CONDITIONS OF APPROVAL
VESTING TENTATIVE PARCEL MAP NO. 2004-20
NOTICE TO PROJECT APPLICANT
In accordance with the provisions-of Government Code §66020(d)(1), the imposition
of fees, dedications, reservations or exactions for this project are subject to protest
by the project applicant at the time of approval or conditional approval of the
development or within 90 days after the date of the imposition of the fees, dedications,
reservations or exactions imposed on the development project.
The City of Fresno Planning and Development Department has completed a review of the subject
tentative parcel map in accordance with the State Subdivision. Map Act and the Fresno Municipal
Code. The conditions of approval for Vesting Tentative Parcel Map No. 2004-20 are as follows:
LEGAL STATUS OF SITE TO BE SUBDIVIDED
1. The parcel map site, was legally created as Lot 748 together with those portions of
Lots 749, 768, 769, and 770 of Bullard Land Irrigated Subdivision No. 6, in the City
of Fresno, State of California, according to the map thereof recorded in Book 8 Page
25 of Plats, Fresno County Records.
ZONING
2. Proposed parcel is consistent with the C-1/BA-20/UGM/cz (Neighborhood Shopping
Center District/Boulevard Area Overlay/Urban Growth Management/conditions of
zoning) zone district for the parcel map site in terms of lot width, depth, height, and
lot area and must provide access to a public right-of-way.
3. Prior to the development, sale, lease or finance of the remainder portion a"Certificate
of Compliance" shall be requested from the City of Fresno.
CONDITIONS OF ZONING
4. The City of Fresno shall require the dedication of an avigation easement and
agreement as called of in the 1995 Sierra Sky Park Land Use Policy Plan.
5. No structure, tree, or other object shall be permitted to exceed the height limits
established in accordance with Part 77, Subpart C, of the Federal Aviation
Regulations (FAR).

6. The development of schools, hospitals, nursing homes or similar uses shall be
prohibited.
7. Development of the subject site shall be in substantial conformance with Conditional
Use Permit No. C-01-144 and attached Exhibit "A" dated November 26, 2001 as
determined by the Planning and Development Director. The design and theme,
landscaping, circulation etc., shall be established with the development proposal by
Conditional.Use Permit No. C-01-144 and subsequent phases shall be in substantial
conformance with this development.
8. The sale.of pornographic material shall be prohibited on the subject property.
9. Car washes, mortuaries and service stations shall be prohibited on the subject
property.
10. Development of the M-1 zoned portion of the subject property shall be in accordance
with the M-1-P zone district standards.
11. The maximum building height on the subject property shall not exceed 50 feet.
12. The C-P zoned portion of the subject property shall be limited to a church use only.
PLAN CONSISTENCY
13. The 2025 Fresno General Plan and the Bullard Community Plan designate the parcel
map for development with neighborhood commercial land uses. The Zoning District
Consistency Table of the Fresno Municipal Code identifies neighborhood commercial
land uses as consistent with the C-1 zone district.
SUBDIVISION MAP ACT REQUIREMENTS
14. Concurrent with the filling of a final map and when the provisions of Section 66436 of
the Subdivision Map Act apply, the subdivider is responsible to send, by certified mail,
a sketch of the proposed final map, together with a copy of SMA Section
66436(a)(3)(A), to any public entity or public utility which has previously acquired a
right-of-way easement.
15. Comply with provision of the State of California Government Code Sections 66410 -
'66499.58 (the Subdivision Map Act) and the City of Fresno Municipal Code Chapter
12, Article 10 (Subdivision of Real Property).
16. Private Easements shall not be shown on a Final Map. Remove"Proposed Common
Access Easement' from map.

GENERAL PUBLIC WORKS REQUIREMENTS
Dedications
17. The subdivider shall dedicate public easements to facilitate the construction of curbs,
gutters, sidewalk, bus bays, right turn lanes, bike lanes, bike paths, multi-purpose
trail, wheelchair ramps and public utilities in accordance with City plans, ordinances,
resolutions and policies, and the Standard Specifications of the Public Works
Department within the limits of the parcel map. Additionally, a minimum 4 foot wide
clear path of travel is required along the public sidewalk on all frontages of the
property as required by Title 24 of the California Administration Code as determined
by the City Engineer. An on-site pedestrian easement and construction of a path.may
be required if Title 24 provisions can not be met within the public rights-of-way. All
such public easements shall be identified and dedicated with the processing and,
recordation of the Parcel Map or at the time of Special Permit reviews for the
proposed development of the parcels.
Street Improvements
18. The subdivider shall construct curb, gutters, curb returns and landings, 'wheelchair
ramps, sidewalks with street tree wells and irrigation systems (when applicable),
permanent pavement,street/safety lighting, bike lanes,bike paths,multi-purpose trail,
walls and fences in accordance with City plans, ordinances, resolutions, policies and
the Standard Specifications of the Public Works Department within the limits of the
parcel map.
19. Existing improvements that are not to the planned alignment shall be removed and
required improvements installed to the new street alignment and grade. Existing
improvements to remain in place shall be repaired if determined to be damaged
and/or off grade by the City Engineer. Existing driveway approaches not identified for
current or future utilization shall be removed and sidewalk(when applicable),curb and
gutter shall be installed to match existing or proposed street line and grade as
determined by the City Engineer.
Sanitary Sewer System
20. The subdivider shall connect each parcel being created to the City of Fresno's
sanitary sewer system with a separate sewer. house branch unless other
arrangements are approved by the City Engineer. All sanitary sewer system
improvements shall be constructed in accordance with City plans, ordinances,
resolutions, policies and the Standard Specifications of the Public Works Department.
The connection to the City's sanitary sewer system requires the payment of all
applicable sewer connection charges in accordance with the provisions of FMC
Chapter 9, Article 5 prior to the approval of.the map.

Water System
21. The subdivider shall connect each parcel being created to the City of Fresno's water
system with a separate water service"and meter unless other arrangements are
approved by the City Engineer. All water system improvements shall be constructed
in accordance with City plans, ordinances, resolutions, policies and the Standard
Specifications of the Public Works Department. The connection to the City's system
requires the payment of all applicable water connection charges in accordance with
the provisions of FMC Chapter 14, Article 1 prior to the approval of the map.
Street, Sewer and Water Construction Plans
22. The subdivider shall provide street, sewer and water construction plans for the
required public improvements as determined by the City Engineer. Such plans shall
be prepared by a registered Civil Engineer and approved by the City Engineer prior
to the issuance of Street Work permits.
OFF-SITE REQUIREMENTS
23. The subdivider may either construct the required off-site improvements prior to the
approval of the final parcel map; or enter into an agreement with the City of Fresno
providing for the construction of the required improvements and sufficient security
prior to the approval of the final parcel map.
24. All off-site and public improvements shall be constructed in accordance with the
Public Works Department Standards, Specifications and Policies. .Engineered
construction plans and estimates for all or part of the required work shall be required
prior to the issuance of Street Work Permits unless otherwise determined by the City
Engineer. The cost for such plan preparation, review and construction inspection
shall be at the'subdivider's expense.
25. Any existing utilities, including but not limited to, street lights, traffic signals, fire
hydrants, poles (power,-telephone, cable, etc), fire hydrants which must be relocated
or removed in conjunction with the construction of these off-site improvement
requirements, shall be the responsibility and at the expense of the subdivider.
26. All existing overhead utilities, including but not limited to, electrical systems,
communication systems and street lighting systems shall be placed underground in
accordance with the provisions of Section 12-1011 of the Fresno Municipal Code and
the policies of the Public Works Department.

27. When street/safety lighting installations are required, street lighting plans shall be
submitted for review and approval by the Traffic Engineer prior to the issuance of
permits for the work. Services to street lighting installations shall be separated from
the electrical service(s) serving the development. The type, location and service for
street lighting installations shall be as determined by the Traffic Engineer. Street
lighting installations shall be dedicated to the City upon completion and acceptance
of the installations.
28. On-site Sewer and/or Water System(s). All on-site sewer and water systems shall be
"private". In the event the subdivider proposes to construct "public" on-site sewer
and/or water systems facilities, written approval by the Public Utilities Department
shall be required and provided with the submittal of the initial final parcel map. Such
facilities shall be placed in a dedicated easement and shall be included as public
improvement requirements for the parcel map.
29. Sidewalks (including wheelchair ramp landings) and driveway approaches, for
undeveloped parcels of this parcel map, shall be required as a condition of site
development.
30. Easements: Identify the location, type, size, and record information of easements on
the final map.
31. -If P.G. & E. has an existing pole line that serves the property and the existing pole line
crosses proposed property lines and is not covered by an existing easement, it is the
property owner's responsibility to provide adequate rights-of-way to P.G. & E.
If P.G. & E's. assistance is required to determine whether an easement will be
required contact Scott Combs, Senior Land Technician, Fresno Land Rights Office,
at 263-7375.
32. Unless otherwise noted, all covenants or agreements will be prepared upon receipt
of the fee indicated below. Covenants must be approved by the City Attorney's Office
prior to issuance of building permits.
33. Telephone, cable, and other public utilities which propose above-ground facilities
determined by the Planning and Development Director to be oversized shall be
located in an additional easement area outside of the landscape strips required along
major streets.
34. All work and engineered plans for public improvements shall conform to the 2002
Edition of the City of Fresno Standard Specifications and Drawings (City Council
Resolution No. 70-36 and Resolution No. 84-361) and any amendments thereto,
hereinafter referred to as the "Public Works Standards".

PARK SERVICE
35. Contact the Parks, Recreation and Community Services Department at (559) 621-

FIRE SERVICE
36. Fire Department has no requirements for Vesting Tentative Parcel Map No. 2004-20.
STREETS AND RIGHTS-OF-WAY
37. Submittal of engineered construction plans to Public Works for approval must be
made prior to final map. All required signing and striping shall be done and paid for
by the developer/owner. The signing and striping plans shall be done per the current
CalTrans standards and shall be submitted as a part of the street construction plans
for this tentative map to the Public Works Department for review and approval.
38. Repair or replace any existing damaged off-site concrete improvements in
accordance with the Standard Specifications and Standard Drawings of the City of
Fresno, Public Works Standards.
39. Additional off-site improvements will be required at the time of future site plan review.
40. Underground all existing overhead utilities within the limits of this map as per Fresno
Municipal Code Section 12-1011, Section 8-801 and Resolution Nos. 78-522/88-229.
41. All survey monuments within the area of construction shall be preserved or,reset by
-
a person licensed to practice Land Surveying in the State of California.
North Figarden Drive
42. Concrete curb and gutter exist. Construct sidewalk in accordance with Public Works
Standard P-5 along Parcel "A" and the remainder parcel.
43. Dedicate right-of-way for street type entry where Parcel "A"and the remainder parcel
come together for public street purposes.
44. Construct an underground street lighting system in accordance with Public Works
Standard E-1 within the limits of this map. Spacing and design shall conform to Public
Works Standard E-7 for Arterial streets.
45. Concrete improvements are required on the remainder parcel as a prerequisite to the
orderly development of the subdivision pursuant to Section 66424.6-A-B of the
Subdivision Map Act.

North Brunswick Avenue
46. Dedicate 30 feet of property measured from center line for public street purposes
within the limits of this map. Dedicate a 50 foot radius for North Brunswick Avenue
to allow for the construction of a cul-de-sac at the intersection of North Bulletin and
North Brunswick Avenue.
47. Construct concrete curb, gutter, and sidewalk to a 10 foot pattern in accordance with
Public Works Standard P-50. Install A.C. transition paving as needed.
48. Construct 20 feet of permanent asphalt concrete paving from face of curb in
accordance with Public Works Standard P-50. Install A.C. transition paving as
needed.
49. Construct an underground street lighting\system in accordance with Public Works
Standard E-2 within the limits of this map. Spacing and design shall conform to Public
Works Standard E-9 for local streets.
50. Traffic Mitigation: Construct one twelve foot center section travel lane within the limits
of this development for north bound travel. Details of said street shall be depicted on
the approved street plans. Dedication shall be sufficient to accommodate local
Standards and any other grading or transitions as necessary.based on a 30 mph
design speed.
51. Concrete improvements are required on the remainder parcel as a prerequisite to the
orderly development of the subdivision pursuant to Section 66424.6-A-B- of the
Subdivision Map Act.
UGM Requirements
52. This Parcel Map is located within U.G.M Major Street Zone C/D-2. Pay U.G.M. fees.
SANITARY SEWER
The nearest sanitary sewer mains to the-project area is a 8-inch sewer main located in North
Figarden Drive and a 8-inch sewer main located in West Bullard Avenue. The following
conditions shall be required to provide sanitary sewer service to the proposed project.
53. Construct an 8-inch sanitary sewer main in West Bullard Avenue from the existing
- main east to North Brunswick Avenue.
54. Construct an 8-inch sanitary sewer main in North Brunswick Avenue from West
Bullard Avenue north across the project frontage. .
55. Separate sewer house branches shall be provided for each lot created.

56. Public sewer facilities shall be constructed in accordance with the Department of
Public Works standards, specifications, and policies.
57. Engineered improvement plans prepared by a Registered Civil Engineer shall be
submitted for Department of Public Utilities review and approval for the proposed
additions to the City Sewer System.
58. Upon connection of this Project to the City Sewer System the owner shall be subject
to payment of Sewer Facility charges per Fresno Municipal Code Section 9-505.2.
Sewer Facility Charges consist of two components, a Wastewater Facilities Charge
and Trunk Sewer Charge where applicable.
59. Sewer Facility Charges are collected after occupancy on a bi-monthly basis over time
based on meter (water or sewer effluent) usage. The developer may contact the
Department of Public Utilities (559) 621-8554 to receive an estimated cost of the
Sewer Facility Charges applicable to the project (based on. a constant sewer
discharge and loading (Biochemical Oxygen Demand [BOD] and Total Suspended
Solids[TSS] levels anticipated)at the current rates in effect, at that time, per Fresno's
Master Fee Resolution. The developer shall provide data regarding estimated sewer
discharge rates [flow] and loading [BOD/TSS levels] required for calculating the
estimated charges.
UGM Requirements
60. Parcel Map No. 2004-20 is located in U.G.M. Oversize Sewer Reimbursement Area 35.
WATER SERVICE
The nearest water mains to the project area is a 14-inch water main located in North Figraden
Drive and a 14-inch water main located in West Bullard Avenue. The following conditions are
required to provide water service to the project.
'61. Construct a 8-inch water main in North Brunswick Avenue from West Bullard Avenue
north across the project frontage.
62. Separate water services with meter boxes shall be provided to each lot created.
63. Public water facilities shall be constructed in accordance with Public Works Department
standards, specifications, and policies.
64. Engineered improvement plans prepared by a Registered Civil Engineer are required for
proposed additions to the City Water System.
UGM Requirements
65. Parcel Map No. 2004-20 is located in U.G.M Water Supply Area 136.

FLOOD CONTROL AND DRAINAGE
66. The subdivider shall be required to pay any applicable storm drainage fees to comply
with Fresno Municipal Code Chapter 13, Article 13.
67. The subdivider shall be required to comply with the specific requirements imposed by the
Fresno Metropolitan Flood Control District (FMFCD) for the subdivision or any
amendments or modifications to those requirements which may be granted by the
FMFCD Board of Directors, pursuant to Section 13-1307 of the Fresno Municipal Code.
These requirements are identified in the District's letter to the Planning and Development
Department dated August 26, 2004.
FRESNO IRRIGATION DISTRICT
68. FID's "H" Ditch No. 128 Canal transverses the subject property as shown on the
enclosed map.
69. The reach of canal affected by the development can be contained in a 24 inch diameter
pipeline. FID requests that the applicant grant to FID an exclusive pipeline easement
and pipe the open canal across the development in accordance with FID standards, and
that the applicant enter into an agreement for piping the canal with costs to be borne by
the applicant not to exceed the cost of a 54 inch diameter pipeline, subject to approval
by FID's Board of Directors.
70. FID requests that its easement be shown on.the map with proper recording information,
and that FID be made a party to signing all plans which affect its easement and
canal/pipeline facility and also be made party to signing the final map.
71. FID requests that the applicant be required to submit a grading and drainage plan for
FID approval which shows that the proposed development will not endanger the
structural integrity of the canal embankment, or result in drainage patterns that will
adversely affect FID or the applicant.
FRESNO UNIFIED SCHOOL DISTRICT
72. Prior to issuance of a building permit, school fees must be paid. Contact the Fresno
School District for their requirements.

73. Attached for your review is a Caltrans memorandum dated August 25, 2004.

DATED AUGUST 10, 2004, PROPOSING A ONE (1) LOT PARCEL MAP WITH ONE
REMAINDER FOR PROPERTY LOCATED ON THE EAST SIDE OF NORTH
FIGARDEN DRIVE BETWEEN WEST BULLARD AND WEST SIERRA AVENUES.
The City of Fresno Planning Division has completed its review of the subject parcel map dated
August 10, 2004. Pursuant to Fresno Municipal Code FMC Section 12-1205(c), this letter is written to
advise that the conditions of approval dated September 24, 2004, are as noted on the attached
document.
If you have any questions regarding the conditions notify me at 621-8073 no later than September 30,
2004, to request a review of the conditions. Otherwise, the stipulated conditions of approval are in
effect as of that date. No further notice will be sent.
Appeal: The divider or any aggrieved person may file an appeal regarding to conditions of approval
within fifteen (15) days from the date of approval.
To protest the Director's decision regarding the conditions of approval, you must appeal by filing,a
written appeal with the Director of the Planning and Development Department. Appeal must include
the appellant's interest in/or relationship to the subject property, the decision or action appealed, and
specific reasons why the appellant believes the decision or action appealed from should not be
upheld
Appeals must be submitted to the Director of the Planning and Development Department prior to 5
p.m. on October 12, 2004.
EXPIRATION: The approval or conditional approval of this Vesting Tentative Parcel Map expires two
years from the date of approval. The expiration shall terminate all proceedings and a final Parcel
Map may not be filed without first processing a new Tentative Parcel Map.
Modification of a Vesting Tentative Parcel Map after approval or conditional approval does not extend
the two year time limit.

EXTENSION: The divider may request an extension of the tentative map expiration date by filing a
written application together with the fee set forth in the Master Fee Schedule at the time of the
request with the Director of the Planning and Development Department at least thirty days before the
expiration date of the map. The applicant must state the reasons requesting the extension. New
conditions may be imposed if an extension is granted.
An extension may not exceed an aggregate of five years.

The purpose of this letter is to request the City of Fresno to delete any improvement requirements
and payment of fees for the Remainder Parcel (8.83 acres) Vesting T.P.M. 2004-20
Specifically, items 46, 47,48, 49, 50, 51, 53, 54, 55, 61 and 62 plus those portions of items 44
and 52 which relate to the Remainder Parcel.
All of the specified improvements for the Remainder Parcel will be installed upon submittal of an
entitlement for the development of the Remainder.Parcel..

written application together with the fee set forth in the Master Fee Schedule at the time of the
request with the Director of the Planning and Development Department at least thirty days before the

BACKGROUND
Vesting Tentative Parcel Map No. 2004-20, dated August 10, 2004, filed by R.W. Greenwood for
Robert Diel on July 7, 2004, and accepted for processing on August 10, 2004, proposes to create one
(1) parcel with one (1) remainder for 10.37 acres of property zoned C-1/BA-20/UGM/cz (Neighborhood
Shopping Center District/Boulevard Area Overlay/Urban Growth Management/conditions of zoning)
zone district. The parcel map site is located on the east side of North Figarden Drive between West
Bullard and West Sierra Avenues. The one lot parcel map will facilitate the future development of the
C-1 portion of the property. Approval of a tentative parcel map is subject to the Planning and
Development Department Director finding that the map is consistent with the officially adopted plans
and polices of the City of Fresno. The project site is designated in the 2025 Fresno General Plan,
Edison Community Plan and Sierra Sky Park Land Use Policy Plan for neighborhood commercial land
uses. Pursuant to Table 2 of the 2025 Fresno General Plan, neighborhood commercial land use is
consistent with the C-1 zone district. Staff has reviewed the proposed design and improvement of
Vesting Tentative Parcel Map No. 2004-20 and has determined that the map is consistent with adopted
policies as described below.
REQUIRED FINDINGS ,
California Environmental Quality Act (CEQA) - The California Environmental Quality Act (Public
Resources.Code Section 21000 et seq.) permits a public agency to determine whether a particular
project is exempt from CEQA.
A determination of a.Class 15 Categorical Exemption (Section 15315/Minor Land Divisions) from ,
CEQA was made and Environmental Assessment No. TPM 2004-20 (Categorical Exemption) was _
completed for this project and dated on September 21, 2004; and, filed with the Fresno City Clerk on
September 24, 2004.

STATE SUBDIVISION MAP ACT- The Subdivision Map Act (California Government Code Section
66410 et. seq.) requires that a proposed parcel map not be approved unless the map, together with its
design and improvement, is found to be consistent with the General Plan and any applicable specific
plan (Finding No. 1 below). State law further provides that the proposed parcel map be denied
approval if any one of the Finding Nos. 2-5, below, is made in the negative.
1. The proposed parcel map, together with its design and improvements is consistent with the
City's 2025 General Plan, Bullard Community Plan, and Sierra Sky Park Land Use Policy Plan
which designate the site for neighborhood commercial land uses.
2. The site is physically suitable for the proposed type and density of development because of the
flat terrain of the site and adequate access and drainage on and off the site.
3. The proposed parcel map design and improvements are not likely to cause substantial and
considerable damage to the natural environment, including fish, wildlife or their habitat, because
of the urbanized nature of the area in which the site is located.
4. The proposed parcel map design and improvements are not likely to cause serious public
health and safety problems, because the conditions of approval have shown and will insure that
the subdivision conforms with City health and safety standards.
5. The proposed parcel map design will not conflict with public easements within or through the
site because conditions of approval will assure noninterference with any existing or proposed
public easements.
Staff, based on its own analysis, has determined that the parcel map, subject to the recommended
conditions of approval, otherwise complies with the design and property development standards of the
Zoning Ordinance and local Parcel Map Ordinance and recommends the approval of the parcel map.
DIRECTOR DETERMINATION
1. Based upon the above analysis, the Planning and Development Director finds that Vesting
Tentative Parcel Map No. 2004-20 dated August 10, 2004, is consistent with the applicable
plans and policies of the City of Fresno.
2. The Planning and Development Director hereby grants approval of Vesting Tentative Parcel
Map No. 2004-20 dated August 10; 2004, subject to the conditions of approval dated

Sanitary sewer service
The nearest sanitary sewer mains to the project are a 8-inch main located in North Fig Garden Drive
and a S-inch main located in West Bullard Avenue. The following conditions shall be required to
provide sewer service to the project.
1. Construct an 8-inch sanitary sewer main in West Bullard Avenue from the existing main east to
North Brunswick Avenue.
2. Construct an 8-inch sanitary sewer main in North Brunswick Avenue from West Bullard Avenue
north across the project frontage.
3. Separate sewer house branches shall be provided,for each lot created.
4. Public sewer facilities shall be constructed in accordance with the Department of Public Works
standards, specifications, and policies.
5. Engineered improvement plans prepared by a Registered Civil Engineer shall be submitted for
Department of Public Utilities review and approvals for proposed additions to the City Sewer
System.
Sanitary Sewer Fees
The following Sewer Connection Charges shall be paid for the Project:.

4. Upon connection of this Project to the City Sewer System the owner shall be subject to payment of

Charges consist of two components, a Wastewater Facilities Charge and Trunk Sewer Charge
where applicable.
5. Sewer Facility Charges are collected after occupancy on a bi-monthly basis over time based on
metered (water or sewer effluent) usage. The developer may contact the Department of Public
Utilities(559) 621-8554 to receive an estimated cost of the Sewer Facility Charges applicable to
the project (based on a constant sewer discharge and loading (Biochemical Oxygen Demand
[BOD] and Total Suspended Solids [TSS] levels anticipated) at the current rates in effect, at that
time, per Fresno's Master Fee Resolution. The developer shall provide data regarding estimated
sewer discharge rates [flow] and loading [BOD/TSS levels] required for calculating the estimated
charges.
Water service
The nearest water mains to the project are a 14-inch main located in North Fig Garden Drive and a 14-
inch main located in West Bullard Avenue. The following conditions shall be required to provide
sewer service to the project.

PUBLIC IMPROVEMENT REQUIREMENTS
The Public Works, Transportation Planning Section, has completed its review of Tentative Parcel Map
2004-20, which was submitted by R. W. Greenwood Associates, Inc. on behalf of Robert Diel, the
property owner. The following requirements are to be placed on this Tentative Parcel Map as a
condition of approval by the Public Works Department.
General Conditions
• All survey monuments within the area of construction shall be preserved or reset by a person
licensed to practice Land Surveying in the State of California.
• Repair or replace all existing damaged and /or off-grade offsite concrete improvements in
accordance with the Standard Specifications and Standard Drawings of the City of Fresno,
Public Works Department.
• Submittal of enpgineered construction plans to Public Works for approval must be made rfor to
final map. All required signing and striping shall be installed and paid for by the developer/
owner. The signing and striping plans shall comply with the current Caltrans standards and be
submitted as a part of the street improvement plans.
• Underground all existing offsite overhead utilities with the limits of this map in accordance with
Fresno Municipal Code Section 12-1011, 8-801 and Resolution No. 78-522/88-229.
• Additional offsite concrete improvements will be required at the time of future site plan review.
Maior Streets:
North Figarden Drive (Arterial 106'):
1. Concrete.curb and gutter, built to a ten-foot pattern, in accordance with Public Works Standard P-5
exist.
2. Dedicate right of way for street type entry, where the 2 parcels meet, for public street purposes
within the limits of this map.
3. Construct an underground street lighting system in accordance with Public Works Standard E-1
within the limits of this map. Spacing and design shall conform to Public Works Standard E-7 for
Arterial streets.

North Brunswick Avenue:
1. Dedicate 30 feet of property, measured from center line, for public street purposes within the limits
of this map. Also dedicate 50 ft. radius cal-de-sac at the intersection of North Bulletin Avenue.
2. Construct concrete curb and gutter, built to a ten-foot pattern, in accordance with Public Works
Standard P-5.
3. Construct 20-feet, from face of curb, of permanent asphalt concrete paving in accordance with
Public Works Standard P-50, install A. C. transition as needed.
4. Construct an underground street lighting system in accordance with Public Works Standard E-2
within the limits of this map. Spacing and design shall conform to Public Works Standard E-9 for
local streets.
5. A traffic mitigation: Construct one twelve (12) foot center section travel lane within the limits of this
development for north bound travel. Details of said street shall be depicted on the approved street
plans. Dedication shall be sufficient to accommodate local Standards and any other grading or
transitions as necessary, based on a 30 mph design speed.
UGM:
This Parcel Map is within U.G.M. Major Street Zone C/D-2. Pay UGM fee.
IRRIGATION /CANAL REQUIREMENTS
The developer shall enter into an agreement with the Fresno Irrigation District.providing for piping
the canal(s) and submit an executed copy,of the agreement or commitment letter from FID to the
Planning and Development Department. All piping shall be located outside of the proposed street
right of way. Any piping across city streets shall be rubber gasket reinforced concrete pipe
(RGRCP) constructed perpendicular to the street. Submit engineered plans to Pubic Works
Department, Engineering Division for review and approval.

The.proposed development will generate storm runoff which produces potentially significant
environmental impacts and which must be properly discharged and mitigated pursuant to the
California Environmental Quality Act and the National Environmental Policy Act. The O
District in cooperation with the City and County has developed and adopted the Storm
Drainage and Flood Control Master Plan. Compliance with and implementation of this
Master Plan by this development project will satisfy the drainage related CEQA/NEPA impact
of the project mitigation requirements.
The proposed development shall pay drainage fees pursuant to the Drainage Fee Ordinance
prior to approval of the final map at the rates in effect at the time of such approval. The fee O

6. The Federal Clean Water Act and the State General Permits for Storm Water Discharges
Associated with Construction and Industrial Activities (State General Permits) require developers
of construction projects disturbing five or more acres; and discharges associated with industrial 00
activity not otherwise exempt from National Pollutant Discharge Elimination System (NPDES)
permitting,to implement controls to reduce pollutants, prohibit the discharge of waters other than.
storm water to the municipal storm drain system, and meet water quality standards. These
requirements apply both to pollutants generated during construction, and to those which may be
generated by operations at the development after construction.

State General Permit for Storm Water Discharges Associated with Construction
Activities, approved August 1999, (modified December 2002.) A State General
Construction Permit is required for all clearing, grading, and disturbances to the ground
that result in soil disturbance of at least one acre (or less than one acre if part of a larger
common plan of development or sale). Permittees are required to: submit a Notice of
Intent to be covered and must pay a permit fee to the State Water Resources Control Z
Board (State Board), develop and implement a storm water pollution prevention plan,
eliminate non-storm water discharges, conduct routine site inspections, train employees O
in permit compliance, and complete an annual certification of compliance.

b. State General Permit for Storm Water Discharges Associated with Industrial Activities, O
April, 1997 (available at the District Office.) A State General Industrial Permit is
required for specific types of industries described in the NPDES regulations-or by
Standard Industrial Classification (SIC) code. The following categories of industries
are generally required to secure an industrial permit:manufacturing; trucking; O
recycling;and waste and hazardous waste management. Specific exemptions exist for
manufacturing activities.which occur entirely indoors. Permittees are required to:
submit a Notice of Intent to be covered and must pay a permit fee to the State Water O
Resources Control Board, develop and implement a storm water pollution prevention
plan, eliminate,non-storm water,discharges, conduct routine site inspections,train
employees in permit compliance, sample storm water runoff and test it for pollutant
indicators, and annually submit a report to the State Board.

The drainage system cost and fee schedule update is currently underway. The drainage system cost
and fee obligation indicated in this notice is the obligation which is valid at the date of this notice.
Contact the District for a final drainage fee obligation prior to issuance of a building permit or
recording of the final map.
The following paragraphs only apply towards development of the individual parcels and are not
conditions for the recording of the map.
In an effort to improve storm water runoff quality, outdoor storage areas shall be
constructed and maintained such that material which_ generates contaminants will not .
be conveyed by runoff into the storm drain system.
The District encourages, but does not require that roof drains from non-residential
development be .constructed such that they 'are directed onto and through a
landscaped grassy swale area to filter out pollutants from roof runoff..
Runoff from areas where industrial activities, product, or merchandise come into
contact with and may contaminate storm water must be directed through landscaped
areas or otherwise treated before discharging it off-site or into a storm drain. Roofs
covering such areas are recommended. Cleaning of such areas by sweeping instead
of washing is to be required unless such wash water can be directed to the sanitary
sewer system. Storm drains receiving untreated runoff from such areas that directly
connect to the District's system will not be permitted. Loading docks, depressed
areas, and areas servicing or fueling vehicles are specifically subject to these .
requirements. The District's policy governing said industrial site NPDES program
requirements are attached.

FID's comments and requests are as follows: .
1. FID's `H' Ditch No. 128 Canal traverses the subject property as shown on the enclosed
map.
2. The reach of canal affected by the development can be contained in a 24" (twenty-four
inch) diameter pipeline. FID requests that the applicant grant to FID an exclusive
pipeline easement and pipe the open canal across the development in accordance with
FID standards, and that the applicant enter- into an agreement for piping the canal with
costs to be borne by the applicant not to exceed the cost of a 54-inch diameter pipeline,
subject to approval by FID's Board of Directors.
3. FID requests that. its easement be shown on the map with proper recording information,
and that FID be made a party to signing all plans which affect its easement and
canal/pipeline facility and also be made party to signing the final map.
4. FID requests that the applicant be required to submit a grading and drainage plan for FID
approval which shows that the proposed development will not endanger the structural
integrity of the canal embankment, or result in drainage patterns that will adversely affect
FID or the applicant.
