FOR PROPERTY LOCATED ON BOTH SIDES OF EAST DOROTHY
AVENUE BETWEEN SOUTH CHERRY AND SOUTH EAST AVENUES
The City of Fresno Planning Division has completed its review of the subject map. Pursuant
to FMC Section 12-1205(c), this letter is written to advise you that the conditions of approval
are as noted on the attached document, dated February 23, 2001.
If you have any questions regarding the conditions you must notify either Louis Rocha or
Robert Lewis at 498-4451 no later than March 12, 2001, to request a review of the
conditions. Otherwise, the stipulated conditions of approval are in effect as of that date. No
further notice will be sent.
Appeal: The divider or any aggrieved person may file an appeal regarding the conditions of
approval within fifteen (15) days_from the.date of approval.
To protest the Director's decision regarding the conditions of approval, you must appeal by
filing a written appeal with the Director of the Development Department. Appeal must
include the appellant's interest in/or relationship to the subject property, the decision or
action appealed, and specific reasons why the appellant believes the decision or action
appealed from should not be upheld
Appeals must be submitted to the Director of the Development Department prior to 5 p.m.
on March 20, 2001.

EXPIRATION: The approval or conditional approval of this tentative Parcel Map expires
two years from the date of approval. The expiration shall terminate all proceedings and a
final Parcel Map may not be filed without first processing a new Tentative Parcel Map.
Modification of a Tentative Parcel Map after approval or conditional approval does not
extend the two year time limit.
EXTENSION: The divider may request an extension of the tentative map expiration date by
filing a written application together with the fee set forth in the Master Fee Schedule at the
time of the request with the Director of the Development Department at least thirty days
before the expiration date of the map. The applicant must state the reasons for the requesting
the extension. New conditions may be imposed if an extension is granted.
An extension may not exceed an aggregate of five years.

CONDITIONS OF APPROVAL
TENTATIVE PARCEL MAP NO. 2000-18
The City of Fresno Development Department has completed a review of the subject tentative parcel
map in accordance with the State Subdivision Map Act and the Fresno Municipal Code.
NOTICE TOAPPLICANT. In accordance with theprovisions of Government Code Section 66020(d)
(1), the imposition offees, dedications, reservations or exactionsfor thisproject are subject to protest by
the project applicant at the time of approval or conditional approval of the development or within 90
days after the date of the imposition of thefees, dedications, reservations or exactions imposed on the
development project.
This notice does not apply to those fees, dedications, reservations or exactions which were previously
imposed and duly noticed; or where no notice was previously required under the provisions of
Government Code Section 66020(d)(1) in effect before January 1, 1997.
The conditions of approval for Tentative Parcel Map No. 2000-18 are as follows:
I. Legal Status of Site to be Subdivided
A. The parcel map site, has been deemed to have been lawfully created.
II. Zoning
A. The proposed parcels are consistent with the existing M-YUGM zoning of the parcel
map site in terms of lot width, depth and agea. All parcels will have access and frontage
on a public street.
III. Plan Consistency
A. The Edison Community Plan designates the parcel map site for development with heavy
industrial uses. The Zoning District Consistency Table of the Fresno Municipal Code
identifies heavy industrial uses as consistent with the heavy M-3 zone.
IV. On-Site Requirements
A. Easements: The location, type, size and record information of easements on and through
the site must be shown on the final map.

crosses proposed property lines and is not covered by an existing easement, it is the
property owner's responsibility to provide adequate rights-ofway to P.G.&E. If P.G.&E's
assistance is required to determine whether an easement will be required contact Scott
Combs, Senior Land Technician, Fresno Land Rights Office, at 263-7375
V. Roosevelt Community Plan Findings
The recently adopted update of-the Roosevelt Community Plan was the subject of environmental
review under Environmental Impact Report (EIR)No. 10113. This EIR was reviewed in public
hearing by the City Council and the Council certified the EIR and adopted the community plan
update on December 5, 1994. Environmental Impact Report No. 10113 requires specific
"finding procedures" to verify the availability of adequate water and sewer service and street
capacity for every development entitlement and plan amendment application located in t4e
Roosevelt Plan area. The required finding procedures have been completed for the project by the
Department of Public Utilities and the Fire Department and the specific findings are incorporated
into this analysis and where appropriate, are included as mitigation measures to the approval of
the parcel map.
It is also noted that EIR No. 10113 requires the preparation of a monitoring checklist to ensure
compliance with and implementation of plan policies adopted with the Roosevelt Community
Plan Update. The completed monitoring checklist for this project has been completed and is on
file in the Development Department.
Water Findings
Subject to the above-noted conditions, it has been determined that the parcel map site can be
-provided with water service provided that the-conditions and mitigation measures listed below
under VII are implemented.
Traffic Findings
This parcel map is also subject to the traffic circulation "finding procedure" to verify the
availability of adequate public street capacity as required by EIR No. 10 113 for the Roosevelt
Community Plan area. The Public Works Department Traffic Engineer has conducted a separate
traffic review and has determined:
That all recommended mitigation measures that are economically feasible have been
incorporated into the Parcel Map and Urban Growth Management permit requirements.
Sanitary Sewer Findings
This project is subject to the sewer service "finding procedure" to verify the availability of
adequate sewer service as required by EIR No. 10113 for the Roosevelt Community Plan area.
A sewer availability analysis was completed for this parcel map and it has been determined by
the Department of Public Utilities that:

Sanitary sewer capacity will be available to serve this project in the North Avenue trunk sewer
with the implementation of the conditions and mitigation measures listed below under VI.
VI. Off-Site Improvement Requirements
A. The subdivider may either construct the required off site improvements prior to the
approval of the final parcel map; or enter into an agreement with the City of Fresno
providing for the construction of the required improvement and sufficient security prior
to the approval of the final parcel map.
B. All off-site and public improvements shall be constructed in accordance with the Public
Works Department Standards, Specifications and Policies. Engineered construction plans
and estimates for all or part of the required work shall be required prior to the issuance
of Street Work Permits unless otherwise determined by the City Engineer. The cost for
such plan preparation, review and construction inspection shall be at the subdivider's
expense.
C. Any existing utilities, including but not limited to, street lights, traffic signals, fire
hydrants, poles (power, telephone, cable, etc), fire hydrants which must be relocated or
removed in conjunction with the construction of these off-site improvement
requirements, shall be the responsibility and at the expense of the subdivider.
D. All existing overhead utilities, including but not limited to, electrical systems,
communication systems and street lighting systems shall be placed underground in
accordance with the provisions of Section'12-1011 of the Fresno Municipal Code and
the policies of the Public Works Department.
E. When street/safety lighting installations are required, street lighting plans shall be
submitted for review and approval by the Traffic Engineer prior to the issuance of
permits for the work. Services to street lighting installations shall be separated from the
electrical service(s) serving the development. The type, location and service for street
lighting installations shall be as determined by the Traffic Engineer. Street lighting
installations shall be dedicated to the City upon completion and acceptance of the
installations.
F. On-site Sewer and/or Water System(s). All on-site sewer and/or water systems shall be
"private". In the event the subdivider proposes to construct "public" on-site sewer and/or
water system facilities, written approval by the Public Utilities Department shall be
required and provided with the submittal of the initial final parcel map. Such facilities
shall be placed in a dedicated easement and shall be included as public improvement
requirements for the parcel map. Unless otherwise determined by the Public Utilities
Director, a covenant shall be required which provides that the property owners shall be
responsible for the restoration, replacement and expense of any private surface
improvements removed or damaged during the course of maintaining such public
facilities by the City or its agents.

G. Sidewalks (including wheelchair ramp landings) and driveway approaches, for
undeveloped parcels of this parcel map, shall be required as a condition of site
development.
Those items identified with an asterisk(*) refer to obligations of the applicant for
development of parcels with net acreage of 4 to 10 acres. The Public Works Director has
determined that completion of such designated improvements may be deferred until time
of development or further division of the parcel(s) upon written request by the applicant.
The request must specifically acknowledge the applicant's waiver of any rights provided
by Section 65961 of the California Government Code.
H. Street Improvement Requirements
1. East Dorothy and South Angus Avenue
b. All interior streets have been dedicated to the 64-foot local industrial
street standard width, and improved with standard concrete curb, gutter,
handicap ramps, and permanent street paving.
C. Install an underground steel pole street lighting system to local industrial
street standards( 3 streetlights on East Dorothy Avenue and 1 streetlight
on South Anugs Avenue ) in accordance with Public Works Department
Standard Drawing No. E-2.
I. Sanitary Sewer System Requirements
1 . An 8-inch sanitary sewer main is existing in East Dorothy Avenue . No extension
of public sewer is required.
2. Installation of a separate sewer house branch connecting each parcel to a public
sewer main is required.
J. Water System Requirements
1 . An 8-inch water main is existing in East Dorothy Avenue . No extension of
public water is required.
2. Installation of a separate water service each parcel to a public sewer main is
required.
K. Flood Control Facilities
1 . Construct Master Planned flood control facilities as indicated on the attached
FMFCD memorandum dated February 22, 2001.

M. Parks, Recreation and Community Service Department
1. Comply with Parks Department memorandum dated February 22, 2001.
VII. GENERAL PUBLIC WORKS REQUIREMENTS
A. DEDICATIONS. The subdivider shall dedicate public easements to facilitate the
construction of curbs, gutters, sidewalk, bus bays, right turn lanes, bike lanes, bike paths,
multi-purpose trail, wheelchair ramps and public utilities in accordance with City plans,
ordinances, resolutions and policies, the Standard Specifications of the Public Works
Department within the limits of the parcel map. Additionally, a minimum 4 foot wide
clear path of travel is required along the public sidewalk on all frontages of the property
as required by Title 24 of the California Administration Code as determined by the City
Engineer. An on-site pedestrian easement and construction of a path may be required if
Title 24 provisions can not be met within the public rights of way. All such public
easements shall be identified and dedicated with the processing and recordation of the
Parcel Map or at the time of Special Permit reviews for the proposed development of the
parcels.
B. STREET IMPROVEMENTS. The subdivider shall construct curb, gutters, curb
returns and landings, wheelchair ramps, sidewalks with street tree wells and irrigation
systems(when applicable), permanent pavement, street/safety lighting, bike lanes, bike
paths, multi-purpose trail, walls and fences in accordance with City plans, ordinances,
resolutions, policies and the Standard Specifications of the Public Works.Department
within the limits of the parcel map.
Existing improvements that are not to the planned alignment shall be removed and
required improvements installed to the new street alignment and grade. Existing
improvements to remain in place shall be repaired if determined to be damaged and/or off
grade by the City Engineer. Existing driveway approaches not identified for current or
future utilization shall be removed and sidewalk (when applicable), curb and gutter shall
be installed to match existing or proposed street line and grade as determined by the City
Engineer.
C. SANITARY SEWER SYSTEM. The subdivider shall connect each parcel being
created to the City of Fresno's sanitary sewer system with a separate sewer house branch
unless other arrangements are approved by the City Engineer. All sanitary sewer system
improvements shall be constructed in accordance with City plans, ordinances,
resolutions, policies and the Standard Specifications of the Public Works Department.
The subdivider is required to construct sewer main extensions to serve the parcel map in
a manner determined by the City Engineer. The connection to the City's sanitary sewer
system requires the payment of all applicable sewer connection charges in accordance
with the provisions of FMC Chapter 9, Article 5 prior to the approval of the map.

D. WATER SYSTEM. The subdivider shall connect each parcel being created to the City
of Fresno's water system with a separate water services and meters unless other
arrangements are approved by the City Engineer. All water system improvements shall
be constructed in accordance with City plans, ordinances, resolutions, policies and the
Standard Specifications of the Public Works Department. The subdivider is required to
construct water main extensions to serve the parcel map in a manner determined by the
City Engineer. The connection to the City's sanitary sewer system requires the payment
of all applicable water connection charges in accordance with the provisions of FMC
Chapter 14, Article 1 prior to the approval of the map
E. STREET, SEWER AND WATER CONSTRUCTION PLANS. The subdivider shall
provide street, sewer and water construction plans for the required public improvements
as determined by the City Engineer. Such plans shall be prepared by a registered Civil
Engineer and approved by the City Engineer prior to the issuance of Street Work
permits.
F. CONSTRUCTION/DEFERRAL. The subdivider shall construct the street, sanitary
sewer system and water system improvements required for this parcel map, and the work
deemed completed by acceptance of the work by the City Engineer, prior to the approval
and recordation of the Parcel Map.
Alternatively, the subdivider may request the deferral of the construction of such
improvements with a parcel map agreement. The City Engineer may approve such
agreement wherein the subdivider will be required to provide an Engineer's Estimate of
the work. The agreement will be prepared by the City and will require performance
securities as determined by the City Engineer.
VIII. Development Fees
Industrial Development Incentives (Informational Only)
The City Council on June 17, 1997 adopted Ordinance No. 97-29 (effective July 28, 1997)
establishing Section 12, Articlel S of the Fresno Municipal Code to provide the following
development incentives for parcels zoned M-1, M-2, M-3 or M-1-P:
Impact Fee Reduction. Provides for the reduction of the number of units for sewer
and water connection charges for low flow users as determined by the Director of the
Public Utilities Department, based on certified estimates, the City Engineer's opinion and
an agreement with the City.
Impact Fee Waiver. Waives the Trunk Sewer and Major Facilities Trunk Sewer fees
for projects within the trunk sewer service areas for Herndon, Cornelia and Fowler.
Impact Fee Deferral. Provides for the deferral of the payment of various sewer and
water connection charges, and UGM fees to the time of occupancy under an agreement

with the City.
Impact Fee Financing. Provides for.the financing of the sewer Wastewater Facilities
Charge over a 5 year period under an agreement with the city.
Public Improvement Deferral. Provides for the deferral of certain public infra-
structure improvements, by agreement, if the appropriate findings are made by the Public
Works Director.

The Parks Department has reviewed the Tentative Parcel Map prepared by R. W. Greenwood Associates,
Inc., dated August 7,2000. Parks offers the following comments regarding the street tree,and
buffer/parkway strip conditions ...
1. Street trees are required in accordance with the provisions of FMC Section 12-1206(c)(5). The
number of street trees shall be determined at the rate of one tree for each 60' of street frontage as
specified in FMC 11-301(c).
2. Each tree shall be provided with drip irrigation in conformance with the provisions of FMC
Sections 12-306-N-23.
3. The applicable street tree fees and/or alternative measures to satisfy the street tree requirement
are deferred to the time of development of each parcel. Street tree fees shall be based on the fee
rates established in the Master Fee Schedule in effect at the time payment is due.

The proposed development will generate storm runoff which produces potentially significant
environmental impacts and which must be properly discharged and mitigated pursuant to the
California Environmental Quality Act and the National Environmental Policy Act. The District
in cooperation with the City and County has developed and adopted the Storm Drainage and
Flood Control Master Plan. Compliance with and implementation of this Master Plan by this
development project will satisfy the drainage related CEQA/NEPA impact of the project
mitigation requirements.
The proposed development shall pay drainage fees pursuant to the Drainage Fee Ordinance
prior to approval of the final map at the rates in effect at the time of such approval. The fee Z

e) When the actual costs incurred in constructing Master Plan facilities exceeds the
drainage fee obligation,reimbursement will be made for the excess costs from
future fees collected by the District from other development.
Approval of this development shall be conditioned upon compliance with these District

6. The Federal Clean Water Act and the State General Permits for Storm Water Discharges Nq
Associated with Construction and Industrial Activities (State General Permits) require Ma
developers of construction projects disturbing five or more acres, and discharges associated
with industrial activity not otherwise exempt from National Pollutant Discharge Elimination
System (NPDES) permitting, to implement controls to reduce pollutants, prohibit the
discharge of waters other than storm water to the municipal storm drain system, and meet water
quality standards. These requirements apply both to pollutants generated during construction,
and to those which may be generated by operations at the development after construction.
a. State General Permit for Storm Water Discharges Associated with Construction
Activities, August 1999 (available at the District Office.) A State General
Construction Permit is required for all clearing, grading, and disturbances to the
ground that result in soil disturbance of at least five acres (or less than five acres
if part of a larger common plan of development or sale). Permittees are required
to: submit a Notice of Intent to be covered and must pay a permit fee to the
State Water Resources Control Board (State Board), develop and implement a
storm water pollution prevention plan, eliminate non-storm water discharges,
conduct routine site inspections, train employees in permit compliance, and

Under the Phase II federal storm water quality regulations a State General
Construction Storm Water Permit will be required for all activities that disturb

Activities, April, 1997 (available at the District Office.) A State General ■
Industrial Permit is required for specific types of industries described in the
NPDES regulations or by Standard Industrial Classification (SIC) code. The
following categories of industries are generally required to secure an industrial
permit: manufacturing; trucking; recycling; and waste and hazardous waste Z
management. Specific exemptions exist for manufacturing activities which
occur entirely indoors. Permittees are required to: submit a Notice of Intent to Z
be covered and must pay a permit fee to the State Water Resources Control O
Board, develop and implement a storm water pollution prevention plan,
eliminate non-storm water discharges, conduct routine site inspections, train
employees in permit compliance, sample storm water runoff and test it for Z

C. The proposed development is encouraged to select and implement storm water
quality controls recommended in the Fresno-Clovis Storm Water Quality
Management Construction and Post-Construction Guidelines (available at the
District Office)to meet the requirements of the State General Permits, eliminate the
potential for non-storm water to enter the municipal storm drain system, and where
possible minimize contact with materials which may contaminate storm water
runoff.
7. A requirement of the District may be appealed by filing a written notice of appeal with
the Secretary of the District within ten days of the date of this Notice of Requirements.
8. The District reserves the right to modify, reduce or add to these requirements, or revise
fees, as necessary to accommodate changes made in the proposed development by the
developer or requirements made by other agencies.

The purpose of this letter is to appeal certain conditions and to memorilize other conditions for
Tentative Parcel Map No. 2000-18 as follows:
Item VI and H.l.c. We request the existing power lines located on the south side of East Dorothy
Avenue remain,not to be undergrounded, furthermore,the three(3)existing power poles should be used for
mounting of street lights on each pole, This industrial neighborhood typically has overhead power lines
with street lighting mounted on the power poles and modification/revision to this condition needs to be
recognized.
Item Vl F. There are existing water services to each proposed parcel. We have delineated in red ink
the size and location of these services.
Item VI G. We request the concrete sidewalks be waived for the project. There are no other sidewalks
in the neighborhood.
We request that all Parks Department fees, sewer connection charges, and water connection
charges, if any, be processed for payment with the Building Permit stage of development.

Bob,
Mr. Greenwood's request to remove the condition to underground overhead facilities and install streetlights on
existing power poles is approved. This approval is conditioned on this parcel map being required to install the
street lights on either the existing power poles w/PG&E approval, or install new steel pole street lights per E-2,
city standard, with overhead electrical facilities.
Last, Mr. Greenwood's request to remove the sidewalks from the requirements of this parcel map is a moot
point.We have not required this parcel map to install sidewalks. However, if he is referring to the requirement
to install handicap ramps,then this request is approved. Please remove the requirement to install handicap
ramps on the corners of this industrial development.
