Tentative Parcel Map No..�99 q filed by Ralph Lovelace, proposes the creation of 4 parcels and
one remainder on 2.3 acres located on the northwest corner of West Kearney Boulevard and South
West Avenue. On April 4, 2001, the City of Fresno approved the subject tentative parcel map for
an initial two years.
The approval of a tentative parcel map shall expire not later than two years from the date it was
approved (Expiration Date of April 4, 2003). An extension, however, may be approved or
approved with conditions in the manner provided by Section 12-1205(e)(2) of the Fresno Municipal
Code relating to the extension of approval of tentative parcel maps (five year maximum per
Subdivision Map Act).
The City has received your timely request for an extension of time, dated October 28, 2002, in
accordance with Section 12-1205(e)(2) of the Fresno Municipal Code and in accordance with
Section 66463.5 of the Subdivision Map Act. A two (2) year extension is hereby granted and the
approval of Tentative Parcel Map No. 299449-, is extended to an Expiration Date of April 4, 2005

SUBJECT: REQUIRED FINDINGS AND APPROVAL OF TENTATIVE
PARCEL MAP NO. 2000-19
BACKGROUND
Tentative Parcel Map No. 2000-19, filed by Ralph E. Lovelace, on August 25, 2000, and
accepted on October 27, 2000, proposes the creation of a 4-parcel single-family residential
subdivision with one remainder parcel froin 2.3 acres of property approved for the R-1-C
zone district and located on the northwest corner of West Kearney Boulevard and South
West Avenue. Approval of a tentative parcel map is subject to the Development Director
finding that the map is consistent with the officially adopted plans and policies of the City of
Fresno. Staff has reviewed the proposed design and improvement of Vesting Tentative
Parcel Map No. 2000-19 and has determined that the map is consistent with adopted plans
and policies as described below.
The tentative parcel map was reviewed by the Edison/Southwest Citizens Advisory
Committee. The Committee recommends approval of the parcel map.
Please review the following required findings for determination,of consistency for the
tentative parcel map. Upon your determination that the required findings can be made, the
applicant will be notified of the conditions of approval of Tentative Parcel
Map No. 2000-19.
REQUIRED FINDINGS
California Environmental Quality Act - The California Environmental Quality Act (Public
Resources Code Section 21000 et seq.), the State EIR Guidelines require that a public
agency prepare an initial environmental study for each project. If a public agency finds that
there is no substantial evidence in the record that a project may have an significant effect on
the environment, a Negative Declaration will be prepared.

Environmental Assessment No. A-00-15, R-00-33 was completed for this project. The
Environmental Assessment showed that there is no evidence in the record that the proposed
project may have a significant effect on the environment, and a Mitigated Negative
Declaration was filed on November 14, 2000, and adopted by the City Council on
February 27, 2001.
The California Environmental Quality Act (Public Resources Code Section 21000 et seq.)
and the State EIR Guidelines, Section 1.5061 (Review for Exemptions), also permits a public
agency to determine whether a particular project is exempt from CEQA.
A determination of a Class 15 Categorical Exemption from CEQA was made and
Environmental Assessment No. TPM-2000-19 (Categorical Exemption) was completed for
this project and issued on April 4, 2001. and filed with the Fresno City Clerk on April 4,
2001.
State Subdivision Map Act - The Subdivision Map Act (California Government Code
Section 66410 et. seq.) requires that a proposed parcel map not be approved unless the map,
together with its design and improvement, is found to be consistent with the General Plan
and any applicable specific plan (Finding No. 1 below). State law further provides that the
proposed parcel map be denied approval if any one of the Finding Nos. 2 -5, below, is made
in the negative.
1. The proposed subdivision map, together with its design and improvement is consistent
with the City's General Plan and any applicable specific plan, because the Edison
Community Plan and the Fresno-Chandler Downtown Airport Master and Environs
Plan designate the site for medium-low density residential land uses and the project
design meets the density and zoning ordinance criteria for development in this plan
designation.
2. The site is physically suitable for the proposed type and density of development
because of the flat terrain of the site and adequate access and drainage on and off the
site.
3. The proposed subdivision design and improvements are not likely to cause substantial
and considerable damage to the natural environment, including fish, wildlife or their

habitat, because of the urbanized nature of the area in which the site is located.
4. The proposed subdivision design and improvements are not likely to cause serious
public health and safety problems, because the conditions of approval have shown and
will insure that the subdivision conforms with City health and safety standards.
5. The proposed subdivision design will not conflict with public easements within or
through the site because conditions of approval will assure noninterference with any
existing or proposed public easements.
Staff, based on its own analysis, has determined that the parcel map, subject to the
recommended conditions of approval, otherwise complies with the design and property
development standards of the Zoning Ordinance and local Parcel Map Ordinance and
recommends the approval of the parcel map.
DIRECTOR DETERMINATION
1. Based upon the above analysis, the Development Director finds that Tentative Parcel
Map No. 2000-19 is consistent with the applicable plans and policies of the City of
Fresno.
2. The Development Director hereby approves the Categorical Exemption and grants
approval of Tentative Parcel Map No. 2000-19 dated October 27, 2000, subject to the
conditions of approval dated April 4, 2001, and to become effective on April 11,
2001.

Explanation: This project is a Class 15 exemption which consist of a division of

zoning, no variances or exceptions are required, all services and
access to the proposed parcels to local standards are available, the
parcel was not involved in a division of a larger parcel within the
previous two years, and the parcel does not have an average slope
greater than 20 percent.

FOR PROPERTY LOCATED ON THE NORTHWEST CORNER OF
SOUTH WEST AVENUE AND WEST KEARNEY BOULEVARD
The City of Fresno Planning Division has completed its review of the subject map. Pursuant
to FMC Section 12-1205(c), this letter is written to advise you that the conditions of approval
are as noted on the attached document, dated April 4, 2001.
If you have any questions regarding the conditions you must notify either Louis Rocha or
Robert Lewis at 498-4451 no later than April 11, 2001, to request a review of the conditions.
Otherwise, the stipulated conditions of approval are in effect as of that date. No further
notice will be sent.
Appeal: The divider or any aggrieved person may file an appeal regarding the conditions of
approval within fifteen (15) days from the date of approval.
To protest the Director's decision regarding the conditions of approval, you must appeal by
filing a written appeal with the Director of the Development.Department. Appeal must
include the appellant's interest in/or relationship to the subject property, the decision or
action appealed, and specific reasons why the appellant believes the decision.or action
appealed from should not be upheld
Appeals must be submitted to the Director of the Development Department prior to 5 p.m.
on April 19, 2001.

EXPIRATION: The approval or conditional approval of this tentative Parcel Map expires
two years from the date of approval. The expiration shall terminate all proceedings and a
final Parcel Map may not be filed without first processing a new Tentative Parcel Map.
Modification of a Tentative Parcel Map after approval or conditional approval does not
extend the two year time limit.
EXTENSION: The divider may request. an extension of the tentative map expiration date by
filing a written application together with the fee set forth in the Master Fee Schedule at the
time of the request with the Director of the Development Department at least thirty days
before the expiration date of the map. The applicant must state the reasons for the requesting
the extension. New conditions may be imposed if an extension is granted.
An extension may not exceed an aggregate of five years.

CONDITIONS OF APPROVAL
TENTATIVE PARCEL MAP NO. 2000-19
The City of Fresno Development Department has completed a review of the subject tentative parcel
map in accordance with the State Subdivision Map Act and the Fresno Municipal Code.
The conditions of approval for Tentative Parcel Map No. 2000-19 are as follows:
NOTICE TO PROJECT APPLICANT
In accordance with the provisions of Government Code §66020(d)(1), the
imposition of fees, dedications, reservations or exactions for this project are subject -
to protest by the project applicant at the time of approval or conditional approval
of the development or within 90 days after the date of the imposition of the fees,
dedications, reservations or exactions imposed on the development project. ' --
I. Legal Status of Site to be Subdivided
A. The parcel map site, was legally created as a portion of Lot 14 of Tract No. 1080.
II. Zoning
_ A. Proposed parcels are consistent with the existing R-1-C zoned single-family residential
district for the parcel map site in terms of lot width, depth and area. All parcels have
approved to a public street or right-of-way.
B. Rezoning Application No. R-00-33, approved by the City Council on February 27, 2001;
approved this site for the R-1-C zone district subject to the following conditions of
approval:
a. An avigation easement for the subject property shall be dedicated to the City of
Fresno as required by the plan. — -
b. No structure, tree, or other object shall be permitted to exceed the height limits
established in accordance with Part 77, subject C of the Federal Aviation
Regulations.

C. Schools, hospitals, nursing homes, or similar uses shall be prohibited within the
Traffic Pattern Zone of the Fresno-Chandler Downtown Airport.
III. Plan Consistency
A. The Edison Community Plan and the Fresno-Chandler Downtown Airport Master and
Environs Plan designate the parcel map site for development with medium-low density
residential land uses. The Zoning District Consistency Table of the Fresno Municipal
Code identifies medium-low density residential uses as consistent with the R-1-C zone
district.
-__ C. The Fresno-Chandler Downtown Airport Master and Environs Plan indicates that this
_ site is outside the 60 dB CNEL noise contours and no noise attenuation is required.
IV. On-Site Requirements

_ the site must be shown on the final map.

Provide Public Utility Easements (PUE) which may be required for P. G. & E. use. It is
the owner's responsibility to provide P.G. & E. with adequate rights-of-way satisfactory
to P.G. & E. If the property owner needs P.G. & E. to help assist in making the _
determination if an easement will be necessary, the property owner or their agent may
contact the Scott Combs, Land Agent, Fresno Land Rights Office at 263-7375.
The developer/owner will be responsible for the costs associated with any removal or
relocation of existing facilities on the property.
-,_ C. An Avigation easement is required for this site and shall contain the following property
rights:
--. I. Right-of-flight at any altitude above acquired easement surfaces.
Right to generate noise, vibrations, fumes, dust and fuel particle emissions.
3. Right-of-entry to remove, mark,.or light any structures or growths above

- 4. Right to prohibit creation of electrical interference, unusual light sources, and

other hazards to aircraft flight.
5. Right to prevent erection or growth or all objects above acquired easement
surfaces.
The easement surfaces acquired shall be based on Part 77 of the Federal Aviation
Regulations except that no easement surface less than 35 feet above ground shall be
acquired.
Remainder Parcel
-1. A Certificate of Compliance or Conditional Certificate of Compliance, whichever
lies shall be required to be recorded for the proposed Remainder Parcel prior

to the sale, lease or financing of the Remainder Parcel. _
The. Remainder Parcel shall be shown on the Parcel Map and shall be denoted to
require a Certificate of Compliance or Conditional Certificate of Compliance,
whichever applies, prior to the sale, lease or financing of the Remainder Parcel.
E. ' `' Water Well Abandonment
' All existing water wells within the limits of the proposed subdivision (proposed
Parcel D), which have not been approved to be retained, shall be abandoned prior to
-" approval of the Parcel Map for recordation. Wells shall be abandoned in accordance
with the specifications of the City Water Division and the Development Department.
Satisfaction of this requirement shall be the finalized Plumbing Permit issued by the
Development Department for such well(s).
V. Off-Site Improvement Requirements
A. Street Improvements
-
I. SOUTH WEST AVENUE—within the limits of the parcel map the developer shall
dedicate additional right-of-way street in accordance with the arterial street
standard width and the Hughes-West Diagonal Official Plan Line. The developer
shall improve this street with concrete curb, gutter, sidewalk (to a 10-foot..___ .
pattern) and 20 feet of permanent street paving consistent with the requirements
for frontage construction under the Fresno Municipal Code. The developer shall
also construct AC transition pavement as required.
The owner shall wave vehicular access to Westi Avenue"from Parcel B.

The developer shall construct an underground electrical street lighting system
within the limits of the parcel map and shall comply with Public Works Standards
E-1, E-2 and spacing requirements for arterial streets.
The developer shall install a 70-watt street light on the northwest corner of South
West Avenue and West Kearney Boulevard.
Backing of vehicles onto the South West Avenue arterial street shall not be
allowed. The Parcel Map shall provide a 40-foot front yard building setback off
of South West Avenue for Parcels D and E to provide for an onsite vehicular
turn-around to allow vehicles to enter South West Avenue in a forward direction.
2. `, ' WEST KEARNEY BOULEVARD FRONTAGE ROAD—within the limits of the
_~ parcel map the developer shall improve this street with concrete curb, gutter,
sidewalk (to a 5-foot pattern) and permanent street paving consistent with the
requirements for frontage construction under the Fresno Municipal Code.
The developer shall construct an underground electrical street lighting system
within the limits of the parcel map and shall comply with Public Works Standards
E-1, E-2 and spacing requirements for scenic collector streets.
The Public Works Department: advises that the developer may request deferral of the
above South West Avenue street improvement subject to a secured deferral agreement.

UGM STREET REQUIREMENTS
This parcel map is not within a UGM area.
Sanitary Sewer System
A 10-inch VCP sanitary sewer is existing in South West Avenue and an 8-inch VCP
sanitary sewer is existing in West Kearney Boulevard adjacent to this parcel map. _
The developer shall construct an 8-inch sewer main extension in West Kearney
Boulevard from the existing 8-inch sewer main on the north side of this street to
provide sewer service to Parcel A.
The developer shall further extend the existing 8-inch sewer main in West
Kearney Boulevard easterly 10-feet east of the westerly property line of Parcel A.

--___3. Parcels proposed to be served with direct sewer lateral connections to public
mains must have house branches provided or secured prior to recordation of the
final Parcel Map.
C. Water Service
- Twelve-inch water mains are existing in South West Avenue and West Kearney
Boulevard. No extension of water mains is required.
Provide separate water services for each parcel created.
D. Parks, Recreation and Community Services
1. Comply with the Parks memorandum dated November 1, 2000.
- E. Fire Department
1. No requirements
F. School Fees
Contact West Fresno High School and West Fresno Elementary School for payment of
any required school fees.
-__G. Canal Pipeline and Easement
The Fresno Irrigation District advises that it does not own, operate or maintain any
facilities located on the applicant's property.
VII. GENERAL PUBLIC WORKS REQUIREMENTS
A. DEDICATIONS. The subdivider shall dedicate public easements to facilitate the
construction of curbs, gutters, sidewalk, bus bays, right turn lanes, bike lanes, bike paths,
multi-purpose trail, wheelchair ramps and public utilities in accordance with City plans,
ordinances, resolutions and policies, the Standard Specifications of the Public Works
Department within the limits of the parcel map. Additionally, a minimum 4 foot wide
clear path of travel is required along the public sidewalk on all frontages of the property
as required by Title 24 of the California Administration Code as determined by the City
Engineer. An on-site pedestrian easement and construction of a path may be required if
Title 24 provisions can not be met within the public rights of way. All such public
easements shall be identified and dedicated with the processing and recordation of the
Parcel Map or at the time of Special Permit reviews for the proposed development of the

parcels.
W B. STREET IMPROVEMENTS. The subdivider shall construct curb, gutters, curb
returns and landings, wheelchair ramps, sidewalks with street tree wells and irrigation.
systems (when applicable), permanent pavement, street/safety lighting, bike lanes, bike
paths, multi-purpose trail, walls and fences in accordance with City plans, ordinances,
resolutions, policies and the Standard Specifications of the Public Works Department
within the limits of the parcel map.
Existing improvements that are not to the planned alignment shall be removed and
required improvements installed to the new street alignment and grade. Existing
improvements to remain in place shall be repaired if determined to be damaged and/or off
grade by the City Engineer. Existing driveway approaches not identified for current or
future utilization shall be removed and sidewalk (when applicable), curb and gutter shall
be installed'to match existing or proposed street line and grade as determined by the City
Engineer. _
- _. . -C. SANITARY SEWER SYSTEM. The subdivider shall connect each parcel being
created to the City of Fresno's sanitary sewer system with a separate sewer house branch
unless other arrangements are approved by the City Engineer. All sanitary sewer.system
improvements shall be constructed in accordance with City plans, ordinances,
resolutions, policies and the Standard Specifications of the Public Works Department.
The subdivider is required to construct sewer main extensions to serve the parcel map in
a manner determined by the City Engineer. The connection to the City's sanitary sewer
system requires the payment of all applicable sewer connection charges in accordance
with the provisions of FMC Chapter 9, Article 5 prior to the approval of the map.

D. WATER SYSTEM. The subdivider shall connect each parcel being created to the City
_ � of Fresno's water system with a separate water services and meters unless other
arrangements are approved by the City Engineer. All water system improvements shall
be constructed in accordance with City plans, ordinances, resolutions, policies and the
Standard Specifications of the Public Works Department. The subdivider is required to --
construct water main extensions to serve the parcel map in a manner determined by the
City Engineer. The connection to the City's sanitary sewer system requires the payment
of all applicable water connection charges in accordance with the provisions of FMC
Chapter 14, Article 1 prior to the approval of the map
E. STREET, SEWER AND WATER CONSTRUCTION PLANS. The subdivider shall
provide street, sewer and water construction plans for the required public improvements
as determined by the City Engineer. Such. plans shall be prepared by a registered Civil
Engineer and approved by the City Engineer prior to the issuance of Street Work
permits.

--- _F.,__ CONS TRUCTION/DEFERRAL. The subdivider shall construct the street, sanitary
sewer system and water system improvements required for this parcel map, and the work
deemed completed by acceptance of the work by the City Engineer, prior to the approval
and recordation of the Parcel Map.
Alternatively, the subdivider may request the deferral of the construction of such
improvements with a parcel map agreement. The City Engineer may approve such
agreement wherein the subdivider will be required to provide an Engineer's Estimate of
the work. The agreement will be prepared by the City and will require performance
securities as determined by the City Engineer.

All fees noted in this section shall be due and payable to the City of Fresno prior to the approval
of the final parcel map. All fee quotations are based on current rates. Applicant shall pay the
.fee in effect at the time of final map approval.

video tapes, Water Division will provide written requirements for the abandonment of the well
to the applicant.
b. When applying for a Plumbing Permit application to abandon a well, the applicant must '
include the Water Division's written requirements and an 81/2" x 11" sketch with dimensions to
locate the well. For information regarding the Plumbing Permit process, inspection, fees and

STREET TREE REQUIREMENTS
1. Street tree planting is required at the rate of one tree for each 60'of street frontage. Street tree species
for Parcel Map 2000-19 shall be as follows:

3. For street tree planting the developer shall select one of the two following options:
A. Street Tree planting by the Parks Division: The developer shall notify Parks to mark tree locations

paid in accordance with the most current version of the Master Fee Schedule.
B. Street Tree Planting by Developer: The applicant may choose to plant one tree for each 60' of street
frontage, or one tree per lot having street frontage,whichever is greater.
a. Street tree inspection fees shall be collelcted for each 60'of public street frontage 60' in width.
b. Trees shall be planted in accordance with "Specifications for Developer Street Tree Planting".

a permit include, but are not limited to: trucking terminals; municipal passenger service
facilities; manufacturing facilities; and other industrial activities which might generate
contaminated runoff. The industrial permit is secured by filing a Notice of Intent and paying
a fee to the State Water Resources Control Board, 30 days prior to the beginning of
operation. The permittee must also develop and implement a storm water pollution
prevention plan,reporting plan,and monitoring plan,and eliminate all prohibited non-storm
water discharges.
7. Construction activity including grading,clearing,grubbing,filling,excavation,development
or redevelopment of land that results in a disturbance of 5 acres or more(or less than 5 acres
if part of a larger common plan of development or sale)must secure a construction storm
water discharge permit in compliance with U.S.E.P.A.'s NPDES regulations(CFR Parts 122-
124,Nov. 1990). The construction permit is secured by filing a Notice of Intent and paying
a fee to the State Water Resources Control Board prior to the commencement of
construction. The permittee must also develop and.implement a storm water pollution
prevention plan, monitoring plan, reporting plan, and eliminate all prohibited non-storm
water discharges.
8. The proposed development shall implement all applicable BMPs presented in the
Construction Site and Post-Construction Storm Water Quality Management Guidelines
(available at the District Office),to reduce the release of pollutants in storm water runoff to
the maximum extent practicable.
9. A requirement of the District may be appealed by filing a written notice of appeal with the
Secretary of the District within ten days of the date of this Notice of Requirements.

r. The cost of construction of Master Plan facilities, excluding dedication of storm
drainage easements, is eligible for credit against the drainage fee of the drainage
area served by the facilities. A development agreement shall be executed with the
District to effect such credit. Reimbursement .provisions in accordance with the
drainage fee ordinance will be included to the extent that developer Master Plan
costs for an individual drainage area exceed the .fee of said area. Should the
facilities cost for such individual area total less than the fee of said area, the
difference shall be paid upon demand to the City or District.
Fee credit for basin excavation is provided only when the excavation is required
by the District and the material is not utilized by the Developer. Removal of
material from a basin requires a District excavation permit.
