HomeMy WebLinkAboutPM 2005-04 - Conditions of Approval - 1/12/2006 CITY OF FRESNO � PLANNING AND DEVELOPMENT DEPARTMENT do CONDITIONS OF APPROVAL JULY 19, 2005 �s VESTING TENTATIVE PARCEL MAP No. 2005-04 Southwest corner of East Herndon and North Willow Avenues NOTICE TO PROJECT APPLICANT All tentative maps are subject to the applicable provisions of the State Subdivision Map Act, Fresno Municipal Code (FMC), City policies, and City of Fresno Standard Specifications. The following specific conditions are applicable to this tentative map. In accordance with the provisions of Government Code §66020(d)(1), the imposition of fees, dedications, reservations or exactions for this project are subject to protest by the project applicant at the time of approval or conditional approval of the development or within 90 days after the date of the imposition of the fees, dedications, reservations or exactions imposed on the development project. Upon conditional approval of Vesting Tentative Parcel Map No.2005-04,dated March 14, 2005,the subdivider may prepare a Final Parcel Map in accordance with the approved tentative map. Note that a final parcel map may not be filed until the appeal period has expired. Should an appeal be filed pursuant to Section 12-1207 of the FMC,the application will be scheduled to be heard before the City of Fresno Planning Commission. The appellant may withdraw their appeal pursuant to Section 12- 1207.2 of the FMC. Concurrent with the filing of a final map and when the provisions of Section 66436 of the Subdivision Map Act apply,the subdivider is responsible to send, by certified mail, a sketch of the proposed final map, together with a copy of SMA Section 66436(a)(3)(A), to any public entity or public utility which has previously acquired a right-of-way easement. LEGAL STATUS OF SITE TO BE SUBDIVIDED 1. The parcel map was legally created, by deed prior to 1972, as the west half of the northeast quarter of the northwest quarter of Section 6, Township 13 South, Range 21 East, Mount Diablo Base and Meridian, in the City of Fresno, County of Fresno, State of California. Excepting therefrom that portion condemned for public purposes in favor of the City of Fresno by Final Order recorded September 16, 1993 as Document No.93142427 of Official Records. PLAN CONSISTENCY 2. The 2025 Fresno General Plan designates the parcel map site for development with neighborhood commercial and commercial office planned land uses. The Zoning District Consistency Table of the Fresno Municipal Code identifies neighborhood commercial and commercial office planned land uses as consistent with the existing C-1/EA/cz(Neighborhood Shopping Center DistricbExpressway Area Overlay Districbwith conditions of zoning) and R- Conditions of Approval Tentative Parcel Map No. 2005-04 July 19,2005 Page 2 P/cz (Residential and Professional Office District/with conditions of zoning) zone districts. ZONING 3. Comply with all provisions of the State of California Government Code Sections 66410 - 66499.58(the Subdivision Map Act)and the City of Fresno Municipal Code Chapter 12,Article 10 (Subdivision of Real Property). 4. Proposed Parcels A, B, C, D, E and F are consistent with the C-1/EA/cz (Neighborhood Shopping Center District/Expressway Area Overlay District/with conditions of zoning) and R-P/cz(Residential and Professional Office District/with conditions of zoning) zone districts. CONDITIONS OF ZONING The following conditions of approval are provided for information purposes only: 5. The site plan review or conditional use permit for the project area shall be subject to a public hearing before the Planning Commission. 6. Notices for this public hearing shall be mailed to all property owners in a 350 foot radius of the project area and to the signatories of the petition related to neighborhood concerns of Rezone Application No. R-90-36. 7. Access to and from the project area from East Fremont Avenue shall be prohibited. 8. A seven-foot solid masonry wall between the subject property and the residential properties to the west and south shall be required. Said wall is also to include a landscape cover on its east and north sides to prevent graffiti. MODIFICATIONS TO PROPERTY DEVELOPMENT STANDARDS 9. Proposed parcels must be consistent with the C-1/EA/cz (Neighborhood Shopping Center District/Expressway Area Overlay District/with conditions of zoning) and R-P/cz(Residential and Professional Office District/with conditions of zoning)zone districts for the parcel map site in terms of lot depth and area, subject to approval of a special permit for a planned development project. All parcels must provide access to public street rights-of-way under a planned development special permit. 10. Conditional Use Permit Application No. C-05-045,which was approved on June 15,2005 by the Planning and Development Department Director,authorized the construction of a 70,980 square-foot retail shopping center incorporating two phases of development. Phase I comprises 24,480 square-feet of retail building area (two buildings) and Phase II comprises 44,500 square feet of retail building area(three buildings). Conditional Use Permit Application No. C-05-045 shall be revised to include the property lines as proposed pursuant to Vesting Tentative Parcel Map No.2005-04, dated March 14,2005 thereby authorizing the creation of the commercial planned development. Submit draft copies of Covenants,Conditions and Restrictions/Owners Association documents (CC& R's)for review and approval. Final,executed and notarized document are to be located with the parcel map. CC & R's shall conform with the provisions of Section 12-1026 of the Fresno Municipal Code and address ingress, egress, sewer and water service maintenance and access, fire protection, solid waste service, storm drainage, parking and landscaping as follows: a) Cross Access for ingress/egress as indicated per Fire Department Memorandum date March 14, 2005. b) Cross Drainage as indicated per Fresno Metropolitan Flood Control District Memorandum dated April 05, 2005. c) Covenant for Shared Parking d) Covenant to maintain sewer, water and all other utilities e) Covenant for fire protection, underground water supplies and Covenant to access buildings f) Covenant to maintain all landscaping within the limits of this map g) Covenant for shared solid waste facilities h) Provide Covenant Agreement for access to land locked parcels i) Provide Covenant Agreement for maintenance of fire suppression water system 12. The placement of a parcel line in close proximity to any existing and/or proposed structures requires that the structure be found in compliance with the fire resistive standards of the Uniformed Building Code, Chapter 5. In the event the structures do not comply they must be modified so as to meet the requirement. 13. The proposed structure(s) on the site may be affected due to the location of the proposed parcel lines. Compliance with the prevailing Uniform Building Code as it relates to exterior wall protection, allowable area, etc. (as applicable to new parcel line locations) must be demonstrated prior to final map submittal. Contact the Planning and Development Department, Building and Safety Services Division at (559) 621-8200. GENERAL CONDITIONS 14. All off-site and public improvements shall be constructed in accordance with the Public Works Department Standards, Specifications and Policies. Engineered construction plans and estimates for all or part of the required work shall be required prior to the issuance of Street Work Permits unless otherwise determined by the City Engineer. The cost for such plan preparation, review and construction inspection shall be at the subdivider's expense. 15. Any existing utilities, including but not limited to,street lights,traffic signals,fire hydrants,poles (power, telephone, cable, etc.), which must be relocated or removed in conjunction with the construction of these off-site improvement requirements,shall be the responsibility and at the expense of the subdivider. 16. All existing overhead utilities, including but not limited to, electrical systems, communication systems and street lighting systems shall be placed underground in accordance with the w V, a Conditions of Approval Tentative Parcel Map No. 2005-04 July 19, 2005 Page 4 provisions of Section 12-1011, and Section 8-801 of the Fresno Municipal Code, Resolution No. 78-522/88-229, and the policies of the Public Works Department. 17. When street/safety lighting installations are required,street lighting plans shall be submitted for review and approval by the Traffic Engineer prior to the issuance of permits for the work. Services to street lighting installations shall .be separated from the electrical service(s) serving the development. The type, location and service for street lighting installations shall be as determined by the Traffic Engineer. Street lighting installations shall be dedicated to the City upon completion and acceptance of the installations. 18. Sidewalks(including wheelchair ramp landings)and driveway approaches,for undeveloped parcels of this parcel map,shall be required and constructed at the time of site development. Curb ramps are required at all corners within the limits of this map. 19. Whenever covenants or agreements are required, they shall be prepared by the city upon receipt of the fee in accordance with the adopted Master Fee Schedule. All covenants and agreements must be approved by the City Attorney's Office and shall be recorded with the final parcel map. 20. Telephone, cable, and other public utilities which propose above-ground facilities (such as cabinets) determined by the Planning and Development Director to be oversized shall be located in an additional easement area outside of the required landscape strip. 21. All work and engineered plans for public improvements shall conform to the 2002 Edition of the City of Fresno Standard Specifications and Drawings(City Council Resolution No.70-36 and Resolution Nos. 84-361) and any amendments thereto, hereinafter referred to as the "Public Works Standards." 22. The subdivider shall dedicate and construct public easements to facilitate the construction of curbs, gutters, sidewalks with street tree wells and irrigation systems (when applicable), permanent pavement, street/safety lighting, bus bays, right turn lanes, bike lanes, bike paths, multi-purpose trail,wheelchair ramps and public utilities in accordance with City plans, ordinances, resolutions and policies, and the Standard Specifications of the Public Works Department within the limits of the parcel map. 23. Existing improvements that are not to the planned alignment shall be removed and required improvements installed to the new street alignment and grade. Existing improvements to remain in place shall be repaired if determined to be damaged and/or off grade by the City Engineer. Existing driveway approaches not identified for current or future utilization shall be removed and sidewalk(when applicable),curb and gutter shall be installed to match existing or proposed street line and grade as determined by the City Engineer. 24. A minimum four foot wide clear path of travel is required along the public sidewalk on all frontages of the property as required by Title 24 of the California Administration Code as determined by the City Engineer. An on-site pedestrian easement and construction of a path may be required if Title 24 provisions cannot be met within the public rights-of-way. All such public easements shall be identified and dedicated with the processing and recordation of the Final Parcel Map and/or at the time of Special Permit review for the proposed Conditions of Approval Tentative Parcel Map No. 2005-04 July 19, 2005 Page 5 development of the parcel(s). 25. All required signing and striping shall be done and paid for by the developer/owner. The signing and striping plans shall be done per the current CalTrans standards and shall be submitted as a part of the street construction plans for this tentative map to the Public Works Department for review and approval. 26. The subdivider may either construct the required off-site improvements,when required, prior to the approval of the final parcel map; or enter into an agreement with the City of Fresno providing for the construction of the required improvements and sufficient security prior to the approval of the final parcel map. Additional offsite improvements will be required at the time of future site plan review. SPECIFIC CONDITIONS FIRE SERVICE 27. The Fresno Fire Department requires covenants for the following: a) A cross-access covenant agreement is required for proposed Parcel E. STREETS AND RIGHTS-OF-WAY Streets and right-of-way shall be provided in accordance with the Department of Public Works Transportation memorandum dated April 05, 2005 and as follows: East Herndon Avenue (Expressway): 28. Construct an underground street lighting system in accordance with Public Works Standard E-1 within the limits of this map. Spacing and design shall conform to Public Works Standard E-10 for expressways. 29. Construct concrete curb and gutter, built to a ten-foot pattern, in accordance with Public Works Standard P-5. 30. Construct 20-feet of permanent asphalt concrete paving (from face of curb) in accordance with Public Works Standard P-50. 31. Relinquish direct vehicular access rights to East Herndon Avenue from all lots within this map. North Willow Avenue.(Super Arteriao: 32. Existing rights-of-way at the entrances do not meet current Public Works Standards. Vacate excessive rights-of-way, as applicable, once the signal location is determined. 33. If not existing,construct an underground street lighting system to Public Works Standard E-1 Conditions of Approval Tentative Parcel Map No.2005-04 July 19, 2005 Page 6 within the limits of this map. Spacing and design shall conform to Public Works Standard E-7 for arterial streets. East Fremont Avenue (Local Street): 34. Design and construct concrete curb and gutter to Public Works Standards at the east end of East Fremont Avenue. Exact location to be determined with street plans (to provide landscaped area in coordination with the property development requirements of Site Plan Review Application No. S-05-314). Comply with the Department of Public Works, Engineering Division memorandum dated April 05, 2005. Sanitary Sewer Service 35. Separate sewer house branches are required for each lot created. 36. . Comply with the Department of Public Utilities memorandum dated April 01, 2005. Water Service 37. Separate water services with meter boxes shall be provided to each lot created. 38. Installation(s) of fire hydrant(s) is/are required in accordance with City Standards. 39. Comply with the Department of Public Utilities memorandum dated April 01, 2005. FLOOD CONTROL AND DRAINAGE 40. The subdivider shall be required to comply with the specific requirements imposed by the Fresno Metropolitan Flood Control District(FMFCD)forthe subdivision or any amendments or modifications to those requirements, which may be granted by the FMFCD Board of Directors, pursuant to Section 13-1307 of the Fresno Municipal Code. These requirements are identified in the attached District's letter to the Planning and Development Department dated April 05, 2005. FRESNO IRRIGATION DISTRICT Fl D's Helm Colonial West Branch No. 116 pipeline traverses the subject property in an exclusive easement recorded on September 21, 1993 as Document No.93144460,Official Records of Fresno County. 41. FID requires its easement be shown on the map with proper recording information,and that FID be made party to signing all plans which affect its easement and canal/pipeline facility and also be made party to signing the final map. FID requests the applicant be exempted from any condition that would require the construction of public facilities or conveyance of deeds or easements within FID's canal easement to any other party without FID's written consent. PACIFIC GAS AND ELETRIC COMPANY 43. Pacific Gas and Electric Company request that a Public Utility Easement (PUE) be incorporated within all access easement(s) as shown on said Parcel Map. 44. Existing gas or electric facility relocations necessitated by new street improvements (which are required as conditions of a development's final acceptance by the City of Fresno)will be at the expense of the developer. 45. Comply with the attached Pacific Gas & Electric Company memorandum dated March 17, 2005. The city should consider requiring the subdivider to provide a city-standard turn around on the parcel map site or to entend E Frement Ave easterly(both are probably not good ideas) ... or, to require the subdivider to process the vacation of the stub street in lieu of the turn around or extension. General Conditions: All survey monuments within the area of construction shall be preserved or reset by a person licensed to practice Land Surveying in the State of California. • Repair or replace all existing damaged and/or off-grade offsite concrete improvements in accordance with the Standard Specifications and Standard Drawings of the City of Fresno, Public Works Department. • Submittal of engineered construction plans to the Planning and Development Department for approval must be made prior to the final map. Record title interest signatures required;exceptions; notary seal not required (a) A statement, signed and acknowledged by all parties having any record title interest in the subdivided real property,consenting to the preparation and recordation of the final map is required,except in the following circumstances: (1) A lien for state, county, municipal, or local taxes or special assessments, a trust interest under bond indentures, or mechanics' liens do not.constitute a record title interest in land for the purpose of this chapter or any local ordinance. (2) The signature of either the holder of beneficial interests under trust (deeds or the trustee under the trust deeds, but not both, may be omitted. The signature of either shall constitute a full and complete subordination of the lien of the deed of trust to the map and any interest created by the map. (3) Signatures of parties owning the following types of interests maybe omitted if their names and the nature of their respective interests are stated on the final map: (A) (i) Rights-of-way, easements or other interests which cannot ripen into a fee, except those owned by a public entity, public utility, or subsidiary of a public utility for conveyance to the public utility for rights-of-way. If, however, the legislative body or advisory agency determines that division and development of the property in the manner set forth on the approved or conditionally approved tentative map will not unreasonably interfere with the free and complete exercise of the public entity or public utility rightliof-way or easement, the signature of the public entity or public utility may be omitted. Where that determination is made, the subdivider shall send, by certified mail, a sketch of the proposed final map, together with a copy of this section, to any public entity or public utility which has previously acquired a right-of-way or easement. 25 (ii) If the public entity or utility objects to either recording the final map without its signature or the determination of the legislative body or advisory agency that the division and development of the property will not unreasonably interfere with the full and complete exercise of its right-of-way or easement, it shall so notify the subdivider and the legislative body or advisory agency within 30 days after receipt of the materials from the subdivider. (iii) if the public entity or utility objects to recording the final map without its signature, the public entity or utility so objecting may affix its signature to the final map within 30 days of filing its objection with the legislative body or advisory agency. (iv) If the public entity or utility either does not file an objection with the legislative body or advisory agency or fails to affix its signature within 30 days of filing its objection to recording the map without its signature, the local agency may record the final map without the signature. (v) if the public entity or utility files an objection to the determination of the legislative body or advisory agency that the division and development of the property will not unreasonably interfere with the exercise of its right-of-way or easement, the legislative body or advisory agency shall set the matter for public hearing to be held not less than 10 nor more than 30 days of receipt of the objection. At the hearing, the public entity or public utility shall present evidence in support of its position that the division and development of the property will unreasonably interfere with the free and complete exercise of the objector's right-of-way or easement. (vi) if the legislative body or advisory agency finds, following the hearing, that the development and division will in fact unreasonably interfere with the free and complete exercise of the objector's right- of-way or easement, it shall set forth those conditions whereby the unreasonable interference will be eliminated and upon compliance with those conditions by the subdivider, the final map may be recorded with or without the signature of the objector. If the legislative body or advisory agency finds that the development and division will in fact not unreasonably interfere with the free and complete exercise of the objector's right-of-way or easement, the final map may be recorded without the signature of the objector, notwithstanding the objections. (vii) Failure of the public entity or public utility to file an objection pursuant to this section shall in no way affect its rights under a right- of-way or easement. (viii) No fee shall be charged by a public entity, public utility, subsidiary of a public utility, or objector for signing, omitting a signature, or objecting pursuant to this section. (B) Rights-of-way, easements, or reversions, which by reason of changed conditions, long disuse, or laches appear to be no longer of practical use or value and signatures are impossible or impractical to obtain.
