VESTING.TENTATIVE PARCEL MAP NO. 2002-30
Vesting Tentative Parcel Map No. 2002-30, filed by Coast-to-Coast Petroleum, proposes the
creation of three parcels on 2.5 acres located on the southeast corner of South Elm and East
Jensen Avenues. On January 17, 2003, the City of Fresno Planning and Development
Department Director approved the subject vesting tentative parcel map for an initial two years.
Pursuant to Section 12-1205(e)(1) of the Fresno Municipal Code (FMC) the approval of a
tentative parcel map shall expire not later than two years from the date it was approved
(expiration date January 17, 2005). An extension, however, may be approved or approved with
conditions in the manner provided pursuant to Section 12-1205(e)(2) of the FMC. Note that per
Government Code Section 66463.3 (SMA) extensions may not exceed five years.
The Planning and Development Department has received your letter dated December 20; 2004,
requesting an extension of time in accordance with Section 12-1205(e)(2) of the FMC and
Government Code Section 66463.5 of the SMA. A two year extension is hereby granted and
the approval of Vesting Tentative Parcel Map No. 2002-30 is extended to an expiration date of
January 17, 2007.

The City of Fresno Planing Division.has completed its review of the. subject map. Pursuant
to FMC Section 12-1205(c), this letter is written to advise that the conditions of approval are
as noted on the attached document, dated January 17, 2003.
If you have any questions regarding the conditions you must notify either Louis Rocha or
Robert Lewis at 621-8055 no later than January 24, 2003, to request a review of the
conditions. Otherwise, the stipulated conditions of approval are in effect as of that date. No
further notice will be s nt.
Appeal: The divider or any aggrieved person may file an appeal regarding to conditions of
approval within fifteen (15) days from the date of approval.
To protest the Director's decision regarding the conditions of approval, you must appeal by
filing a written appeal (with the Director of the Development Department. Appeal must
include the appellant's interest in/or relationship to the subject property, the decision or
action appealed, and specific reasons why the appellant.believes the decision or action
appealed from should not be upheld
Appeals must be submitted to the Director of the Development Department prior to 5 p.m.
on February 3, 2003.

EXPIRATION: The approval or conditional approval of this tentative Parcel Map expires
two years from the dat of approval. The expiration shall terminate all proceedings and a
final Parcel Map may not be filed without first processing a new Tentative Parcel Map.
Modification of a Tentative Parcel Map after approval or conditional approval does not
extend the two year time limit.
EXTENSION: The divider may request an extension of the tentative map expiration date by
filing a written application together with the fee set forth in the Master Fee Schedule at the
time.of the request with the Director of the Development Department at least thirty days
before the expiration date of the map. The applicant must state the reasons for the requesting
the extension. New conditions may be imposed if an extension is granted.
An extension may not exceed an aggregate of five years.

CONDITIONS OF APPROVAL
VESTING TENTATIVE PARCEL MAP NO. 2002-30
The City of Fresno Development Department has completed a review of the subject tentative parcel
map in accordance with the State Subdivision Map Act and the Fresno Municipal Code.
The conditions of approval for Vesting Tentative Parcel Map No. 2002-30 are as follows:
NOTICE TO PROJECT APPLICANT
In accordance with the provisions of Government Code §66020(d)(1), the
imposition of fees, dedications, reservations or exactions for this:project are subject
to protest by the project applicant at the time of approval or conditional approval
of the development or within 90 days after the date of the imposition of the fees,
dedications, reservations or exactions imposed on the development project.
I. Legal Status of Site to be Subdivided
A. The parcel map site, was legally created.

A. Proposed parcels is consistent with the approved M-1 zoned light industrial district
standards for the parcel map site in terms of lot width, depth and area. All parcels must
have approved access to a public street or right-of-way under a special permit.
B. If not already obtained secure approval of an amendment to Conditional Use Permit

No. C-01-95 or a new entitlement authorizing the creation of the new parcels on the site
to reflect the proposed parcel lines.
C. The placement of a parcel line in close proximity to any existing and/or proposed
structure requires the structures be found in compliance with the fire resistive standards
of the Uniform Building Code, Chapter 5. In the event the structures do not comply
they must be modified so as to meet the requirement.
The proposed structure(s) on the site may be affected due to the location of the
proposed parcel line. Compliance with the prevailing Uniform Building Code as it
relates to the exterior wall protection, allowable area, etc. (as applicable to new parcel

Department, Building and Safety Services at 621-8200.
E.. Submit draft copies of Covenants, Conditions and Restrictions/Owners Association
documents(CC&R's)for review and approval. Final, executed and notarized
documents are to be recorded with the parcel map. CC &R's shall conform with the
provisions of Section 12-1026 FMC and address ingress, egress, sewer and water
service, maintenance, and access, fire protection, solid waste service, storm drainage,
parking and landscaping.
III. Plan Consistency.
A. The Edison Community Plan and the Southwest Fresno G.N.R.A. Redevelopment
Plan desig�ates the parcel map site for development with light industrial land uses. The
Zoning District Consistency Table of the Fresno Municipal Code identifies light
industrial uses as consistent with the approved M-I zone district.
IV. On-Site Requirements
A. Fresno Metropolitan Flood Control District requirements:
Comply with Flood Control memo dated January 10, 2003.
B. Fresno Irrigation District:
No requirements.
C. Easements: The 1 cati n, type, size, and record information of easements on and through
the site must be shown on the final map.
A. Provide Public Utility Easements(PUE)which may be required for P. G. &E.
use. It is the owner's responsibility to provide P.G. & E. with adequate rights-of-
way satisfactory to P.G. &E. If the property owner needs P.G. &E. to help
assist in making the determination if an easement will be necessary, the property
owner or their agent may contact the Scott Combs,Land Agent,Fresno Land .
Rights.Office at 263-7375.
The developer/owner will be responsible for the costs associated with any
removal or relocation of existing facilities on the property.

2. Provide the necessary private sewer easements to provide for sewer service to
each parcel created is private sewer service is proposed.
3. Provide approved easements and/or covenants for cross access between parcels
(minimum of two for each parcel) for fire protection access. Provide approved

V. Off-Site Improvement Requirements
A. Street Improvements

and reciprocal access and maintenance easements must be provided. In addition,
an engineered onsite utility plan showing the proposed outfall to the public sewer
system must be submitted to the City for review and approval.

VII. GENERAL PUBLIC WORKS REQUIREMENTS
A. DEDICATIONS. The subdivider shall dedicate public easements to facilitate the
construction of curbs, gutters,sidewalk, bus bays, right turn lanes, bike lanes, bike paths,
multi-purplose trail, wheelchair ramps and public utilities in accordance with City plans,
ordinances, resolutions and policies, the Standard Specifications of the Public Works
Department within the limits of the parcel map. Additionally, a minimum 4 foot wide
clear path of travel is required along the public sidewalk on all frontages of the property
as required by Title 24 of the California Administration Code as determined by the City
Engineer. An on-site pedestrian easement and construction of a path may be required if
Title 24provisions can not be met within the public rights of way. All such public
easements shall be identified and dedicated with the processing and recordation of the
Parcel Map or at the time of Special Permit reviews for the proposed development of the
parcels.

B. STREET IMPROVEMENTS. The subdivider shall construct curb,gutters, curb
returns and landings, wheelchair ramps, sidewalks with street tree wells and irrigation
systems (when applicable), permanent pavement, street/safety lighting, bike lanes, bike
paths, walls and fences in accordance with City plans, ordinances, resolutions, policies
and the Standard Specifications of the Public Works Department within the limits of the
parcel map.
Existing in that are not to the planned alignment shall be removed and
required improvements installed to the new street alignment and grade. Existing
improvements to remain in place shall be repaired if determined to be damaged and/or off
grade by the City Engineer. Existing driveway approaches not identified for current or
future utilization shall be removed and sidewalk(when applicable), curb and gutter shall
be installed to match existing or proposed street line and grade as determined by the City
Engineer.
C. SANITARY SEWER SYSTEM. The.subdivider shall connect each parcel being
created to the City of Fresno's sanitary sewer system with a separate sewer house branch
unless other arrangements are approved by the City.Engineer. All sanitary sewer system
improvements shall be constructed in accordance with City plans, ordinances,
resolutions, policies and the Standard Specifications of the Public Works Department.
The subdivider is required to construct sewer main extensions to serve the parcel map in
a manner determined by the City Engineer. The connection to the City's sanitary sewer
system requires the payment of all applicable sewer connection charges in accordance
with the provisions of FMC Chapter 9, Article 5 prior to the approval of the map.

D. WATER SYSTEM. The subdivider shall connect each parcel being created to the City
of Fresno's water system with a separate water services and meters unless other
arrangements are approved by the City Engineer. All water system improvements shall
be constructed in accordance with City plans, ordinances, resolutions, policies and the
Standard Specifications of the Public Works Department. The subdivider is required to
construct water main extensions to serve the parcel map in a manner determined by the .
City Engineer. The connection to the City's sanitary sewer system requires the payment
of all applicable water connection charges in accordance with the provisions of FMC
Chapter 14, Article 1 prior to the approval of the map
E. STREET, SEWER AND WATER CONSTRUCTION PLANS. The subdivider shall
provide stc�eet, sewer and water construction plans for the required public improvements
as determined by the City Engineer. Such plans shall be prepared by a registered Civil
Engineer and approved by the City Engineer prior to the issuance of Street Work

ermits:F. CONSTRUCTION/DEFERRAL. The subdivider shall construct the street, sanitary
sewer system and water system improvements required for this parcel map, and the work
deemed completed by acceptance of the work by the City Engineer, prior to the approval
and recordation of the Parcel.Map.
Alternatively, the subdivider may request the deferral of the construction of such

improvements with a parcel map agreement. The City Engineer may approve such
agreement wherein the subdivider will be required to provide an Engineer's Estimate of
the work. The agreement will be prepared by the City and will require performance
securities as determined by the City Engineer.
VI. Development Fees
All fees noted in this section shall be due and payable to the City of Fresno prior to the approval
of the final parcel inap. All fee quotations are based on current rates. Applicant shall.pay the
fee in effect at the time of final map approval.

BACKGROUND
Tentative Parcel Map No. 2002-30, filed by Coast to Coast Petroleum LLC, on
November 19, 2002, and accepted on December 20, 2002, proposes the creation of a
3-parcel industrial subdivision on 2.5 acres of M-1 zoned property located on the southeast
corner of South Elm and East Jensen Avenues. The project site is zoned M-1 (Light
Industrial District zoning). Approval of a tentative parcel map is subject to the Development
Director finding that the map is consistent with the officially adopted plans and policies of
the City of Fresno. Staff has reviewed the proposed design and improvement of Tentative
Parcel Map No. 2002-30 and has determined that the map is consistent with adopted plans
and policies as described below.
The Edison/SW Fresno Citizens Planning Advisory Committee took action to recommend
approval of the tentative parcel map. Redevelopment Agency Staff concurs with the
Committee recommendation and required no conditions of parcel map approval.
Please review the following required findings for determination of consistency for the
tentative parcel map Upon your determination that the required findings can be made, the
applicant will be notified of the conditions of approval of Tentative Parcel Map
No. 2002-30.
REQUIRED FINDINGS
California Environmental Quality Act CEQA) The California Environmental Quality Act
(Public Resources Code Section 21000 et seq.) and the State EIR Guidelines, Section 15061
1&(Review for Exemptions), permit a.public agency to determine whether a particular project
is exempt from CEQA.1 If a public agency finds that the activity is covered by the general
rule that CEOAt�annliesl only to nroiects which have the notential for causing a significant

effect on the environment and it can be seen with certainty that there is no possibility that the
activity in question may have a significant effect on the environment, the activity is not
subject to CEQA and a notice of exemption.
A determination of a Class 15 Categorical Exemption (Section 15315/minor land.division of
4 or fewer parcels) from CEQA was made and Environmental Assessment
No. TPM-2002-16 (Categorical Exemption) was completed for this project and issued on
January 16, 2003 and filed with the Fresno City Clerk on January 16, 2003.
State Subdivision Map Act - The Subdivision Map Act (California Government Code
Section 66410.et. seq.) requires that a proposed parcel map not be approved unless the map,
together with its design and improvements, is found to be consistent with the General Plan
and any applicable specific plan (Finding No. 1 below). State law further provides that the
proposed parcel map be denied approval if anyone of the Finding Nos. 2 -5, below, is made
in the negative.
1. The proposed subdivision map, together with its design and improvements is
consistent with the City's General Plan and any applicable specific plan, because the
Edison Community Plan and the Southwest Fresno G.N.R.A. Redevelopment Plan
designates the site for Light Industrial land uses and the project design meets the
density and zoning ordinance criteria for development in this plan designation.
2. The site is physilally suitable for the proposed type and density of development
because of the flat terrain of the site and adequate access and drainage on and off the
site.
3. The proposed subdivision design and improvements are not likely to cause substantial
and considerable damage to the natural environment, including fish, wildlife or their
habitat, because of the urbanized nature of the area in which the site is located.
4. The proposed subdivision design and improvements are not likely to cause serious
public health and safety problems, because the conditions of approval have shown and
will insure that the subdivision conforms with City health and safety standards.
5. The proposed subdivision design will not conflict with public easements within or

through the site.because conditions of approval will assure noninterference with any
existing or proposed public easements.
Staff, based on its own analysis, has determined that the parcel map, subject to the
recommended conditions of approval, otherwise complies with the design and property
development standards hof the Zoning Ordinance and local Parcel Map Ordinance and
recommends the approval of the parcel map.

1. Based upon the above analysis, the Development Director finds that Tentative Parcel
Map No. 2002-3�0 is consistent with the applicable plans and policies of the City of
Fresno.
2. The Development Director hereby approves the categorical exemption for the
environmental assessment and grants approval of Tentative Parcel Map No. 2002-30
dated December 20, 2002, subject to the conditions of approval dated January 17,
2003, and to become effective on January 24, 2003.

Thank you for the opportunity to review the Tentative Parcel Map No. 01-36.
Pacific Gas and Electric Company (PG&E) owns and operates an electric
transmission line. and gas transmission. facilities located within the proposed
project's boundaries. To promote the safe. and reliable maintenance and
operation of utility facilities, the California Public Utilities Commission (CPUC) has
mandated specific` clearance : requiremenfs 'between ..utility facilities and
surrounding objects or construction activities. To ensure compliance with these
standards, project proponents should coordinate with PG&E early in the
development of their project plans. Any proposed development plans should
provide for unrestricted utility access and prevent easement encroachments that
might impair the safe and reliable maintenance and operation of PG&E's facilities.
Some examples of activities that could have an impact upon our facilities include
permanent/temporary changes in grade under our facilities; construction of
structures within or�, adjacent to PG&E's easements; and planting of certain types
of vegetation under our electric facilities.
Developers will be responsible for the costs associated with the relocation of
existing PG&E facilities to accommodate their proposed development. Because
facility relocation's require long lead times and are not always feasible,
developers should be encouraged to consult with PG&E as early in their planning,
stages as possible. .

Expansion of distribution and transmission lines and related facilities are a
necessary consequence of growth and development. In addition to adding new
distribution feeders, the range of electric system improvements needed to
accommodate growth may include upgrading existing substation and
transmission line equipment, expanding existing substations to their ultimate
buildout capacity, and building new substations and interconnecting transmission
lines. Comparable upgrades or additions needed to accommodate additional
load on the gas system could include facilities such as regulator stations,
odorizer stations, valve lots, distribution and transmission lines.

6. The Federal Clean Water Act and the State General Permits for Storm Water Discharges
Associated with Construction and Industrial Activities (State General Permits) require
developers of construction projects disturbing five or more acres, and discharges associated Ma
with industrial activity not otherwise exempt from National Pollutant Discharge Elimination
System (NPDES)permitting, to implement controls to reduce pollutants,.prohibit the
discharge of waters other than storm water to the municipal storm drain system, and meet water
quality standards. These requirements apply both to pollutants generated during construction,
and to those which may be generated by operations at the development after construction.
a. State General Permit for Storm Water Discharges Associated with Construction
Activities, August 1999 (available at the District Office.) A State General
Construction Permit is required for all clearing, grading, and disturbances to the
ground that result in soil disturbance of at least five acres Or less than five acres
if part of a larger common plan of development or sale). Permittees are required
to: submit a Notice of Intent to be covered and must pay a permit fee to the
State Water Resources Control Board (State Board), develop and implement a. Z
storm water pollution prevention plan, eliminate non-storm water discharges,
conduct rolutine site inspections,train employees in permit compliance, and O
complete an annual certification of compliance. ■
.Under the hase II federal storm water quality regulations a State General

Industrial Permit is required for specific types of industries described in the

occur entirely indoors. Permittees are required to: submit a Notice of Intent to
be covered and must pay a permit fee to the State Water Resources Control
Board, develop and implement a storm water pollution prevention plan,
eliminate non-storm water discharges, conduct routine site inspections, train
employees in permit compliance, sample storm water runoff and test it for
pollutant indicators, and annually submit a report to the State Board.

future Master Planned storm drain facilities within S.Elm Avenue. Construction is planned to begin
during the Spring of 2003. Upon completion of these facilities,permanent drainage service will be

In an effort to improve storm water runoff quality, outdoor storage areas shall be

FORM AND CONTENT OF TENTATIVE PARCEL MAPS AND RELATED APPLICATIONS
(Pursuant to Fresno Municipal Code Section 12-1205)
FORM AND CONTENT OF-TENTATIVE PARCEL MAPS
(1) A preliminary parcel map shall be filed with the Director. The preliminary map shall be submitted on a sheet
18 by 26 inches or 460 by 660 millimeters. A marginal line shall be drawn completely around each sheet, leaving
an entirely blank margin of one inch or 025 millimeters. The map shall be legibly drawn on tracing paper,suitable
for reproduction to a scale and in a manner to best illustrate the proposed division. A marginal line shall be drawn
completely around the sheet leaving an entirely blank margin of one inch. The following information shall be
shown on the map:
�o�(2)The boundary lines of the entire parcel including the area to be divided, with dimensions, based on existing
survey data or property descriptions.
'.(3) The proposed division lines with dimensions.
72tz, (4) Identification of each parcel with a letter designation.
(5) All existing buildings and structures located on the land to be divided, together with their major exterior
dimensions and distance from said buildings and structures to the boundary lines of the parcels which are to be
!/created by the proposed land division.

(6) The location of existing wells, septic tanks, leaching fields, and house branch sewer lines and.water lines.
(7) The location and names of all abutting streets, alleys, and easements.
(8) The location and widths of any streets, alleys, and easements proposed by the subdivider.
(9) Source of data from which the map was drawn.
(10) Name, address, and telephone number of the person preparing the map and any record owner of the land.
(11)For residential parcel maps, a statement indicating how the parcel map design provides, to the extent feasible,
for passive and natural heating or cooling opportunities and for other measures that conserve nonrenewable energy
resources.
(12) Such additional information as the Director deems necessary, including but not limited to the information
required by Sections 12-1004 and 12-1009 of the Fresno Municipal Code('rhe additional information is listed on page 2).

Applications related to a tentative parcel map that are submitted prior to or concurrently with a tentative parcel
map shall contain clear, legible and accurate information. Such applications may include the following:
1. Environmental Assessment Application.
2. Rezoning Application.
+_ 3. Urban Growth Management Application.
4. Special Permit Application.
5. Request for Modification of Standards.
4 6. Internal Consistency of Applications:
a. Information presented in each application must be consistent with information presented in related
applications and on the tentative tract map.
b. Site plans, drawings and other graphic materials that are part of a special permit application must
be consistent with the tentative tract map.
C. An application for rezoning of property with the boundaries of a tentative tract map must contain
a legal description of the property to be rezoned that is consistent with the tentative tract map.

The following features shall be shown accurately to a distance of two hundred feet from the proposed subdivision boundary:
1. Existing zoning. .

THE PROJECT DESCRIBED HEREIN IS DETERMINED TO BE CATEGORICALLY EXEMPT
r FROM THE PREPARATION OF ENVIRONMENTAL DOCUMENTS PURSUANT TO ARTICLE
19 OF THE STATE OF CEQA GUIDELINES.
APPLICANT: Coast to Coast Petroleum LLC
PROJECT LOCATION: The southeast corner of South Elm and East Jensen Avenues
PROJECT DESCRIPTION: Tentative Parcel Map No. 2002-30 is a proposed 3-parcel
industrial subdivision on a 2.5 acre, M-1 zoned parcel.
This project is exempt under Section 15315 of the State of CEQA Guidelines.
Explanation: This project is a Class 15 exemption which consist of a division of
property in urbanized area zoned for residential use into four or fewer
parcels and is in conformance with the General Plan and the zoning, no
variances or exceptions are required, all services and access to the
proposed parcels to local standards are available, the parcel was not
involved in a division of a larger parcel within the previous two years,
and the parcel does not have an average slope greater than 20 percent.
