SUBJECT: NOTICE OF APPROVAL OF VESTING TENTATIVE PARCEL MAP NO. #**L-
DATED JANUARY 27, 2004, PROPOSING A THREE (3) LOT PARCEL MAP FOR
PROPERTY LOCATED ON THE EAST SIDE OF NORTH MARTY AVENUE
BETWEEN WEST SHAW AND WEST ASHLAN AVENUES.
The City of Fresno Planning Division has completed its review of the subject parcel map dated
January 27, 2004. Pursuant to Fresno Municipal Code FMC Section 12-1205(c), this letter is written
to advise that the Conditions of Approval dated March 18, 2004, are as noted on the attached
document.
If you have any questions regarding the conditions you must notify either Louis Rocha or Paul Bernal
at 621-8073 no later than March 31, 2004, to request a review of the conditions. Otherwise, the
stipulated conditions of approval are in effect as of that date. No further notice will be sent.
Appeal: The divider or any aggrieved person may file an appeal regarding to conditions of approval
within fifteen (15) days from the date of approval.
To protest the Director's decision regarding the conditions of approval, you must appeal by filing a
written appeal with the Director of the Development Department. Appeal must include the appellant's
interest in/or relationship to the subject property, the decision or action appealed, and specific
reasons why the appellant believes the decision or action appealed from should not be upheld
Appeals must be submitted to the Director of the Development Department prior to 5 p.m. on April 12,
2004.
EXPIRATION: The approval or conditional approval of this tentative Parcel Map expires two years
from the date of approval. The expiration shall terminate all proceedings and a final Parcel Map may
not be filed without first processing a new Tentative Parcel Map.
Modification of a Tentative Parcel Map after approval or conditional approval does not extend the two
year time limit.

EXTENSION: The divider may request an extension of the tentative map expiration date by filing a
written application together with the fee set forth in the Master Fee Schedule at the time of the
request with the Director of the Development Department at least thirty days before the expiration
date of the map. The applicant must state the reasons for the requesting the extension. New
conditions may be imposed if an extension is granted.
An extension may not exceed an aggregate of five years.

TENTATIVE PARCEL MAP NO. 2004-01
NOTICE TO PROJECT APPLICANT
In accordance with the provisions of Government Code §66020(d)(1), the imposition
of fees, dedications, reservations or exactions for this project are subject to protest
by the project applicant at the time of approval or conditional approval of the
development or within 90 days after the date of the imposition of the fees,dedications,
reservations or exactions imposed on the development project.
The City of Fresno Planning and Development Department has completed a review of the subject
tentative parcel map in accordance with the State Subdivision Map Act and the Fresno Municipal
Code. The conditions of approval for Tentative Parcel Map No. 2004-01 are as follows:
LEGAL STATUS OF SITE TO BE SUBDIVIDED
1. The parcel map site was legally created as Parcel B of Parcel Map No. 93-03, in the
City of Fresno, County of Fresno, State of California, according to the map thereof
recorded in Book 54, Page 55 of Parcel Maps, Fresno County Records.
ZONING
2. Proposed parcels are consistent with the C-M/cz (Commercial and Light
Manufacturing/conditions of zoning) zone district for the parcel map site.
CONDITIONS OF ZOINING (As required by Rezone Application No. R-01-024)
The project will be developed in a unified manner with the contiguous parcels to the
north and eas�twith the exteriors of all buildings being designed in a manner that
`lP,f conveys a sense of unity of design.

of the Bullard Community Plan for all special permits.
5. Owner of the subject property shall enter into a cross access agreement with the

6. No building or structure erected on the subject site shall have a height greater than
yr two (2) stories, not to exceed thirty-five (35) feet. Exceptions to this restrictions may
be granted through the conditional use permit process.
7. All development shall utilize common driveways and access points.
8. Any storage of material shall take place inside buildings. No outside storage of
materials or equipment will be allowed unless the structure is designed to be
--- integrated into the whole design theme of the complex.
9. A unified landscape design theme shall be utilized throughout the development.
10. All lighting shall be hooded and directed onto the subject property.
11. All noise generating equipment such as compressors, pumps, etc., shall be located
within the proposed buildings.
12. Any roof mounted airconditioning units shall be acoustically baffled and shielded from
direct view from any street or adjoining property.

J14. The applicant shall install an appropriate barrier(fence or masonry wall)on the south

15. The following uses as listed in Section 12-224.1 subsection D (Manufacturing),
E (Processing) and F (Fabrication) shall be subject to a conditional use permit:
Bookbinding, rubber stamps, blue printing and photocopying, assembly of small
electrical equipment.
16. The following uses shall be prohibited:
Drive-through car wash, mechanical car wash, self service car wash, department
stores, farm equipment sales and incidental repair, motorcycle shop, pawn shops,
baths (Turkish, etc.), body and fender shop, equipment rental, farm equipment
service, taxidermist, care takers residence, frozen food lockers, grocery stores, ice
and food product dispensing machines, bar and cocktail lounges, kennels, rubber-
fabrication or production made from finished rubber, and all uses listed in Section 12-
224.1 subsection D(Manufacturing), E(Processing), F (Fabrication), G (Public Utility
Service Yards with Incidental Buildings), H (Off-Street Parking), I (Agricultural Uses),

J (Electrical Distribution Substation), K (Communications Equipment Buildings), L
(Temporary or Permanent Telephone Booths), and M (Water Pump Stations) of the
Fresno Municipal Code, notwithstanding the uses listed in Condition No. 13.
PLAN CONSISTENCY
17. The Bullard Community Plan and 2025 Fresno General Plan designate the parcel
map for development with the light industrial land uses.
SUBDIVISION MAP ACT REQUIREMENTS
18. Concurrent with the filling of a final map and when the provisions of Section 66436 of
the Subdivision Map Act apply,the subdivider is responsible to send, by certified mail,
a sketch of the proposed final map, together with a copy of SMA Section
0� 66436(a)(3)(A), to any public entity or public utility which has previously acquired a
right-of-way easement.
19. Comply with provision of the State of California Government Code Sections 66410 -
66499.58 (the Subdivision Map Act) and the City of Fresno Municipal Code Chapter
12, Article 10 (Subdivision of Real Property).
GENERAL PUBLIC WORKS REQUIREMENTS
Dedications
20. The subdivider shall dedicate public easements to facilitate the construction of curbs,
gutters, sidewalk, bus bays, right turn lanes, bike lanes, bike paths, multi-purpose
trail, wheelchair ramps and public utilities in accordance with City plans, ordinances,
resolutions and policies,the Standard Specifications of the Public Works Department
within the limits of the parcel map. Additionally, a minimum 4 foot wide clear path of
travel is required along the public sidewalk on all frontages of the property as required
by Title 24 of the California Administration Code as determined by the City Engineer.
An on-site pedestrian easement and construction of a path may be required if Title
24 provisions can not be met within the public rights of way. All such public
easements shall be identified and dedicated with the processing and recordation of
the Parcel Map or at the time of Special Permit reviews for the proposed development
of the parcels.

Street Improvements
21. The subdivider shall construct curb, gutters, curb returns and landings, wheelchair
ramps, sidewalks with street tree wells and irrigation systems (when applicable),
\4 permanent pavement,street/safety lighting,bike lanes, bike paths, multi-purpose trail,
walls and fences in accordance with City plans, ordinances, resolutions, policies and
the Standard Specifications of the Public Works Department within the limits of the
parcel map.
22. Existing improvements that are not to the planned alignment shall be removed and
required improvements installed to the new street alignment and grade. Existing
P\� improvements to remain in place shall be repaired if determined to be damaged
and/or off grade by the City Engineer. Existing driveway approaches not identified for
current or future utilization shall be removed and sidewalk(when applicable),curb and
gutter shall be installed to match existing or proposed street line and grade as
determined by the City Engineer.
Sanitary Sewer System
23. The subdivider shall connect each parcel being created to the City of Fresno's
sanitary sewer system with a separate sewer house branch unless other
arrangements are approved by the City Engineer. All sanitary sewer system
improvements shall be constructed in accordance with City plans, ordinances,
resolutions,policies and the Standard Specifications of the Public Works Department.
The connection to the City's sanitary sewer system requires the payment of all
applicable sewer connection charges in accordance with the provisions of FMC
Chapter 9, Article 5 prior to the approval of the map.
Water System
24. The subdivider shall connect each parcel being created to the City of Fresno's water
system with a separate water service and meter unless other arrangements are
approved by the City Engineer. All water system improvements shall be constructed
in accordance with City plans, ordinances, resolutions, policies and the Standard
Specifications of the Public Works Department. The connection to the City's system
requires the payment of all applicable water connection charges in accordance with
the provisions of FMC Chapter 14, Article 1 prior to the approval of the map.
Street, Sewer and Water Construction Plans
25. The subdivider shall provide street, sewer and water construction plans for the
required public improvements as determined by the City Engineer. Such plans shall
be prepared by a registered Civil Engineer and approved by the City Engineer prior
to the issuance of Street Work permits.

ON-SITE REQUIREMENTS
26. The subdivider may either constru t the required off-site improvements prior to the
approval of the final parcel map; r nter into an agreement with the City of Fresno
providing for the construction of a required improvements and sufficient security
prior to the approval of the final parcel map.
27. All off-site and public improvements shall be constructed in accordance with the
Public Works Department Standards, Specifications and Policies. Engineered
construction plans and estimates for all or part of the required work shall be required
prior to the issuance of Street Work Permits unless otherwise determined by the City
Engineer. The cost for such plan preparation, review and construction inspection
shall be at the subdivider's expense.
28. Any existing utilities, including but not limited to, street lights, traffic signals, fire
hydrants, poles (power, telephone, cable, etc),fire hydrants which must be relocated
or removed in conjunction with the construction of these off-site improvement
requirements, shall be the responsibility and at the expense of the subdivider.
29. All existing overhead utilities, including but not limited to, electrical systems,
communication systems and street lighting systems shall be placed underground in
accordance with the provisions of Section 12-1011 of the Fresno Municipal Code and
the policies of the Public Works Department.
30. When street/safety lighting installations are required, street lighting plans shall be
submitted for review and approval by the Traffic Engineer prior to the issuance of
permits for the work. Services to street lighting installations shall be separated from
the electrical service(s) serving the development. The type, location and service for
street lighting installations shall be as determined by the Traffic Engineer. Street
lighting installations shall be dedicated to the City upon completion and acceptance
of the installations.
31. On-site Sewer and/or Water System(s). All on-site sewer and water systems shall be
"private". In the event the subdivider proposes to construct "public" on-site sewer
and/or water systems facilities, written approval by the Public Utilities Department
shall be required and provided with the submittal of the initial final parcel map. Such
facilities shall placed in a dedicated easement and shall be included as public
improvement requirements for the parcel map.
32. Unless otherwise determined by the Public Utilities Director, a covenant shall be
required which provides that the property owners shall be responsible for the
restoration, replacement and expense of any private surface improvements removed
or damaged during the course of maintaining such public facilities by the City or its
agents.

/33. Sidewalks (including wheelchair ramp landings) and driveway approaches, for
undeveloped parcels of this parcel map, shall be required as a condition of site
development.
34. Those items identified with an asterisk (*) refer to obligations of the applicant for
development of parcels with net acreage of 4 to 10 acres. The Public Works Director
has determined that completion of such designated improvements may be deferred
until time of development or further division of the parcel(s) upon written request by
the applicant. The request must specifically acknowledge the applicant's waiver of
any rights provided by Section 65961 of the California Government Code.
35. Easements: Identify the location, type, size, and record information of easements on
and through the site must be shown on the final map.
36. If P.G. & E. has an existing pole line that serves the property and the existing pole line
crosses proposed property lines and is not covered by an existing easement, it is the
property owner's responsibility to provide adequate rights-of-way to P.G. & E.
If P.G. & E's. assistance is required to determine whether an easement will be
required contact Scott Combs, Senior Land Technician, Fresno Land Rights Office,
at 263-7375.
37. Unless otherwise noted, all covenants or agreements will be prepared upon receipt
of the fee indicated below. Covenants must be approved by the City Attorney's Office
prior to issuance of building permits.
38. Telephone, cable, and other public utilities which propose above-ground facilities
determined by the Planning and Development Director to be oversized shall be
located in an additional easement area outside of the landscape strips required along
major streets.
39. All work and engineered plans for public improvements shall conform to the 2002
Edition of the City of Fresno Standard Specifications and Drawings (City Council
Resolution No. 70-36 and Resolution No. 84-361) and any amendments thereto,
hereinafter referred to as the "Public Works Standards".
PARK SERVICE
40. The develop ment/owner shall contact Parks, Recreation and Community Services at
621-2903 for street tree requirement.
FIRE SERVICE
41. No requirement.

STREETS AND RIGHTS-OF-WAY
42. Repair or replace all existing damaged and/or off-site concrete improvements in
accordance with the Standard Specifications and Standard Drawings of the City of
Fresno Public Works Department.
43. Additional off-site improvements will be required at the time of future site plan review.
North Marty Avenue (Major Street)
44. No dedication is required with this map.
45. Concrete curb, gutter, asphalt paving and streetlights exist.
SANITARY SEWER
Sanitary Sewer facilities are currently or would be available to provide sanitary sewer service to the
site subject to the following requirements.

46. Separate sewer house branches are required for each lot created.
47. The project developer should contact Wastewater Management
Division/Environmental Services (559) 621-5100 regarding conditions of service for
special industrial users.
48. Construct a 8-inch sanitary sewer main in North Marty Avenue from the existing 8-inch
sanitary sewer main south to serve proposed parcel C of Parcel Map No. 2004-01.
49. Upon connection of this Project to the City Sewer System the owner shall be subject
to payment of Sewer Facility charges per Fresno Municipal Code Section 9-505.1 and
9-505.2. Sewer Facility charges consist of two components, a Wastewater Facilities
Sewer Charge and Trunk Sewer Charge where applicable. Sewer Facility Charges
are collected after occupancy on a bi-monthly basis over time based on metered
(water or sewer effluent)usage. The developer may contact the Department of Public
Utilities (6559) 621-8554 to receive an estimated cost of the Sewer Facility Charges
applicable to the project (based on a constant sewer discharge and loading
(Biochemical Oxygen Demand [BOD] and Total Suspended Solids [TSS] levels
anticipated) at the current rates in effect, at the time per Fresno's Master Fee
Resolution. The developer shall provide data regarding estimated sewer discharge
rates [flow] and loading [BOD/TSS levels] required for calculating the estimated
charges.

WATER SERVICE
Water facilities are currently or would be available to provide sanitary sewer service to the site
subject to the following requirements:
50. Payment for installation of water service(s) and/or meter(s) is required.
51. Water Connection Charges are due and shall be paid for this project.
FLOOD CONTROL AND DRAINAGE
52. The subdivider shall be required to pay any applicable storm drainage fees to comply
with Fresno Municipal Code Chapter 13, Article 13.
53. The subdivider shall be required to comply with the specific requirements imposed by
the Fresno Metropolitan Flood Control District (FMFCD) for the subdivision or any
amendments or modifications to those requirements which may be granted by the
FMFCD Board of Directors, pursuant to Section 13-1307 of the Fresno Municipal
Code. These requirements are identified in the District's letter to the Planning and
Development Department dated February 13, 2004.
FRESNO IRRIGATION DISTRICT
54. FID's Herndon No. 39 Canal traverses the subject property, as shown on the attached
map.
55. FID request that the applicant be required to submit a grading and drainage plan for
FID approval which shows that the proposed development will not endanger the
structural integrity of the canal, or result in drainage patterns that will adversely affect
FID or the applicant.
56. FID may request that the applicant pipe, concrete line, encase in a box culvert or
other approved means to protect canal integrity,the Herndon No. 39 Canal across the
proposed development in accordance with FID standards,and the applicant enter into
an agreement with FID for that purpose. The applicant will need to meet with FID to
determine the canal alignment and required canal dimensions.
57. Pursuant to the Fresno Municipal Code Section 12-306-0.2. all irrigation or drainage
canals of a capacity which cannot be accommodated by a pipeline having an inside
diameter of fifty-four inches or less shall be piped in the manner described in Section
12-306-0.1. of this code. If the pipeline exceeds the fifty-four inch diameter, the
governing board of the Fresno Irrigation District may enter into an agreement with the
person constructing the pipeline and assume all costs for construction of the pipeline
in excess of the cost of a fifty-four inch diameter pipeline.

In the event the governing body of the Fresno Irrigation District chooses not to enter
into the agreement, the developer shall be relieved of the responsibility to construct
a pipeline larger than fifty-four inches in diameter. Section 12-306-0, makes no
.provisions for requiring concrete lining, encasing in a box culvert, or other means of
canal improvement.
58. FID requests that it be made party to signing all plans, which affect its easement and
canal/pipeline facility.
FRESNO UNIFIED SCHOOL DISTRICT
59. Prior to issuance of a building permit, school fees must be paid. Contact the Fresno
Unified School District for their requirements.
DEPARTMENT OF TRANSPORTATION
59. Attached for your review is the memorandum from the Department of Transportation
dated February 4, 2004.

SUBJECT: REQUIRED FINDINGS AND APPROVAL OF VESTING TENTATIVE PARCEL
MAP NO. 2004-01, LOCATED ON THE EAST SIDE OF NORTH MARTY
AVENUE BETWEEN WEST SHAW AND WEST ASHLAN AVENUES.

BACKGROUND
Vesting Tentative Parcel Map No. 2004-01, filed by Precision Civil Engineering Inc. on January 14,
2004, and accepted on January 27, 2004, proposes the creation of a three (3) parcel subdivision for
3.04 acres of C-M/cz (Commercial and Light Manufacturing/conditions of zoning) zoned property
located on the east side of North Marty Avenue between West Shaw and West Ashlan Avenues.
Rezone Application No. R-01-024 rezoned the property to C-M/cz (Commercial and Light
Manufacturing/conditions of zoning) zone district. The conditions of zoning established by R-01-024
are identified in the Conditions of Approval dated March 18, 2004 for Vesting Tentative Parcel Map
No. 2004-01. Approval of a tentative parcel map is subject to the Planning and Development Director
finding that the map is consistent with the officially adopted plans and policies of the City of Fresno.
The 2025 Fresno General Plan and Bullard Community Plan designate the subject site for light
industrial land uses. Pursuant to Table 2 "Planned Land Use and Zone District Consistency Matrix" of
the 2025 Fresno General Plan, light industrial land uses are consistent with the C-M zone district. The
Bullard Community Plan Committee reviewed the proposed project and recommended approval of the
project. Staff has reviewed the proposed design and improvement's of Vesting Tentative Parcel Map
No. 2004-01 and has determined that the map is consistent with adopted plans and policies as
described below.
REQUIRED FINDINGS
California Environmental Quality Act (CEQA) - The California Environmental Quality Act (Public
Resources Code Section 21000 et seq.) permits a public agency to determine whether a particular
project is exempt from CEQA.
A determination of a Class 15 Categorical Exemption (Section 15315/Minor Land Divisions) from
CEQA was made and Environmental Assessment No. TPM 2004-01 (Categorical Exemption) was
completed for this project and dated on March 18, 2004; and, filed with the Fresno City Clerk on
March 18, 2004.

STATE SUBDIVISION MAP ACT- The Subdivision Map Act (California Government Code Section
66410 et. seq.) requires that a proposed parcel map not be approved unless the map, together with its
design and improvement, is found to be consistent with the General Plan and any applicable specific
plan (Finding No. 1 below). State law further provides that the proposed parcel map be denied
approval if any one of the Finding Nos. 2-5, below, is made in the negative.
1. The proposed parcel map, together with its design and improvements is consistent with the
City's 2025 General Plan and Bullard Community Plan which designates the site for light
industrial type land uses.
2. The site is physically suitable for the proposed type and density of development because of the
flat terrain of the site and adequate access and drainage on and off the site.
3. The proposed parcel map design and improvements are not likely to cause substantial and
considerable damage to the natural environment, including fish, wildlife or their habitat,
because of the urbanized nature of the area in which the site is located.
4. The proposed parcel map design and improvements are not likely to cause serious public
health and safety problems, because the conditions of approval have shown and will insure
that the subdivision conforms with City health and safety standards.
5. The proposed parcel map design will not conflict with public easements within or through the
site because conditions of approval will assure noninterference with any existing or proposed
public easements.
Staff, based on its own analysis, has determined that the parcel map, subject to the recommended
conditions of approval, otherwise complies with the design and property development standards of the
Zoning Ordinance and local Parcel Map Ordinance and recommends the approval of the parcel map.
DIRECTOR DETERMINATION
1. Based upon the above analysis, the Planning and Development Director finds that Vesting
Tentative Parcel Map No. 2004-01 is consistent with the applicable plans and policies of the
City of Fresno.
2. The Planning and Development Director hereby grants approval of Parcel Map No. 2004-01
dated January 27, 2004, subject to the conditions of approval dated March 18, 2004, and to

WHEREAS, the Council of the City of Fresno finds that the proposed C-M/cz zone district is
consistent with the General Plan and the Bullard Community Plan because the C-M/cz zone district,
subject to Section 12-403-B of the Fresno Municipal Code, is consistent with the respective light
industrial land use designations shown for this site.
NOW, THEREFORE, THE COUNCIL OF THE CITY OF FRESNO DOES ORDAIN AS
FOLLOWS:
SECTION 1. Based upon the testimony and information presented at the hearing and upon review
and consideration of the environmental documentation provided, the adoption of the proposed rezoning is
in the best interests of the City of Fresno. The Council finds in accordance with their own independent
judgment that with the implementation of the Initial Study for Environmental Assessment No. A-0I-18,
R-0 1-24 and S-01-228 dated August 28, 2001, there is no substantial evidence in the record that the
rezoning may have a significant effect on the environment, and the negative declaration prepared for this
project is hereby approved. The initial study for Environmental Assessment No. A-01-18, R-01-24 and S-
0 1-228
-01-228 is incorporated into this ordinance and compliance therewith is made a condition of this rezoning.
SECTION 2. The zone district of the real property described hereinbelow, located in the City of
Fresno and shown on the Official Zone Map of the City of Fresno is reclassified from the
C-2/BA-20/cz to the C-M/cz zone district.
Commencing at a point 20.113 chains East of the Northwest corner of Section
13, Township 13 South, Range 19 East, Mount Diablo Base and Meridian,
according to the official plat thereof, and on the North line of said Section;
thence running East 3.397 chains;thence South 15.617 chains to the center line
of the Herndon Canal; thence along the center line of said canal North
61' 57'West 3.881 chains; thence North 13.807 chains to the point of beginning. -

SECTION 3. This ordinance shall be conditioned upon the record owners of the property
described in Section 2 executing and causing to be recorded a covenant running with the land
guaranteeing the following conditions on the subject property:
1. The project will be developed in a unified manner with the contiguous parcels to the north and
east with the exteriors of all buildings being designed in a manner that conveys a sense of unity of
design. -
2. Incorporate appropriate West Shaw Avenue'commercial design policies(Policy 5.11) of the
Bullard Community Plan for all special permits.
3. Owner of the subject property shall enter into a cross access agreement with the property owners
of the abutting parcels to the north and east and herein agrees upon development of the subject
property to allow cross access for employees, agents, licensees, invitees, and other members of the
public, between the above referenced properties and in the event that the Owner shall sell any
portion of these properties, agrees to require a covenant, (in a form approved by the City
Attorney) at the time of sale, allowing and reserving cross access between the three properties.
4. No building or structure erected on the subject site shall have a height greater than two (2) stories,
not to exceed thirty-five (35)feet. Exceptions to this restriction may be granted through the
conditional use permit process.
5. All developments shall utilize common driveways and access points.
6. Any storage of material shall take place inside of buildings. No outside storage of materials or
equipment will be allowed unless the structure is designed to be integrated into the whole design
theme of the complex.
7. A unified landscape design theme shall be utilized throughout the development.
8. All lighting shall be hooded and directed onto the subject property.
9. All noise generating equipment such as compressors, pumps, etc., shall be located within the
proposed buildings.
10. Any roof mounted air conditioning units shall be acoustically baffled and shielded from direct
view from any street or adjoining property.
11. A twenty (20)foot landscaped setback shall be provided on the Marty Avenue frontage. This
landscaped area may not be used for parking or storage.

12. The applicant shall install an appropriate barrier(fence or masonry wall) on the south property
line as a safety feature for the Hemdon Canal. This barrier shall be approved by both the City of
Fresno and the Fresno Irrigation District.
13. The following uses as listed in Section 12-224.1 subsections D (Manufacturing), E (Processing)
and F (Fabrication) shall be subject to a conditional use permit:
Bookbinding, rubber stamps, blue printing and photocopying, assembly of small electrical
equipment.
14. The following uses shall be prohibited:
Drive-through car wash,-mechanical car wash, self service car wash, department stores, farm
equipment sales and incidental repair, motorcycle shop, pawn shops, baths (Turkish, etc.), body
and fender shop, equipment rental, farm equipment service, taxidermist, care taker's residence,
frozen food lockers, grocery stores, ice and food product dispensing machines, bar and cocktail
lounges, kenr_els, rubber-fabrication of production made from finished rubber, and all uses listed
in Section 12-224.1 subsections D (Manufacturing), E (Processing), F (Fabrication), G(Public
Utility Service Yards with Incidental Buildings), H(Off-Street Parking), I (Agricultural Uses), J
(Electrical Distribution Substation),K (Communications Equipment Buildings), L (Temporary or
Permanent Telephone Booths), and M(Water Pump Stations) of the Fresno Municipal Code,
notwithstanding the uses listed in Condition No. 13.
• SECTION 4. The ordinance shall become effective and in full force and effect at 12:01 a. m. on
the thirty-first day after its passage and upon compliance with the requirements of Fresno Municipal
Code Section 12-403-K and L.

I. FID's Herndon No. 39 Canal traverses the subject property, as shown on the attached map.
2. FID requests that the applicant be required to submit a grading and drainage plan for FID
approval which shows that the proposed development will not endanger the structural
integrity of the canal, or result in drainage patterns that will adversely affect FID or the
applicant.
3. FID may request that the applicant pipe, concrete line, encase in a box culvert or other
approved means to protect canal integrity, the Herndon No. 39 Canal across the proposed

6. The Federal Clean Water Act and the State General Permits for Storm Water Discharges
Associated with Construction and Industrial Activities (State General Permits) require developers
of construction projects disturbing five or more acres, and discharges associated with industrial
activity not otherwise exempt from National Pollutant Discharge Elimination System (NPDES)
permitting, to implement controls to reduce pollutants, prohibit the discharge of waters other than
storm water to the municipal storm drain system, and meet water quality standards. These
requirements apply both to pollutants generated during construction, and to those which may be
generated by operations at the development after construction.

State General Permit for Storm Water Discharges Associated with Construction
Activities, approved August 1999, (modified December 2002.) A State General
Construction Permit is required for all clearing, grading, and disturbances to the ground
that result in soil disturbance of at least one acre (or less than one acre if part of a larger
common plan of development or sale). Permittees are required to: submit a Notice of
Intent to be covered and must pay a permit fee to the State Water Resources Control Z
Board (State Board), develop and implement a storm water pollution prevention plan,
eliminate non-storm water discharges, conduct routine site inspections, train employees O
in permit compliance, and complete an annual certification of compliance.

b. State General Permit for Storm Water Discharges Associated with Industrial Activities, O
April, 1997 (available at the District Office.) A State General Industrial Permit is
required for specific types of industries described in the NPDES regulations or by
Standard Industrial Classification(SIC) code. The following categories of industries
are generally required to secure an industrial permit: manufacturing; trucking; O
recycling; and waste and hazardous waste management. Specific exemptions exist for O
manufacturing activities which occur entirely indoors. Permittees are required to:
submit a Notice of Intent to be covered and must pay a permit fee to the State Water
Resources Control Board, develop and implement a storm water pollution prevention
plan, eliminate non-storm water discharges, conduct routine site inspections,train
employees in permit compliance, sample storm water runoff and test it for pollutant
indicators, and annually submit a report to the State Board.

C. The proposed development is encouraged to select and implement storm water quality
controls recommended in the Fresno-Clovis Storm Water Quality Management
Construction and Post-Construction Guidelines (available at the District Office) to
meet the requirements of the State General Permits, eliminate the potential for non-
storm water to enter the municipal storm drain system, and where possible minimize
contact with materials which may contaminate storm water runoff.
7. A requirement of the District may be appealed by filing a written notice of appeal with the
Secretary of the District within ten days of the date of this Notice of Requirements.

EXHIBIT NO. 2
The District requests that the City of Fresno require TPM 2004-001 to grant a drainage covenant
for APN 424-022-02 as needed to allow surface runoff to reach existing Master Planned
facilities located on Marty Avenue. The drainage covenant shall be made a condition of the
permit process with the City of Fresno.
There is an existing ten-foot (10') storm drain easement as shown on the attached sketch. The
existing easement is associated with an adjoining easement located on APN 424-022-02 easterly
of the site. It has been brought to the Districts attention that the existing thirty-six inch (36")
storm drain is not located within the easement located on APN 424-022-02. Therefore the
Developer of TPM 2004-001 must verify the existing 36" pipe is located within the easement
recorded September 21, 1971 as instrument No. 76586, Book 5939, Page 194 of the Official
Record and make any changes to the easement should it be necessary to correct the location.
In addition to the existing ten-foot (10') storm drain easement, the District has estimated an
additional eleven-foot (11') wide storm drain easement is needed and therefore required as a
condition of TPM 2004-001. No encroachments into the twenty-one-foot(21')easement will be
permitted including but not limited to, foundations,roof overhangs, swimming pools,and trees.
The Developer's engineer should Contact the District as early as possible to review and verify
the width of the additional eleven-foot (11') wide storm drain easement that is required.
The following paragraphs only apply towards development of the individual parcels and are not
conditions for the recording of the map.
In an effort to improve storm water runoff quality, outdoor storage areas shall be
constructed and maintained such that material which generates contaminants will not be
conveyed by runoff into the storm drain system.
The District encourages, but does not require that roof drains from non-residential
development be constructed such that they are directed onto and through a landscaped
grassy swale area to filter out pollutants from roof runoff.
Runoff from areas where industrial activities,product,or merchandise come into contact
with and may contaminate storm water must be directed through landscaped areas or
otherwise treated before discharging it off-site or into a storm drain. Roofs covering
such areas are recommended. Cleaning of such areas by sweeping instead of washing is
to be required unless such wash water can be directed to the sanitary sewer system.
Storm drains receiving untreated runoff from such areas that directly connect to the
District's system will not be permitted. Loading docks, depressed areas, and areas
servicing or fueling vehicles are specifically subject to these requirements. The
District's policy governing said industrial site NPDES program requirements are
attached.

Subject: SANITARY SEWER AND WATER REQUIREMENTS FOR PM-2004-01
General
PM-2004-01 proposes to create three parcels from one 3.04 acre parcel zoned C-M located
on the east side of N Marty Ave south of W Shaw Ave.
Environmental Recommendations
A NEGATIVE DECLARATION MAY BE ISSUED: The project may have adverse impacts
but impacts can be mitigated without further study or are not serious enough to warrant an
Environment Impact Report.
Sanitary Sewer Ree uirements
Sanitary Sewer facilities are currently or would be available to provide sanitary sewer service
to the site subject to the following requirements:
Separate sewer house branches are required for each lot.
The project developer should contact Wastewater Management Division/Environmental
Services (559) 621-5100 regarding conditions of service for special industrial users.
Construct a 8-inch sanitary sewer main in N Marty Ave from the existing 8-inch sanitary
sewer main south to serve proposed parcel C of PM-2004-01.
Sanitary Sewer Fees
The following Sewer Connection Charges are due and shall be paid for the Project:
Sewer Lateral Charge
Oversize Sewer Charge
Trunk Sewer Charge: Cornelia
Sewer Facility Charge (Non-Residential)
Upon connection of this Project to the City Sewer System the owner shall be subject to
payment of Sewer Facility charges per Fresno Municipal Code Section 9-505.1 and 9-505.2.
Sewer Facility Charges consist of two components, a Wastewater Facilities Charge and
Trunk Sewer Charge where applicable.
v . Sewer Facility Charges are cc ;ted after occupancy on a bi-monthly r s over time based
on metered (water or sewer etnuent) usage. The developer may contact Wo Department of
Public Utilities (559) 621-8554 to receive an estimated cost of the Sewer Facility Charges
applicable to the project (based on a constant sewer discharge and loading (Biochemical
Oxygen Demand [BOD] and Total Suspended Solids [TSS] levels anticipated) at the current
rates in effect, at that time, per Fresno's Master Fee Resolution. The developer shall provide
data regarding estimated sewer discharge rates [flow] and loading [BOD/TSS levels]
required for calculating the estimated charges.

SUBJECT: Tentative Parcel Map 2004-01 Located on the east side of North Marty Avenue,
between West Shaw and West Ashlan Avenues.
PUBLIC IMPROVEMENT REQUIREMENTS
The Public Works, Transportation Planning Section, has completed its review of Tentative
Parcel Map 2004-01, which was submitted by Fresport Partners. The following requirements
are to be placed on this Tentative Parcel Map as a condition of approval by the Public Works
Department.
General Conditions
• Repair or replace all existing damaged and / or off-grade offsite concrete improvements
in accordance with the Standard Specifications and Standard Drawings of the City of
Fresno, Public Works Department.
• Additional offsite concrete improvements will be required at the time of future site plan
review.
Maior Streets:
North Marty Avenue:
1. No dedication is required with this map.
2. Concrete curb and gutter, asphalt paving and streetlights exist.
