SUBJECT: NOTICE OF APPROVAL OF TENTATIVE PARCEL MAP NO. 2002-04 FOR
PROPERTY LOCATED ON THE NORTHWEST CORNER OF NORTH INGRAM
AND WEST LOCUST AVENUES
The City of Fresno Planning Division has completed its review of the subject map. Pursuant to FMC
Section 12-1205(c),this letter is written to advise that the conditions of approval are as noted on the
attached document, dated May 15, 2002 and on Tentative Parcel Map dated April 12, 2002.
If you have any questions regarding the conditions you must notify either Louie Rocha or Amoldo
Rodriguez at (559)621-8063 no later than August 8, 2002, to request a review of the conditions.
Otherwise, the stipulated conditions of approval are in effect as of that date. No further notice will be
sent.
Appeal: The divider or any aggrieved person may file an appeal regarding conditions of approval
within fifteen (15) days from the date of approval.
To protest the Director's decision regarding the conditions of approval,you must appeal by filing a
written appeal with the Director of the Development Department. The appeal must include the
appellant's interest in/or relationship to the subject property, the decision or action appealed, and
specific reasons why the appellant believes the decision or action appealed from should not be upheld.
Appeals must be submitted to the Director of the Development Department prior to 5 p.m. on
August 8, 2002.
EXPIRATION: The approval or conditional approval of this tentative Parcel Map expires two years
from the date of approval. The expiration shall terminate all proceedings and a final Parcel Map may
not be filed without first processing a new Tentative Parcel Map.
Modification of a Tentative Parcel Map after approval or conditional approval does not extend the two
year time limit.

EXTENSION: The divider may request an extension of the tentative map expiration date by filing a
written application together with the fee set forth in the Master Fee Schedule at the time of the request
with the Director of the Development Department at least thirty days before the expiration date of the
map. The applicant must state the reasons for the requesting the extension. New conditions may be
imposed if an extension is granted.
An extension may not exceed an aggregate of 5 years.

CONDITIONS OF APPROVAL
TENTATIVE PARCEL MAP NO. 2002-04
NOTICE TO PROJECT APPLICANT
In accordance with the provisions of Government Code §66020(d)(1), the imposition of fees,
dedications, reservations or exactions for this project are subject to protest by the project
applicant at the time of approval or conditional approval of the development or within 90 days
after the date of the imposition of the fees,dedications,reservations or exactions imposed on the
development project.
The City of Fresno Development Department has completed a review of the subject tentative parcel
map in accordance with the State Subdivision Map Act and the Fresno Municipal Code.
The conditions of approval for Tentative Parcel Map No. 2002-04 are as follows:
1. Legal Status of Site to be Subdivided
A. The parcel map site, was legally created.
II. Zoning
A. Proposed parcels are consistent with the property's existing C-M, Commercial and
Light Manufacturing and M-1, Light Manufacturing zone districts.
III. Plan Consistency
A. The Bullard Community Plan designates the parcels for light manufacturing type land
uses. The Zoning District Consistency Table of the Fresno Municipal Code identifies
light industrial type uses as consistent with the C-M and M-1 zone districts.
IV. On-Site Requirements
A. Fresno Metropolitan Flood Control District requirements:
Comply with memorandum dated April 22, 2002.
B. Easements: Identify the location, type, size, and record information of easements on
and through the site must be shown on the final map.
C. Unless otherwise noted, all covenants or agreements will be prepared upon receipt of
the fee indicated below. Covenants must be approved by the City Attorney's Office

prior to issuance of building permits.
The proposed"Remainder"parcel must have two points of access to public streets. A
cross access covenant will be required. In addition, if the Vendo Company wishes to
maintain their existing address of 7435 North Ingram Avenue,they must have access
to North Ingram Avenue. Provide a letter addressing this issue.
D. Department of Community Health
Comply with letter from Department of Community Health dated April 24, 2002.
V. Off-Site Improvement Requirements
A. The developer shall be required to construct any sewer and water mains necessary to
serve adjacent properties prior to placement of any permanent street surfacing.
B. Sanitary Sewer Service
1. The subject site is located within the Pinedale Public Utility District (PPUD) sewer
service area.
A 10-inch PPUD sewer main is located in West Locust Avenue and is available to
provide sewer service to proposed Parcels "E"and"F."
No PPUD sewer facilities exist with North Ingram Avenue.
A 21-inch City of Fresno sanitary sewer trunk main exist with North Ingram Avenue
and is available to provide sewer service to proposed Parcels "A," `B," and "C."
According to approved sewer and water improvement plans for Tract Map No. 4637,
sewer and water services have been provided to proposed Parcel"D"in North Ingram
Avenue.
C. Water Service
1. The subject site is located within the Pinedale County Water District(PCWD)and City
of Fresno water service areas.
A 12-inch PCWD water main is located in West Locust Avenue and is available to
provide water service to proposed Parcels `B" and "F." A 16-inch City water main
exists in North Ingram Avenue and is available to provide water service to proposed

Parcels"A,""B,"and"C." Proposed Parcel "D"is located within the PCWD service
area. According to approved sewer and water improvement plans for Tract Map No.
4637, sewer and water services have been provided for proposed Parcel "D"in North
Ingram Avenue.
D. Parks, Recreation and Community Services

for additional information.
E. Street Improvements
1. North Ingram - Install return landing with wheelchair ramp at the southeast corner of
proposed Parcel "D," curb exist.
Curb and gutter exist. Repair any damaged concrete curb or other off-site
improvements to Public Works Standards.
Install an underground street lighting system to Public Works E-1 standard.
West Locust Avenue-Curb&gutter exist. Repair any damaged concrete curb or other
off-site improvements to Public Works Standards.
F. Street Name
Change the street name from N. Ingram Avenue to North Ingram Avenue.
VI. General Public Works Requirements
A. DEDICATIONS. The subdivider shall dedicate public easements to facilitate the
construction of curbs, gutters, sidewalk, bus bays, right turn lanes, bike lanes, bike
paths, multi-purpose trail, wheelchair ramps and public utilities in accordance with
City plans, ordinances, resolutions and policies, the Standard Specifications of the
Public Works Department within the limits of the parcel map. Additionally, a
minimum 4 foot wide clear path of travel is required along the public sidewalk on all
frontages of the property as required by Title 24 of the California Administration Code
as determined by the City Engineer. An on-site pedestrian easement and construction
of a path may be required if Title 24 provisions can not be met within the public rights
of way. All such public easements shall be identified and dedicated with the
processing and recordation of the Parcel Map or at the time of Special Permit reviews

for the proposed development of the parcels.
B. STREET IMPROVEMENTS. The subdivider shall construct curb, gutters, curb
returns and landings,wheelchair ramps,sidewalks with street tree wells and irrigation
systems(when applicable),permanent pavement,street/safety lighting,bike lanes,bike
paths,multi-purpose trail,walls and fences in accordance with City plans,ordinances,
resolutions,policies and the Standard Specifications of the Public Works Department
within the limits of the parcel map.
Existing improvements that are not to the planned alignment shall be removed and
required improvements installed to the new street alignment and grade. Existing
improvements to remain in place shall be repaired if determined to be damaged and/or
off grade by the City Engineer. Existing driveway approaches not identified for current
or future utilization shall be removed and sidewalk(when applicable),curb and gutter
shall be installed to match existing or proposed street line and grade as determined by
the City Engineer.
C. SANITARY SEWER SYSTEM. The subdivider shall connect each parcel being
created to the City of Fresno's sanitary sewer system with a separate sewer house
branch unless other arrangements are approved by the City Engineer. All sanitary
sewer system improvements shall be constructed in accordance with City plans,
ordinances,resolutions,policies and the Standard Specifications of the Public Works
Department. The subdivider is required to construct sewer main extensions to serve
the parcel map in a manner determined by the City Engineer. The connection to the
City's sanitary sewer system requires the payment of all applicable sewer connection
charges in accordance with the provisions of FMC Chapter 9, Article 5 prior to the
approval of the map.
D. WATER SYSTEM. The subdivider shall connect each parcel being created to the City
of Fresno's water system with a separate water services and meters unless other
arrangements are approved by the City Engineer. All water system improvements shall
be constructed in accordance with City plans,ordinances,resolutions,policies and the
Standard Specifications of the Public Works Department. The subdivider is required
to construct water main extensions to serve the parcel map in a manner determined by
the City Engineer. The connection to the City's sanitary sewer system requires the
payment of all applicable water connection charges in accordance with the provisions
of FMC Chapter 14, Article 1 prior to the approval of the map
E. STREET, SEWER AND WATER CONSTRUCTION PLANS. The subdivider shall
provide street, sewer and water construction plans for the required public

improvements as determined by the City Engineer. Such plans shall be prepared by a ,
registered Civil Engineer and approved by the City Engineer prior to the issuance of
Street Work permits.
VII. Development Fees
All fees noted in this section shall be due and payable to the City of Fresno prior to the
approval of the final parcel map. All fee quotations are based on current rates. Applicant shall
pay the fee in effect at the time of final map approval.
GOVERNMENT CODE §66020(d)(1)
A protest filed pursuant to subdivision(a)shall be filed at the time of approval or conditional approval
of the development or within 90 days after the date of the imposition of the fees, dedications,
reservations, or other exactions to be imposed on a development project. Each local agency shall
provide to the project applicant a notice in writing at the time of the approval of the project or at the
time of the imposition of the fees, dedications, reservations, or other exactions, a statement of the
amount of the fees or a description of the dedications,reservations,or other exactions,and notification
that the 90-day approval period in which the applicant may protest has begun.

PROJECT DESCRIPTION AND LOCATION: Tentative Parcel Map Application
2002-04 requests authorization to create six parcels ranging in size from 0.69± acres to
3.0± acres in size with a 28.2± acre Remainder parcel from 36.75± acres. Also requests
authorization to rezone said parcels from M-1 to C-M.
APN: 405-332-22 and 405-550-32 Address: 7213, 7223, 7235, & 7245 N. Ingram
Comments/Concerns:
The location identified as 7223 N. Ingram (APN 405-550-32) was formerly occupied by
Rogers Trucking. The Department of Toxic Substance Control is the lead agency for clean
up activities relative to soil contamination on the site. It is recommended that concurrence
be received from them prior to approval of the application. For more information, contact
Carolyn Tatoian Cain at (916) 255-3545.
Since no uses have been identified for this application, the full range of C-M uses must be
considered. The potential adverse impacts could include (hut are not limited to) storage of
hazardous materials and/or wastes, medical waste, solid waste, water quality degradation,
and odors.
Recommended Conditions of Approval:
• Should a retail food establishment be proposed, prior to issuance of building permits,
the applicant or future tenant shall submit complete food facility plans and specifications
to the Fresno County Department of Community Health, Environmental Health System,
for review and approval. Contact the Consumer Food Protection Program at (559) 445-
3392 for more information.
• Prior to operation, the applicant or future tenant may be required to apply for and obtain
a license to sell alcoholic beverages. Contact the California Alcoholic Beverage Control

• The applicant should be advised that construction and operating permits may be
required by the State of California, Department of Health Services for wholesale food
manufacturing. -Contact the staff at the Division of Food and Drug at (559) 445-5323 for
more information.
• Certain uses allowed may utilize hazardous materials or create hazardous wastes. If a
tenant with such uses is proposed, then prior to occupancy the tenant shall complete
and submit either a Hazardous Materials Business Plan or a Business Plan Exemption
form to the Fresno County Department of Community Health, Environmental Health
System. Contact the Certified Unified Program Agency at (559) 445-3271 for more
information.
• All hazardous waste shall be handled in accordance with requirements set forth in the
California Health and Safety Code, Chapter 6.5. This chapter discusses proper labeling,
storage and handling of hazardous wastes.
• Certain uses allowed may utilize underground storage tank systems. If a tenant with
such uses is proposed, then the applicant or future tenant shall submit three (3) sets of
complete plans and specifications regarding the installation of any underground storage
tanks to the Fresno County Department of Community Health, Environmental Health
System. Contact the Certified Unified Program Agency, at (559) 445-3271 for more
information.
• The applicant or future tenants may be required to obtain a Medical Waste Permit from
the California Department of Health Services, Medical Waste Management Program.

THE INITIAL STUDY EVALUATING THE PROJECT SHOULD RESULT IN A NEGATIVE
DECLARATION: The project may have adverse impacts, but impacts can be mitigated

6. Verification by Construction Management that the durable monuments have been set.
In accordance with Section 66497 of the Subdivision Map Act,the City must receive evidence of

approval. In the event of the deferment of the setting of interior corners by secured agreement,
evidence of payment to the engineer or surveyor must be received prior to the release of such
agreement and security.

Dear Arnaldo,
Bobby Fena and I met with Nick Yovino and his staff earlier this year, regarding the issue of
"access" and maintaining Vendo's existing address.
It was discussed and agreed that if we established a 20' emergency access easement through
Parcel C to allow for the requested access,it would also allow for the continuation of the
existing Vendo address.

1. The applicable street tree fees and/or alternative measures to satisfy the street tree requirement
are deferred to the time of development of each parcel. Street tree fees shall be based on the fee
rates established in the Master Fee Schedule in effect at the time payment is due.
