NOTICE TO PROJECT APPLICANT
All tentative maps are subject to the,applicable provisions of the State Subdivision Map Act, Fresno
Municipal Code (FMC), City policies, and City of Fresno Standard Specifications. The following
specific conditions are applicable to this tentative maps.
In accordance with the provisions of Government Code §66020(d)(1), the imposition of fees,
dedications, reservations or exactions for this project are subject to protest by the project applicant at
the time of approval or conditional approval of the development or within 90 days after the date of the
imposition of the fees, dedications, reservations or exactions imposed on the development project.
Upon conditional approval of Tentative Parcel Map No.2004-39,dated April 22,2005,the subdivider
may prepare a Final Parcel Map in accordance with the approved tentative map. Note that a final
parcel map may not be filed until the appeal period hast expired. Should an appeal be filed pursuant
to Section 12-1207 of the FMC,the application will be scheduled to be heard before the City of Fresno
Planning Commission. The appellant may withdraw their appeal pursuant to Section 12-1207.2 of the
FMC.
Concurrent with the filing of a final map and when the provisions of Section 66436 of the Subdivision
Map Act apply, the subdivider is responsible to send, by certified mail, a sketch of the proposed final
map, together with a copy of SMA Section 66436(a)(3 (A), to any public entity or public utility which
has previously acquired a right-of-way easement.
LEGAL STATUS OF SITE TO BE SUBDIVIDED
1. The parcel map site was legally created as lots 24, 25 and 26 of Grand Avenue Park, in the
City of Fresno, County of Fresno, State of California, according to the map recorded in plat
book 1, page 24, Fresno County Records.
PLAN CONSISTENCY
2. The 2025 Fresno General Plan, the Edison Community Plan and the Southwest G.N.R.A.
(Redevelopment Area No. 15)designate the property for medium density residential planned
land uses. The Zoning District Consistency Table of the Fresno Municipal Code identifies the
medium density residential planned land use dgsignation as consistent with the existing R-1
(Single-Family Residential Districo zone district.I The property also lies within the traffic pattern
zone of the Fresno-Chandler Downtown Airport Specific Plan. Under the safety standards of
the Specific Plan residential use is permitted on the subject property for human habitation at
a density of a maximum of 150 persons per ace. RECEIVED

PROJECT LOCATION: 243 East Stanislaus Street
Located on the north side of fast Stanislaus Street, between
South Modoc and South Trinity Streets. (APN No. 465-213-17, 18)
PROJECT DESCRIPTION:. Variance Application No. V j04-47 requests authorization for a 22-
foot, 6-inch reduction to the required 60-foot lot width and a 750-square
foot reduction to the required 6000 square foot lot area, to facilitate the
creation of Tentative Parcel Map 2004-39 which establishes two
residential lots 5,250 square-feet in area with dimensions of 37 feet, 6-
inches in width and 140 feet in depth for property located in the R-1
(Single Family Residential I istrict)zone district.
This project is exempt under Sections 15303(a)and 15332/Class 32 of the California Environmental
Quality Act(CEQA)Guidelines.
EXPLANATION: Section 15303(a) exempts from the provisions of CEQA the construction
and location of up to three single-family residences in an existing urbanized
area.
Section 15332/Class 32 exempts from the provisions of CEQA,
projects characterized as in-fill development where (a) the project is
consistent with the applicable general plan designation, general plan
policies and zoning designation and regulations; (b) the proposed
development occurs within city limits on a project site of no more than 5
acres substantially surrounded by urban uses; (c) the project has no value
as habitat for rare, threatened or endangered species; (would not result in
any significant effects relating to traffic, noise, air, or water quality; (e) the
site can be adequately served by all required utilities and public services.
The proposed project would'authorize the creation of two residential lots for
development with single-family dwellings. The site has no value as habitat
for endangered, rare or threatened species. No adverse environmental .
impacts would occur as,a result of the proposed project.

SUBJECT: NOTICE OF APPROVAL OF TENTATIVE PARCEL MAP NO. 2004-39 DATED
APRIL 22, 2005, PROPOSING A TWO LOT PARCEL MAP FOR PROPERTY
LOCATED ON THE NORTH SIDE OF EAST STANISLAUS STREET,
BETWEEN SOUTH MODOC AND SOUTH TRINITY STREETS
The City of Fresno Planning Division has completed its review of the subject parcel map dated
April 22, 2005. Pursuant to Section 12-1205 of the Fresno Municipal Code, this letter is written
to advise you that the Conditions of Approval dated August 3, 2005, are as noted on.the
attached document.
Environmental Assessment No. V-04-47/TPM 2004-039 was conducted and resulted in the
finding of Categorical Exemption under Sections 15303(a) and 15332 of the California
Environmental Quality Act Guidelines, dated August 3, 2005.
Appeal: The divider or any aggrieved person may file an appeal regarding to conditions of
approval within fifteen (15) days from the date of approval.
To protest the Director's decision regarding the conditions of approval, you must appeal by filing -
a written appeal with the Director of the Planning & Development Department. Appeal must
include the appellant's interest in/or relationship to the subject property, the decision or action
appealed, and specific reasons why the appellant believes the decision or action appealed from
should not be upheld.
Appeals must be submitted to the Director of the Planning and Development Department prior to
5 p.m. on August 22, 2005.
EXPIRATION: The approval or conditional approval of this tentative Parcel Map expires two
years from the date of approval. The expiration shall terminate all proceedings and a final
Parcel Map may not be filed without first processing a new Tentative Parcel Map.
Modification of a Tentative Parcel Map after approval or conditional approval does not extend
the two year time limit.
EXTENSION: The divider may request an extension of the tentative map expiration date by
filing a written application together with the fee set forth in the Master Fee Schedule at the time
of the request with the Director of the Planning & Development Department at least thirty days
before the expiration date of the map. The applicant must state the reasons for the requesting
