SUBJECT: NOTICE OF APPROVAL OF TENTATIVE PARCEL MAP NO. 2003-11
PROPOSING A NINE(9) LOT COMMERCIAL PLANNED DEVELOPMENT
PARCEL MAP FOR PROPERTY LOCATED ON THE NORTHEAST CORNER OF
NORTH FORT WASHINGTON ROAD AND NORTH FRIANT ROAD.
The City of Fresno Planning Division has completed its review of the subject map, Pursuant to FMC
Section 12-1205(c), this letter is written to advise that the Conditions of Approval are as noted on the
attached document,dated September 16,2003.
If you have any questions regarding the conditions you must notify either Louis Rocha or Paul Bernal
at 621-8073 no later than October 8, 2003, to request a review of the conditions. Otherwise, the
stipulated conditions of approval are in effect as of that date. No further notice will be sent.
Appeal: The divider or any aggrieved person may file an appeal regarding to conditions of approval
within fifteen(15)days from the date of approval.
To protest the Director's decision regarding the conditions of approval, you must appeal by filing a
written appeal with the Director of the Development Department. Appeal must include the appellant's
interest in/or relationship to the subject property, the decision or action appealed, and specific reasons
why the appellant believes the decision or action appealed from should not be upheld
Appeals must be submitted to the Director of the Development Department prior to 5 p.m. on October
13, 2003.

EXPIRATION: The approval or conditional approval of this tentative Parcel Map expires two years
from the date of approval. The expiration shall terminate all proceedings and a final Parcel Map may
not be filed without first processing a new Tentative Parcel Map.
Modification of a Tentative Parcel Map after approval or conditional approval does not extend the two
year time limit.
EXTENSION: The divider may request an extension of the tentative map expiration date by filing a
written application together with the fee set forth in the Master Fee Schedule at the time of the request
with the Director of the Development Department at least thirty days before the expiration date of the
map. The applicant must state the reasons for the requesting the extension. New conditions may be
imposed if an extension is granted.
An extension may not exceed an aggregate of five years.

CONDITIONS OF APPROVAL
TENTATIVE PARCEL MAP NO. 2003-11
NOTICE TO PROJECT APPLICANT
In accordance with the provisions of Government Code§66020(d)(1),the imposition of fees,dedications,
reservations or exactions for this project are subject to protest by the project applicant at the time of
approval or conditional approval of the development or within 90 days after the date of the imposition
of the fees,dedications,reservations or exactions imposed on the development project.
The City of Fresno Development Department has completed a review of the subject tentative parcel map in
accordance with the State Subdivision Map Act and the Fresno Municipal Code.
The conditions of approval for Tentative Parcel Map No. 2003-11 are as follows:
I. Legal Status of Site to be Subdivided
A. The parcel map site,was legally created by Lane Tract and Lot 149 of Perrin Colony No. 2.
11. Zoning
A. Proposed parcels are consistent with the existing C-2/EA/UGM/cz (Community
Commercial/Expressway Area Overlay/Urban Growth Management/conditions of zoning)zone
district for the parcel map site in terms of lot width, depth and area subject to approval of a
special permit for a planned development project. All parcels must have approved access to
a public street or right-of-way under a planned development special permit. Amend
Conditional Use Permit No. C-98-208 to authorize and match Tentative Parcel Map
No. 2003-11.
B. Relinquish access to North Friant Road to and from all parcels that abut North Friant Road.
III. Conditions of Zoning
A. Friant Expressway: Within the limits of the subject property,dedication of sufficient street
right-of-way along the entire frontage to complete the 126-feet expressway cross-section in
accordance with the circulation element of the General Plan.

North Fort Washington Road:Within the limits of the subject property,dedication of a two
to twelve-foot wide easement for street right-of-way along the entire frontage to complete the
84-foot wide collector street cross-section in accordance with the circulation element of the
General Plan.
B. Deed documents shall be prepared at no expense to the City. The owner is responsible to
secure the services of a licensed State Land Surveyor or Civil Engineer to provide the City with
legal descriptions,drawings,and associated documentation in the form and manner provided
in Section 12-403-K-4 and the payment of a deed technical check and recordation processing
fee for each document.
C. Deed documents offering the dedication of the required public easements shall be submitted
to the City in a technically correct form within One Hundred Twenty (120) days following
Council approval of the zone district amendment. In the event such deed documents are not
timely delivered,the approval of he zone district amendment shall lapse.
1. Implementation of mitigation measures identified by Mitigated Negative Declaration
for Environmental Assessment No. A-98-08, R-98-10 which are attached and
incorporated herein as Attachment"A".
2. Development of the project site shall occur generally in accordance with the types,
arrangement and proportions of uses (congregate care, offices, and retail/service
commercial)depicted on the development concept attached and incorporated herein as
Attachment"B".
IV. Property Development Standards
Modifications of Property Development Standards/Planned Commercial Development
A. The proposed subdivision requires that modification of the C-2/EA/UGM/cz zone district
property development standards in that proposes the creation of parcels within an approved
commercial planned development which do not abut a public street or right-of-way. Such
standards and access may be accomplished by compliance with conditions below.
B. If not already obtained,secure approval of an amendment to the Site Plan Review(S-99-200)
or Conditional Use Permit (C-98-208) or a new entitlement authorizing the creation of an
commercial planned development on the parcel map site to reflect the proposed parcel lines and
modifications.
C. Submit draft copies of Covenants,Conditions and Restrictions/Owners Association documents
(CC & R's) for review and approval. Final, executed and notarized documents are to be
recorded with the parcel map. CC&R's shall conform with the provisions of Section 12-1026
FMC and address ingress, egress, sewer and water service, maintenance, and access, fire
protection,solid waste service, storm drainage, parking and landscaping as follows:

• Cross Access for ingrees/egrees
• Cross Drainage as indicated per Flood Control District's Memo
• Covenant for Shared Parking
• Covenant to maintain water,sewer and all other utilities
• Covenant for fire protection underground water supplies and Covenant for access to
buildings
• Covenant to maintain all landscaping within the limits of the map
• Covenant for shared solid waste facilities
• Provide Covenant Agreement for access to land locked parcels
• Provide Covenant Agreement for maintenance of fire suppression water system.
D. The placement of a parcel line in close proximity to any existing and/or proposed structures
requires the structures be found in compliance with the fire resistive standards of the
Uniformed Building Code,Chapter 5. In the event the structures do not comply they must be
modified so as to meet the requirement.
The proposed structure(s)on the site may be affected due to the location of the proposed parcel
line. Compliance with the prevailing Uniform Building Code as it relates to the exterior wall
protection, allowable area, etc. (as applicable to new parcel line locations) must be
demonstrated prior to final map submittal. Contact Planning and Development Department,

V. Plan Consistency
A. The 2025 Fresno General Plan and the Woodward Park Community Plan designates the parcel
map for development with Commercial Regional type land uses. The Zoning District
Consistency Table of the Fresno Municipal Code identifies commercial regional uses as
consistent with the approved C-2/EA/UGM/cz zone district.
VI. Subdivision Map Act Requirement
A. Concurrent with the filing of a final map and when the provisions of Section 66436 of the
Subdivision Map Act apply,the subdivider is responsible to send,by certified mail,a sketch
of the proposed final map,together with a copy of SMA Section 66436(a)(3)(A),to any public
entity or public utility which has previously acquired a right-of-way or easement.
B. Comply with the provisions of the State of California Government Code Sections 66410 -
66499.58 (the Subdivision Map Act) and the City of Fresno Municipal Code Chapter 12,
Article 10(Subdivision of Real Property).
VII. On-Site Requirements
A. The subdivider may either construct the required off-site improvements prior to the approval
of the final parcel map; or enter into an agreement with the City of Fresno providing for the

construction of the required improvements and sufficient security prior to the approval of the
final parcel map.
B. All off-site and public improvements shall be constructed in accordance with the Public Works
Department Standards, Specifications and Policies. Engineered construction plans and
estimates for all or part of the required work shall be required prior to the issuance of Street
Work Permits unless otherwise determined by the City Engineer. The cost for such plan
preparation,review and construction inspection shall be at the subdivider's expense.
C. Any existing utilities, including but not limited to, street lights, traffic signals, fire hydrants,
poles (power, telephone, cable, etc), fire hydrants which must be relocated or removed in
conjunction with the construction of these off-site improvement requirements, shall be the
responsibility and at the expense of the subdivider.
D. All existing overhead utilities,including but not limited to,electrical systems,communication
systems and street lighting systems shall be placed underground in accordance with the
provisions of Section 12-1011 of the Fresno Municipal Code and the policies of the Public
Works Department.
E. When street/safety lighting installations are required, street lighting plans shall be submitted
for review and approval by the Traffic Engineer prior to the issuance of permits for the work.
Services to street lighting installations shall be separated from the electrical service(s)serving
the development. The type, location and service for street lighting installations shall be as
determined by the Traffic Engineer. Street lighting installations shall be dedicated to the City
upon completion and acceptance of the installations.
F. On-site Sewer and/or Water System(s). All on-site sewer and water systems shall be"private".
In the event the subdivider proposes to construct"public"on-site sewer and/or water systems
facilities,written approval by the Public Utilities Department shall be required and provided
with the submittal of the initial final parcel map. Such facilities shall placed in a dedicated
easement and shall be included as public improvement requirements for the parcel map. Unless
otherwise determined by the Public Utilities Director, a covenant shall be required which
provides that the property owners shall be responsible for the restoration, replacement and
expense of any private surface improvements removed or damaged during the course of
maintaining such public facilities by the City or its agents.
G. Sidewalks(including wheelchair ramp landings)and driveway approaches, for undeveloped
parcels of this parcel map, shall be required as a condition of site development.
Those items identified with an asterisk(*)refer to obligations of the applicant for development
of parcels with net acreage of 4 to 10 acres. The Public Works Director has determined that
completion of such designated improvements may be deferred until time of development or
further division of the parcel(s) upon written request by the applicant. The request must
specifically acknowledge the applicant's waiver of any rights provided by Section 65961 of the

California Government Code.
H. Fresno Metropolitan Flood Control District requirements:
Comply with the Fresno Metropolitan Flood Control District's memorandum,dated
July 29, 2003.
The Developer shall comply with the existing agreements 1038(D)-DK that are currently in
place between the District and the Developer of the pervious SPR 99-290 and SPR 2002-263
for this site location.
A fifteen-foot(15) storm drain easement,required previously, has not yet been dedicated to
the District. No encroachments into the easement will be permitted including,but no limited
to,foundations,roof overhangs, swimming pools,and trees.
There is an existing Flood Release Easement for TPM 2033-011 as shown on Exhibit No. 1
The developer has been required thru prior notification to install the facilities shown on Exhibit
No. 1. These facilities are currently under construction and upon completion and acceptance
of the facilities permanent drainage service will be available.
1. Easements: Identify the location, type, size, and record information of easements on and
through the site must be shown on the final map.
If P.G.&E.has an existing pole line that serves the property and the existing pole line crosses
proposed property lines and is not covered by an existing easement,it is the property owner's
responsibility to provide adequate rights-of-way to P.G. & E. if P.G. & E's. assistance is
required to determine whether an easement will be required contact Scott Combs,Senior Land
Technician,Fresno Land Rights Office,at 263-7375.
J. Unless otherwise noted,all covenants or agreements will be prepared upon receipt of the fee
indicated below. Covenants must be approved by the City Attorney's Office prior to issuance
of building permits.
Telephone,cable,and other public utilities which propose above-ground facilities determined
by the Planning and Development Director to be oversized shall be located in an additional
easement area outside of the landscape strips required along major streets.

1. Street trees are required in accordance with the provisions of the Fresno Municipal
Code Section 11-306. The number of street trees shall be determined at the rate of one
tree for each 60 feet of street frontage.
2. Street tree fees shall be based on the fee rates established in the Master Fee Schedule
in effect at the time payment is due.
3. Contact Parks Division for their street tree requirement.
VIII. Off-Site Improvement Requirements:
Sanitary Sewer
A. In compliance with the Woodward Park Community Plan Verification and Monitoring
Procedure for Sanitary Sewer Service, it has been demonstrated and determined that sanitary
sewer service is available to this project in the Herndon/Cornelia Trunk Sewer. The average
daily additional sanitary sewer flow contribution resulting from this project has been estimated
at 20,898 gallons per day.
❑ It has been determined that the 42-inch segment between North Fresno Street and North
Howard Avenue and the 21-inch segment in North Cedar Avenue between East Fir and East
Herndon Avenue of the Herndon Trunk Sewer will be impacted as a result of this project;
therefore, the developer shall construct the following improvements prior to issuance of
occupancy permits unless otherwise stated:
• The developer shall be required to enhance(by pipe lining)the 42-inch segment of the
Herndon Trunk Sewer between North Fresno Street and North Howard Avenue
impacted as a result of this project.
• The developer shall replace or enhance the existing 21-inch section of sewer main to
the capacity of the 42-inch sewer main immediately upstream. Match the upstream of
the 42-inch sewer main immediately upstream. Match the upstream of the 42-inch
sewer main located in North Cedar Avenue between East Herndon and East Fir
Avenues.
• Extension of the sewer main in North Fort Washington Road from an existing point
near the easterly boundary of the project to the westerly boundary of the project.
As an alternative to the above; the City is willing to accept payment of the established sewer
enhancement connection fee at the time of development. The City of Fresno would then
assume responsibility to make the enhancements to mitigate this project's impacts on the sewer
system.
A 8-inch public sanitary sewer main is existing in North Fort Washington Road east of the
proposed development.
1. A 8-inch public sewer main extension shall be installed within North Fort Washington
Road westerly from the existing sanitary sewer main along the development frontage.

2. Separate sewer house branches shall be provided to each parcel created.
3. All public sewer facilities shall be constructed in accordance with City of Fresno
standards, specifications,and policies.
B. Water Service
In compliance with the Woodward Park Community Plan Verification and Monitoring
Procedure for Water Service, it has been determined that an adequate source of potable water
is available to meet City,State,and Federal standards during periods of peak flow in the City
water system serving the Woodward Park Community Plan Area for this project including
existing demand and all other approved development. The additional projected peak water
demand resulting from this project has been estimated at 151 gallons per minute.
❑ Based upon the estimated demand the City will require the following prior to occupancy for a
specific development entitlement for this property:
• Any existing agricultural wells within the boundaries of the proposed development
shall be sealed and abandoned in compliance with California Well Standards,Bulletin
74-90 or current revisions,issued by California Department of Water Resources,and
City of Fresno standards.
• Payment for installation of water service(s)and/or meter(s)is required.
• Payment for installation of public fire hydrant(s)is required.
• Water Connection Charges are due and shall be paid for the Project.
• No extensions required.
❑ All work and engineered plans for public improvements shall conform to the 2002 Edition of
the City of Fresno Standard Specifications and Drawings(City Council Resolution No.70-36
and Resolution No.84-361)and any amendments thereto,herein after referred to as the"Public
Works Standards".
Special Conditions
❑ Woodward Park Community Plan Findings for the availability of water service is required for
this project. Comply with conditions.
Code Requirements
The Fresno Municipal code(FMC)requires that a separate sewer house branch shall be provided for
each proposed parcel(or secured under an agreement). Proposed parcels without public streets access
must be provided with C.C.&Rs and private cross-lot utility easements to guarantee maintenance and
repair access to utility pipelines and services and/or private sewer lift stations.

C. Street Improvements:
General Conditions:
All required signing and striping shall be done and paid for by the developer/owner. The
signing and striping plans shall be done per the current CalTrans standards and shall be
submitted as a part of the street construction plans for this tentative map to the Public Works
Department for review and approval. Repair or replace any existing offsite improvements to
Public Works Standards.
Frontage Improvement Requirements:
Major Street:
North Friant Road Expressway:
1. Install concrete curb, gutter, (8 foot pattern) and 20 feet of A.C. paving to Public
Works Standards.
2. Install a 30 foot radius concrete return with wheelchair ramp to Public Works
Standards P-28.
3. City standards Expressway street lighting already exist.
4. Additional off-site concrete improvements will be required at the time of future site
plan review.
North Fort Washington Road:
1. Dedicate ingress-egress easement from proposed landlocked Parcels "D", "E", "F",
"G","H",&641"to North Fort Washington Road. Show easement on this Map.
2. Install concrete curb,gutter,10 foot curb pattern,and 18 feet of A.C.Paving to Public
Works Standards.
3. Construct intersection with North Friant Road to City Public Works Standard P-69.
4. Install an underground street lighting system to Public Works Standard E-1. Spacing
to conform to Public Works Standards for Collector streets.
5. Additional off-site concrete improvements will be required at the time of future site
plan review.

UGM Requirements:
1. This Tentative Parcel Map is in UGM Major Street Zone"A", therefore, pay UGM
Major Street Fees.
North Friant Road:
1. Construct 22 feet wide raised concrete median island within the limits of this parcel
map.
East Fort WashinLyton Road:
1. No UGM requirements.
D. Clovis Unified School District
Contact the Clovis Unified School District for fee requirements.
E. Engineering Servics
All private well and septic systems must be properly abandoned prior to connection into the
City Sewer and Water system
IX. General Public Works Requirements
A. DEDICATIONS. The subdivider shall dedicate public easements to facilitate the construction
of curbs,gutters,sidewalk,busbays,right turn lanes,bike lanes,bike paths,multi-purpose trail,
wheelchair ramps andpublic utilities in accordance with Cityplans,ordinances,resolutions and
policies,the Standard Specifications of the Public Works Department within the limits of the
parcel map. Additionally, a minimum 4 foot wide clear path of travel is required along the
public sidewalk on all frontages of the property as required by Title 24 of the California
Administration Code as determined by the City Engineer. An on-site pedestrian easement and
construction of a path may be required if Title 24 provisions can not be met within the public
rights of way. All such public easements shall be identified and dedicated with the processing
and recordation of the Parcel Map or at the time of Special Permit reviews for the proposed
development of the parcels.
B. STREET IMPROVEMENTS. The subdivider shall construct curb,gutters,curb returns and
landings, wheelchair ramps, sidewalks with street tree wells and irrigation systems (when
applicable),permanent pavement,street/safety lighting,bike lanes,bike paths,multi-purpose
trail,walls and fences in accordance with City plans,ordinances,resolutions,policies and the
Standard Specifications of the Public Works Department within the limits of the parcel map.
Existing improvements that are not to the planned alignment shall be removed and required
improvements installed to the new street alignment and grade. Existing improvements to
remain in place shall be repaired if determined to be damaged and/or off grade by the City

Engineer. Existing driveway approaches not identified for current or future utilization shall be
removed and sidewalk(when applicable), curb and gutter shall be installed to match existing
or proposed street line and grade as determined by the City Engineer.
C. SANITARY SEWER SYSTEM. The subdivider shall connect each parcel being created to
the City of Fresno's sanitary sewer system with a separate sewer house branch unless other
arrangements are approved by the City Engineer. All sanitary sewer system improvements shall
be constructed in accordance with City plans, ordinances, resolutions, policies and the
Standard Specifications of the Public Works Department. The connection to the City's sanitary
sewer system requires the payment of all applicable sewer connection charges in accordance
with the provisions of FMC Chapter 9,Article 5 prior to the approval of the map.
D. WATER SYSTEM. The subdivider shall connect each parcel being created to the City of
Fresno's water system with a separate water service and meter unless other arrangements are
approved by the City Engineer. All water system improvements shall be constructed in
accordance with City plans,ordinances,resolutions,policies and the Standard Specifications
of the Public Works Department. The connection to the City's system requires the payment of
all applicable water connection charges in accordance with the provisions of FMC Chapter 14,
Article 1 prior to the approval of the map.
E. STREET,SEWER AND WATER CONSTRUCTION PLANS. The subdivider shall provide
street,sewer and water construction plans for the required public improvements as determined
by the City Engineer. Such plans shall be prepared by a registered Civil Engineer and approved
by the City Engineer prior to the issuance of Street Work permits.
X. Development Fees
All fees noted in this section shall be due and payable to the City of Fresno prior to the approval of the
final parcel map. All fee quotations are based on current rates. Applicant shall pay the fee in effect at
the time of final map approval.

GOVERNMENT CODE §66020(d)(1)
A protest filed pursuant to subdivision(a)shall be filed at the time of approval or conditional approval
of the development or within 90 days after the date of the imposition of the fees, dedications,
reservations, or other exactions to be imposed on a development project. Each local agency shall
provide to the project applicant a notice in writing at the time of the approval of the project or at the
time of the imposition of the fees, dedications, reservations, or other exactions, a statement of the
amount of the fees or a description of the dedications,reservations,or other exactions,and notification

The proposed development will generate storm runoff which produces potentially significant
environmental impacts and which must be properly discharged and mitigated pursuant to the
California Environmental Quality Act and the National Environmental Policy Act. The O
District in cooperation with the City and County has developed and adopted the Storm
Drainage and Flood Control Master Plan. Compliance with and implementation of this
Master Plan by this development project will satisfy the drainage related CEQA/NEPA impact
of the project mitigation requirements.
The proposed development shall pay drainage fees pursuant to the Drainage Fee Ordinance
prior to approval of the final map at the rates in effect at the time of such approval. The fee O
indicated above is based on the tentative map. Contact the FMFCD project engineer prior to
approval of the final map for the fee. O
Considerations which may affect the fee obligation(s) or the timing or form of fee payment: w
a) Fees related to undeveloped or phased portions of the project may be deferrable. O
b) Fees may be calculated based on the actual percentage of runoff if different than that
typical for the zone district under which the development is being undertaken and if
permanent provisions are made to assure that the site remains in that configuration.
c) Master Plan storm drainage facilities may be constructed,or required to be
constructed in lieu of paying fees.
d) The actual cost incurred in constructing Master Plan drainage system facilities is
credited against the drainage fee obligation.

e) When the actual costs incurred in constructing Master Plan facilities exceeds the
drainage fee obligation, reimbursement will be made for the excess costs from
future fees collected by the District from other development.

Requirements.

6. The Federal Clean Water Act and the State General Permits for Storm Water Discharges
Associated with Construction and Industrial Activities(State General Permits)require developers 04
of construction projects disturbing five or more acres,and discharges associated with industrial 00
activity not otherwise exempt from National Pollutant Discharge Elimination System (NPDES)
permitting, to implement controls to reduce pollutants,prohibit the discharge of waters other than
storm water to the municipal storm drain system, and meet water quality standards. These
requirements apply both to pollutants generated during construction, and to those which may be
generated by operations at the development after construction.

State General Permit for Storm Water Discharges Associated with Construction
Activities,approved August 1999, (modified December 2002.) A State General
Construction Permit is required for all clearing, grading,and disturbances to the ground
that result in soil disturbance of at least one acre(or less than one acre if part of a larger
common plan of development or sale). Permittees are required to: submit a Notice of
Intent to be covered and must pay a permit fee to the State Water Resources Control Z
Board(State Board),develop and implement a storm water pollution prevention plan,
eliminate non-storm water discharges, conduct routine site inspections,train employees O
in permit compliance,and complete an annual certification of compliance.

b. State General Permit for Storm Water Discharges Associated with Industrial Activities, O
April, 1997(available at the District Office.) A State General Industrial Permit is
required for specific types of industries described in the NPDES regulations or by
Standard Industrial Classification(SIC)code. The following categories of industries
are generally required to secure an industrial permit:manufacturing;trucking; O
recycling;and waste and hazardous waste management. Specific exemptions exist for j
manufacturing activities which occur entirely indoors. Permittees are required to:
submit a Notice of Intent to be covered and must pay a permit fee to the State Water
Resources Control Board,develop and implement a storm water pollution prevention
plan,eliminate non-storm water discharges,conduct routine site inspections,train
employees in permit compliance, sample storm water runoff and test it for pollutant
indicators,and annually submit a report to the State Board.

C. The proposed development is encouraged to select and implement storm water quality
controls recommended in the Fresno-Clovis Storm Water Quality Management
Construction and Post-Construction Guidelines(available at the District Office)to
meet the requirements of the State General Permits,eliminate the potential for non-
storm water to enter the municipal storm drain system, and where possible minimize
contact with materials which may contaminate storm water runoff.
7. A requirement of the District may be appealed by filing a written notice of appeal with the
Secretary of the District within ten days of the date of this Notice of Requirements.
8. The District reserves the right to modify,reduce or add to these requirements,or revise fees, as
necessary to accommodate changes made in the proposed development by the developer or
requirements made by other agencies.

The Developer shall comply with the existing Agreements 1038(D)-DK and 1198(D)-DK that are
currently in place between the District and the Developer of the previous SPR 99-290 and SPR 2002-
263 for this site location.
A fifteen-foot (15') storm drain easement, required previously, has not yet been dedicated to the
District. No encroachments into the easement will be permitted including, but not limited to,
foundations, roof overhangs, swimming pools,and trees.
There is an existing Flood Release Easement for TPM 2003-011 as shown on Exhibit No. 1.
The developer has been required thru prior notification to install the facilities shown on Exhibit No.
1. These facilities are currently under construction and upon completion and acceptance of the
facilities permanent drainage service will be available.
