SUBJECT: NOTICE OF APPROVAL OF TENTATIVE PARCEL MAP NO. 2001-02
FOR PROPERTY LOCATED ON THE SOUTHEAST CORNER OF NORTH
BRAWLEY AND WEST HERNDON AVENUES
The City of Fresno Planning Division has completed its review of the subject map. Pursuant
to FMC Section 12-1205(c), this letter is written to advise you that the conditions of approval
are as noted on the attached document, dated February 23, 2001.
If you have any questions regarding the conditions you must notify either Louis Rocha or
Robert Lewis at 498-4451 no later than March 2, 2001, to request a review of the
conditions. Otherwise, the stipulated conditions of approval are in effect as of that date. No
further notice will be sent.
Anneal: The divider or any aggrieved person may file an appeal regarding the conditions of
approval within fifteen (15) days from the date of approval.
To protest the Director's decision regarding the conditions of approval, you must appeal by
filing a written appeal with the Director of the Development Department. Appeal must
include the appellant's interest in/or relationship to the subject property, the decision or
action appealed, and specific reasons why the appellant believes the decision or action
appealed from should not be upheld
Appeals must be submitted to the Director of the Development Department prior to 5 p.m.
on March 13, 2001.

EXPIRATION: The approval or conditional approval of this tentative Parcel Map expires
two years from the date of approval. The expiration shall terminate all proceedings and a
final Parcel Map may not be filed without first processing a new Tentative Parcel Map.
Modification of a Tentative Parcel Map after approval or conditional approval does not
extend the two year time limit.
EXTENSION: The divider may request an extension of the tentative map expiration date by
filing a written application together with the fee set forth in the Master Fee Schedule at the
time of the request with the Director of the Development Department at least thirty days
before the expiration date of the map. The applicant must state the reasons for the requesting
the extension. New conditions may be imposed if an extension is granted.
An extension may not exceed an aggregate of five years.

CONDITIONS OF APPROVAL
VESTING TENTATIVE PARCEL MAP NO. 2001-02
The City of Fresno Development Department has completed a review of the subject tentative parcel
map in accordance with the State Subdivision Map Act and the Fresno Municipal Code.
The conditions of approval for Vesting Tentative Parcel Map No. 2001-02 are as follows:
NOTICE TO PROJECT APPLICANT
In accordance with the provisions of Government Code §66020(d)(1), the
imposition of fees, dedications, reservations or exactions for this project are subject
to protest by the project applicant at the time of approval or conditional approval
of the development or within 90 days after the date of the imposition of the fees,
dedications, reservations or exactions imposed on the development project.
I. Legal Status of Site to be Subdivided
A. The parcel map site, was legally created as Lots 523, 524 and 557 of Bullard Lands
Irrigated Subdivision No. 6 and Lot Line Adjustment No. 2000-.
II. Zoning
A. Proposed parcels are consistent with the approved C-2 zoned community commercial
district for the parcel map site in terms of lot width, depth and area subject to approval
of a special permit for a planned development project. All parcels must approved access
to a public street or right-of-way under a planned development special permit.
Modification of Property Development Standards/Planned Unit Development
B. The proposed subdivision requires the modification of the C-2 zone district property
development standards in that is proposes the creation of parcels within an approved
commercial planned development which have reduced lot sizes and do not have direct
access to a public street or right-of-way. Such standards and access may be
accomplished by compliance with condition(s) below.
C. If not already obtained, secure approval of an amendment to Conditional Use Permit
No. C-00-108, to be approved for the creation of an commercial planned development

on the parcel map site to reflect the proposed parcel lines and modifications.
D. The placement of a parcel line in close proximity to any existing and/or proposed
structure requires the structures be found in compliance with the fire resistive standards
of the Uniform Building Code, Chapter 5. In the event the structures do not comply
they must be modified so as to meet the requirement.
The proposed structure(s) on the site may be affected due to the location of the
proposed parcel line. Compliance with the prevailing Uniform Building Code as it
relates to the exterior wall protection, allowable area, etc. (as applicable to new parcel
line locations) must be demonstrated prior to final map submittal. Contact Development
Department, Building and Safety Services at 498-1384.
E. Submit draft copies of Covenants, Conditions and Restrictions/Owners Association
documents (CC &R's) for review and approval. Final, executed and notarized
documents are to be recorded with the parcel map. CC &R's shall conform with the
provisions of Section 12-1026 FMC and address ingress, egress, sewer and water
service, maintenance, and access, fire protection, solid waste service, storm drainage,
parking and landscaping.
III. Plan Consistency -
A. The Bullard Community Plan designates the parcel map.site for development,with
community commercial land uses. The Zoning District Consistency Table of the Fresno
Municipal Code identifies community commercial uses as consistent with the approved
C-2 zone district.
IV. On-Site Requirements
A. Fresno Metropolitan Flood Control District requirements:
Comply with Flood Control memo dated February 7, 2001.
B. Fresno Irrigation District:
The Fresno Irrigation District Bullard Canal traverses the north boundary of the
proposed parcel map. Pursuant to Section 12-1012-(a) of the Fresno Municipal Code,
the subdivider shall be required to replace the open canal with an underground pipeline,
located outside of public right-of-way, and provide the necessary easements to
accommodate the pipeline prior to final map approval.

The developer shall be required to comply with the specific requirements imposed by the
Fresno Irrigation District for the parcel map as identified in the attached letter to the City
date February 12, 2001.
C. A private irrigation canal traverses the proposed subdivision. Pursuant to
Section 12-1012(a) of the Fresno Municipal Code, the subdivider shall be required to
pipe and relocate the canal outside of public street rights-of-way, and provide the
easements necessary to accommodate the pipeline prior to final map approval.
In lieu of the above requirement, the subdivider shall provide acceptable evidence that all
downstream users of the canal have relinquished their rights to its use.
D. Easements: The location, type, size, and record information of easements on and through
the site must be shown on the final map.
1. Provide Public Utility Easements (PUE) which may be required for P. G. &E.
use. It is the owner's responsibility to provide P.G. &E. with adequate rights-of-
way satisfactory to P.G. &E. If the property owner needs P.G. &E. to help
assist in making the determination if an easement will be necessary, the property
owner or their agent may contact the Scott Combs, Land Agent, Fresno Land
Rights Office at 263-7375.
The developer/owner will be responsible for the costs associated with any
removal or relocation of existing facilities on the property.
2. Provide the easements for the Fresno Irrigation District in accordance with their
letter dated February 12, 2001.
3. Provide the necessary private sewer easements to provide for sewer service to
each parcel created.
4. Provide approved easements and/or covenants for cross access between parcels
(minimum of two for each parcel) for fire protection access. Provide approved
easements and/or covenant for shared fire hydrant use between all parcels.
5. Provide any easements if necessary in accordance with the Bullard Community
Plan and the Master Trails Manual for bikeways and trails required for this site.
6. The owner shall wave direct vehicular and pedestrian access to West Herndon
Avenue from all parcels which abut this expressway street

7. The owner shall wave direct vehicular access to North Brawley Avenue for the
north 100 feet of proposed Lot E.
8. The owner shall dedicate an avigation easement to the City of Fresno in
accordance with the provisions of the Sierra Sky Park Land Use Policy Plan.
The easement surfaces acquired shall be based on Part 77 of the Federal Aviation
Regulations.
V. Off-Site Improvement Requirements
A. Street Improvements
• West Herndon Avenue. Within the limits of the subject property, dedication of
a easement for street right of way along the entire frontage in accordance with
Official Plan Line No. 89-03.
• North Brawley Avenue. Within the limits of the subject property, dedication of
a easement for street right of way along the entire frontage in accordance with
Public Works Director's Determination No. 38 (and amendments thereto).
• West Herndon Avenue & North Brawley Avenue. Dedicate sufficient right of
way for future installation of a wheelchair-ramp conforming to Public Works
standard P-28.
• Install permanent paving, paving transitions, concrete curb, gutter, bike paths,
bus bays, right turn lanes, etc. as determined by the City Engineer on all street
frontages in accordance with Exhibit"A" of Conditional Use Permit
No. C-00-108 dated August 4, 2000. Wheelchair ramps shall be installed at all
curb returns. Additional requirements are noted on Exhibit A.
B. Sanitary Sewer System
A 12-inch sanitary sewer is existing in West Figarden Avenue south of this parcel map.
Extension of an 8-inch public sewer is required in North Brawley Avenue northerly from
West Figarden Avenue to serve the proposed parcel map.
■ Parcels proposed to be served with direct sewer lateral connections to public
mains must have house branches provided or secured prior to recordation of the
final Parcel Map.
■ If parcels are proposed to be served by a private onsite sewer system, C C &Rs

and reciprocal access and maintenance easements must be provided. In addition,
an engineered onsite utility plan showing the proposed outfall to the public sewer
system must be submitted to the City for review and approval.
C. Water Service
12-inch water mains are existing in North Brawley and West Herndon Avenues.
1. No extension of public water main is required.
2. Provide separate water services.for each parcel created.
3. If parcels are proposed to be served by a private onsite sewer system, C C &Rs
and reciprocal access and maintenance easements must be provided. In addition,
an engineered onsite utility plan showing the proposed outfall to the public sewer
system must be submitted to the City for review and approval.
D. Parks, Recreation and Community Services
1. Comply with the Parks memorandum dated February 1, 2001.
E. Fire Department
1. Comply with the notes on Exhibit A of CUP No. C-00-108, for fire hydrants
and/or emergency access and Fire Department memorandum dated February 1,
2001. (Contact Fire Prevention, 559/498-1023 for further information.)
2. All construction work on this project is subject to interruption if the road system
becomes impassable for fire apparatus due to rain or other obstacles. (Include
this note on the site plan.)
3. Provide approved covenants for cross access and shared fire hydrant use between
all parcels.
F. Clovis Unified School District
1. This project is subject to school development fee in accordance with the Clovis
Unified School District adopted fee standard.
VII. GENERAL PUBLIC WORKS REQUIREMENTS
A. DEDICATIONS. The subdivider shall dedicate public easements to facilitate the

construction of curbs, gutters, sidewalk, bus bays, right turn lanes, bike lanes, bike paths,
multi-purpose trail, wheelchair ramps and public utilities in accordance with City plans,
ordinances, resolutions and policies, the Standard Specifications of the Public Works
Department within the limits of the parcel map. Additionally, a minimum 4 foot wide
clear path of travel is required along the public sidewalk on all frontages of the property
as required by Title 24 of the California Administration Code as determined by the City
Engineer. An on-site pedestrian easement and construction of a path may be required if
Title 24 provisions can not be met within the public rights of way. All such public
easements shall be identified and dedicated with the processing and recordation of the
Parcel Map or at the time of Special Permit reviews for the proposed development of the
parcels.
B. STREET IMPROVEMENTS. The subdivider shall construct curb, gutters, curb
returns and landings, wheelchair ramps, sidewalks with street tree wells and irrigation
systems (when applicable), permanent pavement, street/safety lighting, bike lanes, bike
paths, multi-purpose trail, walls and fences in accordance with City plans, ordinances,
resolutions, policies and the Standard Specifications of the Public Works Department
within the limits of the parcel map.
Existing improvements that are not to the planned alignment shall be removed and
required improvements installed to the new street alignment and grade. Existing
improvements to remain in place shall be repaired if determined to be damaged and/or off
grade by the City Engineer. Existing driveway approaches not identified for current or
future utilization shall be removed and sidewalk(when applicable), curb and gutter shall
be installed to match existing or proposed street line and grade as determined by the City
Engineer.
C. SANITARY SEWER SYSTEM. The subdivider shall connect each parcel being
created to the City of Fresno's sanitary sewer system with a separate sewer house branch
unless other arrangements are approved by the City Engineer. All sanitary sewer system
improvements shall be constructed in accordance with City plans, ordinances,
resolutions, policies and the Standard Specifications of the Public Works Department.
The subdivider is required to construct sewer main extensions to serve the parcel map in
a manner determined by the City Engineer. The connection to the City's sanitary sewer
system requires the payment of all applicable sewer connection charges in accordance
with the provisions of FMC Chapter 9, Article 5 prior to the approval of the map.
D. WATER SYSTEM. The subdivider shall connect each parcel being created to the City
of Fresno's water system with a separate water services and meters unless other
arrangements are approved by the City Engineer. All water system improvements shall
be constructed in accordance with City plans, ordinances, resolutions, policies and the
Standard Specifications of the Public Works Department. The subdivider is required to

construct water main extensions to serve the parcel map in a manner determined by the
City Engineer. The connection to the City's sanitary sewer system requires the payment
of all applicable water connection charges in accordance with the provisions of FMC
Chapter 14, Article 1 prior to the approval of the map
E. STREET, SEWER AND WATER CONSTRUCTION PLANS. The subdivider shall
provide street, sewer and water construction plans for the required public improvements
as determined by the City Engineer. Such plans shall be prepared by a registered Civil
Engineer and approved by the City Engineer prior to the issuance of Street Work
permits.
F. CONS TRUCTION/DEFERRAL. The subdivider shall construct the street, sanitary
sewer system and water system improvements required for this parcel map, and the work
deemed completed by acceptance of the work by the City Engineer, prior to the approval
and recordation of the Parcel Map.
Alternatively, the subdivider may request the deferral of the construction of such
improvements with a parcel map agreement. The City Engineer may approve such
agreement wherein-the subdivider will be required to provide an Engineer's Estimate of
the work. The agreement will be prepared by the City and will require performance
securities as determined by the City Engineer.
VI. Development Fees
All fees noted in this section shall be due and payable to the City of Fresno prior to the approval
of the final parcel map. All fee quotations are based on current rates. Applicant shall pay the
fee in effect at the time of final map approval.

5. Tax Compliance Request Form with: (a) subdivision guarantee (one copy); (b) legal description
(two copies).

6. Verification by Construction Management that the durable monuments have been set.
In accordance with Section 66497 of the Subdivision Map Act, the City must receive evidence.
of payment to the engineer or surveyor for the setting of final monuments prior to final map
approval. In the event of the deferment of the setting of interior corners by secured agreement,
evidence of payment to the engineer or surveyor must be received prior to the release of such
agreement and security.

BACKGROUND
Tentative Parcel Map No. 2001-02, filed by Herndon First Mortgage Associates, on January
29, 2001, and accepted on February 1, 2001, proposes the creation of a 5-parcel commercial
planned development subdivision with one 4 acre remainder parcel from 9.4 acres of
C-2/UGM zone property located on the southeast corner of West Herndon and North
Brawley Avenues. The project site is zoned C-2 (Community Commercial District zoning).
Approval of a tentative parcel map is subject to the Development Director finding that the
map is consistent with the officially adopted plans and policies of the City of Fresno. Staff
has reviewed the proposed design and improvement of Vesting Tentative Parcel Map
No. 2001-02 and has determined that the map is consistent with adopted plans and policies
as described below.
The tentative parcel map was reviewed by the Bullard Community Plan Advisory
Committee. The Committee recommends approval of the parcel map.
Please review the following required findings for determination of consistency for the
tentative parcel map. Upon your determination that the required findings can be made, the
applicant will be notified of the conditions of approval of Tentative Parcel Map
No. 2001-02.
REQUIRED FINDINGS
California Environmental Quality Act - The California Environmental Quality Act (Public
Resources Code Section 21000 et seq.), and the State EIR Guidelines require that a public
agency prepare an initial environmental study for each project. If a public agency finds that
there is no substantial evidence in the record that a project may have an significant effect on
the environment, a Negative Declaration will be prepared.

Environmental Assessment No. TPM-2000-17 was completed for the Tentative Parcel Map
No. 2001-02 project site with the same parcelization but did not include a remainder parcel.
The Environmental Assessment showed that there is no evidence in the record that the
proposed prof ct may have a significant effect on the environment,-a-ndMitigated Negative
Declarationolished on November 6, 2000 and-was filed with the City Clerk on
November 7, 2000.
State Subdivision Map Act - The Subdivision Map Act (California Government Code
Section 66410 et. seq.) requires that a proposed parcel map not be approved unless the map,
together with its design and improvements, is found to be consistent with the General Plan
and any applicable specific plan (Finding No. 1 below). State law further provides that the
proposed parcel map be denied approval if any one of the Finding Nos. 2 -5, below, is made
in the negative.
1. The proposed subdivision map, together with its design and improvements is
consistent with the City's General Plan and any applicable specific plan, because the
Bullard Community Plan designates the site for community commercial land uses and
the project design meets the density and zoning ordinance criteria for development in
this plan designation.
2. The site is physically suitable for the proposed type and density of development
because of the flat terrain of the site and adequate access and drainage on and off the
site.
3. The proposed subdivision design and improvements are not likely to cause substantial
and considerable damage to the natural environment, including fish, wildlife or their
habitat, because of the urbanized nature of the area in which the site is located.
4. The proposed subdivision design and improvements are not likely to cause serious
public health and safety problems, because the conditions of approval have shown and
will insure that the subdivision conforms with City health and safety standards.
5. The proposed subdivision design will not conflict with public easements within or
through the site because conditions of approval will assure noninterference with any

existing or proposed public easements.
Staff, based on its own analysis, has determined that the parcel map, subject to the
recommended conditions of approval, otherwise complies with the design and property
development standards of the Zoning Ordinance and local Parcel Map Ordinance and
recommends the approval of the parcel map.
DIRECTOR DETERMINATION
1. Based upon the above analysis, the Development Director finds that Tentative Parcel
Map No. 2001-02 is consistent with the applicable plans and policies of the City of
Fresno.
2. The Development Director hereby approves the environmental assessment and grants
approval of Parcel Map No. 2001-02 dated February 1, 2001, subject to the
conditions of approval dated February 23, 2001, and to become effective on March 2,
2001.

The Parks, Recreation&Community Services Department has reviewed the Engineering plan
submitted for review by Rabe Engineering, Inc., dated January 24,2001. The following
comments are submitted based on the parcel as shown, without any existing street trees.
1. Street trees are required in accordance with the provisions of FMC Section 12-1206(c)(5).
The number of street trees shall be determined at the rate of one tree for each 60' of street
frontage as specified in FMC 11-3 0 1(c).
2. Each tree shall be provided with drip irrigation in conformance with the provisions of FMC
Sections 12-306-N-23.
3. The applicable street tree fees and/or alternative measures to satisfy the street tree
requirement are deferred to the time of development of each parcel. Street tree fees shall be
based on the fee rates established in the Master Fee Schedule in effect at the time payment is
due.
4. Environmental Assessment: The nearest regional park is Woodward Park. The nearest
neighborhood park site is Forkner Park located @Valentine and Spruce. An addition
neighborhood park is proposed at Figarden Drive and Santa Fe. The project is consistent with

This Parcel Map is being submitted to allow for on-site parcelization as it relates to a submitted Site
Plan for the Halferty Project, Ralphs Supermarket, and Residential Subdivision on the NE corner of
Palo Alto and Brawley. The conditions of improvement for this Parcel Map have been required with
the Plan Amendment and Rezone, Site Plan for the Commercial Portion, and the Tract Conditions for
the residential. Please refer to these various entitlements for conditions of improvement along the
Herndon, Brawley, and Palo Alto frontages, the interior residential street off Palo Alto, and the Urban
Growth Requirements along Herndon and Brawley.
This Project, essentially is required to complete all frontage improvements, including curb, gutter,
sidewalk, street lighting, and permanent paving along all street frontages, and construction shall be to
Public Works Standards for the type of street associated. Such as Arterial, Expressway, and local.
In addition, this project is required to install the center median on Brawley, from Palo Alto to
Herndon and, the NB and SB travel lanes, 17 ft. wide. The requirement for a traffic signal at the main
entrance to this project site, where parcels A and B contact Brawley Avenue, is a condition of the
Traffic Impact Study that was completed with the commercial center. This requirement rests with the
development of Parcels A—E as commercial, and with a supermarket.
The Civil Engineer for this site, Rabe Engineering, has been provided with layouts for the
construction of Brawley Avenue as previously described and have stated they are nearly complete
with this design. Any modifications to these requirements, if any, will be made at the time of street
plan check.

The proposed development will generate storm runoff which produces potentially significant
environmental impacts and which must be properly discharged and mitigated pursuant to the
California Environmental Quality Act and the National Environmental Policy Act. The District
in cooperation with the City and County has developed and adopted the Storm Drainage and

6. The Federal Clean Water Act and the State General Permits for Storm Water Discharges Eq
Associated with Construction and Industrial Activities (State General Permits) require
developers of construction projects disturbing five or more acres, and discharges associated
with industrial activity not otherwise exempt from National Pollutant Discharge Elimination
System (NPDES) permitting, to implement controls to reduce pollutants, prohibit the
discharge of waters other than storm water to the municipal storm drain system, and meet water
quality standards. These requirements apply both to pollutants generated during construction,
and to those which may be generated by operations at the development after construction.
a. State General Permit for Storm Water Discharges Associated with Construction
Activities, August 1999 (available at the District Office.) A State General
Construction Permit is required for all clearing, grading, and disturbances to the
ground that result in soil disturbance of at least five acres (or less than five acres
if part of a larger common plan of development or sale). Permittees are required
to: submit a Notice of Intent to be covered and must pay a permit fee to the
State Water Resources Control Board (State Board), develop and implement a
storm water pollution prevention plan, eliminate non-storm water discharges,
conduct routine site inspections, train employees in permit compliance, and
complete an annual certification of compliance.
Under the Phase II federal storm water quality regulations a State General
Construction Storm Water Permit will be required for all activities that disturb
one acre no later than November, 2003. Z

Industrial Permit is required for specific types of industries described in the
NPDES regulations or by Standard Industrial Classification (SIC) code. The
following categories of industries are generally required to secure an industrial
permit: manufacturing; trucking; recycling; and waste and hazardous waste Z
management. Specific exemptions exist for manufacturing activities which
occur entirely indoors. Permittees are required to: submit a Notice of Intent to
be covered and must pay a permit fee to the State Water Resources Control
Board, develop and implement a storm water pollution prevention plan,
eliminate non-storm water discharges, conduct routine site inspections, train
employees in permit compliance, sample storm water runoff and test it for Z
pollutant indicators, and annually submit a report to the State Board. Z

The drainage system cost and fee schedule update is currently underway.The drainage system cost
and fee obligation indicated in this notice is the obligation which is valid at the date of this notice.
Contact the District for a final drainage fee obligation prior to recording of the final map.
The cost of construction of Master Plan facilities,excluding dedication of storm drainage easements,
is eligible for credit against the drainage fee of the drainage area served by the facilities. A
Development Agreement shall be executed with the District to effect such credit. Reimbursement
provisions, in accordance with the Drainage Fee Ordinance, will be included to the extent that
Developer's Master Plan costs for an individual drainage area exceed the fee of said area. Should
the facilities cost for such individual area total less than the fee of said area,the difference shall be
paid upon demand to the City or District.
Pursuant to the Ordinance Code, the drainage fee identified on the cover page of this notice is the
preliminary drainage fee due for the entire area of TPM 2001-002, excluding the remainder area.
The estimated construction obligation, required by Paragraph No. 2 of this Notice, is estimated to
exceed the drainage fee for the map. In the event the final construction costs exceed the final
drainage fee obligation,reimbursement of the excess construction costs shall be made to Developer
by District in accordance with the provisions of the Drainage Fee Ordinance Code from future
drainage fees received by District.
There is an existing twenty-foot (20') storm drain easement within the northwest portion of TPM
2001-002,as shown on Exhibit No. 1. The Developer shall dedicate an additional twenty-foot(20)
wide storm drain easement, as shown on Exhibit No. 1, as a condition of TPM 2001-002. Said
easement shall be exclusive except for the Developer's right to grant an easement to the Fresno
Irrigation District for an underground irrigation line.No encroachments into the easements shall be
permitted including, but not limited to, foundations, roof overhangs, swimming pools, and trees.
Cross drainage covenants are required on Parcels "A" through"E"to allow drainage to reach the
proposed Master Plan inlet located on the east side of Brawley Avenue approximately five hundred
feet(500') south of Herndon Avenue.
The proposed thirty-six inch(36") parallel storm drain line lying south of Figarden Drive shall be
constructed within an existing permanent twenty-foot (20') storm drain easement as shown on
Exhibit No. 1 and no additional storm drain easement acquisition will be required as this time.
However,the Developer shall acquire a twenty-five foot(25')wide temporary construction easement
to facilitate the construction of the thirty-six inch(36")storm drain line. The District will consider
condemnation proceedings, in order to acquire the easement on behalf of the Developer, if the
Developer can not negotiate an acquisition. The Developer shall deposit with the District the
estimated easement and appraisal costs with the Developer's authorization to proceed with any

acquisition. The deposit shall include all acquisition costs,including,if determined by the District to
be warranted, applicable legal costs. The Developer will receive drainage fee credit for the cost of
the acquisition of the construction easement.
The required storm drain inlet located in Brawley Avenue, and the required thirty-six inch (36")
parallel storm drain line lying south of Figarden Drive, as shown on Exhibit No. 1, have also been
required of the Developer of CUP 2000-108,TPM 2000-017, and Tract 4988. If these facilities are
completed prior to the development of this site, the construction requirement will be dropped.
The following paragraphs only apply towards development of the individual parcels and are not
conditions for the recording of the map:
In an effort to improve storm water runoff quality,outdoor storage areas shall be constructed
and maintained such that material which generates contaminants will not be conveyed by
runoff into the storm drain system.
The District encourages, but does not require that roof drains from non-residential
development be constructed such that they are directed onto and through a landscaped grassy
swale area to filter out pollutants from roof runoff.
Runoff from areas where industrial activities, product, or merchandise come into contact
with and may contaminate storm water must be directed through landscaped areas or
otherwise treated before discharging it off-site or into a storm drain. Roofs covering such
areas are recommended. Cleaning of such areas by sweeping instead of washing, is to be
required unless such wash water can be directed to-the sanitary sewer system. Storm drains
receiving untreated runoff from such areas that directly connect to the District's system will
not be permitted. Loading docks,depressed areas,and areas servicing or fueling vehicles are
specifically subject to these requirements.
