The City of Fresno Planning Division has completed its review of the subject map. Pursuant to FMC Section 12-1205(c), this letter is written to advise that the Conditions of Approval are as noted on the attached document, dated September 22, 2003. If you have any questions regarding the conditions you must notify either Louis Rocha or Paul Bernal at 621-8073 no later than October 9, 2003, to request a review of the conditions. Otherwise, the stipulated conditions of approval are in effect as of that date. No further notice will be sent. Appeal: The divider or any aggrieved person may file an appeal regarding to conditions of approval within fifteen(15) days from the date of approval. The expiration shall terminate all proceedings and a final Parcel Map may not be filed without first processing a new Tentative Parcel Map. Modification of a Tentative Parcel Map after approval or conditional approval does not extend the two year time limit. EXTENSION: The divider may request an extension of the tentative map expiration date by filing a written application together with the fee set forth in the Master Fee Schedule at the time of the request with the Director of the Development Department at least thirty days before the expiration date of the map. The applicant must state the reasons for the requesting the extension. New conditions may be imposed if an extension is granted. An extension may not exceed an aggregate of five years. Yovino Fresno, California 93721-3604 Director (559)621-8277 FAX(559)498-1012 September 22, 2003 CONDITIONS OF APPROVAL TENTATIVE PARCEL MAP NO. 2003-16 NOTICE TO PROJECT APPLICANT In accordance with the provisions of Government Code§66020(d)(1),the imposition of fees,dedications, reservations or exactions for this project are subject to protest by the project applicant at the time of approval or conditional approval of the development or within 90 days after the date of the imposition of the fees, dedications, reservations or exactions imposed on the development project. The City of Fresno Development Department has completed a review of the subject tentative parcel map in accordance with the State Subdivision Map Act and the Fresno Municipal Code. The conditions of approval for Tentative Parcel Map No. 2003-05 are as follows: I. Legal Status of Site to be Subdivided A. The parcel map site,was legally created. II. Zoning A. The existing zoning of the site does not conform to the"Planned Land Use and Zone District Consistency Matrix" located in Table 2 of the 2025 Fresno General Plan. Pursuant to the matrix, Commercial Office Land Uses are consistent with the RP-L, R-P, C-P and the S-L zone districts. However, it has been determined that consistency can be established by rezoning the property to the C-P (Administrative and Professional Office District) or with the provision of a covenant limiting development of the site in accordance with the C-P(Administrative and Professional Office District)standards and requirements. The provision of such a covenant has been made as a condition of approval of the tentative parcel map. B. To bring the proposed parcels into compliance,comply with the conditions under item IV. C. Relinquish direct access to Friant Road within the limits of this parcel map. D. Rezone Application No.R-7143 and R-7635 rezoned the property and established conditions of zoning for the subject property. The 2025 Fresno General Plan and the Woodward Park Community Plan designates the parcel map for development with Commercial Office type land uses. The Zoning District Consistency Table of the Fresno Municipal Code identifies commercial office land uses as consistent with the RP-L,R-P,C-P, S-L,R-P Planned Office Development,and C-P Planned Office Development zone districts. B. Consistency may be established by rezoning the property to the C-P(Administrative and Professional Office)zone district which is consistent with the commercial office land use or by the provision of a covenant providing for the development of the site in accordance with the C-P District standards and regulations. C. All covenants or agreements will be prepared upon receipt of the fee indicated below. Covenants must be approved by the City Attorney's Office prior to the issuance of building permits. • Submit the following documentation for the preparation of the required covenant agreement providing for the development of the site in accordance with the C-P District standards and regulations: Title Report within the last 6 months. • Remit$250.00 fee for preparation and processing of the covenant(s)or agreement(s). IST. Modifications to Property Development Standards A. Proposed parcels must be consistent with approved C-M/UGM/cz, (Administrative and Professional Office/Urban Growth Management/conditions of zoning) zone district for the parcel map site in terms of lot width,depth,height, and area subject to approval of a special permit for a planned development project. All parcels must provided access to a public street right-of-way under a planned development special permit. B. If not already obtained,secure approval of an amendment to the Site Plan Review(5-99-200) or Conditional Use Permit (C-98-208) or a new entitlement authorizing the creation of an commercial planned development on the parcel map site to reflect the proposed parcel lines and modifications. C. Submit draft copies of Covenants,Conditions and Restrictions/Owners Association documents (CC & R's) for review and approval. Final, executed and notarized documents are to be recorded with the parcel map. CC&R's shall conform with the provisions of Section 12-1026 FMC and address ingress, egress, sewer and water service, maintenance, and access, fire protection, solid waste service, storm drainage,parking and landscaping as follows: Conditions of Approval Tentative Parcel Map No. 2003-16 Page 3 September 22, 2003 • Cross Access for ingreeslegrees • Cross Drainage as indicated per Flood Control District's Memo • Covenant for Shared Parking • Covenant to maintain water, sewer and all other utilities • Covenant for fire protection underground water supplies and Covenant for access to buildings • Covenant to maintain all landscaping within the limits of the map • Covenant for shared solid waste facilities • Provide Covenant Agreement for access to land locked parcels • Provide Covenant Agreement for maintenance of fire suppression water system. D. The placement of a parcel line in close proximity to any existing and/or proposed structures requires the structures be found in compliance with the fire resistive standards of the Uniformed Building Code,Chapter 5. In the event the structures do not comply they must be modified so as to meet the requirement. The proposed structure(s) on the site may be affected due to the location of the proposed parcel line. Compliance with the prevailing Uniform Building Code as it relates to the exterior wall protection, allowable area, etc. (as applicable to new parcel line locations) must be demonstrated prior to final map submittal. Contact Planning and Development Department, Building and Safety Services at 621-8200. V. Subdivision Map Act Requirement A. Concurrent with the filing of a final map and when the provisions of Section 66436 of the Subdivision Map Act apply, the subdivider is responsible to send,by certified mail, a sketch of the proposed final map,together with a copy of SMA Section 66436(a)(3)(A),to any public entity or public utility which has previously acquired a right-of-way or easement. B. Comply with the provisions of the State of California Government Code Sections 66410 - 66499.58 (the Subdivision Map Act) and the City of Fresno Municipal Code Chapter 12, Article 10(Subdivision of Real Property). VI. On-Site Requirements A. The subdivider may either construct the required off-site improvements prior to the approval of the final parcel map; or enter into an agreement with the City of Fresno providing for the construction of the required improvements and sufficient security prior to the approval of the final parcel map. All off-site and public improvements shall be constructed in accordance with the Public Works Department Standards, Specifications and Policies. Engineered construction plans and estimates for all or part of the required work shall be required prior to the issuance of Street Work Permits unless otherwise determined by the City Engineer. The cost for such plan preparation, review and construction inspection shall be at the subdivider's expense. C. Any existing utilities, including but not limited to, street lights, traffic signals,fire hydrants, poles (power, telephone, cable, etc), fire hydrants which must be relocated or removed in conjunction with the construction of these off-site improvement requirements, shall be the responsibility and at the expense of the subdivider. D. All existing overhead utilities,including but not limited to,electrical systems,communication systems and street lighting systems shall be placed underground in accordance with the provisions of Section 12-1011 of the Fresno Municipal Code and the policies of the Public Works Department. E. When street/safety lighting installations are required,street lighting plans shall be submitted for review and approval by the Traffic Engineer prior to the issuance of permits for the work. Services to street lighting installations shall be separated from the electrical service(s)serving the development. The type, location and service for street lighting installations shall be as determined by the Traffic Engineer. Street lighting installations shall be dedicated to the City upon completion and acceptance of the installations. F. On-site Sewer and/or Water System(s). All on-site sewer and water systems shall be "private". In the event the subdivider proposes to construct"public" on-site sewer and/or water systems facilities,written approval by the Public Utilities Department shall be required and provided with the submittal of the initial final parcel map. Such facilities shall placed in a dedicated easement and shall be included as public improvement requirements for the parcel map. Unless otherwise determined by the Public Utilities Director, a covenant shall be required which provides that the property owners shall be responsible for the restoration, replacement and expense of any private surface improvements removed or damaged during the course of maintaining such public facilities by the City or its agents. G. Sidewalks(including wheelchair ramp landings)and driveway approaches, for undeveloped parcels of this parcel map, shall be required as a condition of site development. Those items identified with an asterisk (*) refer to obligations of the applicant for development of parcels with net acreage of 4 to 10 acres. The Public Works Director has determined that completion of such designated improvements may be deferred until time of development or further division of the parcel(s)upon written request by the applicant. The request must specifically acknowledge the applicant's waiver of any rights provided by Section 65961 of the California Government Code. r Conditions of Approval Tentative Parcel Map No. 2003-16 Page 5 September 22, 2003 H. Fresno Metropolitan Flood Control District requirements: Comply with the Fresno Metropolitan Flood Control District's memorandum, dated August 7, 2003. I. Easements: Identify the location, type, size, and record information of easements on and through the site must be shown on the final map. If P.G.&E.has an existing pole line that serves the property and the existing pole line crosses proposed property lines and is not covered by an existing easement,it is the property owner's responsibility to provide adequate rights-of-way to P.G. & E. If P.G. & E's. assistance is required to determine whether an easement will be required contact Scott Combs,Senior Land Technician,Fresno Land Rights Office,at 263-7375. J. Unless otherwise noted,all covenants or agreements will be prepared upon receipt of the fee indicated below. Covenants must be approved by the City Attorney's Office prior to issuance of building permits. In an effort to improve storm water runoff quality,outdoor storage areas shall be constructed and maintained such that material which generates contaminants will not be conveyed by runoff into the storm drain system. The District encourages, but does not require that roof drains from non-residential development be constructed such that they are directed onto and through a landscaped grassy swale area to filter out pollutants from roof runoff. Runoff from areas where industrial activities,product,or merchandise come into contact with and may contaminate storm water be directed through landscaped areas or otherwise treated before discharging it off-site or into a storm drain. Roofs covering such areas are recommended. Cleaning or such areas by sweeping instead of washing is to be required unless such wash water can be directed to the sanitary sewer system. Storm drains receiving untreated runoff from such areas that directly connect to the District's system will not be permitted. Loading docks, depressed areas, and areas servicing or fueling vehicles are specifically subject to these requirements. The District's policy governing said industrial site NPDES program requirements are attached. Major storm flows from the north of TPM-2003-16 shall be conveyed southeasterly through this project to North Friant Expressway. The developer shall provide a conveyance method for review and approval such that major storm flow can be safely conveyed to the North Friant Expressway without damage to proposed and future structures within the property. Telephone,cable,and other public utilities which propose above-ground facilities determined by the Planning and Development Director to be oversized shall be located in an additional easement area outside of the landscape strips required along major streets. Fire Department p� A covenant agreement shall be provided for cross access on properties aHd for maintenance of the fire service lines which serve the fire hydrants and fire sprinkler systems on the parcels. L. Parks Recreation& Community Services Department Contact Parks Recreation and Community Services Department for their requirements. VII. Off-Site Improvement Requirements: Sanitary Sewer A. In compliance with the Woodward Park Community Plan Verification and Monitoring Procedure for Sanitary Sewer Service,it has been demonstrated and determined that sanitary sewer service is available to this project in the Hemdon/Comelia Trunk Sewer. The average daily additional sanitary sewer flow contribution resulting from this project has been estimated at 45,920 gallons per day. A 10-inch sanitary sewer main is existing in North Fresno Street at North Friant Avenue. A private sewer main exists on site within East and West River Park Place. No sewer main extensions are required. ❑ Sanitary Sewer facilities are currently or would be available to provide sanitary sewer service to the site subject to the following requirements: • Separate sewer house branches are required for each lot. • All public sewer facilities shall be constructed in accordance with City of Fresno standards, specifications, and policies. • Nor extensions required. B. Water Service In compliance with the Woodward Park Community Plan Verification and Monitoring Procedure for Water Service,it has been determined that an adequate source of potable water is available to meet City,State,and Federal standards during periods of peak flow in the City water system serving the Woodward Park Community Plan Area for this project including existing demand and all other approved development. The additional projected peak water demand resulting from this project has been estimated at 330 gallons per minute. A 14-inch public water main is existing on site within East and West River Park Place. No water main extensions are required. Conditions of Approval Tentative Parcel Map No. 2003-16 Page 7 September 22, 2003 ❑ Water facilities are currently or would be available to provide water service to the site subject to the following requirements. • Separate water services shall be provided to each lot created. • Payment for installation of water service(s)and/or meter(s) is required. • Payment for installation of public fire hydrant(s) is required. • Water Connection Charges are due and shall be paid for the Project. • All public water facilities shall be constructed in accordance with City of Fresno standards, specifications, and policies. ❑ All work and engineered plans for public improvements shall conform to the 2002 Edition of the City of Fresno Standard Specifications and Drawings(City Council Resolution No.70-36 and Resolution No. 84-361) and any amendments thereto, herein after referred to as the "Public Works Standards". Special Conditions ❑ Woodward Park Community Plan Findings for the availability of water service is required for this project. Comply with conditions. Code Requirements The Fresno Municipal code(FMC)requires that a separate sewer house branch shall be provided for each proposed parcel(or secured under an agreement). Proposed parcels without public streets access must be provided with C.C.&Rs and private cross-lot utility easements to guarantee maintenance and repair access to utility pipelines and services and/or private sewer lift stations. C. Street Improvements: General Conditions: • All required signing and striping shall be done and paid for by the developer/owner. The signing and striping plans shall be done per the current CalTrans standards and shall be submitted as a part of the street construction plans for this tentative map to the Public Works Department for review and approval. Repair or replace any existing offsite improvements to Public Works Standards. • Repair or replace any existing damaged off-site concrete improvements to Public Works Standards. • Additional off-site concrete improvement requirements will be required at time of site plan review. • Comply with conditions of approval for S-03-074. Frontage Improvement Requirements: Conditions of Approval Tentative Parcel Map No. 2003-16 Page 8 September 22, 2003 Frontage Improvement Requirements: Major Streets: North Friant Road Expressway: 1. Concrete curb, gutter(10 foot pattern)and 20 feet of permanent A. C.pavement are to existing to Public Works Standards. 2. The City standards for Expressway street lighting are existing. 3. Underground all proposed and existing utilities. 4. Remove existing street type approach and replace with concrete curb and gutter per Public Works Standard P-5 5. Relinquish direct access to Friant Road within the limits of this parcel map. East Audubon Drive: 1. Install an underground street lighting system to Public Works Standard E-1. Spacing to conform to Public Works Standards for Arterial Streets. UGM Requirements: This Parcel Map is within U.G.M.Major Street Zone"A",therefore,pay U.G.M:Major Street Zone fee. North Friant Road Expressway: No U.G.M requirements. East Audubon Drive: No U.G.M. requirements. D. Clovis Unified School District Prior to issuance of a building permit, school fees must be paid. Contact Clovis Unified School District for their requirements. E. Fresno Irrigation District 1. FID's Forkner No. 121 pipeline traverses the proposed property on the east as shown on the enclosed map. 2. FID request that the applicant be required to submit a grading and drainage plan for FID approval which shows the proposed development will not endanger the structural integrity of the pipeline, or result in drainage patterns that will adversely affect FID or the applicant. FID's Forkner No. 12 pipeline traverses the subject property in an exclusive easement recorded on February 20, 1991, as Document No. 91020381, Official Records of Fresno County. 4. Should the applicant build any permanent structures within FID's easement for the Forkner No. 121 pipeline FID may request the applicant replace the existing pipe in the effected area with a new pipe of the same diameter in accordance with FID standards and that the applicant enter into an agreement with FID for that purpose. 5. FID request that its easement be shown on the map with proper recording information, and that FID be made a party to signing all plans which affect its easement and canal/pipeline facility and also be made party to signing the final map. General Public Works Requirements A. DEDICATIONS. The subdivider shall dedicate public easements to facilitate the construction of curbs, gutters, sidewalk, bus bays, right turn lanes, bike lanes, bike paths, multi-purpose trail, wheelchair ramps and public utilities in accordance with City plans, ordinances, resolutions and policies,the Standard Specifications of the Public Works Department within the limits of the parcel map. Additionally, a minimum 4 foot wide clear path of travel is required along the public sidewalk on all frontages of the property as required by Title 24 of the California Administration Code as determined by the City Engineer. An on-site pedestrian easement and construction of a path may be required if Title 24 provisions can not be met within the public rights of way. All such public easements shall be identified and dedicated with the processing and recordation of the Parcel Map or at the time of Special Permit reviews for the proposed development of the parcels. B. STREET IMPROVEMENTS. The subdivider shall construct curb,gutters,curb returns and landings, wheelchair ramps, sidewalks with street tree wells and irrigation systems (when applicable),permanent pavement,street/safety lighting,bike lanes,bike paths,multi-purpose trail,walls and fences in accordance with City plans,ordinances,resolutions,policies and the Standard Specifications of the Public Works Department within the limits of the parcel map. Existing improvements that are not to the planned alignment shall be removed and required improvements installed to the new street alignment and grade. Existing improvements to remain in place shall be repaired if determined to be damaged and/or off grade by the City Engineer. Existing driveway approaches not identified for current or future utilization shall be removed and sidewalk (when applicable), curb and gutter shall be installed to match existing or proposed street line and grade as determined by the City Engineer. . The subdivider shall connect each parcel being created to the City of Fresno's sanitary sewer system with a separate sewer house branch unless other arrangements are approved by the City Engineer. All sanitary sewer system improvements shall be constructed in accordance with City plans,ordinances,resolutions,policies and the Standard Specifications of the Public Works Department. The connection to the City's sanitary sewer system requires the payment of all applicable sewer connection charges in accordance with the provisions of FMC Chapter 9,Article 5 prior to the approval of the map. D. WATER SYSTEM. The subdivider shall connect each parcel being created to the City of Fresno's water system with a separate water service and meter unless other arrangements are approved by the City Engineer. All water system improvements shall be constructed in accordance with City plans,ordinances,resolutions,policies and the Standard Specifications of the Public Works Department. The connection to the City's system requires the payment of all applicable water connection charges in accordance with the provisions of FMC Chapter 14,Article 1 prior to the approval of the map. E. STREET,SEWER AND WATER CONSTRUCTION PLANS. The subdivider shall provide street,sewer and water construction plans for the required public improvements as determined by the City Engineer. Such plans shall be prepared by a registered Civil Engineer and approved by the City Engineer prior to the issuance of Street Work permits. IX. Development Fees All fees noted in this section shall be due and payable to the City of Fresno prior to the approval of the final parcel map. All fee quotations are based on current rates. Applicant shall pay the fee in effect at the time of final map approval. A. Metropolitan Flood Control District Drainage Area: "CW" $0.00 B. Each local agency shall provide to the project applicant a notice in writing at the time of the approval of the project or at the time of the imposition of the fees, dedications, reservations, or other exactions, a statement of the amount of the fees or a description of the dedications, reservations, or other exactions, and notification that the 90-day approval period in which the applicant may protest has begun. The Federal Clean Water Act and the State General Permits for Storm Water Discharges Associated with Construction and Industrial Activities (State General Permits) require developers of construction projects disturbing five or more acres, and discharges associated with industrial Ma activity not otherwise exempt from National Pollutant Discharge Elimination System (NPDES) permitting, to implement controls to reduce pollutants, prohibit the discharge of waters other than storm water to the municipal storm drain system, and meet water quality standards. These requirements apply both to pollutants generated during construction, and to those which may be generated by operations at the development after construction. a. State General Permit for Storm Water Discharges Associated with Construction Activities, approved August 1999, (modified December 2002.) A State General Construction Permit is required for all clearing, grading, and disturbances to the ground that result in soil disturbance of at least one acre (or less than one acre if part of a larger common plan of development or sale). Permittees are required to: submit a Notice of Intent to be covered and must pay a permit fee to the State Water Resources Control Z Board(State Board), develop and implement a storm water pollution prevention plan, eliminate non-storm water discharges, conduct routine site inspections, train employees O in permit compliance, and complete an annual certification of compliance. ■ O b. State General Permit for Storm Water Discharges Associated with Industrial Activities, O April, 1997 (available at the District Office.) A State General Industrial Permit is required for specific types of industries described in the NPDES regulations or by Standard Industrial Classification(SIC) code. The following categories of industries are generally required to secure an industrial permit: manufacturing; trucking; O recycling; and waste and hazardous waste management. Specific exemptions exist for manufacturing activities which occur entirely indoors. The District encourages, but does not require that roof drains from non-residential development be constructed such that they are directed onto and through a landscaped grassy swale area to filter out pollutants from roof runoff. Runoff from areas where industrial activities, product, or merchandise come into contact with and may contaminate storm water must be directed through landscaped areas or otherwise treated before discharging it off-site or into a storm drain. Roofs covering such areas are recommended. Cleaning of such areas by sweeping instead of washing is to be required unless such wash water can be directed to the sanitary sewer system. Storm drains receiving untreated runoff from such areas that directly connect to the District's system will not be permitted. Loading docks,depressed areas, and areas servicing or fueling vehicles are specifically subject to these requirements. The District's policy governing said industrial site NPDES program requirements are attached. Major storm flows from north of TPM 2003-016 shall be conveyed southeasterly through this project to North Friant Expressway. The developer shall provide a conveyance method for review and approval such that the major storm flow can be safely conveyed to the North Friant Expressway without damage to proposed and future structures within the property.
