SUBJECT: NOTICE OF APPROVAL OF TENTATIVE PARCEL MAP NO. 2002-08 FOR
PROPERTY LOCATED ON THE NORTHEAST CORNER OF NORTH VAN
NESS BOULEVARD AND WEST HERNDON AVENUE
The City of Fresno Building and Safety Services Division has completed its review of the subject
map. Pursuant to FMC Section 12-1205(c), this letter is written to advise that the conditions of
approval are as noted on the attached document, dated October 11, 2002.
If you have any questions regarding the conditions you must notify either Louis Rocha or Robert
Lewis at 621-8277, no later than October 21, 2002, to request a review of the conditions.
Otherwise, the stipulated conditions of approval are in effect as of that date. No further notice will
be sent.
Anneal: The divider or any aggrieved person may file an appeal regarding to conditions of approval
within fifteen (15) days from the date of approval.
To protest the Director's decision regarding the conditions of approval, you must appeal by filing a
written appeal with the Director of the Development Department. Appeal must include the
appellant's interest in/or relationship to the subject property, the decision or action appealed, and
specific reasons why the appellant believes the decision or action appealed from should not be
upheld
Appeals must be submitted to the Director of the Development Department prior to 5 p.m. on
October 31, 2002.

EXPIRATION: The approval or conditional approval of this tentative Parcel Map expires two years
from the date of approval. The expiration shall terminate all proceedings and a final Parcel Map
may not be filed without first processing a new Tentative Parcel Map.
Modification of a Tentative Parcel Map after approval or conditional approval does not extend the
two year time limit.
EXTENSIOhj: The divider may request an extension of the tentative map expiration date by filing a
written application together with the fee set forth in the Master Fee Schedule at the time of the
request with the Director of the Development Department at least thirty days before the expiration
date of the map. The applicant must state the reasons for the requesting the extension. New
conditions may be imposed if an extension is granted.
An extension may not exceed an aggregate of five year.

SUBJECT: REQUIRED FINDINGS AND APPROVAL OF TENTATIVE
PARCEL MAP NO. 2002-08
BACKGROUND
Tentative Parcel Map No. 2002-08, filed by The McCaffrey Group, on April 9, 2002, and
accepted on May 23, 2002, proposes the creation of a 2-parcel commercial planned
development subdivision from 2.5 acres of R-P/EA/UGM zone property located on the
northeast corner of West Herndon Avenue and North Van Ness Boulevard. The proposed
tentative parcel map also requesovacation of approximately 18 feet of street right-of-way in
North Van Ness Boulevard, a designated scenic drive. The Public Works Department has
amended the Public Works standard for Scenic Drives to allow for the proposed vacation.
The project site is zoned R-P (Residential and Professional Office District). Approval of a
tentative parcel map is subject to the Development Director finding that the map is consistent
with the officially adopted plans and policies of the City of Fresno. Staff has reviewed the
proposed design and improvement of Tentative Parcel Map No. 2002-08 and has determined
that the map is consistent with adopted plans and policies as described below.
Please review the following required findings for determination of consistency for the
tentative parcel map. Upon your determination that the required findings can be made, the
applicant will be notified of the conditions of approval of Tentative Parcel Map
No. 2002-08.
REQUIRED FINDINGS
California Environmental Quality Act (CEQA) - The California Environmental Quality Act
(Public Resources Code Section 21000 et seq.) and the State EIR Guidelines, Section 15061
(Review for Exemptions), permit a public agency to determine whether a particular project
is exempt from CEQA. If a public agency finds that the activity is covered by the general
rule that CEQA applies only to projects which have the potential for causing a significant
effect on the environment and it can be seen with certainty that there is no possibility that the

activity in question may have a significant effect on the environment, the activity is not
subject to CEQA and a notice of exemption.
A determination of a Class 15 Categorical Exemption (Section 15315/minor land division of
4 or fewer parcels) from CEQA was made and Environmental Assessment
No. TPM-2002-08 (Categorical Exemption) was completed for this project and issued on
October 11, 2002 and filed with the Fresno City Clerk on October 11, 2002.
State Subdivision Map Act - The Subdivision Map Act (California Government Code
Section 66410 et. seq.) requires that a proposed parcel map not be approved unless the map,
together with its design and improvements, is found to be consistent with the General Plan
and any applicable specific plan (Finding No. 1 below). State law further provides that the
proposed parcel map be denied approval if any one of the Finding Nos. 2 -5, below, is made
in the negative.
1. The proposed subdivision map, together with its design and improvements is
consistent with the City's General Plan and any applicable specific plan, because the
Bullard Community Plan designates the site for commercial office land uses and the
project design meets the density and zoning ordinance criteria for development in this
plan designation.
2. The site is physically suitable for the proposed type and density of development
because of the flat terrain of the site and adequate access and drainage on and off the
site.
3. The proposed subdivision design and improvements are not likely to cause substantial
and considerable damage to the natural environment, including fish, wildlife or their
habitat, because of the urbanized nature of the area in which the site is located.
4. The proposed subdivision design and improvements are not likely to cause serious
public health and safety problems, because the conditions of approval have shown and
will insure that the subdivision conforms with City health and safety standards.
5. The proposed subdivision design will not conflict with public easements within or
through the site because conditions of approval will assure noninterference with any

existing or proposed public easements.
Staff, based on its own analysis, has determined that the parcel map, subject to the
recommended conditions of approval, complies with the design and property development
standards of the Zoning Ordinance and local Parcel Map Ordinance and recommends the
approval of the parcel map.
DIRECTOR DETERMINATION
1. Based upon the above analysis, the Development Director finds that Tentative Parcel
Map No. 2002-08 is consistent with the applicable plans and policies of the City of
Fresno.
2. The Development Director hereby approves the categorical exemption and grants
approval of Tentative Parcel Map No. 2002-08 dated May 23, 2002, subject to the
conditions of approval dated October 11, 2002, and to become effective on
October,W,, 2002.

CONDITIONS OF APPROVAL
VESTING TENTATIVE PARCEL MAP NO. 2002-08
The City of Fresno Development Department has completed a review of the subject tentative parcel
map in accordance with the State Subdivision Map Act and the Fresno Municipal Code.
The conditions of approval for Vesting Tentative Parcel Map No. 2002-08 are as follows:
NOTICE TO PROJECT APPLICANT
In accordance with the provisions of Government Code§66020(d)(1), the
imposition of fees, dedications, reservations or exactions for this project are subject
to protest by the project applicant at the time of approval or conditional approval
of the development or within 90 days after the date of the imposition of the fees,
dedications, reservations or exactions imposed on the development project.
I. Legal Status of Site to be Subdivided
A. The parcel map site, was legally created as portions of lots 1280 and 1281 of Bullard
Lands Irrigated Subdivision No. 8..
II. Zoning
A. Proposed parcels must consistent with the approved R-P zoned residential and
professional office district for the parcel map site in terms of lot width, depth and area
subject to approval of a special permit for a planned development project. All parcels
must approved access to a public street or right-of-way under a planned development
special permit.
Modification of Property Development Standards/Planned Unit Development
B. The proposed subdivision requires the modification of the R-P zone district property
development standards in that is proposes the creation of parcels within an approved
commercial planned development which have reduced lot sizes and do not have abut a
public street or right-of-way. Such standards and access may be accomplished by
compliance with condition(s)below.
C. If not already obtained, secure approval of an amendment to Site Plan Review

No. S-01-407 or a new entitlement authorizing the creation of an commercial planned
development on the parcel map site to reflect the proposed parcel lines and
modifications.
D. The placement of a parcel line in close proximity to any existing and/or proposed
structure requires the structures be found in compliance with the fire resistive standards
of the Uniform Building Code, Chapter 5. In the event the structures do not comply
they must be modified so as to meet the requirement.
The proposed structure(s) on the site may be affected due to the location of the
proposed parcel line. Compliance with the prevailing Uniform Building Code as it
relates to the exterior wall protection, allowable area, etc. (as applicable to new parcel
line locations) must be demonstrated prior to final map submittal. Contact Development
Department, Building and Safety Services at 621-8200.
E. Submit draft copies of Covenants, Conditions and Restrictions/Owners Association
documents (CC &R's) for review and approval. Final, executed and notarized
documents are to be recorded with the parcel map. CC &R's shall conform with the
provisions of Section 12-1026 FMC and address ingress, egress, sewer and water
service, maintenance, and access, fire protection, solid waste service, storm drainage,
parking and landscaping.
III. Plan Consistency
A. The Bullard Community Plan designates the parcel map site for development with office
commercial land uses. The Zoning District Consistency Table of the Fresno Municipal
Code identifies office commercial uses as consistent with the approved R-P zone district.
IV. On-Site Requirements
A. Fresno Metropolitan Flood Control District requirements:
Comply with Flood Control memo dated June 6, 2002.
B. Fresno Irrigation District:
No requirements.
C. Easements: The location, type, size, and record information of easements on and through
the site must be shown on the final map.

1. Provide Public Utility Easements (PUE) which may be required for P. G. &E.
use. It is the owner's responsibility to provide P.G. &E. with adequate rights-of-
way satisfactory to P.G. & E. If the property owner needs P.G. & E. to help
assist in making the determination if an easement will be necessary, the property
owner or their agent may contact the Scott Combs, Land Agent, Fresno Land
Rights Office at 263-7375.
The developer/owner will be responsible for the costs associated with any
removal or relocation of existing facilities on the property.
2. Provide the necessary private sewer easements to provide for sewer service to
each parcel created.
3. Provide approved easements and/or covenants for cross access between parcels
(minimum of two for each parcel) for fire protection access. Provide approved
easements and/or covenant for shared fire hydrant use between all parcels.
V. Off-Site Improvement Requirements
A. Street Improvements
West Beechwood Avenue: Currently curb, gutter and permanent paving exist,
therefore, no additional improvements are required
North Van Ness Boulevard: Construct concrete curb and gutter, 20 feet of
permanent paving or up to centerline whichever is greater along the frontage of
this tract, and any transition paving as necessary. The location of the curb and
gutter shall be as per the attached Exhibit"A", and said curb pattern shall be 6-
feet from the face of curb to the future right-of-way. Since the City of Fresno
has a street improvement project that is anticipated to complete this work the
developer should seek a deferral of this requirement. However, if for any reason
the City of Fresno is unable to construct this with its project, then this
requirement will need to be fulfilled as a condition of approval of this map.
The owner/developer shall obtain approval of the vacation of the excess
right-of-way as shown on Exhibit"A".
Construct an underground street lighting system per Public Works Standard E-1
within the limits of this tentative parcel map. Spacing and design shall conform
to Public Works standards for collector streets.

• East Herndon Avenue: Construct an underground street lighting system per
Public Works Standard E-1 within the limits of this tentative parcel map.
Spacing and design shall conform to Public Works standards for Expressways.
Dedicate a bike path easement 15-feet wide as per Public Works Standard P-75.
Within the limits of the parcel map, concrete curb and gutter exist.
B. Sanitary Sewer System
A 12-inch public sanitary sewer main exists in North Van Ness Boulevard. An 8-inch
public sanitary sewer main exists in West Beechwood Avenue. No public sanitary sewer
main extensions are required. Separate sewer house branches shall be provided to each
parcel. All public sewer facilities shall be constructed in accordance with City of Fresno
standards, specifications, and policies.
If parcels are proposed to be served by a private onsite sewer system, C C &Rs and
reciprocal access and maintenance easements must be provided. In addition, an
engineered onsite utility plan showing the proposed outfall to the public sewer system
must be submitted to the City for review and approval
C. Water Service
A 12-inch water main exists in North Van Ness Boulevard. An 8-inch water main exists
in West Beechwood Avenue. No. public water main extensions are required. All public
water facilities shall be constructed in accordance with City of Fresno standards,
specifications, and policies.
If parcels are proposed to be served by a private onsite water system, C C &Rs and
reciprocal access and maintenance easements must be provided. In addition, an
engineered onsite water utility plan showing the proposed connection to the public water
system must be submitted to the City for review and approval.
D. Parks, Recreation and Community Services
1. Comply with the Parks requirements for Site Plan Review No. 5-01-407.

F. Fresno Unified School District
1. This project is subject to school development fee in accordance with the Fresno
Unified School District adopted fee standard.
VII. GENERAL PUBLIC WORKS REQUIREMENTS
A. DEDICATIONS. The subdivider shall dedicate public easements to facilitate the
construction of curbs, gutters, sidewalk, bus bays, right turn lanes, bike lanes, bike paths,
multi-purpose trail, wheelchair ramps and public utilities in accordance with City plans,
ordinances, resolutions and policies, the Standard Specifications of the Public Works
Department within the limits of the parcel map. Additionally, a minimum 4 foot wide
clear path of travel is required along the public sidewalk on all frontages of the property
as required by Title 24 of the California Administration Code as determined by the City
Engineer. An on-site pedestrian easement and construction of a path may be required if
Title 24 provisions can not be met within the public rights of way. All such public
easements shall be identified and dedicated with the processing and recordation of the
Parcel Map or at the time of Special Permit reviews for the proposed development of the
parcels.
B. STREET IMPROVEMENTS. The subdivider shall construct curb, gutters, curb
returns and landings, wheelchair ramps, sidewalks with street tree wells and irrigation
systems(when applicable), permanent pavement, underground serviced street/safety
lighting, bike lanes, bike paths, multi-purpose trail, walls and fences in accordance with
City plans, ordinances, resolutions, policies and the Standard Specifications of the Public
Works Department within the limits of the parcel map.
Existing improvements that are not to the planned alignment shall be removed and
required improvements installed to the new street alignment and grade. Existing
improvements to remain in place shall be repaired if determined to be damaged and/or off
grade by the City Engineer. Existing driveway approaches not identified for current or
future utilization shall be removed and sidewalk(when applicable), curb and gutter shall
be installed to match existing or proposed street line and grade as determined by the City
Engineer.
C. SANITARY SEWER SYSTEM. The subdivider shall connect each parcel being
created to the City of Fresno's sanitary sewer system with a separate sewer house branch
unless other arrangements are approved by the City Engineer. All sanitary sewer system
improvements shall be constructed in accordance with City plans, ordinances,
resolutions, policies and the Standard Specifications of the Public Works Department.
The connection to the City's sanitary sewer system requires the payment of all applicable
sewer connection charges in accordance with the provisions of FMC Chapter 9, Article

5 prior to the approval of the map.
D. WATER SYSTEM. The subdivider shall connect each parcel being created to the City
of Fresno's water system with a separate water service and meter unless other
arrangements are approved by the City Engineer. All water system improvements shall
be constructed in accordance with City plans, ordinances, resolutions, policies and the
Standard Specifications of the Public Works Department. The connection to the City's
sanitary sewer system requires the payment of all applicable water connection charges in
accordance with the provisions of FMC Chapter 14, Article 1 prior to the approval of
the map
E. STREET, SEWER AND WATER CONSTRUCTION PLANS. The subdivider shall
provide street, sewer and water construction plans for the required public improvements
as determined by the City Engineer. Such plans shall be prepared by a registered Civil
Engineer and approved by the City Engineer prior to the issuance of Street Work
permits.
F. CONSTRUCTION/DEFERRAL. The subdivider shall construct the street, sanitary
sewer system and water system improvements required for this parcel map, and the work
deemed completed by acceptance of the work by the City Engineer, prior to the approval
and recordation of the Parcel Map.
Alternatively, the subdivider may request the deferral of the construction of such
improvements with a parcel map agreement. The City Engineer may approve such
agreement wherein the subdivider will be required to provide an Engineer's Estimate of
the work. The agreement will be prepared by the City and will require performance
securities as determined by the City Engineer.
G. UTILITY SYSTEMS. All existing and proposed utility systems shall be installed
underground in accordance with Section 12-1011(h) of the Fresno Municipal Code. The
subdivider's attention is directed to the installation of street lights in accordance with
Resolution Nos. 68-187, 78-522, 81-219 and 88-229.
VI. Development Fees
All fees noted in this section shall be due and payable to the City of Fresno prior to the approval
of the final parcel map. All fee quotations are based on current rates. Applicant shall pay the
fee in effect at the time of final map approval.

The proposed development will generate storm runoff which produces potentially significant
environmental impacts and which must be properly discharged and mitigated pursuant to the
California Environmental Quality Act and the National Environmental Policy Act. The District
in cooperation with the City and County has developed and adopted the Storm Drainage and
Flood Control Master Plan. Compliance with and implementation of this Master Plan by this
development project will satisfy the drainage related CEQA/NEPA impact of the project
mitigation requirements.
The proposed development shall pay drainage fees pursuant to the Drainage Fee Ordinance Z
prior to approval of the final map at the rates in effect at the time of such approval. The fee O
indicated above is based on the tentative map. Contact the FMFCD project engineer prior to
approval of the final map for the fee. ■

6. The Federal Clean Water Act and the State General Permits for Storm Water Discharges
Associated with Construction and Industrial Activities (State General Permits)require W4
developers of construction projects disturbing five or more acres,and discharges associated
with industrial activity not otherwise exempt from National Pollutant Discharge Elimination
System(NPDES)permitting, to implement controls to reduce pollutants, prohibit the
discharge of waters other than storm water to the municipal storm drain system,and meet water
quality standards. These requirements apply both to pollutants generated during construction,
and to those which may be generated by operations at the development after construction.
a. State General Permit for Storm Water Discharges Associated with Construction
Activities,August 1999 (available at the District Office.) A State General
Construction Permit is required for all clearing, grading,and disturbances to the
ground that result in soil disturbance of at least five acres(or less than five acres
if part of a larger common plan of development or sale). Permittees are required
to: submit a Notice of Intent to be covered and must pay a permit fee to the
State Water Resources Control Board(State Board), develop and implement a
storm water pollution prevention plan,eliminate non-storm water discharges,
conduct routine site inspections,train employees in permit compliance,and
complete an annual certification of compliance.
Under the Phase II federal storm water quality regulations a State General
Construction Storm Water Permit will be required for all activities that disturb
one acre no later than November, 2003. Z
b. State General Permit for Storm Water Discharges Associated with Industrial O
Activities,April, 1997(available at the District Office.) A State General ■
Industrial Permit is required for specific types of industries described in the
NPDES regulations or by Standard Industrial Classification(SIC)code. The
following categories of industries are generally required to secure an industrial
permit: manufacturing;trucking; recycling; and waste and hazardous waste Z
management. Specific exemptions exist for manufacturing activities which
occur entirely indoors. Permittees are required to: submit a Notice of Intent to Z
be covered and must pay a permit fee to the State Water Resources Control
Board, develop and implement a storm water pollution prevention plan,
eliminate non-storm water discharges,conduct routine site inspections,train
employees in permit compliance, sample storm water runoff and test it for O
pollutant indicators,and annually submit a report to the State Board. O

e) When the actual costs incurred in constructing Master Plan facilities exceeds the
drainage fee obligation, reimbursement will be made for the excess costs from
future fees collected by the District from other development.
Approval of this development shall be conditioned upon compliance with these District
Requirements.

C. The proposed development is encouraged to select and implement storm water
quality controls recommended in the Fresno-Clovis Storm Water Quality
Management Construction and Post-Construction Guidelines (available at the
District Office)to meet the requirements of the State General Permits, eliminate the
potential for non-storm water to enter the municipal storm drain system, and where
possible minimize contact with materials which may contaminate storm water
runoff.
7. A requirement of the District may be appealed by filing a written notice of appeal with
the Secretary of the District within ten days of the date of this Notice of Requirements.
8. The District reserves the right to modify, reduce or add to these requirements, or revise
fees, as necessary to accommodate changes made in the proposed development by the
developer or requirements made by other agencies.

There is an existing twenty-foot (20') storm drain easement along the southerly property line of
TPM 2002-008 as shown on Exhibit No. 1. No encroachments into the easement shall be permitted
including,but not limited to, foundations, roof overhangs, swimming pools, and trees.
The Developer shall contact the District to coordinate the construction of the TPM 2002-008
improvements with the District's construction of a proposed pump station as shown on
Exhibit No. 1.
If the site is to be fenced,the Developer shall provide the District with access to the existing pump
station for operation, maintenance and repair.
In an effort to improve storm water runoff quality, outdoor storage areas shall be constructed and
maintained such that material which generates contaminants will not be conveyed by runoff into the
storm drain system.
The District encourages,but does not require that roof drains from non-residential development be
constructed such that they are directed onto and through a landscaped grassy swale area to filter out
pollutants from roof runoff.

6. Verification by Construction Management that the durable monuments have been set.
In accordance with Section 66497 of the Subdivision Map Act, the City must receive evidence
of payment to the engineer or surveyor for the setting of final monuments prior to final map
approval. In the event of the deferment of the setting of interior corners by secured agreement,
evidence of payment to the engineer or surveyor must be received prior to the release of such
agreement and security.

General
The subject site is located on the northeast corner of Herndon Avenue and Van Ness Avenue.
The subject tentative parcel map proposes to create two parcels on 1.35 acres with R-P/EA/UGM
zoning.
Prior to placement of any permanent street surfacing, the developer shall be required to construct
any sewer and water mains necessary to serve adjacent properties.
Sanitary sewer
A 12-inch public sanitary sewer main exists in North Van Ness. A 8-inch public sanitary sewer
main exists in West Beechwood Avenue.No public sanitary sewer main extensions are required.
The following conditions are required to provide sanitary sewer service to the proposed parcels.
1. Separate sewer house branches shall be provided to each parcel created.
2. All public sewer facilities shall be constructed in accordance with City of Fresno
standards, specifications, and policies.
Water service
A 12-inch water main exists in North Van Ness. A 8-inch water main exists in West Beechwood
Avenue.No public water main extensions are required. The following conditions are required to
