The conditions of approval for Tentative Parcel Map No. 2003-36 are as follows: LEGAL STATUS OF SITE TO BE SUBDIVIDED 1. The parcel map site, was legally created as parcels of Bullard Lands Irrigated No. 1. ZONING 2. Proposed parcels are consistent with the C-2 (Community Commercial) and C-P (Administrative and Professional Office)zone districts for the parcel map site in terms of lot width, depth, and area. 3. Plan Amendment No.A-03-12, Rezone Application No. R-03-60,and Conditional Use Permit No. C-03-20,5 were filed with the City of Fresno Planning and Development Department. The plan amendment is requesting a land use change from office commercial to general heavy commercial. The rezone application is requesting a zone change from the C-P zone district to the C-6 zone district and the conditional use permit which was conditionally approved by the Fresno City Planning Commission on May 12, 2004, requested development of the project site with three automobile dealerships. The proposed parcels are consistent with the requested C-6 zone district. Comply with all conditions issued under A-03-12, R-03-60, and C-03-205. 4. If Plan Amendment No. A-03-12 and Rezone Application No. R-03-60 are denied by the Fresno City Council then the applicant shall be required to revise Exhibit"A"dated April 30, 2003, of Conditional Use Permit No. C-03-038 originally approved for the project site by the Fresno City Council on July 15, 2004 to reflect the property lines as proposed by Vesting Tentative Parcel Map No. 2003-36, dated January 26, 2004. Conditions of Approval Tentative Parcel Map,No.2003-36 Page 3 June 16, 2004 • Cross Access for ingrees/egrees • Cross Drainage as indicated per Flood Control District's Memo Covenant for Shared Parking • Covenant to maintain water, sewer and all other utilities • Covenant for fire protection underground water supplies and Covenant for :.access to buildings Covenant to maintain all landscaping within the limits of the map • Covenant for shared solid waste facilities Provide.Covenant Agreement for access to land locked.parcels • :Provide Covenant Agreement for maintenance of fire suppression water system. 10. The placement of a parcel line in close proximity to any existing and/or proposed structures requires the structures be found in compliance with the fire resistive standards of the Uniformed Building Code,.Chapter 5. In the event the structures do not comply they must be modified so as to meet the requirement. 11. The proposed structure(s) on the site may be affected due to the location of the proposed parcel line. Compliance with the prevailing Uniform Building Code as it relates to the exterior wall protection,allowable area,etc. (as applicable to new parcel line locations)must be demonstrated prior to final map submittal. Contact Planning and.Development Department, Building and Safety Services at 621-8200. GENERAL'PUBLIC WORKS REQUIREMENTS Dedications 12. The subdivider shall dedicate public easements to facilitate the construction of curbs, gutters, sidewalk, bus bays, right turn lanes, bike lanes, bike paths, multi-purpose trail,. wheelchair ramps and public utilities in accordance with City plans, ordinances, resolutions and policies,the Standard Specifications of the Public Works Department within the limits of the parcel map. Additionally, a minimum 4 foot wide clear path of travel is required along the public sidewalk on all frontages of the property as required by Title 24 of the California Administration Code as determined by the City Engineer. An on-site pedestrian easement and construction of a path may be required if Title 24 provisions can not be met within the public rights of way. All such public easements shall be identified and dedicated with the processing and recordation of the Parcel Map or at the time of Special Permit reviews for the proposed development of the parcels. All off-site and public improvements shall be constructed in accordance with the Public Works Department Standards, Specifications and Policies. Engineered construction plans and .estimates for all or part of the required work shall be required prior to the issuance of Street Work Permits unless otherwise determined by the City Engineer. The cost for such plan preparation, review and construction inspection shall be at the subdivider's expense. 20. Any existing utilities, including but not limited to, street lights, traffic signals, fire hydrants, poles (power, telephone, cable, etc), fire hydrants which must be.relocated or removed in conjunction with the construction of these off-site improvement requirements, shall be the responsibility and at the expense of the subdivider. 2. 1. All existing overhead. utilities, including but not limited to, electrical systems, communication systems and street lighting systems shall be placed underground in accordance with the provisions of Section 12-1011 of the Fresno Municipal Code and the policies of the Public Works Department. 22. When street/safety lighting installations are required, street lighting plans shall be; submitted for review and approval by the Traffic Engineer prior to the issuance of permits for the work. Services to street lighting installations shall be separated from the electrical service(s) serving the development. The type, location and service for street lighting installations shall be as determined by the Traffic Engineer. Street lighting installations shall be dedicated to the City upon completion and acceptance of the installations: 23. On-site Sewer and/or Water System(s). All on-site sewer and water systems shall be "private". - In the event the subdivider proposes to construct "public" on-site sewer and/or water systems facilities, written approval by the Public Utilities Department shall be required and provided with the submittal of the initial final parcel map. Such facilities shall placed in a dedicated easement and shall be included. as public improvement requirements for the parcel map. .24. Sidewalks (including wheelchair ramp landings) and driveway approaches, for undeveloped parcels of this parcel map, shall be required as a condition of site development: 25. Easements: Identify the location, type, size, and record information of easements on and through the site must be shown on the final map. 26. If P.G.& E. has an existing pole line that serves the property and the existing pole line crosses proposed property lines and is not covered by an existing easement, it is the property owner's responsibility to provide adequate rights-of-way to P.G. &E. Relinquish direct vehicular access to North Palm Avenue from West Herndon Avenue ---- 261.91 feet south to the proposed street type entrance. In addition, relinquish vehicular access 50 feet east along the north side of proposed street type entrance and 65 feet on the south side of said street type entrance: 38. Dedicate additional right-of-way for street purposes as need to comply with Public Works Standard P-69 and as needed for street type approach P-77, as shown on Exhibit "A" of Conditional Use Permit Nos. C-03-038 and C-03-205. 39. Dedicate ingress-egress easement from proposed landlocked Parcels "C,.."D", "E", and "F to.North Palm Avenue.."Show easement on map: West Herndon Avenue (Maior Street) 40. Where not existing, install concrete curb, gutter, streetlights; and permanent A.C. pavement as needed to Public Works Standards. 41. Dedicate 160 feet of right-of-way for street purposes per Public Works Standard P-69 Bus Bay at the southeast corner of North Palm and West Herndon Avenues. 42. Relinquish direct vehicular access to West Herndon Avenue within the limits of this map: North Roosevelt and North Colonial Avenues (Local Street 43. Access to North Roosevelt and North Colonial Avenues shall be conform with Exhibit "A" of. Conditional Use Permit Nos. C-03-038 and C-03-205. Specific Requirements 44. Comply with all conditions issued under Conditional Use Permit Nos. C-03-038 and C-03-205, Plan Amendment Application No. A-03-12, and Rezone Application No.- R-03-60. Urban Growth Management Requirements 45. This parcel map is not within the U.G.M. Major Street Zone. SANITARY SEWER 46. Project site is located within the jurisdiction of another provider for sanitary sewer - service. The applicant shall contact Pinedale County Water District for service conditions and/or restrictions. 47. The project developer shall contact Wastewater Management Division/Environmental Services (559) 621-5100 regarding conditions of service for special industrial users. BACKGROUND Vesting Tentative Parcel Map No. 2003-36, filed by Yamabe & Horn Engineering, Inc. on December 18, 2003, and accepted for processing on January 26,2004, proposes the creation of six (6) parcels for a commercial planned development on 17.63 acres of property located on the southeast corner of North Palm and West Herndon Avenues. The parcel map site is designated for community commercial and office commercial land uses by the 2025 Fresno General Plan and the Bullard Community Plana Rezone Application. No. R-99-06, rezoned the property to the C-2 (Community Shopping Center) and C-P (Administrative and Professional Office) zone districts. Rezone ,Application No. R-99-06 was conditioned by City Council adoption of Ordinance No. 200-35 wherein the mitigation measures established under Environmental Assessment.No. A-99-03 be incorporated as conditions of zoning. The applicant has since filed Plan Amendment No. A-03-12, Rezone Application No. R-03-60, and Conditional Use Permit Application No.'C-03-205. The plan amendment is a request,to change the land use designation for a portion of the project site from the office commercial land use designation to the general heavy commercial land use designation. The rezone application is.a request to rezone. the C-P (Administrative and Professional Office.)zone district to the C-6 (Heavy Commercial) zone district. Staff has required Exhibit "A" dated April 12, 2004, for Conditional Use Permit No. C-03-205 to be converted to a "Planned Development" and that the site plan shall reflect the property Eines as proposed by Vesting Tentative Parcel Map No. 2003-36 dated January 26, 2004. The plan development is required because the appl'icant's parcel map is proposing the creation of parcels that due not have access to a public street or public right-of-way. The parcel map has been.conditioned upon the approval of Plan Amendment No. A-03-12 and Rezone Application No. R-03-60. If the plan amendment and rezone applications (A-03-12, R-03-60) are denied by the Fresno City Council the applicant shall be required to revise the previously approved conditional use permit for the project site. Conditional Use Permit No. C-03-038 is the application which.was approved by the Fresno.City Council on July 12, 2004. The following comments are submitted based on the parcel as shown, without any existing street trees. The following 3paragrraphs apply to Non-residential parcel maps only. The street tree and median island requirements are deferred until the special permit process. 1. Street trees are required inaccordance with the provisions of FMC Section 12- 1206(c)(5). The number of street trees shall be determined at the rate of.one tree for each 60' of street frontage.as specified in FMC 11-301(c). 2. Each tree shall be provided with drip irrigation in conformance with the provisions of FMC Sections 12-306-N-23. 3. The applicable street tree fees and/or alternative measures to satisfy the street tree requirement are deferred to the time of development of each parcel. The District in cooperation with the City and County has developed and adopted the Storm Drainage and Flood Control Master Plan. Compliance with and implementation of this Master Plan by this development project will satisfy the drainage related CEQA/NEPA impact of the project mitigation requirements. The proposed development shall pay drainage fees pursuant to the Drainage Fee Ordinance prior to approval of the final map at the rates in effect at the time of such approval. The fee indicated above is based on the tentative map. Contact the FMFCD project engineer prior to approval of the final map for the fee. FRESNO METROPOLITAN FLOOD CONTROL DISTRICT NOTICE OF REQUIREMENTS Page 3 of 4 6 The Federal Clean Water Act and the State General Permits for Storm.Water Discharges Associated with Construction and Industrial Activities_(State General Permits) require developers of construction projects disturbing five or more acres, and discharges associated with industrial Ma activity not otherwise exempt from National Pollutant Discharge Elimination System (NPDES) permitting, to implement controls to reduce pollutants, prohibit the discharge of waters other than storm water to the municipal storm drain system, and meet water quality standards. These requirements apply both to pollutants generated during construction, and to those.which may be generated by operations at the development after construction. a. State General Permit for Storm Water Discharges Associated with Construction Activities, approved August 1999, (modified December 2002.) A State General Construction Permit is required for all clearing, grading, and disturbances to theground that result in soil disturbance of at least one acre (or less than one acre if part of a larger common plan of development or sale). Permittees are required to: submit a Notice of Intent to be covered and must pay a permit fee to the State Water Resources Control Board(State Board), develop and implement a storm water pollution prevention plan, eliminate non-storm water discharges, conduct routine site inspections, train employees 0 in permit compliance, and complete an annual certification of compliance— b. ■ b. State General Permit for Storm Water Discharges Associated with Industrial Activities, April, 1997 (available at the District Office.) A State General Industrial Permit is required for specific types of industries described in the NPDES regulations or by Standard Industrial Classification (SIC) code. The following categories of industries are generally required to secure an industrial permit: manufacturing; trucking; recycling; and waste and hazardous waste management. Specific exemptions exist for manufacturing activities which occur entirely indoors. The drainage system cost and fee obligation indicated in.this notice is the obligation which is valid at the date of this notice. Contact the District for a final drainage fee obligation prior to issuance of a building or permit recording of the final map. The Developer shall dedicate a twenty-foot (20`) wide storm drain easement as shown on Exhibit No.l as a condition of the final map. No encroachments into the easement will be permitted including, but not limited to, foundations, roof overhangs, swimming pools, and trees. There is an existing ten-foot (10') storm drain easement along the northerly property line. No encroachments into the easement-shall be permitted including,but not limited to,foundations,roof overhangs, swimming pools, and trees. No surface run-off shall be directed towards the District basin. The District requests that the grading Engineer contact the District as early as possible to review the proposed site grading for verification and acceptance of grades at our mutual property line prior to preparing a grading plan. The District recommends a single fence between the-site and the District's basin. The Developer should contact the District so that alternatives to a dual fence can be reviewed. If a fence other than the existing chain link fence is proposed, District review and approval of the proposed fence is required. The following paragraphs only apply towards development of the individual.-parcels and are not conditions for the recording of the map. In an effort to improve storm water runoff quality,outdoor storage areas shall be constructed and maintained such that material which generates contaminants will not be conveyed'by runoff into the storm drain system. The District encourages, but does not require that roof drains from non-residential development be constructed such that they are directed onto and through a landscaped grassy , swale area to filter out pollutants from roof runoff. Runoff from areas where industrial activities, product, or merchandise come into contact with and may contaminate storm water must.be directed through landscaped areas or otherwise treated before discharging it off-site.or into a storm drain. Roofs covering such areas are recommended. Cleaning of such areas by sweeping instead of washing is to be -.--_ required unless such wash water can be directed to the sanitary sewer system. Storm drains receiving untreated runoff from such areas that directly connect to the District's system will not be permitted. Loading docks,depressed areas,and areas servicing or fueling vehicles are specifically subject to these requirements. The District's policy governing said industrial site NPDES program requirements are attached.
