CONDITIONS OF APPROVAL
"REVISED"TENTAITIVE PARCEL MAP NO. 2002-28
NOTICE TO PROJECT APPLICANT
In accordance with the provisions of Government Code§66020(d)(1),the imposition of fees,dedications,
reservations or exactions for this project are subject to protest by the project applicant at the time of
approval or conditional approval of the development or within 90 days after the date of the imposition
of the fees, dedications, reservations or exactions imposed on the development project.
The City of Fresno Development Department has completed a review of the subject tentative parcel map in
accordance with the State Subdivision Map Act and the Fresno Municipal Code.
The conditions of approval for Tentative Parcel Map No.2002-28 are as follows:
I. Legal Status of Site to be Subdivided
A. The parcel map site,was legally created.
H. Zoning
A. Proposed parcels must consistent withe approved R-P/UGM, Residential and Professional
Office District/Urban Growth Managementzone district for the parcel map site in terms of lot
width, depth and area subject'to approval of a special permit for a planned development
project. All parcels must provided access to a public street right-of-way under a planned
development special permit.
Modifications of Property Development Standards/Planned Unit Development
B. The proposed subdivision requires that modification of the R-P zone district property
development standards in that is proposes the creation of parcels within an approved
commercial planned developmjent which do not abut a public street or right-of-way. Such
standards and access may be accomplished by compliance with conditions below.
C. If not already obtained,secure (approval of an amendment to Site Plan Review No. S-01-235
or a new entitlementauthorizin the creation of an commercial planned development on the
parcel map site to reflect the prposed parcel lines and modifications.

D. The placement of a parcel line in close proximity to any existing and/or proposed structures
requires the structures be found in compliance with the fire resistive standards of the
Uniformed Building Code,Chapter 5. In the event the structures do not comply they must be
modified so as to meet the requirement.
The proposed structure(s) on the site may be affected due to the location of the proposed
parcel line. Compliance with the prevailing Uniform Building Code as it relates to the exterior
wall protection, allowable area, etc. (as applicable to new.parcel line locations) must be
demonstrated prior to final map submittal. Contact Planning and Development Department,
Building and Safety Services at 621-8200.
E. Submit draft copies of Covenants,Conditions and Restrictions/Owner Association documents
(CC & R's) for review and approval. Final, executed and notarized documents are to be
recorded with the parcel map. CC&R's shall conform with the provisions of Section 12-1026
FMC and address ingress, egress, sewer and water service, maintenance, and access, fire
protection, solid waste service,storm drainage,parking and landscaping.
III. Plan Consistency
A. The Woodward Park Community Plan designates the parcel map site for development with
Commercial Office land uses. The Zoning District Consistency Table of the Fresno Municipal
Code identifies office uses as consistent with the approved R-P/UGM zone district.
IV. General Conditions
A. Concurrent with the filing of a,final map and when the provisions of Section 66436 of the
Subdivision Map Act apply,the subdivider is responsible to send,by certified mail, a.sketch
of the proposed final map,together with a copy of SMA Section 66436(a)(3)(A),to any public
entity or public utility which has previously acquired a right-of-way easement.
V. On-Site Requirements
A. Fresno Metropolitan Flood Control District requirements:
Comply with the Fresno Metropolitan Flood Control District letter dated August 7, 2003.
Parcels`B"and"D"are required to grant drainage covenants for Parcels"A"and"C"to allow
surface runoff to reach the Master Plan inlet located at the intersection of Jackson and Maple
Avenues.

Our records indicate that there is not continuous existing curb and gutter to convey runoff to
the Master Plan inlet located at the intersection f Jackson and Maple Avenues, as shown on
Exhibit No. 1. The Developer shall be r uired to provide documentation and/or
improvements satisfactory to the City of Fresno t allow for conveyance of storm water to the
inlet locations.
The following paragraphs only apply towards development of the individual parcels and are
not conditions of the recording of the map:
In an effort to improve storm water runoff qualit ,outdoor storage areas shall be constructed
and maintained such that material which gene tes contaminants will not be conveyed by
runoff into the storm drain system
The District encourages, but does not requ' a that roof drains from non-residential
development be constructed such that they are directed onto and through a landscaped grassy
swale area to filter out pollutants from roof runoff.
F. Easements: Identify the location, type, size, an record information of easements on and
through the site must be shown on the final map.
G. Unless otherwise noted,all covenants or agreements will be prepared upon receipt of the fee
indicated below. Covenants must be approved by the City Attorney's Office prior to issuance
of building permits.
D. Fire Department
Provide approved covenants for cross access and fire fighting water supply for parcel"C".
E. Parks Recreation&Community Services Depent

VI. Off-Site Improvement Requirements:
Sanitary Sewer
A. In compliance with the Woodward Park Cb unity Plan Verification and Monitoring
Procedure for Sanitary Sewer Service,it has belen demonstrated.and determined that sanitary
sewer service is available in the Hemdon/Comelia runk Sewer. The average daily additional
sanitary sewer flow contribution resulting from this project has been estimated at 3,013
gallons per day

Mitigation Measures for Sewer Service
It has been determined that the 42-inch segment of the Herndon Trunk Sewer between Fresno
Street and Howard Avenue will impacted as a result of this project; therefore,the developer
shall construct the following improvements prior to issuance of occupancy permits unless
otherwise stated:
• The Developer shall be required to enhance(by pipe lining)the 42-inch segment of
Herndon Trunk Sewer between North Fresno Street and North Howard Avenue
impacted as a result of this project.
As an alternative to the above;
• The City is willing to accept payment of the established sewer enhancement
connection fee at the time of developmetit. The City of Fresno would then assume
responsibility to make the enhancement$ to mitigate this project's impacts on the
sewer system
❑ Sanitary Sewer facilities are currently or would be available to provide sanitary sewer service
to the site subject to the following requirements:
• Separate sewer house branches are required for each lot.
• Sewer Connection Charges are due and shall be paid for the Project.
• No extensions required.
• All public sewer facilities.shall be constructed in accordance with City of Fresno
standards, specifications, and policies.
B. Water Service
In compliance with the Woodward Park Community Plan.Verification and Monitoring
Procedure for Water Service,it has been determined that an adequate source of potable water
is available to meet City,State,and Federal standards during periods of peak flow in the City
water system serving the Woodward Park Community Plan area for this project including
existing demand and all other approved development. The additional projected peak water
demand resulting from this project has been est' ted at 22 gallons per minute.Based upon
the estimated demand we will require the foll wing prior to occupancy for a specific
development entitlement for this property:
Mitigation Measures for Water Service
• Any existing agricultural wells within the boundaries of the proposed development
shall be sealed and abandoned in compliande with California Well Standards,Bulletin
74-90 or current revisions,issued by California Department of Water Resources,and
City of Fresno standards.

• Payment of water connection fees in effect at the time of entitlement.
❑ Water facilities are currently or would be available to provide water service to the site subject
to the following requirements.
• Payment for installation of water service(s) and/or meter(s)is required.
• Payment for installation of public fire hydrant(s)is required.
• Each parcel shall have an individual water service.
• Water Connection Charges are due and shall be paid for the Project.
• No extensions required.
Special Conditions
Woodward Park Community Plan Findings for the availability of water and sanitary sewer
service is required. for this project. Comply with conditions.
Code Requirements
The Fresno Municipal code(FMC)requires that a separate sewer house branch shall be provided for
each proposed parcel(or secured under an agreement). Proposed parcels without public streets access
must be provided with C.C.&Rs and private cross-lot utility easements to guarantee maintenance and
repair access to utility pipelines and services and/or private sewer lift stations.
D. Street Improvements:
General Conditions:
All required signing and striping shall be done and paid for by the developer/owner. The
signing and striping plans shall be done per the current CalTrans standards and shall be
submitted as a part of the street construction plans for this tentative map to the Public Works
Department for review and approval. Repair or replace any existing offsite improvements to
Public Works.Standards.
Frontage Improvement Requirements:
East Alluvial Avenue (Collector)
1. Concrete curb and gutter exist.
2. Install an underground street lighting system to Public Works Standard E-1. Street
lighting plans are required and must be approved by the Public Works
Department/Engineering services prior to commencement of the work.
3. Install "No Parking" signs along said street, submit plans to the Public Works
Department.

4. Underground all existing offsite overhead utilities within the limits of the tentative
parcel map per Fresno Municipal Code section 12-1011, sec. 8-801 and Resolution
'No. 78-522/88-229.
North Maple (Collecter):
1. Design and construct curb, gutter and 20 feet of A.C. paving to Public Works
standards.
2. Construct an 80-foot bus bay, curb and gutter to Public Works Sandards P-69 and P-
73 and a 10-foot monolithic concrete walk adjacent to the bus bay.
3. Install an underground street lighting system to Public Works Standard E-1. Street
lighting plans are required and must be approved by the Public Works
Department/Engineering services prior to commencement of the work.
4. Underground all existing offsite overhead utilities within the limits of this tentative
parcel map per Fresno Municipal Code Section 12-1011, Sec. 8-801 and Resolution
No. 78-522/88-229.
UGM Requirements:
1. This Tentative Parcel Map is in UGM Major Street Zone E1,therefore,pay a UGM
Major Street Fee.
E. Pacific Bell
1. SBC Pacific Bell will need public utility easement to serve parcel "C". Feed will
come from facilities located on the west side of North Maple Avenue.
VII. General Public Works Requirements
A. DEDICATIONS. The subdivider shall dedicate public easements to facilitate the construction
of curbs, gutters,-sidewalk, bus bays, right turn lanes, bike lanes, bike paths, multi-purpose
trail, wheelchair ramps and public utilities in accordance with City plans, ordinances,
resolutions and policies,the Standard Specifications of the Public Works Department within
the limits of the parcel map. Additionally, a minimum 4 foot wide clear path of travel is
required along the public sidewalk on all frontages of the property as required by Title 24 of
the California Administration Code as determined by the City Engineer. An on-site pedestrian
easement and construction of a path may be required if Title 24 provisions can not be met
within the public rights of way. All such public easements shall be identified and dedicated
with the processing and recordation of the Parcel Map or at the time of Special Permit reviews
for the proposed development of the parcels.

B. STREET IMPROVEMENTS. The subdivider shall construct curb,gutters,curb returns and
landings, wheelchair ramps, sidewalks with street tree wells and irrigation systems (when
applicable),permanent pavement,street/safety lighting,bike lanes,bike paths,multi-purpose
trail,walls and fences in accordance with City plans,ordinances,resolutions,policies and the
Standard Specifications of the Public Works Department within the limits of the parcel map.
Existing improvements that are not to the planned alignment shall be removed and required
improvements installed to the new street alignment and grade. Existing improvements to
remain in place shall be repaired if determined to be damaged and/or off grade by the City
Engineer. Existing driveway approaches not identified for current or future utilization shall
be removed and sidewalk (when applicable), curb and gutter shall be installed to match
existing or proposed street line and grade as determined by the City Engineer.
C. SANITARY SEWER SYSTEM. The subdivider shall connect each parcel being created to
the City of Fresno's sanitary sewer system with a separate sewer house branch unless other
arrangements are approved by the City Engineer. All sanitary sewer system improvements
shall be constructed in accordance with City plans,ordinances,resolutions,policies and the
Standard Specifications of the Public Works Department. The connection to the City's
sanitary sewer system requires the payment of all applicable sewer connection charges in
accordance with the provisions of FMC Chapter 9,Article 5.prior to the approval of the map..
D. WATER SYSTEM. The subdivider shall connect each parcel being created to the City of
Fresno's water system with a separate water service and meter unless other arrangements are
approved by the City Engineer. All water system improvements shall be constructed in
accordance with City plans,ordinances,resolutions,policies and the Standard Specifications
of the Public Works Department. The connection to the City's system requires the payment
of all applicable water connection charges in accordance with the provisions of FMC Chapter
14,Article 1 prior to the approval of the map.
E. STREET,SEWER AND WATER CONSTRUCTION PLANS. The subdivider shall provide.
street,sewer and water construction plans for the required public improvements as determined
by the City Engineer. Such plans shall be prepared by a registered Civil Engineer and
approved by the City Engineer prior to the issuance of Street Work permits.

VII. Development Fees
All fees noted in this section shall be due and payable to the City of Fresno prior to the approval of the
final parcel map. All fee quotations are based on current rates. Applicant shall pay the fee in effect
at the time of final map approval.

SUBJECT: REQUIRED FINDINGS AND APPROVAL OF VESTING TENTATIVE PARCEL
MAP NO.2002-28, LOCATED ON THE SOUTHWEST CORNER OF NORTH
MAPLE AND EAST ALLUVIAL AVENUES.
BACKGROUND
Tentative Parcel Map No. 2002-28, filed by Yamabe and Hom Engineering,on November 13,2002,and
accepted on December 12, 2002,proposes the creation of a four(4)parcel commercial planned development on
1.76 acres of R-P zone property located on the southwest comer of North Maple and East Alluvial Avenues.
The site is zoned R-PIUGM,Residential and Professional Office/Urban Growth Mangement zone district and
the Woodward Park Community Plan designates the parcels as Commercial Office. Site Plan Review No. S-
01-235, a proposed office complex which,was not considered as a commercial planned development was
granted approval on August 29,2001. Approval of this tentative parcel map is subject to the Development
Director finding that the map is consistent with the officially adopted plans and policies of the City of Fresno.
Pursuant to Section 12.407.5. of the Fresno Municipal Code,Modifications of Property Development
Standards/Planned Unit Development, allows the creation of parcels which do not abut a public street right-of-
way to be granted approval by way of a secured approval of an amendment to the existing site plan(S-01-235),
or by a new entitlement authorizing the creation of a commercial planned development on the parcel map site
to reflect the proposed parcel lines and modifications as listed in the Conditions of Approval dated, January 6,
2003. Staff has reviewed the proposed design and improvements of Tentative Parcel Map 2002-28 and has
determined that the map is consistent with adopted plans and policies as described below.
Please review the following required findings for determination of consistency for the tentative parcel map.
Upon your determination that the required findings can be made,the applicant will be notified to the conditions
of approval of Tentative Parcel Map No. 2002-28.
REQUIRED FINDINGS
California Environmental Ouality Act(CEOA) -The California Environmental Quality Act(Public Resources
Code Section 21000 et seq.)and the State EIR Guidelines, Section 15061 (Review for Exemptions),permit a
public agency to determine whether a particular project is exempt from CEQA. If a public agency finds that
the activity is covered by the general rule that CEQA applies only to projects which have the potential for
causing a significant effect on the environment and it can be seen with certainty that there is no possibility that
the activity in question may have a significant effect on the environment,the activity is not subject to CEQA
and a Notice of Exemption may be issued. -

A determination of a Class 15 Categorical Exemption(Section 15315/minor land division of 4 or fewer
parcels) from CEQA was made and Environmental Assessment No. TPM 2002-28 (Categorical Exemption)
was completed for this project and issued on January 9, 2003 and filed with the Fresno City Clerk on January 9,
2003.
STATE SUBDIVISION MAP ACT-The Subdivision Map Act(California Government Code Section 66410 et.
seq.) requires that a proposed parcel map not be approved unless the map,together with its design and
improvement, is found to be consistent with the General Plan and any applicable specific plan(Finding No. 1
below). State law further provides that the proposed parcel map be denied approval if any one of the Finding
Nos.2-5, below, is made in the negative.
1. The proposed parcel map,together with its design and improvements is consistent with the City's
General Plan and any applicable specific plan, because the Woodward Park Community Plan
designates the site for Commercial Office land use.
2. The site is physically suitable for the proposed type and density of development because of the flat
terrain of the site and adequate access and drainage on and off the site.
3. The proposed parcel map design and improvements are not likely to cause substantial and considerable
damage to the natural environment, including fish, wildlife or their habitat,because of the urbanized
nature of the area in which the site is located.
4. The proposed parcel map design and improvements are not likely to cause serious public health and
safety problems,because the conditions of approval have shown and will insure that the subdivision
conforms with City health and safety standards.
5. The proposed parcel map design will not conflict with public easements within or through the site
because conditions of approval will assure noninterference with any existing or proposed public
easements.
Staff,based on its own analysis,has determined that the parcel map, subject to the recommended conditions of
approval, otherwise complies with the design and property development standards of the Zoning Ordinance and
local Parcel Map Ordinance and recommends the approval of the parcel map.
DIRECTOR DETERMINATION
1. Based upon the above analysis, the Development Director finds that Tentative Parcel Map No. 2002-28
is consistent with the applicable plans and policies of the City of Fresno.
2. The Development Director hereb grant oval of Parcel Map No.2002-28 dated December 12,
2002, subject to the conditions o prow ed January 6, 2003, and to become effective on January
13, 2003.

contribution resulting from this project has been estimated at 3,013 gallons per day.
WATER SERVICE
In compliance with the Woodward Park Community Plan Verification and Monitoring Procedure for
Water Service, it has been determined that an adequate source of potable water is available to meet
City, State, and Federal standards during periods of peak flow in the City water system serving the
Woodward Park Community Plan area for this project including existing demand and all other
approved development. The projected peak water demand resulting from this project has been
estimated at 22 gallons per minute.
This document is a determination of capacity available in the sanitary sewer and water systems.
Conditions or requirements imposed as a result of this finding are in addition to all other requirements
set forth. This project shall further comply with applicable provisions of the City ordinance, adopted
standards, and policies for extension and connection to the iewer and water systems.

6. The Federal Clean Water Act and the State General Permits for Storm Water Discharges
Associated with Construction and Industrial Activities (State General Permits) require developers 104
of construction projects disturbing five or more acres, and discharges associated with industrial IV
activity not otherwise exempt from National Pollutant Discharge Elimination System (NPDES)
permitting, to implement controls to reduce pollutants, prohibit the discharge of waters other than
storm water to the municipal storm drain system, and meet water quality standards. These
requirements apply both to pollutants generated during construction, and to those which may be
generated by operations at the development after construction.

State General Permit for Storm Water Discharges Associated with Construction
Activities, approved August 1999, (modified December 2002.) A State General
Construction Permit is required for all clearing, grading, and disturbances to the ground
that result in soil disturbance of at least one acre (or less than one acre if part of a larger
common plan of development or sale). Permittees are required to: submit a Notice of
Intent to be covered and must pay a permit fee to the State Water Resources Control Z
Board (State Board), develop and implement a storm water pollution prevention plan,
eliminate non-storm water discharges, conduct routine site inspections, train employees 0
in permit compliance, and complete an annual certification of compliance. ■

April, 1997 (available at the District Office.) A State General Industrial Permit is
required for specific types of industries described in the NPDES regulations or by
Standard Industrial Classification (SIC) code. The following categories of industries
are generally required to secure an industrial permit: manufacturing; trucking; O
recycling; and waste and hazardous waste management. Specific exemptions exist for
manufacturing activities which occur entirely indoors. Permittees are required to:
submit a Notice of Intent to be covered and must pay a permit fee to the State Water cp
Resources Control Board, develop and implement a storm water pollution prevention
plan, eliminate non-storm water discharges, conduct routine site inspections, train OT
employees in permit compliance, sample storm water runoff and test it for pollutant

C. The proposed development is encouraged to select and implement storm water quality
controls recommended in the Fresno-Clovis Storm Water Quality Management
Construction and Post-Construction Guidelines (available at the District Office)to

contact with materials which may contaminate storm water runoff.
7. A requirement of the District may be appealed by filing a written notice of appeal with the

FLOOD PLAIN POLICY
Primary Flood Plains
Because of the relatively high velocities and volumes of flood flow associated with primary flood
plains, and because the primary flood plain is responsible for passing the greatest percentage of the
flood event,development located in such flood plains is subject to substantial risk,both to itself and
to others as a result of the potential for blockage and diversion of flood waters. In view of these
factors, the following policy statement is proposed:
Policy 1) All proposed development activity shall be the subject of a detailed
hydrological flood hazard investigation to determine the relationship of the
proposed development to the secondary flood plain and the primary flood
plain; and,further,to identify the estimated high water elevation of the 100-
year flood event.
2) All development and/or permanent improvement activity which, if located
within the primary floodway, may unduly impede, retard, or change the
direction of flow of water either,by itself,or by the catching or collecting of
other debris or is placed where the flow of water would carry such
obstruction downstream to the damage or detriment of either life or property,
should not be permitted.
Secondary Flood Plains
Because development within secondary flood plains is subject to inundation,but without the threat of
increased velocities of flood waters, and because the excessive development of the secondary flood
plain can result in increased water surface elevations through displacement of flood waters, the
following policy statement is suggested:
Policy 1) Development in secondary flood plains is generally acceptable when a
detailed hydrological flood hazard investigation report had been prepared
indicating that the area proposed for development is located within a
secondary as opposed to a primary flood plain.
2) The development must be properly flood proofed below the estimated high
water elevation of the 100-year flood event.
3) The development is accomplished is such a way as to prohibit the
displacement of any and all flood waters from that portion of the flood plain
to be developed.

Parcels `B" and "D" are required to grant drainage covenants for Parcels "A" and "C" to allow
surface runoff to reach the Master Plan inlet located at the intersection of Jackson and Maple
Avenues.
Our records indicate that there is not continuous existing curb and gutter to convey runoff to the
Master Plan inlet located at the intersection of Jackson and Maple Avenues, as shown on Exhibit
No. 1. The Developer shall be required to provide documentation and/or improvements satisfactory
