The City of Fresno Planning Division has completed its review of the subject map. Pursuant to FMC
Section 12-1205(c), this letter is written to advise that the Conditions of Approval are as noted on the
attached document, dated July 11, 2003.
If you have any questions regarding the conditions you must notify either Louis Rocha or Paul Bernal
at 621-8073 no later than July 31, 2003,to request a review of the conditions. Otherwise,the
stipulated conditions of approval are in effect as of that date. No further notice will be sent.
Appeal: The divider or any aggrieved person may file an appeal regarding to conditions of approval
within fifteen(15)days from the date of approval.
To protest the Director's decision regarding the conditions of approval, you must appeal by filing a
written appeal with the Director of the Development Department. Appeal must include the appellant's
interest in/or relationship to the subject property, the decision or action appealed, and specific reasons
why the appellant believes the decision or action appealed from should not be upheld
Appeals must be submitted to the Director of the Development Department prior to 5 p.m. on
August 7, 2003.
EXPIRATION: The approval or conditional approval of this tentative Parcel Map expires two years
from the date of approval. The expiration shall terminate all proceedings and a final Parcel Map may
not.be filed without first processing a new Tentative Parcel Map.
Modification of a Tentative Parcel Map after approval or conditional approval does not extend the two
year time limit.

EXTENSION: The divider may request an extension of the tentative map expiration date by filing a
written application together with the fee set forth in the Master Fee Schedule at the time of the request
with the Director of the Development Department at least thirty days before the expiration date of the
map. The applicant must state the reasons for the requesting the extension. New conditions may be
imposed if an extension is granted.
An extension may not exceed an aggregate of five years.

RECOMMENDATION
Based on the independent review conducted by the Planning and Development Department and the Public
Works Department,itwas concluded that the proposed street alignment and width for an 11-parcel industrial
development located on the west side of North Valentine Avenue between West Ashlan and West Shaw
Avenues are acceptable and can accommodate the development of the proposed subdivision for industrial
use.
It is, therefore, recommended that the City Council take the following action:
1. APPROVE the finding of a Categorical Exemption,Class 32 prepared for Environmental Assessment
No. TPM-2003-08, dated June 11, 2003.
2. APPROVE the proposed street alignment and widths as shown on Exhibit A dated May 22, 2003.
EXECUTIVE SUMMARY
This is a request filed by Don Pickett,for City Council approval of a new street alignment for North Valentine
Avenue between West Ashlan and West Shaw Avenues. This request is to facilitate a new industrial
development just east of an existing industrial subdivision. The 64-foot local industrial street, to be located
along the east one-half of the site, will provide improved access to the proposed industrial lots. If Council
concurs in the new street alignment, the applicant will file a parcel map that will create an 11 industrial lot
parcel map. The new street alignment is supported by staff in both Planning and Development and Public
Works Departments.

BACKGROUND/ANALYSIS
Environmental Findina
The environmental assessment of this project (refer to attached Categorical Exemption, dated June 11,
2003) has indicated that the proposed parcel map and street alignment and widths should not have a
significant impact on the surrounding environment. Therefore, staff recommends the adoption of the
Categorical Exemption No. TPM 2003-08 issued for this project.
Community Plan Advisory Committee Review
The Bullard Advisory Community Plan Committee reviewed the project at their meeting on June 9, 2003,
and recommended approval of Tentative Parcel Map No. 2003-08.
Land Use Plans and Policies
The 2025 Fresno General Plan and the Bullard Community Plan both designate the subject property for light
industrial type land uses. The M-1 (Light Manufacturing)zone district is consistent with the planned land
use. The Bullard Community Plan indicates'v�here industrial uses shall be located. The plan provides for
three areas to be developed with light industrial:uses: north and west of Pinedale;the area bounded by the
Southern Pacific Tracks,Ashlan,Valentine and the Herndon Canal;and the area in the extreme northwest
corner of the plan area, east of the Southern Pacific Railroad tracks, north and south of the Herndon
townsite. These areas are proximate to rail lines, major transportation routes and a labor supply.

of no more than five acres substantially surrounded by urban uses,c)the proj ect site
has no value as habitat for endangered,rare or threatened species,d)approval of the
project would not result in any significant effects relating to traffic, noise, air
quality, or water quality,and e) the site can be adequately served by all required
utilities and public services.
The propose street alignment and property is located within the city limits and the
surrounding properties have been developed classifying this project as an infill
project.No habitat for endangered,rare or threatened species exists on the site. The
project is consistent with the community plan land use designation and complies
with all conditions listed above. No adverse environmental impacts would occur
as a result of the proposed project.

A RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO,
CALIFORNIA, FOR THE APPROVAL OF THE STREET ALIGNMENT
AND WIDTH OF A PUBLIC STREET
WHEREAS, on June 24, 2003, a request was filed by Donald Pickett, for City Council
approval of a new street alignment for a new local industrial street located between West Ashlan
and West Shaw Avenues, on the west side of North Valentine Avenue; and,
WHEREAS, this request is to facilitate a new industrial development, Tentative Parcel
Map No. 2003-08, located on the west side of North Valentine Avenue between West Ashland
and West Shaw Avenues and the 64-foot local industrial street,which will connect to the east
side of North Valentine Avenue, will provide improved access to the proposed industrial lots;
and,
WHEREAS, Section 66426 (c)of the Subdivision Map Act and the City's Parcel Map
Ordinance provide that a tentative and final map shall be required for all subdivisions creating
five or more parcels except when the land consists of a parcel or parcels having approved access
to a public street or highway,which comprises part of a tract of land zoned for industrial or
commercial development, and which has the approval of the governing body(City Council) as to
street alignments and widths, and;
WHEREAS, Environmental Assessment No. TPM-2003-08,relating to and
environmentally assessing Tentative Parcel Map Nti.,2003-08 was prepared in compliance with
the California Environmental Quality Act(CEQA),and;
WHEREAS,the environmental assessment conducted for the proposed tentative parcel
map resulted in the filing of a Categorical Exemption/Class 32.
NOW, THEREFORE, BE IT RESOLVED, the City Council finds that there is no evidence
in the record that the project as proposed will result in a significant impact in the local
environment and approves the Categorical Exemption which was issued June 6, 2003; and,
BE IT FURTHER RESOLVED, the Council of the City of Fresno, in accordance with
Section 66426(c)of the Subdivision Map Act and the City's Parcel Map Ordinance, hereby
approves the street alignment and widths as proposed in Exhibit"A",dated May 22, 2003 and to
be developed with Tentative Parcel Map No. 2003-08.

CONDITIONS OF APPROVAL
TENTATIVE PARCEL MAP NO. 2003-08
NOTICE TO PROJECT APPLICANT
In accordance with the provisions of Government Code §66020(d)(1), the imposition of fees,
dedications,reservations or exactions for this project are subject to protest by the project applicant
at the time of approval or conditional approval of the development or within 90 days after the date of
the imposition of the fees,dedications,reservations or exactions imposed on the development project.
The City of Fresno Development Department has completed a review of the subject tentative parcel map in
accordance with the State Subdivision Map Act and the Fresno Municipal Code.
The conditions of approval for Tentative Parcel Map No. 2003-08 are as follows:
I. Legal Status of Site to be Subdivided
A. The parcel map site was legally created.
II. Zoning
A. Proposed parcels are consistent with the property's existing M-1, Light Manufacturing Zone
District and meets the Property Development Standards(minimum width,depth and lot area
requirements).
111. Planning Consistency
A. The 2025 Fresno General Plan and Bullard Community Plan designates the property for Light
Industrial. The Zoning District Consistency Table of the Fresno Municipal Code identifies
Light Industrial as consistent with the M-1 zone district.
IV. On-Site Requirements
A. Fresno Metropolitan Flood Control District requirements:
1. Grading and drainage patterns shall be as identified on Exhibit No. 1 112.
2. The proposed development does not appear to be located within a flood prone area.
3. Comply with Fresno Metropolitan Flood Control District Memorandum dated July 10,
2003.
Public Utilities Easements- PG&E
A. Easements: Identify the location, type, size, and record information of easements on and

through the site must be shown on the final map.
B. Telephone,cable,and other public utilities which propose above-ground facilities determined
by the Planing and Development Director to be oversized shall be located in an additional
easement area outside of the landscape strips required along major streets.
V. Off-Site Improvement Requirements:
A. Sanitary Sewer
❑ It has been determined that the Project will contribute an estimated average daily discharge to
the sanitary sewer system of 7,963 gallons and capacity is available in the Sanitary Sewer
System to serve the Project, and
❑ Sanitary Sewer facilities are currently or would be available to provide sanitary sewer service
to the site subject to the following requirements.
• Separate sewer house branches shall be provided to each parcel created.
• Sewer Connection Charges are due and shall be paid for the Project.
• No extensions required.
B. Water Service
❑ It had been determined that the projected peak of water demand for this Project has been
estimated at 49 gallons per minute and an adequate source of potable water is available to meet
City, State, and Federal standards during periods of peak demand in the City Water System
serving this project, and
❑ Water facilities are currently or would be available to provide water service to the site subject to
the following requirements:
• Payment for installation of water service(s) and/or meter(s) is required.
• Payment for installation of public fire hydrant(s) is required.
• Water Connection Charges are due and shall be paid for the Project.
• No extensions required.
Special Conditions
❑ The project developer should contact Wastewater Management Division/Environmental
Services(559)621-5100 regarding conditions of service for special industrial users.

Major Streets:
NORTH VALENTINE AVENUE:
1. Dedicate an easement for public street right-of-way per North Valentine Avenue Official
Plan Line, (Volume 8, pages 1 through 4; Ordinance No. 92-02; Resolution No. 10265).
2. Construct concrete curb, gutter, and permanent A.C. paving per the Public Works
Standard within the limits of this map.
3. Install an underground street light system per Public Works Standard E-1. Street lighting
plans are required and must be approved by the Public Works Department/Engineering
services prior to commencement of work.
4. Underground all existing offsite overhead utilities within the limits of the tentative parcel
map per FMC sec. 12-1011, sec. 8-801 and Resolution No. 78-522/88-229.

VI. GENERAL PUBLIC WORKS REQUIREMENTS
General Conditions:
All required signing and striping shall be done and paid for by the developer/owner. The signing
and striping plans shall be done per the current CalTrans standards and shall be submitted as
a part of the street construction plans for this tentative map to the Public Works Department for
review and approval. Repair or replace any existing offsite improvements to Public Works
Standards.
A. DEDICATIONS. The subdivider shall dedicate public easements to facilitate the construction
of curbs,gutters,sidewalk,bus bays,right tum lanes,bike lanes,bike paths,multi-purpose trail,
wheelchair ramps and public utilities in accordance with City plans,ordinances,resolutions and
policies, the Standard Specifications of the Public Works Department within the limits of the
parcel map. Additionally, a minimum 4 foot wide Gear path of travel is required along the
public sidewalk on all frontages of the property as required by Title 24 of the California
Administration Code as determined by the City Engineer. An on-site pedestrian easement and
construction of a path may be required if Title 24 provisions can not be met within the public
rights of way. All such public easements shall be identified and dedicated with the processing
and recordation of the Parcel Map.
B. STREET IMPROVEMENTS. The subdivider shall construct curb, gutters, curb returns and
landings, wheelchair ramps, sidewalks with street tree wells and irrigation systems (when
applicable), permanent pavement, street/safety lighting, bike lanes, walls and fences in
accordance with City plans, ordinances, resolutions, policies and the Standard Specifications
of the Public Works Department within the limits of the parcel map.
Existing improvements that are not to the planned alignment shall be removed and required
improvements installed to the new street alignment and grade. Existing improvements to
remain in place shall be repaired if determined to be damaged and/or off grade by the City
Engineer. Existing driveway approaches not identified for current or future utilization shall be
removed and sidewalk(when applicable),curb and gutter shall be installed to match existing or
proposed street line and grade as determined by the City Engineer.
C. SANITARY SEWER SYSTEM. The subdivider shall connect each parcel being created to the
City of Fresno's sanitary sewer system with a separate sewer house branch unless other
arrangements are approved by the City Engineer. All sanitary sewer system improvements shall
be constructed in accordance with City plans,ordinances,resolutions,policies and the Standard
Specifications of the Public Works Department. The connection to the City's sanitary sewer
system requires the payment of all applicable sewer connection charges in accordance with the
provisions of FMC Chapter 9,Article 5 prior to the approval of the map.
D. WATER SYSTEM. The subdivider shall connect each parcel being created to the City of
Fresno's water system with a separate water service and meter unless other arrangements are
approved by the City Engineer. All water system improvements shall be constructed in
accordance with City plans, ordinances, resolutions, policies and the Standard Specifications
of the Public Works Department. The connection to the City's system requires the payment of
all applicable water connection charges in accordance with the provisions of FMC Chapter 14,
Article 1 prior to the approval of the map.

D. STREET, SEWER AND WATER CONSTRUCTION PLANS. The subdivider shall provide
by the City Engineer prior to the issuance of Street Work permits.
F. CONSTRUCTION/DEFERRAL. The subdividershall construct the street,sanitary sewersystem
and water system improvements required for this parcel map,and the work deemed completed
by acceptance of the work by the City Engineer, prior to the approval and recordation of the
Parcel Map.
Alternatively,the subdivider may request the deferral of the construction of such improvements
with a parcel agreement. The City Engineer may approve such agreement wherein the
subdivider will be required to provide an Engineer's Estimate of the work. The agreement will
be prepared by the City and will require performance securities as determined by the City
Engineer.
VII. Development Fees
Industrial Development Incentives (Information Only)
The City Council on June 17,1997 adopted Ordinance No.97-29(effective July 28,1997)establishing
Section 12,Article 15 of the Fresno Municipal Code to provide the following development incentives
for parcels zoned M- 1, M-2, M-3, or M-1-P:
Impact Fee Reduction. Provides for the reduction of the number of units for sewer and water
connection charges for low flow users as determined by the Director of the Public Utilities
Department, based on certified estimates,the City Engineer's opinion and agreement with the
City.
Impact Fee Waiver. Waives the Trunk Sewer and Major Facilities Trunk Sewer fees for
projects within the trunk sewer services area for Herndon, Cornelia and Fowler.
Impact Fee Deferral. Provides for the deferral of the payment of various sewer and water
connection charges,and UGM fees to the time of occupancy under an agreement with the City.
Impact Fee Financing. Provides for the financing of the sewer Wastewater Facilities Charge
over a 5 year period under an agreement with the city.
Public Improvement Deferral. Provides for the deferral of certain public infrastructure
improvements,by agreement,if the appropriate findings are made by the Public Works Director.

A RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO,
CALIFORNIA, FOR THE APPROVAL OF THE STREET ALIGNMENT
AND WIDTH OF A PUBLIC STREET
WHEREAS, on June 24,2003, a request was filed by Donald Pickett, for City Council
approval of a new street alignment for a new local industrial street located between West Ashlan
and West Shaw Avenues, on the west side of North Valentine Avenue; and,
WHEREAS, this request is to facilitate a new industrial development, Tentative Parcel
Map No. 2003-08, located on the west side of North Valentine Avenue between West Ashland
and West Shaw Avenues and the 64-foot local industrial street, which will connect to the east
side of North Valentine Avenue, will provide improved access to the proposed industrial lots;
and,
WHEREAS, Section 66426(c)of the Subdivision Map Act and the City's Parcel Map
Ordinance provide that a tentative and final map shall be required for all subdivisions creating
five or more parcels except when the land consists of a parcel or parcels having approved access
to a public street or highway, which comprises part of a tract of land zoned for industrial or
commercial development,and which has the approval of the governing body(City Council) as to
street alignments and widths, and;
WHEREAS, Environmental Assessment No. TPM-2003-08,relating to and
environmentally assessing Tentative Parcel Map No. 2003-08 was prepared in compliance with
the California Environmental Quality Act(CEQA),and;
WHEREAS,the environmental assessment conducted for the proposed tentative parcel
map resulted in the filing of a Categorical Exemption/Class 32.
NOW, THEREFORE, BE IT RESOLVED, the City Council finds that there is no evidence
in the record that the project as proposed will result in a significant impact in the local
environment and approves the Categorical Exemption which was issued June 6, 2003; and,
BE IT FURTHER RESOLVED, the Council of the City of Fresno,in accordance with
Section 66426 (c) of the Subdivision Map Act and the City's Parcel Map Ordinance,hereby
approves the street alignment and widths as proposed in Exhibit"A", dated May 22, 2003 and to

Associated with Construction and Industrial Activities (State General Permits)require developers
of construction projects disturbing five or more acres, and discharges associated with industrial Mo

recycling; and waste and hazardous waste management. Specific exemptions exist for O
manufacturing activities which occur entirely indoors. Permittees are required to:
submit a Notice of Intent to be covered and must pay a permit fee to the State Water
Resources Control Board,develop and implement a storm water pollution prevention
plan, eliminate non-storm water discharges,conduct routine site inspections,train
employees in permit compliance, sample storm water runoff and test it for pollutant
indicators, and annually submit a report to the State Board.

C. The proposed development is encouraged to select and implement storm water quality
controls recommended in the Fresno-Clovis Storm Water Quality Management
Construction and Post-Construction Guidelines (available at the District Office)to
meet the requirements of the State General Permits, eliminate the potential for non-
storm water to enter the municipal storm drain system, and where possible minimize
contact with materials which may contaminate storm water runoff.
7. A requirement of the District may be appealed by filing a written notice of appeal with the
Secretary of the District within ten days of the date of this Notice of Requirements.
8. The District reserves the right to modify,reduce or add to these requirements, or revise fees, as
necessary to accommodate changes made in the proposed development by the developer or
requirements made by other agencies.

In an effort to improve storm water runoff quality, outdoor storage areas shall be constructed and
maintained such that material which generates contaminants will not be conveyed by runoff into the
storm drain system.
The District encourages, but does not require that roof drains from non-residential development be
constructed such that they are directed onto and through a landscaped grassy swale area to filter out
pollutants from roof runoff.
Runoff from areas where industrial activities, product, or merchandise come into contact with and
may contaminate storm water must be directed through landscaped areas or otherwise treated before
discharging it off-site or into a storm drain. Roofs covering such areas are recommended. Cleaning
of such areas by sweeping instead of washing is to be required unless such wash water can be
directed to the sanitary sewer system. Storm drains receiving untreated runoff from such areas that
directly connect to the District's system will not be permitted. Loading docks,depressed areas, and
areas servicing or fueling vehicles are specifically subject to these requirements. The District's
policy governing said industrial site NPDES program requirements are attached.
