imposition of the fees, dedications, reservations or exactions imposed on the development project.
Upon conditional approval of Tentative Parcel Map No. 2003-35, dated January 12, 20061 the
subdivider may prepare a Final Parcel Map in accordance with the approved tentative map. Note that
a final parcel map may not be filed until the appeal period has expired. Should an appeal be Ifiled

of Fresno Planning Commission. The appellant may withdraw their appeal pursuant to Section
12-1207.2 of the FMC.
Concurrent with the filing of a final map and when the provisions of Section 66436 of the Subdivision
Map Act apply, the subdivider is responsible to send, by certified mail, a sketch of the proposed final
map, together with a copy of SMA Section§§66436(a)(3)(A),to any public entity or public utility which
has previously acquired a right-of-way easement.

PLAN CONSISTENCY
3. The 2025 Fresno General Plan and the Fresno-High Roeding Community Plan designate the
parcel map for development with medium-high density residential planned land uses.I The
Zoning District Consistency Table of the FMC identifies medium-high density residential
planned land uses as consistent with the R-2(Low Density Multiple Family Residential D strico
zone district.
ZONING
i
4. Comply with provision of the State of California Government Code Sections §§66410 -
66499.58(the Subdivision Map Act)and the City of Fresno Municipal Code Chapter 12,Article
10 (Subdivision of Real Property).
5. Proposed parcels A and B are consistent with the R-2 zone district in terms of lot width, depth
and area and all lots abut a public street.
6. Prior to the sale, lease or financing of the remainder parcels the applicant shall be required to
request a certificate of compliance from the Planning and Development Department. IThe
applicant will be required to pay all fees associated with the certificate of compliance as
adopted in the City of Fresno Master Fee Schedule.
TRAILS i
7. It is noted that the subject site abuts the Herndon No.39 Canal, which is located immediately
to the south. According to Exhibit 9 (Multi-Purpose Trails Plan Map) of the 2025 Fresno
General Plan, the Herndon Canal should be developed with a bicycle/pedestrian/equestrian
trail. Over the past several years the surrounding area has been extensively developed I ith
commercial and residential uses, particularly those properties that abut the Herndon No. 39
canal to the immediate east and west. However, during the development of these parcels,,the
development of the trail was never required. Upon analyzing the requirement for this project to
provide a dedicated easement and install the trail, staff determined that the requirement to do
so would be extraneous due the fact that major segments of the trail will never be developed
because of the existing homes and business to the east and west. However, the City of
Fresno and the Fresno Irrigation District have been in discussions regarding canals and trails
which may allow for the future establishment of the trail along the bank of the canal in areas
that have been developed.

SUBJECT: REQUEST FOR A WAIVER OF UNDERGROUND UTILITIES AND STREET
PAVING REQUIREMENTS ON PARCEL MAP 2003-35 j
Dear.Mr. Samuelian:
Public Works has reviewed your request for a waiver of the requirement to install all existing
overhead utilities underground on Parcel Map 2003-35 located at N. Del Mar and E. Fedora
Avenues.
Your request to retainthe existing overhead utilities is approved because the installation of
an underground utility system as required by Parcel Map 2003-35 will not make a substantial
contribution to the complete undergrounding of the immediate area and there isn't any, -- -
extenuating circumstances that would require replacement of the existing overhead system. .
I
Additionally, the existing street paving is in good serviceable condition and does not require.
rep lacement..Therefore, this condition shall be deemed satisfied.
Please call Gary Witzel at 621-8725 if you have any questions.
Sincerely,
Mike T. Kirn P.E.

POLICY MANUAL -
Date Last Amended: August 10,2005
Classification: FLOOD PLAIN MANAGEMENT
Subject: Flood Plain Policy . Approved By:
Because of the relatively high velocities and volumes of flood flow associated with primary flood
plains, and because the primary flood plain is responsible for passing the greatest percentage of the
flood event, development located in such flood plains is subject to substantial risk, both to its
and to others as a result of the potential for blockage and diversion of flood waters. In view of
these factors:
Policy:
(1) All proposed development activity shall reference the Flood Insurance Rate Map to .
determine if it is located in a 1007year flood plain (special flood hazard areas
inundated by a 100-year flood) "Primary Flood Plain". Any project not located
within a FIRM or located in any area where the FIRM is determined to be
inaccurate shall be the subject of a detailed hydrological flood hazard investigation
to determine the relationship of the proposed development to the primary flood
plain; and, further,to identify the calculated water surface elevation of the 100-year
flood event.
(2) The development must be properly flood proofed below the calculated water
surface elevation of the 100-year flood event. j
(3)` All development and/or permanent improvement activity which, if located within
the primary floodway, may unduly impede, retard or change the direction of flow
of water either,by itself,or by the catching or collecting of other debris or is placed
where the flow of water would carry such obstruction downstream to the damage
or detriment of either life or property, should not be permitted.
(4) The development shall not cause displacement of any and all floodwaters from
that portion of the flood plain to be developed.

PLANNING AND DEVELOPMENT DEPARTMENT
DATE: September 14, 2006
TO: NICK P. YOVINO, Director
Planning and Development Department
THROUGH: GILBERT J. HARO, Planning Mana r
Planning Division
FROM: PAUL BERNAL, Planner `
Current Planning Section
SUBJECT: REQUIRED FINDINGS AND CONDITIONAL APPROVAL OF TENTATIVE
PARCEL MAP NO. 2003-35, DATED JANUARY 12, 2006, FOR PROPERTY
LOCATED ON THE SOUTHWEST CORNER OF EAST FEDORA AND
NORTH DEL MAR AVENUES
BACKGROUND
Ronald Martin has filed Tentative Parcel Map No. 2003-35, dated.January 12, 2006. The
subject site is located on the southwest corner of East Fedora and North Del Mar Avenues. 'he
parcel map is proposing to subdivide approximately 0.60 acre into two residential parcels with
two remainders. The site is zoned R-2 (Low Density Multiple Family Residential District) and is
planned for medium-high density residential land uses by both the Fresno High-Roeding
Community Plan and the 2025 Fresno General Plan. Pursuant to Table 2 (Planned Land Use
and Zone District Consistency Table) of the 2025 Fresno General Plan (and applied within all
community plans) the R-2 zone district is consistent with the planned land use designation of
medium-high density residential.
The subject site is currently developed with two single family residence and is surroundedl{ by
single family residences to the north, east and west while the Herndon No. 39 Canal is located
to the south. All comments and requirements from the appropriate agencies have been
addressed in the conditions of approval dated March 6, 2006, for Tentative Parcel Map No.
2003-35. Approval of a tentative parcel map is subject to the Planning and. Development
Department Director finding the map consistent with the officially adopted plans and policies of
the City of Fresno. Staff has reviewed the proposed design and improvements of Tentative
Parcel Map No. 2003-35 and has determined that the map is consistent with adopted policieslas
described below.
TRAILS
It is noted that the subject site abuts the Herndon No. 39 Canal, which is located immediately to
the south. According to Exhibit 9 (Multi-Purpose Trails Plan Map) of the 2025 Fresno General
Plan, the Herndon Canal should be developed with a bicycle/pedestrian/equestrian trail. Over
the past several years the surrounding area has been extensively developed with residential
uses, particularly those properties that abut the Herndon No. 39 canal to the immediate east
and west. However, during the development of these parcels, the development of the trail was
never required. Upon analyzing the requirement for this project (i.e. Tentative Parcel Map No.
- - I
Tentative Parcel Map No. 20u6-37

Page 2
2003-35 toP rovide a dedicated easement and install the trail, staff determined that the
requirement to do so would be extraneous due the fact that major segments of the trail will
never be developed because of the existing.homes to the east and west. However, the City of
Fresno and the Fresno Irrigation District have been in discussions regarding canals and trails
which may allow for the future establishment of the trail along the bank of the canal in areas that
have been developed. `
ENVIRONMENTAL FINDINGS
The initial study prepared for Environmental Assessment No. TPM No. 2003-35 considered
potential environmental impacts associated with the tentative parcel map. The environmental
assessment resulted in a Class 15 Categorical Exemption (Section 15315/Minor Land Division
of the California Environmental Quality Act), was filed on September 15, 2006, with the City
Clerk. Staff determined that a Class 15 Categorical Exemption was appropriate given that the
proposed project is located within the R-2 zone district, which is consistent with the general plan
land use designation of medium-high density residential; the division consists of dividing ',land
into four or fewer parcels; no variances or exceptions are required; all services and access to
the proposed parcel is to local standards; the division of land is not involved in a division `of a
larger parcel within the previous 2 years; and the parcels do not have an average slope greater
than 20 percent.
STATE SUBDIVISION MAP ACT
I
The Subdivision Map Act (California Government Code Section 66410 et. seq.) requires that a
proposed parcel map not be approved unless the map, together with its design and
improvements is found to be consistent with the General Plan and any applicable specific plan
(Finding No. 1 below). State law further provides that the proposed parcel map be denied
approval if any one of the Findings Nos. 2-5, below, is made in the negative.
1. The proposed parcel map, together with its design and improvements is consistent with
the Fresno High-Roeding Community Plan and the 2025 General Plan which designates
the site for medium density residential planned land uses and is consistent with the R-2
zone district.
2. The site is physically suitable for the proposed development'because of the flat terrain of
the site and adequate access and drainage on and off the site. The Fresno Metropolitan
Flood Control District will require that the drainage from the site be diverted to the future
Master Plan Facilities.
i
3. The proposed parcel map design and improvements are not likely to cause substantial
and considerable damage to the natural environment, including fish, wildlife, or their
habitat, because of the urbanized nature of the area in which the site is located.
4. The proposed parcel map design and improvements are not likely to cause serious
public health and safety problems, because the conditions of approval have shown and
will insure that the subdivision conforms with City health and safety standards. ,In
addition, during the entitlement process, staff will ensure that all conditions will be
applied accordingly
5. The proposed parcel map design will not conflict with pubic easements within or through
the site because conditions of approval will assure noninterference with any existing or
proposed public easements.
Tentative Parcel Map No 2'OU6-37
September 14, 2006 t
Page 3
Staff, based on its own analysis, has determined that the parcel map, subject to the
recommended conditions of approval, otherwise complies with the design and property
development standards of the Zoning Ordinance and local Parcel Map Ordinances and
recommends the approval of the parcel map.
DIRECTOR DETERMINATION
1. Based upon the above analysis, the Planning and Development Department Director
finds that Tentative Parcel Map No. 2003-35 dated January 12, 2006, is consistent) with
the applicable plans and policies of the City of Fresno.
2. The Planning and Development Department Director hereby grants approval of
Tentative Parcel Map No. 2003-35 subject to the conditions of approval dated
September 14, 2006, to become effective on September 2°S, 2006. k
