Pursuant. to FMC Section 12-1205(c), this letter is written to advise that the conditions of approval are as noted on the attached'document, dated September 30, 2002. If you have any questions regarding the conditions you must notify either Louis Rocha or Robert Lewis at 621-8277 no later than September 4, 2002, to request a review of the conditions. Otherwise, the stipulated conditions of approval are in effect as of that date. No further notice will be sent. Anneal: The divider or Any aggrieved person may file an appeal regarding to conditions of approval within fifteen (15) days from the date of approval. To protest the Director's decision regarding the conditions of approval, you must appeal by filing a written appeal with the Director of the Development Department. The expiration shall terminate all proceedings and a final Parcel Map may not be filed without first processing a new Tentative Parcel Map. Modification of a Tentative Parcel Map after approval or conditional approval does not extend the two year time'limit. EXTENSION: The divider may request an extension of the tentative map expiration date by filing a written application together with the fee set forth in the Master Fee Schedule at the time of the request with the Director of the Development Department at least thirty days before the expiration date of the map. The applicant must state the reasons for the requesting the extension. New conditions may be imposed if an extension is granted. An extension may not exceed an aggregate of five years. The conditions of approval for Vesting Tentative Parcel Map No. 2002-16 are as follows: NOTICE TO PROJECT APPLICANT In accordance with the provisions of Government Code §66020(d)(1), the imposition of fees, dedications, reservations or exactions for this project are subject to protest by the project applicant at the time of approval or conditional approval. of the development or within 90 days after the date of the imposition of the fees, dedications,reservations or exactions imposed on the development project. I.- Legal Status of Site to be Subdivided A. The parcel map site, was legally created as Parcel E of Parcel Map No. 84-27. II. Zoning r A. Proposed parcels must consistent with the approved C-6 zoned heavy strip commercial district for the parcel map site in terms of lot width, depth and area subject to approval of a special permit for a planned development project. All parcels must approved access to a public street or right-of-way under a planned development special permit. Modification of Property Development Standards/Planned Unit Development B. The proposed subdivision requires the modification of the C-6 zone district property development;standards in that is proposes the creation of parcels within an approved commercial planned development which have reduced lot sizes and do not have abut a public street or right-of-way. Such standards and access may be accomplished by compliance with condition(s)below. } C. If not already obtained, secure approval of an amendment to Site Plan Review No. S-01-99 or a new entitlement authorizing the creation of an commercial planned development,on the parcel map site to reflect the proposed parcel lines and 1 !S Conditions of Approval Tentative Parcel Map No. 2002-16 Page 2 September 30, 2002 modifications. D. The placement of a parcel line in close proximity to any existing and/or proposed structure requires the structures be found in compliance with the fire resistive standards of the Uniform Building Code, Chapter 5. In the event the structures do not comply they must be modified so as to meet the requirement. The proposed structure(s) on the site may be affected due to the location of the proposed parcel line. Compliance with the prevailing Uniform Building Code as it relates to the exterior wall protection, allowable area, etc. (as applicable to new parcel line locations) must be demonstrated prior to final map submittal. Submit draft copies of Covenants, Conditions and Restrictions/Owners Association documents (CC &R's) for review and approval. Final, executed and notarized documents are to be recorded with the parcel map. CC & R's shall conform with the provisions of Section 12-1026 FMC and address ingress, egress, sewer and water service, maintenance, and access, fire protection, solid waste service, storm drainage, parking and landscaping. III. Plan Consistency A. The Hoover Community Plan designates the parcel map site for development with heavy strip commercial land uses. The Zoning District Consistency Table of the Fresno Municipal Code identifies community commercial uses as consistent with the approved C-6 zone district. IV. On-Site Requirements A. Fresno Metropolitan Flood Control District requirements: Comply with Flood Control.memo dated September 9, 2002. B. Fresno Irrigation District: No requirements. C. Easements: The location, type, size, and record information of easements on and through the site must be shown on the final map. A. Provide Public Utility Easements (PUE) which may be required for P. It is the owner's responsibility to provide P.G. & E. with adequate rights-of- way satisfactory to P.G. &E. If the property owner needs P.G. & E. to help assist in making the determination if an easement will be necessary, the property owner or their agent may contact the Scott Combs, Land Agent, Fresno Land Rights Office at 263-7375. The developer/owner will be responsible for the costs associated with any removal or relocation of existing facilities on the property. 2. Provide the necessary private sewer easements to provide for sewer service to each parcel created. 3. Provide approved easements and/or covenants for cross access between parcels (minimum of two for each parcel) for fire protection access. Provide approved easements and/or covenant for shared fire hydrant use between all parcels. V. Off-Site Improvement Requirements A. Street Improvements • East Magill Avenue. Within the limits of the subject property the curb and gutter are existing. The developer shall repair or replace any damaged concrete curb, gutter or off-site improvements to Public Works Standards. Additional off- site concrete improvements may be required at the time of site plan review. • North Effie Avenue. Within the limits of the subject property the curb and gutter are existing. The developer shall repair or replace any damaged concrete curb, gutter or other off-site improvements to Public Works Standards. Additional off-site concrete improvements may be required at the time of site plan review. B. Sanitary Sewer System The subject site is located within the Pinedale'Public Utility District sewer service area. Service connection requirements shall be by Pinedale Public Utility District. If parcels are proposed to be served by a private onsite sewer system, C C &Rs and reciprocal access and maintenance easements must be provided. In addition, an engineered onsite utility plan showing the proposed outfall to the public sewer system must be submitted to the City for review and approval. C. Water Service Conditions of Approval Tentative Parcel Map No. 2002-16 Page 4 September 30, 2002 The subject site is located within the Pinedale Public Utility District water service area. Service connection requirements shall be by Pinedale Public Utility District. If parcels are proposed to be served by a private onsite water system, C C & Rs and reciprocal access and maintenance easements must be provided. In addition, an engineered onsite utility plan showing the proposed outfall to the public sewer system must be submitted to the City for review and approval. D. Parks, Recreation and Community Services 1. Comply with the Parks requirements for Site Plan Review No. S-01-99. E. Fire Department No Requirements F. Fresno Unified School District 1. This project is subject to school development fee in accordance with the Fresno Unified School District adopted fee standard. VII. GENERAL PUBLIC WORKS REQUIREMENTS A. DEDICATIONS. The subdivider shall dedicate public easements to facilitate the construction of curbs, gutters, sidewalk, bus bays, right turn lanes, bike lanes, bike paths, multi-purpose trail, wheelchair ramps and public utilities in accordance with City plans, ordinances, resolutions and policies, the Standard Specifications of the Public Works Department within the limits of the parcel map. Additionally, a minimum 4 foot wide clear path of travel is required along the public sidewalk on all frontages of the property as required by Title 24 of the California Administration Code as determined by the City Engineer. An on-site pedestrian easement and construction of a path may be required if Title 24 provisions can not be met within the public rights of way. All such public easements shall be identified and dedicated with the processing and recordation of the Parcel Map or at the time of Special Permit reviews for the proposed development of the parcels. B. STREET HAPROVEMENTS. The subdivider shall construct curb, gutters, curb returns and landings, wheelchair ramps, sidewalks with street tree wells and irrigation systems (when applicable), permanent pavement, street/safety lighting, bike lanes, bike paths, multi-purpose trail, walls and fences in accordance with City plans, ordinances, resolutions, policies and the Standard Specifications of the Public Works Department within the limits of the parcel map. Conditions of Approval Tentative Parcel Map No. 2002-16 Page 5 September 30, 2002 Existing improvements that are not to the planned alignment shall be removed and required improvements installed to the new street alignment and grade. Existing improvements to remain in place shall be repaired if determined to be damaged and/or off grade by the City Engineer. Existing driveway approaches not identified for current or future utilization shall be removed and sidewalk(when applicable), curb and gutter shall be installed to match existing or proposed street line and grade as determined by the City Engineer. C. SANITARY SEWER SYSTEM. The subdivider shall connect each parcel being created to the City of Fresno's sanitary sewer system with a separate sewer house branch unless other arrangements are approved by the City Engineer. All sanitary sewer system improvements shall be constructed in accordance with City plans, ordinances, resolutions, policies and the Standard'Specifications of the Public Works Department. The subdivider is required to construct sewer main extensions to serve the parcel map in a manner determined by the City Engineer. The connection to the City's sanitary sewer system requires the payment of all applicable sewer connection charges in accordance with the provisions of FMC Chapter 9, Article 5 prior to the approval of the map. D. WATER SYSTEM. The subdivider shall connect each parcel being created to the City of Fresno's water system with a separate water services and meters unless other arrangements are approved by the City Engineer. All water system improvements shall be constructed in accordance with City plans, ordinances, resolutions, policies and the Standard Specifications of the Public Works Department. The subdivider is required to construct water main extensions to serve the parcel map in a manner determined by the City Engineer. The connection to the City's sanitary sewer system requires the payment of all applicable water connection charges in accordance with the provisions of FMC Chapter 14„ Article 1 prior to the approval of the map E. STREET, SEWER AND WATER CONSTRUCTION PLANS. The subdivider shall provide street, sewer and water construction plans for the required public improvements as determined by the City Engineer. Such plans shall be prepared by a registered Civil Engineer and approved by the City Engineer prior to the issuance of Street Work permits. F. CONSTRUCTION/DEFERRAL. The subdivider shall construct the street, sanitary sewer system and water system improvements required for this parcel map, and the work deemed completed by acceptance of the work by the City Engineer, prior to the approval and recordation of the Parcel Map. ` Alternatively, the subdivider may request the deferral of the construction of such improvements with a parcel map agreement. The City Engineer may approve such. agreement wherein the subdivider will be required to provide an Engineer's Estimate of irt Conditions of Approval Tentative Parcel Map No. 2002-16 Page 6 September 30, 2002 the work. The agreement will be prepared by the City and will require performance securities as determined by the City Engineer. VI. Development Fees All fees noted in this section shall be due and payable to the City of Fresno prior to the approval of the final parcel map. All fee quotations are based on current rates. The Federal Clean Water Act and the State General Permits for Storm Water Discharges Associated with Construction and Industrial Activities (State General Permits) require developers of construction projects disturbing five or more acres, and discharges associated with industrial activity not otherwise exempt from National Pollutant Discharge Elimination System (NPDES)permitting, to implement controls to reduce pollutants, prohibit the discharge of waters other than storm water to the municipal storm drain system, and meet water quality standards. These requirements apply both to pollutants generated during construction, and to those which may be generated by operations at the development after construction. a. State General Permit for Storm Water Discharges Associated with Construction Activities, August 1999 (available at the District Office.) A State General Construction Permit is required for all clearing, grading, and disturbances to the ground that result in soil disturbance of at least five acres (or less than five acres if part of a larger common plan of development or sale). Permittees are required to: submit a Notice of Intent to be covered and must pay a permit fee to the State Water Resources Control Board(State Board), develop and implement a Z storm water pollution prevention pl#n,eliminate non-storm water discharges, O conduct routine site inspections,train employees in permit compliance, and complete an annual certification of compliance. Under the Phase 11 federal storm water quality regulations a State General Construction Storm Water Permit will be required for all activities that disturb one acre no later than March,2003. b. State General Permit for Storm Water Discharges Associated with Industrial O Activities, April, 1997 (available at the District Office.) A State General Industrial Permit is required for specific types of industries described in the NPDES regulations or by Standard Industrial Classification(SIC)code. The following categories of industries are generally required to secure an industrial O permit: manufacturing; trucking; recycling; and waste and hazardous waste management. Specific exemptions exist for manufacturing activities which M& occur entirely indoors. In an effort to improve storm water runoff quality, outdoor storage areas shall be constructed and maintained such that material which generates contaminants will not be conveyed by runoff into the storm drain system. The District encourages, but does not require that roof drains from non-residential development be constructed such that they are directed onto and through a landscaped grassy swale area to filter out pollutants from roof runoff. Runoff from areas where industrial activities,product,or merchandise come into contact with and may contaminate storm water must be directed through landscaped areas or otherwise treated before discharging it off-site or into a storm drain. Roofs covering such areas are recommended. Cleaning`of such areas by sweeping instead of washing is to be required unless such wash water'Gan be directed to the sanitary sewer system. Storm drains receiving untreated runoff from such areas that directly connect to the District's system will not be permitted. Loading docks, depressed areas, and areas servicing or fueling vehicles are specifically subject to these requirements. All required street improvements must be completed and accepted.by the City mior to final occupancy. B. The property shall be improved in accordance with the provisions of FMC Section 11-208. Each bin enclosure shall have 6-inch high wheel stops on the ground 18 inches from the rear wall and 12 inches from the side walls. Gate hinges shall be hung on the outside. The area east of Effie Avenue is residential and the landscaping will provide a good buffer between the uses. To further mitigate the commercial from the residential the applicant has indicated that there will be no doors or windows facing Effie Avenue. A five foot landscape stripe is being proposed on the north side of the building and in the parking area. The parking requirement for this project is 1 square foot of parking for every square foot of building. The proposed building is 15,190 square feet in size. The applicant is providing 11,195 square feet of parking. To comply with the parking requirements a covenant for cross access and parking has been recorded with the adjacent property, the Red Roof Inn. This will provide sufficient parking for the proposed project since the hotel has limited use of the parking lot during the day. A cross access driveway adjoining both properties has being proposed. This is a spec building with no specific uses therefore, the uses could range from an office to a repair garage. To mitigate any potential problems that could adversely effect the residential neighborhood and the motel.the following conditions are being required: • All exterior lighting shall be hooded away from the residential neighborhood and motel. • All landscaping and irrigation shall be completed prior to issuance of a certificate of occupancy. • All work shall be conducted in the building. • No equipment or other materials shall be stored or displayed outside the building. • Vehicles left over night shall be stored in the building. • No work shall be conducted between the hours of 8:00 p. m. and 7:00 a. m. The project has been routed to the necessary departments including Traffic, Solid Waste, Fire, Parks,Flood Control, and the Fresno Irrigation District.
