section 8-801 of the FMC, Resolution No.78-522/88-229, and the policies of the Public Works Department. 18. When street/safety lighting installations are required,street lighting plans shall be submitted for review and approval by the Traffic Engineer prior to the issuance of permits for the work. Services to street lighting installations shall be separated from the electrical service(s) serving the development. The type, location and service for street lighting installations shall be as determined by the Traffic Engineer. Street lighting installations shall be dedicated to the City upon completion and acceptance of the installations. 19. Sidewalks(including wheelchair ramp landings)and driveway approaches,for undeveloped parcels of this parcel map,shall be required and constructed at the time of site development. 20. Whenever covenants or agreements are required, they shall be prepared by the city upon receipt of the fee in accordance with the adopted Master Fee Schedule. All covenants and agreements must be approved by the City Attorney's Office and shall be recorded with the. final parcel map. - 21. Telephone, cable, and other public utilities which propose above-ground facilities(such as cabinets) determined by the Planning and Development Director to be oversized shall be - located in an additional easement area outside of the required,landscape strip. 22. All work and engineered plans for public improvements shall conform to the 2002 Edition of the City of Fresno Standard Specifications and Drawings(City Council Resolution No.70-36 and Resolution Nos. 84-361) and any amendments thereto, hereinafter referred to as the Public Works Standards. 23. The subdivider shall dedicate and construct public easements to facilitate the construction of curbs, gutters, sidewalks with street tree wells and irrigation systems (when applicable), permanent pavement, street/safety lighting, bus bays, right turn lanes, bike lanes, bike paths, multi-purpose trail,wheelchair ramps and public utilities in accordance with City plans, ordinances, resolutions and policies, and the Standard Specifications of the Public Works Department within the limits of the parcel map. 24. Existing improvements that are not to the planned alignment shall be removed and required improvements installed to the new street alignment and. grade. Existing improvements to remain in place shall be repaired if determined to be damaged and/or off grade by the City Engineer. Existing driveway approaches not identified for current or future utilization shall be removed and sidewalk(when applicable),curb and gutter shall be installed to match existing or proposed street line and grade as determined by the City Engineer. 25. A minimum four foot wide clear path of travel is required along the public sidewalk on all frontages of the property as required by Title 24 of the California Administration.Code as determined by the City Engineer. An on-site pedestrian easement and construction of a path Conditions of Approval Tentative Parcel Map No. 2005-08 October 31, 2005 Page 5 may be required if Title 24 provisions cannot be met within the public rights-of-way. All such Public easements shall be identified and dedicated with the processing and recordation of the Final Parcel Map and/or at the time of Special Permit review for the proposed development of the.parcel(s). 26. All required signing and striping shall be done and paid for by the developer/owner. The signing and striping plans shall be done per the current CalTrans standards and shall be submitted as a part of the street construction plans for this tentative map to the Public Works Department for review and approval. 27. The subdivider may either construct the required off-site improvements,when required,prior to the approval of the final parcel map; or enter into an agreement with the City of Fresno providing for the construction of the required improvements and sufficient security prior to the approval of the final parcel map. SPECIFIC CONDITIONS FIRE SERVICE 28. . The Fresno. Fire Department requires that covenants be recorded for the following: L Covenant for cross.access and water, supply for all parcels inclusive of Tentative Parcel Map No. 2005-08. Ji. A private fire hydrant will be required. The location of the hydrant shall be located on the side yard property line between proposed Parcels B and C of Tentative Parcel Map No. 2005-08 dated June 7, 2005. STREETS AND RIGHTS-OF-WAY North Maple Avenue (Arterial): 29. Underground all existing offsite overhead utilities within the limits of this map in accordance with FMC Section 12-1011, 8-801 and Resolution No. 78-522/88-229. 30. Repair or replace all existing damaged and/oroff offsite concrete improvements in accordance with the Standard Specifications and Standard Drawings of the City of Fresno, Public Works Department. 31; Curb ramps are required at'all corners within the limits of this parcel map. 32. Dedicate 55-feet of property, measured from section line, for public street purposes within the limits of this parcel map. 33. Construct concrete curb, gutter and sidewalk, built to a 10-foot pattern, in accordance with Public Works Standard P-5: Conditions of Approval Tentative Parcel Map No. 2005-08 October 31, 2005 Page 6 34. Relinquishment of vehicular access to North Maple Avenue from Parcel A of Tentative Parcel Map No. 2005-08 dated June 7, 2005. 35. Construct 20-feet of permanent asphalt concrete paving, from face of curb,in accordance with Public Works Standard P-50, A.C. transition as needed. 36. Construct an underground street lighting system in accordance with Public Works Standard E-1 within the limits of this map. Spacing and design shall conform to Public Works Standard E-7 for arterial streets. 37. Tentative Parcel Map No. 2005-08 is located in UGM Major Street Zone F. 38. Comply with the Department of Public Works, Engineering Division memorandum dated July 18, 2005. SPECIFIC REQUIREMENTS 39. Redesign access to private road from North Maple Avenue to meet minimum.Public Works design standards. 40. Post"No Parking" signs on both sides of the private street. 41. Comply with all conditions issued under Conditional.Use Permit Application No. C-05-095. Sanitary Sewer Service 42. Separate sewer house branches shall be provided to each lot created: 43. Sanitary sewer mains shall be extended within the proposed map to provide sewer service to each lot created. 44. Abandon existing on-site private sanitary sewer system. 45. Public sewer facilities shall be constructed in accordance with Public Works.Department standards, specifications and policies: 46. Comply with the Department of Public Utilities memorandum dated June 22, 2005. Water Service 47. Water mains (including installation of City fire hydrants) shall be extended within the proposed tract to provide water service to each lot created. 48. Installation(s) of private fire hydrant(s) is/are required in accordance with City standards. 49. Separate water services with meter boxes shall be provided to each lot created. Seal and abandon existing on-site well in compliance with State of California Well Standards, Bulletin 74-90 or current revisions issued by California Department of Water. Resources and City of Fresno standards. 51. Two independent sources of water meeting Federal and State Drinking Water Act Standards are required to serve the tract including any subsequent phases thereof. The two source requirement may be accomplished through any combination of water main extensions, construction of supply wells, or other acceptable sources of water supply approved by the Water Systems Manager. 52. Public water facilities shall be constructed in accordance with Public Works Department , standards, specifications and policies. 53. Comply with the Department of Public Utilities memorandum dated June 22,2005. FLOOD CONTROL AND DRAINAGE 54. The subdivider shall be required to comply with the specific requirements imposed by the Fresno Metropolitan Flood Control District(FMFCD)for the subdivision or any amendments or modifications to those requirements, which may be granted by the FMFCD Board of Directors,pursuant to Section 1.3-1307 of the FMC. These requirements are identified in the attached District's letter to the Planning and Development Department dated June 21,2005. PACIFIC GAS & ELECTRIC COMPANY (PG&E) 55. Comply with PG&E's letter dated June 10, 2005. The property is located on the east side of North Maple Avenue between East Copper. and East International Avenues. The subject property is located within the jurisdiction of the Woodward Park Community Plan and the 2025 Fresno General Plan. The Woodward Park Community Plan and, the 2025 Fresno General Plan designate the site for low-density residential planned land uses. Rezone Application No. R-05-23 would bring the subject property into conformance with the Woodward Park Community Plan and the 2025 Fresno General Plan pursuant to Section 12- 403-B-2 of the Fresno.Municipal Code (FMC). The requested rezoning of the site is supported by staff and the Northeast Area Plan and Implementation Committee. On September 21, 2005, the Fresno City Planning Commission recommended approval of the rezone application to the City Council. Single Family Residential District/Urban subdivision Growth Management ENVIRONMENTAL FINDING The initial study prepared for Environmental Assessment No. R-05-23/TPM No. '2005-08/C-05-95 considered. potential environmental impacts associated with the subject rezone and conditional use permit applications and parcel map. .The study indicates that the project, if approved, would conform to the land use designation and land use policies of the 2025 Fresno General Plan and is within the scope of the Master Environmental Impact Report No. 101.30. Therefore, staff has issued a finding,of conformity to the 2025 Fresno General Plan Master Environmental Impact Report (MSIR No. 10130) dated June 29, 2005, which incorporates a MEIR Mitigation Monitoring Checklist. This environmental finding was properly published and noticed on June 29, 2005, with no comments received.. BACKGROUND/ ANALYSIS The applicant, Tejinder Randhawa, has filed Rezone Application No. R-05-23, which proposes to rezone approximately 2.42 acres of property from the R-A/UGM (Single Family Residential - Agricultural District/Urban Growth Management) zone district to the R-1-B/UGM (Single Family Residential District/Urban Growth Management) zone district. The Woodward Park Community Plan and the 2025 Fresno General.Plan designate the subject site for low-density residential planned land uses (0.0- 2.18 units per acre). As previously stated the applicant is requesting R-1-13 zoning, which according to Table 2 (Planned Land Use and Zone District Consistency Matrix) of the 2025 Fresno General Plan, is not .consistent .with the low-density residential planned land use designation. However, in, order to .meet the consistency mandate of the general plan and zoning ordinance the applicant has filed a development plan concurrent with the rezone application. Pursuant to Section .12-403-B-2 of the FMC a proposed zone change that does not meet the criteria of the Zone District Consistency Table may be deemed ;consistent with the corresponding land use designated by the General Plan and any applicable community plan subject to the submittal and approval of a development plan. The applicant has filed Conditional Use Permit Application No. C-05-95 and Tentative Parcel Map No. 2005-08 which is currently being reviewed by the Planning and Development Department. The parcel map is proposing to subdivide the subject site into four parcels while the conditional use permit is proposing to establish a planned development for private street purposes. The project proposed by the submitted applications proposing a density of 1.65 units per acre conforms to the allowable .residential density of the low-density residential planned land use designation. Northeast Area Plan and Implementation Committee The Northeast Area Plan and Implementation Committee reviewed and recommended approval of the requested rezone application and parcel map at their June 21, 2005 meeting. Fresno City Planning Commission On September 21, 2005, the Fresno City Planning Commission considered Rezone Application No. R-05-23. : The Commission voted to recommend approval of the rezone application to the City Council by a vote of 5 to 0 with one commissioner absent. Land Use Plans and Policies The goals and policies of the 2025 Fresno General Plan and the Bullard Community Plan encourage the revitalization of established urban neighborhoods by identifying infill areas where there is an opportunity to develop housing in an attempt to maximize efficient use of the land. By concentrating new development on vacant parcels located within established communities it is anticipated the overall quality of the urban environment may be improved by encouraging a vibrant and livable community. Thus, this application will further promote development of bypassed parcels. Streets and Sidewalks The applicant has also submitted Vesting Tentative Parcel Map No. 2005-08 requesting to subdivide the 2.42-acre site into a four lot single-family residential subdivision. In addition, the applicant will be required to improve North Maple Avenue and construct concrete curb and gutter within the boundaries of the parcel map. . Water Resources and Public Water Supply The Water. Division of the Department of Public Utilities has.determined that there is an adequate source of water available to serve the project with the implementation of the UGM service delivery requirements and environmental impact mitigation measures. The nearest presently available water service line is located in North Maple Avenue, adjacent to the site. The Fresno Metropolitan Flood Control District (FMFCD) has indicated that permanent flood control service is available for this project. The developer will be required to construct facilities as identified by the FMFCD. Implementation of the 2025 Fresno General Plan policies, mitigation measures of Master Environmental Impact Report No. 10130, the Water Resources Management Plan, and the mitigation measures identified by the project environmental assessment/initial study will provide an adequate, reliable and sustainable .water supply for the project's urban domestic and public safety consumptive purposes. Sewage Collection System Capacity Several major facility improvement projects have been implemented at the City of Fresno's Regional Wastewater.Treatment and Reclamation Facility in order to accommodate the projected rates of population and employment growth up to a projected population holding capacity of 590,000 people. These improvements have been completed to provide an expanded wastewater treatment and reclamation capacity of 80 million gallons per day (MGD), which is sufficient to accommodate continued planned urban development including the proposed project. REPORT TO THE CITY COUNCIL Rezone Application No. R-05-23 October 11, 2006 Page 5 The Department of Public Utilities has determined that adequate sanitary sewer service is available to serve the project, subject to the mitigation measures imposed with the environmental assessment. The nearest public sanitary sewer main to serve this project is located in North Maple Avenue. Circulation Element Plan Policies and Major Street System Traffic Capacity The 2025 Fresno General Plan designates North Maple Avenue as a collector street, which typically requires a 94-foot right-of-way width. The applicant will be required to dedicate and construct improvements on North Maple Avenue. Other improvements include the construction of curb; gutter, sidewalk, and transition paving within the limits of the tract; construction of an underground street lighting system; and relinquishment of access rights to North Maple Avenue for all residential lots adjacent to this major street frontage. These street improvements will be addressed in the conditions of approval for Tentative Parcel Map No. 2005-08. State Department of Transportation (Caltrans) The California Department of Transportation (Caltrans), District 6, Office of Intergovernmental Relations has reviewed the proposed rezone and conditional use applications and tentative parcel map and has indicated in their letter dated June 14, 2005, that they have no comments. CONCLUSION The appropriateness of the proposed project has been examined with respect to its consistency with goals and policies of the Woodward Park Community Plan and the 2025 Fresno General Plan; its compatibility with surrounding existing or proposed uses; and, its avoidance or mitigation of.potentially significant adverse environmental impacts. These factors have been evaluated as described above and by the accompanying environmental assessment. Upon consideration of this evaluation, it can be concluded that the proposed Rezone Application No. R-05-23 is appropriate for the project site. Relative to this specific project proposal, the environmental impacts noted in the MEIR, per the 2025 Fresno General Plan land use designations, include impacts associated with the low-density residential planned land use designation specified for the subject parcel Basedon this initial study, the proposed project does not change the land use indicated for the subject parcel and will not generate additional significant effects not previously identified by the MEIR and no new additional mitigation measures are required.
