SUBJECT: NOTICE OF APPROVAL OF VESTING TENTATIVE PARCEL MAP NO. 2004-07
DATED MARCH 25, 2004, PROPOSING A FIVE (5) LOT PARCEL MAP FOR
PROPERTY LOCATED ON THE NORTH SIDE OF WEST NEES AVENUE
BETWEEN NORTH INGRAM AND NORTH PALM AVENUES.
The City of Fresno Planning Division has completed its review of the subject parcel map dated March
25, 2004. Pursuant to Fresno Municipal Code FMC Section 12-1205(c), this letter is written to advise
that the Conditions of Approval dated October 8, 2004, are as noted on the attached document.
If you have any questions regarding the conditions you must notify either Louis Rocha or Paul Bernal
at 621-8073 no later than October 14, 2004, to request a review of the conditions. Otherwise, the
stipulated conditions of approval are in effect as of that date. No further notice will be sent.
Appeal: The divider or any aggrieved person may file an appeal regarding to conditions of approval
within fifteen (15) days from the date of approval.
To protest the Director's decision regarding the conditions of approval, you must appeal by filing a
written appeal with the Director of the Development Department. Appeal must include the appellant's
interest in/or relationship to the subject property, the decision or action appealed, and specific
reasons why the appellant believes the decision or action appealed from should not be upheld
Appeals must be submitted to the Director of the Development Department prior to 5 p.m. on October
25, 2004.
EXPIRATION: The approval or conditional approval of this tentative Parcel Map expires two years
from the date of approval. The expiration shall terminate all proceedings and a final Parcel Map may
not be filed without first processing a new Tentative Parcel Map.
Modification of a Tentative Parcel Map after approval or conditional approval does not extend the two
year time limit.

EXTENSION: The divider may request an extension of the tentative map expiration date by filing a
written application together with the fee set forth in the Master Fee Schedule at the time of the
request with the Director of the Development Department at least thirty days before the expiration
date of the map. The applicant must state the reasons for the requesting the extension. New
conditions may be imposed if an extension is granted.
An extension may not exceed an aggregate of five years.

CONDITIONS OF APPROVAL
VESTING TENTATIVE PARCEL MAP NO. 2004-07
NOTICE TO PROJECT APPLICANT
In accordance with the provisions of Government Code §66020(d)(1), the imposition
of fees, dedications, reservations or exactions for this project are subject to protest
by the project applicant at the time of approval or conditional approval of the
development or within 90 days after the date of the imposition of the fees,dedications,
reservations or exactions imposed on the development project.
The City of Fresno Planning and Development Department has completed a review of the subject
tentative parcel map in accordance with the State Subdivision Map Act and the Fresno Municipal
Code. The conditions of approval for Tentative Parcel Map No. 2004-07 are as follows:
LEGAL STATUS OF SITE TO BE SUBDIVIDED
1. The parcel map site, was legally created as that portion of Lot C of Parcel Map No.
79-16, according to the map thereof recorded in Book 31, Pages 87 through 98 of
Parcel Maps, Fresno County Records.
ZONING
2. The proposed parcels are consistent with the C-P/BA-20/UGM (Administrative and
Professional Office District/Boulevard Area Overlay/Urban Growth Management)and
the C-P/BA-20/BP/UGM (Administrative and Professional Office District/Boulevard
Area Overlay/Bluff Preservation Overlay/Urban Growth Management)zone district for
the parcel map site in terms of lot width, depth, height, and lot area and must provide
access to a public right-of-way.
3. Development and Use of Parcels"A", "B", "C, "E", and remainder is consistent upon
obtaining and maintaining approval from all responsible agencies a post-closure
development plan and related site-specific gas mitigation plans to abate potential
hazards and effects of landfill gas which may be present on the site.
4. Plan Amendment No. A-04-07 amended the 2025 Fresno General Plan and the
Bullard Community Plan from the medium density residential planned land use
designation to the office commercial planned land use designation on approximately
2 acres of the overall project site.

PLAN CONSISTENCY
5. Plan Amendment No. A-04-08 amended the 2025 Fresno General Plan and the
Bullard Community Plan designating the parcel map for development with office
commercial land uses. The Zoning District Consistency Table of the Fresno Municipal
Code identifies office commercial planned land use designation as consistent with
the C-P zone district.
SUBDIVISION MAP ACT REQUIREMENTS
6. Concurrent with the filling of a final map and when the provisions of Section 66436 of
the Subdivision Map Act apply,the subdivider is responsible to send,by certified mail,
a sketch of the proposed final map, together with a copy of SMA Section
66436(a)(3)(A), to any public entity or public utility which has previously acquired a
right-of-way easement.
7. Comply with provision of the State of California Government Code Sections 66410 -
66499.58 (the Subdivision Map Act) and the City of Fresno Municipal Code Chapter
12, Article 10 (Subdivision of Real Property).
GENERAL PUBLIC WORKS REQUIREMENTS
Dedications
8. The subdivider shall dedicate public easements to facilitate the construction of curbs,
gutters, sidewalk, bus bays, right turn lanes, bike lanes, bike paths, multi-purpose
trail, wheelchair ramps and public utilities in accordance with City plans, ordinances,
resolutions and policies,the Standard Specifications of the Public Works Department
within the limits of the parcel map. Additionally, a minimum 4 foot wide clear path of
travel is required along the public sidewalk on all frontages of the property as required
by Title 24 of the California Administration Code as determined by the City Engineer.
An on-site pedestrian easement and construction of a path may be required if Title
24 provisions can not be met within the public rights of way. All such public
easements shall be identified and dedicated with the processing and recordation of
the Parcel Map or at the time of Special Permit review for the proposed development
of the parcels.
Street Improvements
9. The subdivider shall construct curb, gutters, curb returns and landings, wheelchair
ramps, sidewalks with street tree wells and irrigation systems (when applicable),
permanent pavement,street/safety lighting,bike lanes,bike paths,multi-purpose trail,
walls and fences in accordance with City plans, ordinances, resolutions, policies and
the Standard Specifications of the Public Works Department within the limits of the
parcel map.

10. Existing improvements that are not to the planned alignment shall be removed and
required improvements installed to the new street alignment and grade. Existing
improvements to remain in place shall be repaired if determined to be damaged
and/or off grade by the City Engineer. Existing driveway approaches not identified for
current or future utilization shall be removed and sidewalk(when applicable),curb and
gutter shall be installed to match existing or proposed street line and grade as
determined by the City Engineer.
Sanitary Sewer System
11. The subdivider shall connect each parcel being created to the City of Fresno's
sanitary sewer system with a separate sewer house branch unless other
arrangements are approved by the City Engineer. All sanitary sewer system
improvements shall be constructed in accordance with City plans, ordinances,
resolutions,policies and the Standard Specifications of the Public Works Department.
The connection to the City's sanitary sewer system requires the payment of all
applicable sewer connection charges in accordance with the provisions of FMC
Chapter 9, Article 5 prior to the approval of the map.
Water System
12. The subdivider shall connect each parcel being created to the City of Fresno's water
system with a separate water service and meter unless other arrangements are
approved by the City Engineer. All water system improvements shall be constructed
in accordance with City plans, ordinances, resolutions, policies and the Standard
Specifications of the Public Works Department. The connection to the City's system
requires the payment of all applicable water connection charges in accordance with
the provisions of FMC Chapter 14, Article 1 prior to the approval of the map.
Street, Sewer and Water Construction Plans
13. The subdivider shall provide street, sewer and water construction plans for the
required public improvements as determined by the City Engineer. Such plans shall
be prepared by a registered Civil Engineer and approved by the City Engineer prior
to the issuance of Street Work permits.
OFF-SITE REQUIREMENTS
14. The subdivider may either construct the required off-site improvements prior to the
approval of the final parcel map; or enter into an agreement with the City of Fresno
providing for the construction of the required improvements and sufficient security
prior to the approval of the final parcel map.

15. All off-site and public improvements shall be constructed in accordance with the
Public Works Department Standards, Specifications and Policies. Engineered
construction plans and estimates for all or part of the required work shall be required
prior to the issuance of Street Work Permits unless otherwise determined by the City
Engineer. The cost for such plan preparation, review and construction inspection
shall be at the subdivider's expense.
16. Any existing utilities, including but not limited to, street lights, traffic signals, fire
hydrants, poles(power, telephone, cable, etc),fire hydrants which must be relocated
or removed in conjunction with the construction of these off-site improvement
requirements, shall be the responsibility and at the expense of the subdivider.
17. All existing overhead utilities, including but not limited to, electrical systems,
communication systems and street lighting systems shall be placed underground in
accordance with the provisions of Section 12-1011 of the Fresno Municipal Code and
the policies of the Public Works Department.
18. When street/safety lighting installations are required, street lighting plans shall be
submitted for review and approval by the Traffic Engineer prior to the issuance of
permits for the work. Services to street lighting installations shall be separated from
the electrical service(s) serving the development. The type, location and service for
street lighting installations shall be as determined by the Traffic Engineer. Street
lighting installations shall be dedicated to the City upon completion and acceptance
of the installations.
19. On-site Sewer and/or Water System(s). All on-site sewer and water systems shall be
"private". In the event the subdivider proposes to construct "public" on-site sewer
and/or water systems facilities, written approval by the Public Utilities Department
shall be required and provided with the submittal of the initial final parcel map. Such
facilities shall placed in a dedicated easement and shall be included as public
improvement requirements for the parcel map.
20. Sidewalks (including wheelchair ramp landings) and driveway approaches, for
undeveloped parcels of this parcel map, shall be required as a condition of site
development.
21. Easements: Identify the location, type,size, and record information of easements on
and through the site must be shown on the final map.
22. If P.G.&E. has an existing pole line that serves the property and the existing pole line
crosses proposed property lines and is not covered by an existing easement, it is the
property owner's responsibility to provide adequate rights-of-way to P.G. & E.
If P.G. & E's. assistance is required to determine whether an easement will be
required contact Scott Combs, Senior Land Technician, Fresno Land Rights Office,
at 263-7375.

23. Unless otherwise noted, all covenants or agreements will be prepared upon receipt
of the fee indicated below. Covenants must be approved by the City Attorney's Office
prior to issuance of building permits.
24. Telephone, cable, and other public utilities which propose above-ground facilities
determined by the Planning and Development Director to be oversized shall be
located in an additional easement area outside of the landscape strips required along
major streets.
25. All work and engineered plans for public improvements shall conform to the 2002
Edition of the City of Fresno Standard Specifications and Drawings (City Council
Resolution No. 70-36 and Resolution Nos. 84-361 and any amendments thereto,
hereinafter referred to as the "Public Works Standards".
PARK SERVICE
26. Comply with the Parks, Recreation and Community Services Department
memorandum dated March 25, 2004.
FIRE SERVICE
27. Fire Department has no requirements for Vesting Tentative Parcel Map No. 2004-07.
STREETS AND RIGHTS-OF-WAY
28. All required signing and striping shall be done and paid for by the developer/owner.
The signing and striping plans shall be done per the current CalTrans standards and
shall be submitted as a part of the street construction plans for this tentative map to
the Public Works Department for review and approval.
29. Repair or replace any existing damaged off-site concrete improvements in
accordance with the Standard Specifications and Standard Drawings of the City of
Fresno, Public Works Standards.
30. Additional off-site improvements will be required at the time of future site plan review.
31. Underground all existing overhead utilities within the limits of this map as per Fresno
Municipal Code Section 12-1011,Section 8-801 and Resolution Nos. 78-522/88-229.
32. All survey monuments within the area of construction shall be preserved or reset by
a person licensed to practice Land Surveying in the State of California.
West Nees Avenue
33. Concrete curb, gutter, return cuts, streetlights and permanent A. C. pavement exist
to Public Works Standards.

34. Install concrete returns, with wheelchair ramps at the corner of North Audubon and
North Palm Avenues to Public Works Standards.
North Audubon Avenue
35. Concrete curb,gutter, return cuts,streetlights and permanent A.C. pavement exist to
Public Works Standards.
36. Realign North Audubon Avenue with a 415 foot minium center radius fronting on
Parcels "B", "C", and "D", commencing 70 feet north of West Nees Avenue.
37. Remove all existing concrete curb,gutter, streetlights and permanent A.C. pavement
in the area of realignment.
38. Install concrete curb, gutter, streetlights, and permanent A.C. pavement to Public
Works Standards in the area of new alignment.
39. Construct raised concrete median island, to Public Works Standards with
landscaping, as shown on the attached Exhibit "B". The median island can be
installed as an alternative to requirements 34, 35, and 36 above.
North Palm Avenue
40. Concrete curb,gutter, return cuts,streetlights and permanent A.C. pavement exist to
Public Works Standards.
UGM Reguirements:
41. This Parcel Map is located within U.G.M Major Street Zone "A". Pay U.G.M. fees.
SANITARY SEWER
The nearest sanitary sewer main to the project area is a 8 inch sanitary sewer main located
in West Nees Avenue.The following conditions are required to provide sanitary sewer service
to the proposed project.
42. Extension of a 8 inch sewer main in North Palm Avenue from West Nees Avenue is
required.
43. Separate sewer house branches shall be provided for each parcel created.
44. Sewer Connection Charges are due and shall be paid for Project.
45. Upon connection of this Project to the City Sewer System the owner shall be subject
to payment of Sewer Facility charges per Fresno Municipal Code Section 9-505.1 and
9-505.2. Sewer Facility Charges consist of two components, a Wastewater Facilities

Sewer Charge and Trunk Sewer Charge where applicable. Sewer Facility Charges
are collected after occupancy on a bi-monthly basis over time based on metered
(water or sewer effluent) usage.
The developer may contact the Department of Public Utilities (559) 621-8554 to
receive an estimated cost of the Sewer Facility Charges applicable to the project
(based on a constant sewer discharge and loading (Biochemical Oxygen Demand
[BOD] and Total Suspended Solids [TSS] levels anticipated) at the current rates in
effect,at that time, per Fresno's Master Fee Resolution. The developer shall provide
data regarding estimated sewer discharges rates[flow]and loading[BOD/TSS levels]
required for calculating the estimated charges.
46. Public sewer facilities shall be constructed in accordance with Public Works
Department standards, specifications, and policies.
Urban Growth Management
47. Parcel Map No. 2004-07 is located in U.G.M. Oversize Sewer Reimbursement Area 7.
WATER SERVICE
The nearest water mains to the project area are a 14 inch water main located in West Audubon
Avenue, a 14 inch water main located in West Nees Avenue, and a 8 inch water main located
in North Palm Avenue. The following conditions are required to provide water service to the
project.
48. Separate water services with meter boxes shall be provided to each lot created.
49. Water Connection Charges are due and shall be paid for the Project.
50. Public water facilities shall be constructed in accordance with Public Works Department
standards, specifications, and policies.
Urban Growth Management
51. Parcel Map No. 2004-07 is located in U.G.M Water Supply Area 101s.
FLOOD CONTROL AND DRAINAGE
52. The subdivider shall be required to pay any applicable storm drainage fees to comply
with Fresno Municipal Code Chapter 13, Article 13.
53. The subdivider shall be required to comply with the specific requirements imposed by
the Fresno Metropolitan Flood Control District (FMFCD) for the subdivision or any
amendments or modifications to those requirements which may be granted by the
FMFCD Board of Directors, pursuant to Section 13-1307 of the Fresno Municipal Code.
These requirements are identified in the District's letter to the Planning and
Development Department dated April 26, 2004.

FRESNO IRRIGATION DISTRICT
54. FID does not own,operate,or maintain any facilities located on the applicant's property.
55. FID expects no adverse impacts from the approval of the subject property.
CLOVIS UNIFIED SCHOOL DISTRICT
56. Prior to issuance of a building permit, school fees must be paid. Contact the Clovis
School District for their requirements.

SUBJECT: REQUIRED FINDINGS AND APPROVAL OF VESTING TENTATIVE PARCEL
MAP NO. 2004-07, DATED MARCH 25, 2004, LOCATED ON THE NORTH
SIDE OF WEST ALLUVIAL AVENUE BETWEEN NORTH INGRAM AND
NORTH PALM AVENUES.
BACKGROUND
Vesting Tentative Parcel Map No. 2004-07, filed by Riverview Estates on March 15, 2004, and
accepted on March 25, 2004, proposes to create five parcels with one remainder parcel on 16.18 acres
of property zoned C-P/BA-20/UGM (Administrative and Professional Office DistricUBoulevard Area
OverlaylUGM) and C-P/BA-20/BP/UGM (Administrative and Professional Office DistrictlBoulevard Area
Overlay/Bluff Preservation OveHay/UGM) zone districts. The site is located on the north side of West
Alluvial Avenue between North Ingram and North Palm Avenues. The applicant has also filed Plan
Amendment No. A-04-08, Rezone Application No. R-04-21 and Conditional Use Permit No. C-04-115.
Plan Amendment Application No. A-04-08 amended the 2025 Fresno General Plan and Bullard
Community Plan from the medium density residential land use designation to the office commercial
land use designation on approximately 2 acres of the overall project site. Rezone Application No.
R-04-21 rezoned the 2 acres from the R-1/BA-20/UGM and R-1/BA-20/BP/UGM zone districts to the
C-P/BA-20/UGM and C-P/BA-20/BP/UGM zone districts. Conditional Use Permit Application No.
C-04-115 is a request to develop the project site with a three-story office building with related parking
and utility facilities. Due to the project location special provisions were required prior to the issuance of
any project permit. The project site is located within or near a former landfill area of methane gas.
The California Integrated Waste Management Board (CIWMB) and the County Health Department
have determined that any development of the project site shall be required to submit a post landfill
closure plan for each new development. Staff has incorporated this condition as a mitigation measure
identified in the environmental study conducted for this project. Staff has reviewed the proposed
design and improvements for Vesting Tentative Parcel Map No. 2004-07 and has determined that the
map is consistent with adopted policies as described below.
REQUIRED FINDINGS
California Environmental Quality Act(CEQA) - The California Environmental Quality Act (Public
Resources Code Section 21000 et seq.) and the State EIR Guidelines, require that a public agency
prepare an initial environmental study for each project. If a public agency finds that there is no
substantial evidence in the record that a project may have an significant effect on the environment, a
Mitigated Negative Declaration will be prepared. Environmental Assessment No. A-04-08/R-04-21/
TPM 2004-07/C-04-115 was completed resulting in the finding of a Mitigated Negative Declaration
dated July 23, 2004 and filed with the Fresno City Clerk on the same day.

STATE SUBDIVISION MAP ACT-The Subdivision Map Act (California Government Code Section
66410 et. seq.) requires that a proposed parcel map not be approved unless the map, together with its
design and improvement, is found to be consistent with the General Plan and any applicable specific
plan (Finding No. 1 below). State law further provides that the proposed parcel map be denied approval
if any one of the Finding Nos. 2-5, below, is made in the negative.
1. The proposed parcel map, together with its design and improvements is consistent with the
City's 2025 General Plan and the Bullard Community Plan which designate the site for office
commercial land uses.
2. The site is physically suitable for the proposed type and density of development because of the
flat terrain of the site and adequate access and drainage on and off the site.
3. The proposed parcel map design and improvements are not likely to cause substantial and
considerable damage to the natural environment, including fish, wildlife or their habitat, because
of the urbanized nature of the area in which the site is located.
4. The proposed parcel map design and improvements are not likely to cause serious public health
and safety problems, because the conditions of approval have shown and will insure that the
subdivision conforms with City health and safety standards.
5. The proposed parcel map design will not conflict with public easements within or through the site
because conditions of approval will assure noninterference with any existing or proposed public
easements.
Staff, based on its own analysis, has determined that the parcel map, subject to the recommended
conditions of approval, otherwise complies with the design and property development standards of the
Zoning Ordinance and local Parcel Map Ordinance and recommends the approval of the parcel map.
DIRECTOR DETERMINATION

developments the alternative of providing common open space area equivalent to five(5)percent of the
project's area or paying an equivalent amount of funds for the acquisition or improvement of public open
space areas located within three (3) miles of the development.
EA No. A-03-18/R-03-79/T-5248/C-04-148: Granville Homes has filed applications pertaining to
approximately 154 acres of property bound by East Church, East Jensen, South Fowler and South
Sunnyside Avenues. Plan Amendment Application No. A-03-18 proposes to amend the 2025 Fresno
General Plan and the Roosevelt Community Plan pertaining to approximately 22 acres of the project
site from the community commercial(12 acres), medium high density residential(5 acres)and medium
density residential(5 acres)planned land use designations to the medium density residential(17 acres)
and medium high density residential(5 acres)land use designations. The plan amendment application
also proposes to delete the equestrian portion of the multi-use trail along East Jensen Avenue, between
South Fowler and South Clovis Avenues. Rezone Application No. R-03-79 proposes to rezone the
subject site from the R-R(Rural Residential-Fresno County)zone district to the R-1/UGM(Single Family
Residential/Urban Growth Management) zone district for 117 acres, to the R-2/UGM (Low Density

Conditional Use Permit Application No. C-04-115,the vacation of a portion of West Audubon Drive,and
a post-closure development plan. These inter-related projects involve approximately 16.18 acres of
property located north of West Nees Avenue and west of the North Ingram Avenue alignment. These
applications propose to:(1)amend the 2025 Fresno General Plan and the Bullard Community Plan from
medium-density residential land use to office commercial land use on approximately 2 acres of the
overall project site; (2) rezone the aforementioned 2 acres from R-1/BA-20/UGM and
R 1/BA-20/BP/UGM (Single Family Residential District/Boulevard Area Overlay/Urban Growth
Management Area and Single Family Residential District/Boulevard Area Overlay/Bluff Preservation
Zone/UGMArea)to C-P/BA-20/UGM and C-P/BA-20/BP/UGM(Administrative and Professional Office
DistrictlBoulevard Area Overlay/UGM Area and Administrative and Professional Office

EA No. A-04-10/R-04-30/C-0472: Quad Knopf, Inc. has filed for Plan Amendment Application No. A-
04-10, Rezone Application No. R-04-30 and Conditional Use Permit Application No. C-04-72 pertaining
to a 1.93 acre site consisting of four parcels of land located on the northeast corner of West Clinton and
North Brawley Avenues. Pla*endment Application No. A-04-10 p ses to change the planned
t land use designation of the site from the medium low density rest ential to the neighborhood
commercial land use designation. Rezone Application No. R-04-30 proposes to change the zone district
classification from the Fresno County RR(Rural Residential)to the C-1/UGM (Neighborhood Shopping
Center/Urban Growth Management) zone district. Conditional Use Permit Application No. C-04-72
proposes to construct a 14,820 square-foot, single-story building for use as a commercial pharmacy
(Walgreen Drug Store). In addition to the above-referenced applications, the project will include the
detachment of the subject site from the Kings River Conservation District and the North Central Fire
Protect District and annexation into the City of Fresno.
EA No.A-04-12: George Beal,on behalf of Jaswant Kahlon, has filed Plan Amendment Application No.
A-04-12 requesting to amend the 2025 Fresno General Plan and the Roosevelt Community Plan for a
2.5 acre project site, located on the northwest corner of South Maple and East Jensen Avenues, from
the neighborhood commercial planned land use designation to the heavy commercial land use
designation. The site is currently zoned C-6, Heavy Commercial, and the proposed plan amendment
would bring the planned land use into conformance with the existing zone district and existing land use.
EA No.A-04-13/T-5356: CalStar Industries, Inc. has filed Plan Amendment Application No. A-04-013
and Vesting Tentative Tract Map No. 5356/UGM pertaining to one parcel totaling 2.39 acres of property
located on the south side of West Ashlan Avenue between North Polk and North Dante Avenues. Plan
Amendment Application No.A-04-013 proposes to amend the 2025 Fresno General Plan and the West
Area Community Plan from the low density residential planned land use designation to the medium low
density residential planned land use designation. Vesting Tentative Tract Map No.5356/UGM proposes
to subdivide the property into nine residential parcels.
EA No. A-04-14/R-04-39/C-04-112/TPM 2004-12: JPI, on behalf of Helen Storelli, has filed Plan
Amendment Application No. A-04-14, Rezone Application No. R-04-39, Conditional Use Permit
Application No. C-04-112 and Tentative Parcel Map No. 2004-12 which proposes to amend the 2025
Fresno General Plan and the Hoover Community Plan for 5.49 acre parcel located on the south side
of East Barstow Avenue between Freeway 41 and North Fresno Street. The plan amendment is
requesting a change in the planned land use from the medium high density residential designation to
the high density residential designation with a related rezone application from the R-A (Single Family
Residential - Agricultural) zone district to the R-3/cz (Medium Density Multiple Family
Residentiallconditional zoning) zone district. The conditional use permit would authorize the
development of a four-story, 152 dwelling unit student housing complex that is expected to house 480
students. Tentative Parcel Map No. 2004-12 is proposing to split the subject property into two parcels
of 3.29 acres (Parcel A) and 5.49 acres (Parcel B). Only Parcel B will be subject to the entitlement
applications listed above.
EA No.A-04-16/R-04-41/C-04-149: Central Valley RV has filed Plan Amendment Application No.A-04-
16 requesting to amend the 2025 Fresno General Plan and the West Area Community Plan for the
entire 6 acre site located on the northeast and southeast corners of North Marks and West Princeton
Avenues, from the general heavy commercial planned land use designation to the light industrial land
use designation. Rezone Application No. R-04-41 proposes to rezone the site from the C-6 (Heavy
Commercial)zone district to the C-M (Commercial and Light Manufacturing)zone district. Conditional
Use Permit Application No. C-04-149 proposes to allow for automobile/motorcycle sales and
recreational vehicle sales on the subject property.
EA No.A-04-17/R-04-42: The Housing Authority of Fresno City and County has filed Plan Amendment
Application No. A-04-17 and Rezone Application No. R-04-42 pertaining to approximately 94 acres of
property. Applications for a plan amendment and/or a rezone have been filed for 72 parcels located in
the Project Area generally bounded by West California Avenue, Fresno Street and Martin Avenue on
the north, South Walnut Avenue on the east, West Church Avenue on the south, and. South West
Avenue on the west.
Plan Amendment Application No. A-04-17 proposes to amend the 2025 Fresno General Plan and the
Edison Community Plan from the open space-ponding basin/park, medium high density residential,
medium density residential o4blic facilities planned land use designs to open space-ponding
basin/park, medium density residential, medium high density residential or commercial office land use
designations. The Fresno City Redevelopment Agency(RDA)will concurrently be considering several
text changes to the entirety of the Southwest Fresno General Neighborhood Renewal Area Plan and
the entirety of the Fruit/Church Redevelopment Plan (collectively referred to as the RDA plans).
Rezone Application No. R-04-42 is a request to rezone various parcels from O (Open Conservation
District), P (Off-Street Parking District), M-1 (Light Manufacturing District), M-3 (Heavy Industrial
District), C-6 (Commercial Shopping Center District), R-1 (Single-Family Residential District), R-2 (Low
Density Multiple Family Residential District) and R-3 (Medium Density Multiple-Family Residential
District)zone districts to O (Open Conservation District) , R-1 (Single Family Residential District), R-2
(Low Density Multiple Family Residential District), and C-P (Administrative and Professional Office
District).
The applicant, the Housing Authority of the City of Fresno, intends to leverage a $20 million Federal
Department of Housing and Urban Development Hope VI grant for the demolition of 113 obsolete
multiple family dwelling units, the construction of 48 new multiple family dwelling units, up to 300 new
single family housing units,office and commercial facilities near a new aquatic center,the rehabilitation
of up to 120 existing single family dwellings, and related improvements.
EA No.C-04-107: City of Fresno, Public Utilities Department, Water Division has filed Conditional Use
Permit Application No. C-04-107 which requests authorization to construct site improvements at Water
Well Pump Station No. 197. The issuance of the conditional use permit would allow the construction
of chlorination facilities and install water well site improvements at Water Well Pump Station No. 197.
Future facilities, such as wellhead treatment and an emergency generator,will be installed as needed.
The pump station facility will be constructed in three phases on a 0.31 acre site on the south side of
East California Avenue between South Orange and South Cedar Avenues.
ANY INTERESTED PERSON may comment on the mitigated negative declarations to the Fresno City

EA No. R-04-25IT-5294: Union Community Holdings has filed Rezone Application No. R-04-25 and
Vesting Tentative Tract Map No. 5294/UGM pertaining to approximately 20 acres of property located
on the west side of South Temperance Avenue between East Kings Canyon Road and East.Butler
Avenue. The project applications propose to rezone the subject property from the AE-20/UGM
(Exclusive 20-Acre Agricultural/Urban Growth Management)zone district to the R-1/UGM(Single Family
Residential/Urban Growth Management)zone district. Vesting Tentative Tract Map No. T-5294/UGM
proposes to subdivide the subject property into 83 single family residential lots and one outlot. .
Pursuant to Section 21157.1 of CEQA, it may be determined that a subsequent project falls,within the
scope of a MEIR provided that the project does not cause significant impacts on the environment that
were not previously examined by the MEIR. Since the projects do not change the land use indicated
for the subject properties by the 2025 Fresno General Plan and will not generate significant effects not
previously identified by the MEIR staff has determined that the subject applications are within the scope
of the MEIR and, as such, shag subject to the appropriate mitigation 9asures contained therein as
required by Section 15177 of the CEQA Guidelines. No additional specific mitigation measures will be

The Public Works, Transportation Planning Section, has completed its review of Tentative
Parcel Map 2004-07, which was submitted by Harbour & Associates on behalf of Riverview
Estates, the property owner. The following requirements are to be placed on this Tentative
Parcel Map as a condition of approval by the Public Works Department.
General Conditions
• All survey monuments within the area of construction shall be preserved or reset by a
person licensed to practice Land Surveying in the State of California.
• Repair or replace all existing damaged and /or off-grade offsite concrete improvements
in accordance with the Standard Specifications and Standard Drawings of the City of
Fresno, Public Works Department.
• All required signing and striping shall be installed and paid for by the developer/ owner.
The signing and striping plans shall comply with the current Caltrans standards and be
submitted as a part of the street improvement plans for this Tentative Parcel Map to the
Public Works Department for review and approval.
• Underground all existing offsite overhead utilities with the limits of this map in
accordance with Fresno Municipal Code Section 12-1011, 8-801 and Resolution No. 78-
522/88-229.
• Additional offsite concrete improvements will be required at the time of future site plan

General
The subject site is located on the north side of West Nees Avenue between North Ingram and North
Palm Avenues.
Sanitary saver service
An 8-inch sanitary sewer main is located in West Nees Avenue to serve the proposed project. The
following conditions are required to provide sanitary sewer service to the proposed project.
1. Extension of an 8" sewer main in North Palm Avenue from West Nees Avenue.
2. Separate sewer house branches shall be provided for each parcel created.
3. Sewer Connection Charges are due and shall be paid for the Project.
4. Upon connection of this Project to the City Sewer System the owner shall be subject to payment of
Sewer Facility charges per Fresno Municipal Code Section 9-505.1 and 9-505.2. Sewer Facility
Charges consist of two components, a Wastewater Facilities Sewer Charge and Trunk Sewer
Charge where applicable. Sewer Facility Charges are collected after occupancy on a bi-monthly
basis over time based on metered(water or sewer effluent)usage. The developer may contact the
Department of Public Utilities(559) 621-8554 to receive an estimated cost of the Sewer Facility
Charges applicable to the project (based on a constant sewer discharge and loading (Biochemical
Oxygen Demand [BOD] and Total Suspended Solids [TSS] levels anticipated) at the current rates
in effect, at that time, per Fresno's Master Fee Resolution. The developer shall provide data
regarding estimated sewer discharge rates [flow] and loading [BOD/TSS levels] required for
calculating the estimated charges.

Water service

6. The Federal Clean Water Act and the State General Permits for Storm Water Discharges
Associated with Construction and Industrial Activities (State General Permits) require developers
of construction projects disturbing five or more acres, and discharges associated with industrial 11
activity not otherwise exempt from National Pollutant Discharge Elimination System (NPDES)
permitting, to implement controls to reduce pollutants,prohibit the discharge of waters other than
storm water to the municipal storm drain system, and meet water quality standards. These
requirements apply both to pollutants generated during construction,and to those which may be
generated by operations at the development after construction.

Activities, approved August 1999, (modified December 2002.) A State General
Construction Permit is required for all clearing, grading, and disturbances to the ground
that result in soil disturbance of at least one acre(or less than one acre if part of a larger
common plan of development or sale). Permittees are required to: submit a Notice of
Intent to be covered and must pay a permit fee to the State Water Resources Control Z
Board(State Board), develop and implement a storm water pollution prevention plan,

in permit compliance, and complete an annual certification of compliance.

b. State General Permit for Storm Water Discharges Associated with Industrial Activities, O
April, 1997 (available at the District Office.) A State General Industrial Permit is
required for specific types of industries described in the NPDES regulations or by

submit a Notice of Intent to be covered and must pay a permit fee to the State Water
Resources Control Board, develop and implement a storm water pollution prevention
plan, eliminate non-storm water discharges, conduct routine site inspections, train
employees in permit compliance, sample storm water runoff and test it for pollutant
indicators, and annually submit a report to the State Board.

The cost of construction of Master Plan facilities,excluding dedication of storm drainage easements,
is eligible for credit against the drainage fee of the drainage area served by the facilities. A
Development Agreement shall be executed with the District to effect such credit. Reimbursement
provisions, in accordance with the Drainage Fee Ordinance, will be included to the extent that
Developer's Master Plan costs for an individual drainage area exceed the fee of said area. Should the
facilities cost for such individual area total less than the fee of said area,the difference shall be paid
upon demand to the City or District.
No surface runoff shall be directed towards the bluffs.
The subject site is located within the District's Drainage Area"DH". Runoff from the"DH"system
will ultimately drain to the San Joaquin River. Drainage runoff from commercial and industrial land
uses directly to the river is prohibited by the City of Fresno and District policy. The District is
therefore requiring on-site mitigation of the run-off quality prior to discharge to the public drainage
system. The specific plan and detail of the proposed mitigation must be reviewed and approved by
the District prior to implementation. The Developer is responsible to implement mitigation features
which will maintain compliance with the Local,State,and EPA standards and regulations throughout
the life of the project.
There is an existing fifteen-foot (15'), twenty-foot (20') and thirty-foot (30') wide storm drain
easement as shown on Exhibit No. 1. No encroachments into the easements will be permitted
including but not limited to, foundations, roof overhangs, trash enclosures, swimming pools and
trees.
As a condition of the TPM 2004-007, the Developer shall dedicate a surface drainage easement as
shown on Exhibit No. 1 to allow for storm water runoff from TPM 2004-007 to surface drain to the
baffled apron structure during storm events that exceed the design capacity of the drainage system.
The Developer shall dedicate a thirty-foot (30') access easement as shown on Exhibit No. 1 as a
condition of TPM 2004-007. The District has existing storm drain facilities at the bluff. Access to
the storm drain facilities must remain available for maintenance, repair and operation.
The portion of the easement shown as "Existing fifteen-foot (15') Storm Drain Easement to be
Abandoned", shall be quit claimed by the District after the Developer has dedicated the
aforementioned right-of way and easements as shown on Exhibit No. 1.

There is an existing wrought iron fence between the site and the District's baffled apron structure.
The District recommends a single fence. If a fence other than the existing fence is proposed,District
review and approval is required.
The Developer must provide an adequate water supply for bluff landscaping surrounding the
District's baffled apron structure. The water line may be located within the thirty-foot(30') wide
storm drain easement and will not be considered an encroachment. The Developer will pay for the
water line, meter box and City fees through Agreement 27-DH, DI, DJ. The District will pay the
monthly City water service bills at the time water service becomes available.
The following paragraphs only apply towards development of the individual parcels and are not
conditions for the recording of the map:
In an effort to improve storm water runoff quality,outdoor storage areas shall be constructed
and maintained such that material which generates contaminants will not be conveyed by
runoff into the storm drain system.
District encourages,but does not require that roof drains from non-residential development
be constructed such that they are directed onto and through a landscaped grassy swale area to
filter out pollutants from roof runoff.

The Parks, Recreation& Community Services Department has reviewed the Engineering plan
submitted for review by Harbour&Associates Civil Engineers, dated 3-15-04 . The following
comments are submitted based on the parcel as shown,without any existing street trees.
The following 3 para aphs apply to Non-residential parcel maps only. The street tree and
median island requirements are deferred until the special permit process.:
1. Street trees are required in accordance with the provisions of FMC Section 12-
1206(c)(5). The number of street trees shall be determined at the rate of one tree for each
60' of street frontage as specified in FMC 11-301(c).
2. Each tree shall be provided with drip irrigation in conformance with the provisions of
FMC Sections 12-306-N-23.
3. The applicable street tree fees and/or alternative measures to satisfy the street tree
requirement are deferred to the time of development of each parcel. Street tree fees shall
be based on the fee rates established in the Master Fee Schedule in effect at the time
payment is due.
The following are for residential and manufacturing zones:
1. STREET TREE REQUIREMENTS:
Following issuance of the building permit,the subdivider shall notify Parks to mark street tree
locations and to drill through hardpan upon completion of curb and gutter construction. Parks will plant
the street trees upon notification that irrigation has been installed.
Street tree planting fees for two 15 gallon trees shall be paid at the rate in effect in the Master Fee
Schedule at the time payment is due for final parcel map fees(current rate is $129.00 per tree,Acct
#34856,Fund#63548,Org#179900)
OPTION B. Street Tree Planting by Developer-The developer may plant the two required trees. Street
tree planting shall be completed prior to receiving approval of final occupancy on Parcel A. .
Street trees shall be planted in accordance with "Specifications for Developer Street Tree Planting".
Landscape plans approved by the Parks,Recreation and Community Services Department, as part of the
special permit process, shall indicate street tree planting locations and species. A street tree planting
permit for all street tree planting shall be required as part of the landscape plan approval process.
Street Tree Inspection fees for two street tree plantings by the subdivider shall be paid at the rate in
effect in the Master Fee Schedule at the time payment is due for the final parcel map. When a
concurrent application for site plan review is being processed,this fee may deferred for payment with
building permit fees as part of the site plan review(current rate is$28.00 per tree,Acct#34859,Fund
#63548, Org#179900).
Existing Street Trees: There are#trees within the right of way at this site. FOR PALMS
ONLY.-However,palm trees do not satisfy the street tree condition.described in FMC 11-302 wherein
street trees shall "provide shade". Existing trees in the public right of way may not be removed.
[Fresno Municipal Code 11-306(h)(2)]. Said trees near any excavation,construction or street work shall
be sufficiently guarded and protected by those responsible for such work so as to prevent any injury to
said tree. No person shall excavate any ditches,tunnels or trenches,or install pavement within a radius
of four feet from any public tree without the written permission of the Parks Division. (FMC 11-
305(h)2.).
2. STREET TREE IRRIGATION: The applicant shall provide drip irrigation to all street trees in
conformance with FMC 12-306-N-23 whether planted by the City or by the subdivider.
We have been asked to prepare this as instructions to the planner for Map preparation. This is not an
opportunity to explain to the applicant the bigger picture of landscaping/median island issues.

We have reviewed the parcel map for the proposal located on the north side of West Nees
Avenue, Between North Ingram and North Palm Avenues. Caltrans has the following
comments:
The proposal contains insufficient information to evaluate impacts to the State Highway
System. Caltrans requests the opportunity to review any specific development proposals
when available.
Caltrans is evaluating an additional river crossing to be located in the vicinity of this
project. For the proposal to be feasible, West Nees Avenue would need to be widened at
this location. The City should condition this project to dedicate the necessary right-of-way
to allow for future widening of Nees Avenue. Acquiring right-of-way prior to development
will save a considerable amount of transportation dollars.
We request that this letter be made part of the permanent public record for this project and
that a copy of our letter be included in the staff reports for both the City Council and the
Planning Commission. This will provide the decision-making body and the general public
with a complete and accurate environmental evaluation for the project.
Please send a copy of the staff report(s) to Caltrans prior to any scheduled hearings for this

Our Office has received and reviewed the Revision #2- Revised Post Closure Development
Report (Plan) submitted and prepared by Kleinfelder, Inc., on behalf of Mr. Edmund Bergthold.
The Plan dated May 28, 2004, includes a description of the project location, purpose and
objective of the plan, and system monitoring as well as other pertinent information. Overall, we
concur with the implementation of the Plan, however the following items need to be addressed:
Section 3.1 Installation
• The completed geomembrane will need to be certified by a third party who is
knowledgeable in Liquid Boot application.
Section 3.1.2 Vertical Geomembrane Barrier
• Provide our office with detailed drawings of the Liquid Boot that will be applied in the
basement and elevator pits.
Section 3.1.4 Geomembrane Barrier Attachment to Concrete
• Provide a trowel surface which provides more surface area for adhesion of the Liquid
Boot.
Section 4.2.3 Canopy Gas Collection Trenches
• The use of a 2-inch perforated pipe will need to be discussed for comment by California
Integrated Waste Management Board (CIWMB)staff.
Section 4.2.4 Canopy Vent Piping and Risers
• The use of a 2-inch slotted or perforated drainpipe will need to be discussed for
comment by CIWMB staff. Please clarify why perforated or slotted vent pipe is being
used instead of a solid vent pipe.
Section 5.2 Installation
• The main control panel should be located so emergency personnel do not have to enter
the building if activated. In addition, provide a map of the location of the sensors.The
map will need to be located next to the main control panel.
Section 6.2 Other Utilities
• The bentonite/seal should extend a minimum of five (5)feet from the footing.

construction especially during trenching activities.
