The City of Fresno Planning Division has completed its review of the subject map. Pursuant.
to FMC Section 12-1205(c), this letter is written to advise that the conditions of approval are
as noted on the attached'document, dated September 30, 2002.
If you have any questions regarding the conditions you must notify either Louis Rocha or
Robert Lewis at 621-8277 no later than September 4, 2002, to request a review of the
conditions. Otherwise, the stipulated conditions of approval are in effect as of that date. No
further notice will be sent.
Anneal: The divider or Any aggrieved person may file an appeal regarding to conditions of
approval within fifteen (15) days from the date of approval.
To protest the Director's decision regarding the conditions of approval, you must appeal by
filing a written appeal with the Director of the Development Department. Appeal must
include the appellant's interest in/or relationship to the subject property, the decision or
action appealed, and specific reasons why the appellant believes the decision or action
appealed from should not be upheld
Appeals must be submitted to the Director of the Development Department prior to 5 p.m.
on October 16, 2002.

EXPIRATION: The approval or conditional approval of this tentative Parcel Map expires
two years from the date of approval. The expiration shall terminate all proceedings and a
final Parcel Map may not be filed without first processing a new Tentative Parcel Map.
Modification of a Tentative Parcel Map after approval or conditional approval does not
extend the two year time'limit.
EXTENSION: The divider may request an extension of the tentative map expiration date by
filing a written application together with the fee set forth in the Master Fee Schedule at the
time of the request with the Director of the Development Department at least thirty days
before the expiration date of the map. The applicant must state the reasons for the requesting
the extension. New conditions may be imposed if an extension is granted.
An extension may not exceed an aggregate of five years.

VESTING TENTATIVE PARCEL MAP NO. 2002-16
The City of Fresno Development Department has completed a review of the subject tentative parcel
map in accordance with the�State Subdivision Map Act and the Fresno Municipal Code.
The conditions of approval for Vesting Tentative Parcel Map No. 2002-16 are as follows:

imposition of fees, dedications, reservations or exactions for this project are subject
to protest by the project applicant at the time of approval or conditional approval.

I.- Legal Status of Site to be Subdivided
A. The parcel map site, was legally created as Parcel E of Parcel Map No. 84-27.
II. Zoning

A. Proposed parcels must consistent with the approved C-6 zoned heavy strip commercial
district for the parcel map site in terms of lot width, depth and area subject to approval
of a special permit for a planned development project. All parcels must approved access
to a public street or right-of-way under a planned development special permit.
Modification of Property Development Standards/Planned Unit Development
B. The proposed subdivision requires the modification of the C-6 zone district property
development;standards in that is proposes the creation of parcels within an approved
commercial planned development which have reduced lot sizes and do not have abut a
public street or right-of-way. Such standards and access may be accomplished by
compliance with condition(s)below.

C. If not already obtained, secure approval of an amendment to Site Plan Review
No. S-01-99 or a new entitlement authorizing the creation of an commercial planned
development,on the parcel map site to reflect the proposed parcel lines and

modifications.
D. The placement of a parcel line in close proximity to any existing and/or proposed
structure requires the structures be found in compliance with the fire resistive standards
of the Uniform Building Code, Chapter 5. In the event the structures do not comply
they must be modified so as to meet the requirement.
The proposed structure(s) on the site may be affected due to the location of the
proposed parcel line. Compliance with the prevailing Uniform Building Code as it
relates to the exterior wall protection, allowable area, etc. (as applicable to new parcel
line locations) must be demonstrated prior to final map submittal. Contact Development
Department, Building and Safety Services at 621-8200.
E. Submit draft copies of Covenants, Conditions and Restrictions/Owners Association
documents (CC &R's) for review and approval. Final, executed and notarized
documents are to be recorded with the parcel map. CC & R's shall conform with the
provisions of Section 12-1026 FMC and address ingress, egress, sewer and water
service, maintenance, and access, fire protection, solid waste service, storm drainage,
parking and landscaping.
III. Plan Consistency
A. The Hoover Community Plan designates the parcel map site for development with heavy
strip commercial land uses. The Zoning District Consistency Table of the Fresno
Municipal Code identifies community commercial uses as consistent with the approved
C-6 zone district.
IV. On-Site Requirements
A. Fresno Metropolitan Flood Control District requirements:
Comply with Flood Control.memo dated September 9, 2002.
B. Fresno Irrigation District:
No requirements.
C. Easements: The location, type, size, and record information of easements on and through
the site must be shown on the final map.

use. It is the owner's responsibility to provide P.G. & E. with adequate rights-of-
way satisfactory to P.G. &E. If the property owner needs P.G. & E. to help
assist in making the determination if an easement will be necessary, the property
owner or their agent may contact the Scott Combs, Land Agent, Fresno Land
Rights Office at 263-7375.
The developer/owner will be responsible for the costs associated with any
removal or relocation of existing facilities on the property.
2. Provide the necessary private sewer easements to provide for sewer service to
each parcel created.
3. Provide approved easements and/or covenants for cross access between parcels
(minimum of two for each parcel) for fire protection access. Provide approved
easements and/or covenant for shared fire hydrant use between all parcels.
V. Off-Site Improvement Requirements
A. Street Improvements
• East Magill Avenue. Within the limits of the subject property the curb and
gutter are existing. The developer shall repair or replace any damaged concrete
curb, gutter or off-site improvements to Public Works Standards. Additional off-
site concrete improvements may be required at the time of site plan review.
• North Effie Avenue. Within the limits of the subject property the curb and
gutter are existing. The developer shall repair or replace any damaged concrete
curb, gutter or other off-site improvements to Public Works Standards.
Additional off-site concrete improvements may be required at the time of site
plan review.
B. Sanitary Sewer System
The subject site is located within the Pinedale'Public Utility District sewer service area.
Service connection requirements shall be by Pinedale Public Utility District. If parcels
are proposed to be served by a private onsite sewer system, C C &Rs and reciprocal
access and maintenance easements must be provided. In addition, an engineered onsite
utility plan showing the proposed outfall to the public sewer system must be submitted to
the City for review and approval.

The subject site is located within the Pinedale Public Utility District water service area.
Service connection requirements shall be by Pinedale Public Utility District. If parcels
are proposed to be served by a private onsite water system, C C & Rs and reciprocal

utility plan showing the proposed outfall to the public sewer system must be submitted to
the City for review and approval.
D. Parks, Recreation and Community Services
1. Comply with the Parks requirements for Site Plan Review No. S-01-99.

F. Fresno Unified School District
1. This project is subject to school development fee in accordance with the Fresno
Unified School District adopted fee standard.
VII. GENERAL PUBLIC WORKS REQUIREMENTS
A. DEDICATIONS. The subdivider shall dedicate public easements to facilitate the
construction of curbs, gutters, sidewalk, bus bays, right turn lanes, bike lanes, bike paths,
multi-purpose trail, wheelchair ramps and public utilities in accordance with City plans,
ordinances, resolutions and policies, the Standard Specifications of the Public Works
Department within the limits of the parcel map. Additionally, a minimum 4 foot wide
clear path of travel is required along the public sidewalk on all frontages of the property
as required by Title 24 of the California Administration Code as determined by the City
Engineer. An on-site pedestrian easement and construction of a path may be required if
Title 24 provisions can not be met within the public rights of way. All such public
easements shall be identified and dedicated with the processing and recordation of the
Parcel Map or at the time of Special Permit reviews for the proposed development of the
parcels.
B. STREET HAPROVEMENTS. The subdivider shall construct curb, gutters, curb
returns and landings, wheelchair ramps, sidewalks with street tree wells and irrigation
systems (when applicable), permanent pavement, street/safety lighting, bike lanes, bike
paths, multi-purpose trail, walls and fences in accordance with City plans, ordinances,
resolutions, policies and the Standard Specifications of the Public Works Department
within the limits of the parcel map.

Existing improvements that are not to the planned alignment shall be removed and
required improvements installed to the new street alignment and grade. Existing
improvements to remain in place shall be repaired if determined to be damaged and/or off
grade by the City Engineer. Existing driveway approaches not identified for current or
future utilization shall be removed and sidewalk(when applicable), curb and gutter shall
be installed to match existing or proposed street line and grade as determined by the City
Engineer.
C. SANITARY SEWER SYSTEM. The subdivider shall connect each parcel being
created to the City of Fresno's sanitary sewer system with a separate sewer house branch
unless other arrangements are approved by the City Engineer. All sanitary sewer system
improvements shall be constructed in accordance with City plans, ordinances,
resolutions, policies and the Standard'Specifications of the Public Works Department.
The subdivider is required to construct sewer main extensions to serve the parcel map in
a manner determined by the City Engineer. The connection to the City's sanitary sewer
system requires the payment of all applicable sewer connection charges in accordance
with the provisions of FMC Chapter 9, Article 5 prior to the approval of the map.
D. WATER SYSTEM. The subdivider shall connect each parcel being created to the City
of Fresno's water system with a separate water services and meters unless other
arrangements are approved by the City Engineer. All water system improvements shall
be constructed in accordance with City plans, ordinances, resolutions, policies and the
Standard Specifications of the Public Works Department. The subdivider is required to
construct water main extensions to serve the parcel map in a manner determined by the
City Engineer. The connection to the City's sanitary sewer system requires the payment
of all applicable water connection charges in accordance with the provisions of FMC
Chapter 14„ Article 1 prior to the approval of the map
E. STREET, SEWER AND WATER CONSTRUCTION PLANS. The subdivider shall
provide street, sewer and water construction plans for the required public improvements
as determined by the City Engineer. Such plans shall be prepared by a registered Civil
Engineer and approved by the City Engineer prior to the issuance of Street Work
permits.
F. CONSTRUCTION/DEFERRAL. The subdivider shall construct the street, sanitary
sewer system and water system improvements required for this parcel map, and the work
deemed completed by acceptance of the work by the City Engineer, prior to the approval
and recordation of the Parcel Map.
` Alternatively, the subdivider may request the deferral of the construction of such
improvements with a parcel map agreement. The City Engineer may approve such.
agreement wherein the subdivider will be required to provide an Engineer's Estimate of

the work. The agreement will be prepared by the City and will require performance
securities as determined by the City Engineer.
VI. Development Fees
All fees noted in this section shall be due and payable to the City of Fresno prior to the approval
of the final parcel map. All fee quotations are based on current rates. Applicant shall pay the
fee in effect at the time of final map approval.

The proposed development will generate storm runoff which produces potentially significant
environmental impacts and which must be properly discharged and mitigated pursuant to the Z
California Environmental Quality Act and the�INational Environmental Policy Act. The District O

6. The Federal Clean Water Act and the State General Permits for Storm Water Discharges
Associated with Construction and Industrial Activities (State General Permits) require
developers of construction projects disturbing five or more acres, and discharges associated
with industrial activity not otherwise exempt from National Pollutant Discharge Elimination
System (NPDES)permitting, to implement controls to reduce pollutants, prohibit the
discharge of waters other than storm water to the municipal storm drain system, and meet water
quality standards. These requirements apply both to pollutants generated during construction,
and to those which may be generated by operations at the development after construction.
a. State General Permit for Storm Water Discharges Associated with Construction
Activities, August 1999 (available at the District Office.) A State General
Construction Permit is required for all clearing, grading, and disturbances to the
ground that result in soil disturbance of at least five acres (or less than five acres
if part of a larger common plan of development or sale). Permittees are required
to: submit a Notice of Intent to be covered and must pay a permit fee to the
State Water Resources Control Board(State Board), develop and implement a Z
storm water pollution prevention pl#n,eliminate non-storm water discharges, O
conduct routine site inspections,train employees in permit compliance, and
complete an annual certification of compliance.
Under the Phase 11 federal storm water quality regulations a State General
Construction Storm Water Permit will be required for all activities that disturb
one acre no later than March,2003.
b. State General Permit for Storm Water Discharges Associated with Industrial O
Activities, April, 1997 (available at the District Office.) A State General
Industrial Permit is required for specific types of industries described in the
NPDES regulations or by Standard Industrial Classification(SIC)code. The
following categories of industries are generally required to secure an industrial O
permit: manufacturing; trucking; recycling; and waste and hazardous waste
management. Specific exemptions exist for manufacturing activities which M&
occur entirely indoors. Permittees are required to: submit a Notice of Intent to
be covered and must pay a permit fee to the State Water Resources Control
Board, develop and implement a storm water pollution prevention plan,
eliminate non-storm water discharges,conduct routine site inspections, train
employees in permit compliance, sample storm water runoff and test it for
pollutant indicators, and annually submit a report to the State Board.

OTHER REQUIREMENTS

The following paragraphs only apply towards development of the individual parcels and are not
conditions for the recording of the map.
In an effort to improve storm water runoff quality, outdoor storage areas shall be
constructed and maintained such that material which generates contaminants will not be
conveyed by runoff into the storm drain system.
The District encourages, but does not require that roof drains from non-residential
development be constructed such that they are directed onto and through a landscaped
grassy swale area to filter out pollutants from roof runoff.
Runoff from areas where industrial activities,product,or merchandise come into contact
with and may contaminate storm water must be directed through landscaped areas or
otherwise treated before discharging it off-site or into a storm drain. Roofs covering
such areas are recommended. Cleaning`of such areas by sweeping instead of washing is
to be required unless such wash water'Gan be directed to the sanitary sewer system.
Storm drains receiving untreated runoff from such areas that directly connect to the
District's system will not be permitted. Loading docks, depressed areas, and areas
servicing or fueling vehicles are specifically subject to these requirements. The
District's policy governing said industrial site NPDES program requirements are
attached.

outlot for common.area on a .83 acre, C-6 zoned parcel.
This project is exempt under Section 15315 of the State of CEQA Guidelines.
Explanation: This project is a Class 15 exemption which consist of a djAsion of
property in urbanized area zoned for residential use into four or fewer
parcels and is in conformance with the.General.Plan and the zoning, no
variances or exceptions are required, all services and access to the
proposed parcels to local standards are available, the parcel was not
involved in a division of a larger parcel within the previous two years,
and the parcel does not have an average slope greater than 20 percent.

6. Verification by Construction Management that the durable monuments have been-set.
In accordance with Section 66497 of the Subdivision Map Act, the City must receive evidence
of payment to the engineer or surveyor for the setting of final monuments prior to final map
approval. In the event of the deferment of the setting of interior corners by secured agreement,
evidence of payment to the engineer or surveyor must be received prior to the release of such
agreement and security.

signs and their uses, trees, walls, driveways, outdoor storage, and open land use areas on the
subject property and all of the preceding which are located on adjoining property and may

2. All public and private easements,rights-of-way and any actual or potential prescriptive easements

3. Existing and proposedgrade differentials between the subject property and adjoining property

Approval of this special permit may become null and void in the event that development is not

NOTICE TO PROJECT APPLICANT
In accordance with the provisions of government Code Section 66020(d)(1), the imposition of fees,
dedication, reservations or exactions for this project are subject to protest by the project applicant at the
time of approval or conditional approval of the development or within 90 days after the date of the
imposition of the fees, dedications, reservation or exactions imposed on the development project.
This notice does not apply to those fees, dedications, reservations or exactions which were previously
imposed and duly noticed; or, where no notice was previously required under the provisions of
Government Code Section 66020(d)(1) in effect before January 1, 1997.
PART C -PUBLIC IMPROVEMENT & PARKING LOT REQUIREMENTS
The following requirements are based on City records and the accuracy of the existing and proposed on-site
and off-site conditions depicted on the exhibits submitted by the applicant. Requirements which may not
have been addressed due to omission or misrepresentation of information, for which this review process
is dependent,will be imposed whenever such conditions are discovered.

1. STREET ENCROACHMENT PERMITS, DEDICATIONS AND VACATIONS
A. Exhibit"A" is required to include the location of all street furniture,e.g.:public utility poles and
boxes, guy wires, signs, fire hydrants, bus stop benches, mail boxes, news stands, trash
receptacles, tree wells,etc.,within the existing and proposed public rights of way.
a. A minimum 4 foot wide path of travel is required along the public sidewalk on all frontages
of the property as required.by Title 24 of the California Administration Code. An on-site
pedestrian easement and construction of a path may be required if Title 24 requirements can
not be met within the existing public rights of way.
B. ENCROACHMENT PERMITS. The construction of any overhead,surface or sub-surface private
structures and appurtenances extending within the public rights-of-way is prohibited unless an
encroachment permit is approved by the City Engineer. For encroachment permit information,
contact the Public Works Department, Engineering Services Division (David Coker) at (559)
498-4742. Encroachment permits must be approved prior to the issuance of building permits.

C. DEDICATIONS. The following dedication requirements must be satisfied prior to the issuance
of building permits:
a. Magill Avenue Dedicate'a pedestrian easement behind the driveway approach to provide
for a 4' wide unobstructed path.
b. DEED PROCESSING (Informational) Deed documents for the required dedications shall
be prepared by the applicant's engineer and submitted to Public Works Department,
Engineering Services Division with verification of ownership. The cost of deed document
preparation shall be at the expense of the applicant; a deed review processing and
recordation fee must be paid at the time of deed submittal. Deed documents must conform
to the format specified by the City. Document format specifications may be obtained from
the Public Works Department,Engineering Services Division(Chad Phillips)at(559)498-
4737.
C. VACATIONS. The vacation of the following easements shall be satisfied prior to the issuance of
building permits:
a. No vacations required at this time.
2. STREET IMPROVEMENTS
A. STREET WORK PERMIT.. The performance of any work within the public street rights-of-way
(including pedestrian,water and sewer utility easements)requires a Street Work Permit issued by
the Public Works Department, Engineering Services Division(GaryWitzel)at(559)498-4740,
prior to commencement of the work. All required street improvements must be completed and
accepted.by the City mior to final occupancy.
B. The property shall be improved in accordance with the provisions of FMC Section 11-208. All
public street improvements shall be constructed in accordance with the Standard Specifications
of the City of Fresno, Public Works Department and the engineered street construction plans
required and approved by the City Engineer. The final corrected exhibit(Exhibit A) shall
incorporate all required'dedications, parking lot geometries and improvements required as
conditions of approval for the development.
C. Install permanent paving, paving transitions, concrete curb, gutter, sidewalk and driveway
approaches, street tree wells and irrigation, bike paths, bus bays, right turn lanes, etc. as
determined by the City Engineer on all street frontages. Wheelchair ramps shall be installed at
all curb returns. Additional requirements are noted on Exhibit A.
D. STREET CONSTRUCTION PLANS. Street construction plans, prepared by a registered Civil
Engineer and approved by the Cite Engineer,are required unless otherwise determined by the City
Engineer. Plans must be submitted to the Public Works Department, 'Engineering Services
Division, Utility Design Section(559)498-1401.

E Driveway approaches less than 8' in depth(refer to Public Works Department Standard Drawing
Nos. P-2 and P-3 for details)requires the installation of a concrete pedestrian walkway behind the
driveway approaches to provide a 4' wide clear path. Asphalt concrete paving per Public Works
Standard Drawing No. P-34 may be Substituted for concrete. A pedestrian easement is required
for the path area located outside the public street easement.
F. Install street lights on all frontages to City Subdivision Standards as determined by the City
Traffic Engineer. Street lighting plans are required and must be approved by the Public Works
Department, Traffic Engineering Division (559)498-1436 prior to commencement of the work.
G. Existing concrete improvements to remain in place shall be repaired if damaged and/or off grade
as determined by the Public Works Department, Construction Management Division(559)498-
1451. Such repairs must be completed prior to final occupancy.
H. Remove all existing driveway approaches not identified for utilization and install sidewalk, curb
and gutter to match existing or proposed street improvement line and grade.
3. WATER AND SEWER SERVICE REQUIREMENTS AND CONNECTION CHARGES
A. This project is located outside the City of Fresno's sewer service area. Sewer service shall be
provided by Pinedale County Water District.

buildings. All transformers,etc., shall be shown on the site plan. The backflow device shall be
screened by landscaping or such other means as may be approved.(Put this note on the site plan.)
C. Provide a minimum of 10 medium sized trees on-site per the following:
Provide one medium size tree for every two parking spaces. (This requirement may be modified
by the director if the standards for shading and perimeter planting have been met.)
Disperse trees over the parking lot area to provide 50 percent shading of the parking area surface
within 15 years. (This requirement may be reduced to 40 percent for existing development if it
is demonstrated that the constraints of an existing site would make it impossible to meet the
normal standards.)Trees shall also be planted in the required landscaped area along the periphery
of the development in order to shade and enhance adjacent property and public rights-of-way.
Refer to the attached "Performance Standards for Parking Lot Shading," for the tree list and
further details.
NOTE: One medium sized tree is defined as attaining a height of 30-60 feet at maturity. Two
small trees, up to 30-feet high at maturity may be substituted for one medium sized
tree.
VD. Trees shall.be maintained in good health. However,trees may not be trimmed or pruned to reduce
the natural height or overall crown of the tree, except as necessary for the health of the tree and
public safety; or as may otherwise be approved by the Development Department. (Put this note

4. FENCES,HEDGES,AND WALLS

be adequately secured and constructed to prevent overturning due to wind, vandalism, and/or
casual contact by the general public. The construction shall be performed in such a manner as to
minimize any potential safety hazardwhich may occur as a result of improper fence installation

B. Provide a six-foot high solid masonry wall, or an approved equivalent, along the west property
line(s) at finished grade of proposed site. Reduce the required wall to a maximum of three feet

5. OFF-STREET PARKING

✓ A. Provide a 6-foot solid masonry wall with gates around trash enclosures. The trash enclosure area
may not be located in a required setback area. For each bin the enclosure must be a minimum
8 feet X 10 feet (inside dimensions) concrete pad with a 6-foot high concrete block wall. Each
bin enclosure shall have 6-inch high wheel stops on the ground 18 inches from the rear wall and
12 inches from the side walls. Gate hinges shall be hung on the outside. The enclosure shall be
level with the adjoining roadway (with no ramps, slopes, etc.)
B. Trash and recycling enclosures shall be relocated to the north property line as depicted on the site
plan. Contact Solid Waste Management Division, Public Works Department at 559-498-1455,
between 8 a.m. and 9 a.m. regarding this issue.
3. STREET TREE REQUIREMENTS

conducted by a paleontologist and, if the paleontologist determines the material to be
significant, it shall be preserved.
All discretionary conditions of approval will ultimately be deemed mandatory unless appealed
in writing to the Development Department Director within 15 days.

If permanent street lighting is required, the developer shall have plans prepared and

Off-Site Concrete Work
In situations where sidewalks are to be constructed in a solid pattern, tree wells may be
required. When required, construct tree wells at locations indicated on the exhibit
map. Place a one-inch (1") concrete cap over the well for future tree planting.
Remove any abandoned driveway approaches and driveways and reconstruct the
sidewalk, curb and gutter across the opening. Match the existing improvements.
Repair any existing broken or off-grade, off-site concrete. (Construction Management
Division of the Public Works Department will determine required repair.)

If a sewer main extension is required, submit engineered sewer construction plans to

6. The Federal Clean Water Act and the State General Permits for Storm Water Discharges
Associated with Construction and Industrial Activities(State General Permits) require
developers of construction projects disturbing five or more acres, and discharges associated
with industrial activity not otherwise exempt from National Pollutant Discharge Elimination
System (NPDES) permitting, to implement controls to reduce pollutants, prohibit the
discharge of waters other than storm water to the municipal storm drain system, and meet water
quality standards. These requirements apply both to pollutants generated during construction,
and to those which may be generated by operations at the development after construction.
a. State General Permit for Storm Water Discharges Associated with Construction
Activities, August 1999 (available at the District Office.) A State General
Construction Permit is required for all clearing, grading, and disturbances to the
ground that result in soil disturbance of at least five acres (or less than five acres
if part of a larger common plan of development or sale). Permittees are required
to: submit a Notice of Intent to be covered and must pay a permit fee to the
State Water Resources Control Board(State Board), develop and implement a
storm water pollution prevention plan, eliminate non-storm water discharges,
conduct routine site inspections, train employees in permit compliance, and
complete an annual certification of compliance.
Under the Phase II federal storm water quality regulations a State General
Construction Storm Water Permit will be required for all activities that disturb
one acre no later than November, 2003. Z

Industrial Permit is required for specific types of industries described in the

quality controls recommended in the Fresno-Clovis Storm Water Quality

We have established a process of reviewing commercial, multi-dwelling, and
similar-use construction site plans to ensure that they conform to the Fresno
Municipal Code and the State of California Solid Waste Management Board
Regulations, (Administrative Code Division 7)pertaining to container
placement and design requirements.
Fresno Municipal Code Article, Section 9-404 (d) (3): "Containers
used at all places not served from alleys shall be placed for collection
at service locations approved by the Public Works Director, but shall
not be stored in the public right-of-way.

Design Requirements- "The design of any new, substantially
remodeled or expanded building or other facility shall provide for
proper storage or handling which will accommodate the solid waste
loading anticipated, and which will allow for efficient and safe waste

yards in capacity, a storage area with inner diminsions 10 ten feet
by 10 feet is sufficient. There should be wheel stops (12) twelve
inches from sidewalls and (18) eighteen inches from rear wall and at
a height of(8) eight inches. These features are included in order to
reduce the possibility of damage to the enclosure itself.
3. Service access to enclosure shall be an unencumbered opening of(7
seven feet. The gate to be used, shall be built so that bins cannot be
seen when gates are closed and shall be mounted on the outer surface
of enclosure as not to protrude into service access opening. Hardware
latches should be a heavy gauge locking gate latch: NO SLIDE
BOLTS.
4. The floor or bottom surface of the collection area shall be made of
concrete, (SLOPED) to the surrounding area with no incline, or no
drainage gutter in front of entrance. It shall be constructed so the
collection vehicle can drive directly into the pockets of the containers.
S. Ingress and egress shall have an unobstructed overhead-clearance of
(16) sixteen feet and shall be not less than (18).eighteen,feet wide
and._capable of accommodating a truck with a (250) two,hundred
fifty inch wheelbase, a (44) forty four foot turning radius and a
weight of(27) twenty sevewtons. Area shall be unobstructed and so
configured that a truck will be able to make a round trip from the
public right-of-way to the collection;area and return without excessive

STAFF ANALYSIS
The applicant is requesting authorization to construct a 15,190 square foot building.The applicant
has not identified any specific uses for the project. The proposed elevations indicate that the
building will have a stucco finish with a metal fascia, storefront doors, and overhead coil doors.
The overhead coil doors are 10 feet wide by 14 feet in height indicating that a vehicle could be
driven into the building.

The plans indicate a 10 foot landscape stripe along Magill Avenue and 20 feet along Effie
Avenue. The area east of Effie Avenue is residential and the landscaping will provide a good
buffer between the uses. To further mitigate the commercial from the residential the applicant has
indicated that there will be no doors or windows facing Effie Avenue. A five foot landscape
stripe is being proposed on the north side of the building and in the parking area.
The parking requirement for this project is 1 square foot of parking for every square foot of
building. The proposed building is 15,190 square feet in size. The applicant is providing 11,195
square feet of parking. To comply with the parking requirements a covenant for cross access and
parking has been recorded with the adjacent property, the Red Roof Inn. This will provide
sufficient parking for the proposed project since the hotel has limited use of the parking lot during
the day. A cross access driveway adjoining both properties has being proposed.
This is a spec building with no specific uses therefore, the uses could range from an office to a
repair garage. To mitigate any potential problems that could adversely effect the residential
neighborhood and the motel.the following conditions are being required:
• All exterior lighting shall be hooded away from the residential neighborhood and
motel.
• All landscaping and irrigation shall be completed prior to issuance of a certificate
of occupancy.
• All work shall be conducted in the building.
• No equipment or other materials shall be stored or displayed outside the building.
• Vehicles left over night shall be stored in the building.
• No work shall be conducted between the hours of 8:00 p. m. and 7:00 a. m.
The project has been routed to the necessary departments including Traffic, Solid Waste, Fire,
Parks,Flood Control, and the Fresno Irrigation District. As a result,their conditions of approval
are included in the attached Special Permit Conditions of Approval document.

completed within the 14 days for which clearance was obtained for approved locations. Holes
shall be 2 feet in diameter and drilled to a depth where visual evidence of the subsurface sand or
gravel drainage stratum is apparent;the drainage hole shall be drilled to a minimum of 10 feet
deep. Immediately following drilling,the hole shall be backfilled with soil drilled jfrom the hole,
using sufficient water to thoroughly saturate the backfill material. Immediately following
backfilling,the white spot designating the planting site is painted black to indicate the site has
been drilled. The drilled sites are barricaded and checked daily for 5 working days for soil
settling. Soil levels are adjusted as necessary during this time. After 7 days,the',barricades and
excess soil are removed. Soil shall be allowed to settle for a minimum of 20 days prior to
planting

MEDIAN ISLANDS:
5. Median island landscaping is required per FMC section 12-306-N-24. However, a review of the
City's aerial photo's verifies that no median island is constructed fronting the project boundaries and no
further planting or in lieu of fees shall be required.. Should a new median be required by the Traffic
Division, median island landscaping shall be required per FMC.

time payment is due(current rate is$28 per tree,#34859,Fund#63548,Org#179900)(for tree
plantings by private party)or in this fiscal year a total of$140.00.
MEDIAN ISLAND FEES:
The$44.00 median island site plan review fee is waived because median island conditions were
verified with the City's aerial photos and no field inspection was conducted.
